महाराष्ट्र ठेवीदारांच्या (वित्तीय संस्थांमधील) हितसंबंधाचे संरक्षण अधिनियम, १ ९९९ .
क्रमांक एमपीआय. १११८ /प्र. क्र. ७४ ९ /पोल -११.-ज्याअर्थी (१ ) सम्यक को.ऑ.क्रे.सो. लि. (२ ) सम्यक निवास हक्क संघ प्रयोजक भिम फाउंडेशन (यात यापुढे " उक्त वित्तीय संस्था " असा निर्देश करण्यात आला आहे) . या वित्तीय संस्थेचे अध्यक्ष / संचालक यांनी ठेवीदारांकडून स्वीकारलेल्या ठेवी मुदतपुर्तीनंतर परत करण्यास कसूर केली आहे , अशा तक्रारी त्यांच्याविरुद्ध बहुतांश ठेवीदारांकडून प्राप्त झालेल्या आहेत ;
आणि ज्याअर्थी, आरोपींविरुध्द आ.गु.शा. मुंबई गु.र.क्र. १५/२०१७ भा.दं.वि. कलम ४० ९ , ४२० , ३४ सह महाराष्ट्र ठेवीदारांच्या (वित्तीय संस्थांमधील) हितसंबंधाचे संरक्षण अधिनियम , १ ९९९ च्या कलम ३ व ४ अन्वये गुन्हा नोंदविण्यात आला आहे ;

आणि ज्याअर्थी, राज्य शासनाची अशी खात्री झाली आहे की, उक्त वित्तीय संस्था आणि त्यांचे अध्यक्ष / संचालक ठेवीदारांना त्यांच्या ठेवी परत करण्याची शक्यता नाही आणि म्हणून, राज्य शासनाला अशा ठेवीदारांच्या हितसंबंधाचे रक्षण करावे लागेल ;
आणि ज्याअर्थी , यासोबत जोडलेल्या अनुसूचीत विनिर्दिष्ट केलेली मालमत्ता उक्त वित्तीय संस्थेकडून आणि त्यांच्या अध्यक्ष / संचालकांकडून आणि उक्त वित्तीय संस्थेकडून गोळा केलेल्या ठेवींमधून आणि ठेवींतून संपादित करण्यात आलेली आहे असे अभिकथित आहे ;
ज्याअर्थी आता , महाराष्ट्र ठेवीदारांच्या ( वित्तीय संस्थांमधील) हितसंबंधाचे संरक्षण अधिनियम , १ ९९९ ( २००० चा महा.१६ ) (यात यापुढे ज्याचा " उक्त अधिनियम " असा निर्देश करण्यात आला आहे) याच्या कलम ४ चे पोट -कलम ( १ ) व कलम ५ याद्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून महाराष्ट्र शासन याद्वारे, – (क) अनुसूचीत विनिर्दिष्ट केल्याप्रमाणे , उक्त वित्तीय संस्थेची आणि त्यांचे अध्यक्ष / संचालक यांच्या नावे असलेली मालमत्ता जप्त करीत आहे , आणि
(ख) उक्त वित्तीय संस्था आणि त्यांचे संचालक यांच्या जप्त केलेल्या मालमत्तेवर नियंत्रण ठेवण्यासाठी उप जिल्हाधिकारी ( भूसंपादन) , मुंबई यांची सक्षम प्राधिकारी म्हणुन नियुक्ती करीत आहे .
उक्त अधिनियमान्वये नियुक्त करण्यात आलेल्या पदनिर्देशित न्यायालयातील सरकारी अभियोक्ता, विशेष न्यायालयात अर्ज दाखल करताना सक्षम प्राधिकाऱ्यास आवश्यक ते सहाय्य करतील.

NOTIFICATION
MAHARASHTRA PROTECTION OF INTEREST OF DEPOSITORS ( IN FINANCIAL ESTABLISHMENT) ACT, 1999 .
No. MPI 1118 /C.R.749 / Pol - 11.- Whereas complaints have been received from number of depositors against ( 1) Samyak Co - Op Credit Society Ltd. and ( 2 ) Samyak Niwas Hakka Sangh Prayojak Bhim Foundation ( hereinafter referred to as " the said Financial Establishments " ) , complaining that they have collected the Fund and have defaulted to return the said deposits made by the depositors , on demand ;
And whereas , an offence has been registered against the accused at E.O.W. Mumbai vide C.R. No. 15/2017 , u/s . 409, 420, 34 of Indian Penal Code r/ w . 3 & 4 of Maharashtra Protection of Interest of Depositors ( In Financial Establishment ) Act , 1999 ;
And whereas , the State Government is satisfied that the said Financial Establishments and their Chairmen/ Directors are not likely to return the deposits to the depositors and hence the Government has to protect the interests of the depositors ;
And whereas , the properties specified in the Schedule appended hereto are alleged to have been acquired by the said Financial Establishments and their Chairmen/ Directors from and out of the deposits collected by the said Financial Establishments ;
Now , therefore , in exercise of the powers conferred by sub - section ( 1) of Section 4 and Section 5 of the Maharashtra Protection of Interest of Depositors ( in Financial Establishments ) Act , 1999 ( Mah . XVI of 2000) ( hereinafter referred to as " the said Act " ) , the Government of Maharashtra hereby , -
( a) attaches the properties of the said Financial Establishments and the property in the name of their Chairmen /Directors as specified in the Schedule ; and
(b) appoints the Deputy Collector , ( Land Acquisition ) , Mumbai to be the Competent Authority to exercise control over the properties attached of the Financial Establishment and its Directors ;
The Public Prosecutor in designated Court appointed under the said Act shall render necessary assistance to the Competent Authority in filing the application before the Special Court .
