Order

No. SCC /Appt ./Addl . Reg./3255/2020.-The Honourable High Court , vide its Letter , dated 5th December , 2020 has been pleased to approve the names of Shri A. G. Rane , Translator and Interpreter [ presently working as Assistant ( Legal) on the establishment of MLSA , High Court , Bombay , on deputation basis ] and Smt . R. K. Hajare , Judicial Clerk for being promoted as Additional Registrar , Court of Small Causes , Mumbai respectively and accordingly , directed to issue appointment orders .

In view of above , Shri A. G. Rane , Translator and Interpreter [ presently working as Assistant (Legal ) on the establishment of MLSA , High Court , Bombay , on deputation basis ] is promoted and appointed to the post of Additional Registrar , Court of Small Causes , Mumbai with effect from Monday , the 7th December , 2020 on the vacant post of Additional Registrar , Court of Small Causes , Mumbai , vice Smt . S. K. Kaware , who retired voluntarily from the Government Service with effect from 28th August , 2020 (B.N. ) .

Similarly , Smt . R. K. Hajare , Judicial Clerk is promoted and appointed to the post of Additional Registrar , Court of Small Causes , Mumbai with effect from Monday , the 7th December , 2020 on the vacant post of Additional Registrar , Court of Small Causes , Mumbai vice Shri N. V. Shah , who retired voluntarily from the Government Service with effect from 28th August , 2020 (Β.Ν. ) .

क्रमांक वि -१ / निर्मिती नागरीपत/ सुदर्शन लोळगे/क. १५६/२०२० .- महाराष्ट्र सहकारी संस्था अधिनियम , १ ९ ६० चे कलम १५६ (१ ) अन्वये मला प्रदान करण्यात आलेल्या शक्तीचा वापर करून मी , सतिश खरे , जिल्हा उप निबंधक, सहकारी संस्था, नाशिक या आदेशान्वये निर्मिती नागरी सहकारी पतसंस्था मर्या . , नाशिक, ता . जि . नाशिक या संस्थेच्या खालील अधिकाऱ्यांना व त्यांच्या नावापुढे दर्शविलेल्या कार्यक्षेत्रासाठी महाराष्ट्र सहकारी संस्था अधिनियम , १ ९ ६० चे कलम १०१ व कलम ९१ अन्वये प्राप्त झालेल्या वसुली प्रमाणपत्राची अंमलबजावणी/कर्ज वसुली करण्याकरिता महाराष्ट्र सहकारी संस्था अधिनियम , १ ९ ६० चे कलम १५६ ( १ ) व नियम १०७ अनुसार मालमत्ता जप्त करून तिची विक्री करून रकमा वसूल करण्याचे निबंधकाचे अधिकार , खालील अटीस अधीन राहून या आदेशाच्या दिनांकापासून ते दिनांक ३१ मार्च २०२३ या कालावधीकरिता प्रदान करीत आहेत: -

वसुली अधिकारी

अटी:-

(१ ) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १ ९६० चे कलम १५६ व नियम , १ ९ ६१ चे नियम १०७ मधील तरतुदीनुसार कर्जवसुलीची कार्यवाही करावी . कर्जवसुली करताना सहकार कायदा , नियम यातील तरतुदी व परिपत्रकीय सुचनांचे पालन न केल्याचे निदर्शनास आल्यास आवश्यक ती चौकशी करून आवश्यकता भासल्यास सदरचे अधिकार तात्काळ काढून घेण्यात येतील.

( २ ) सदरचे अधिकार सहकार कायदा कलम १०१ व ९ १ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

(३ ) वसुली अधिकारी यांनी दरमहा सोबत जोडलेल्या विहीत नमुन्यात अ-३ , अ-४ , व ब कर्ज वसुलीची माहिती संबंधित जिल्हा उप निबंधक, सहकारी संस्था यांचे कार्यालयास सादर करावी . ज्या सहकारी संस्थेचे कार्यक्षेत्र विभाग , दोन विभाग अथवा राज्य कार्यक्षेत्र आहे त्या संस्थांनीदेखील त्यांचे मुख्य कार्यालय ज्या जिल्ह्यामध्ये आहे त्या जिल्हा उप निबंधक यांचे कार्यालयास माहिती सादर करावी.

(४ ) अधिकार प्रदान केलेल्या वसुली अधिकारी असलेल्या व्यक्तीची बदली झाल्यास किंवा सेवानिवृत्ती झाल्यास किंवा सदर व्यक्तीला सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकाऱ्यास प्रदान केलेले अधिकार आपोआप रद्द होतील.

३ महाराष्ट्रशासन राजपत्र, भाग एक -मध्य उप-विभाग , गुरुवार ते बुधवार, जानेवारी ७-१३ , २०२१ / पौष १७-२३ , शके १९ ४२ (५ ) विशेष वसुली अधिकारी यांनी वसूल केलेल्या संपूर्ण सरचार्ज रकमेचा भरणा वसूल केलेल्या महिन्यातच चलनाने शासकीय कोषागारात करावा. वसुली अधिकारी यांनी वसूल केलेला सरचार्ज , त्याचा शासकीय कोषागारात केलेला भरणा याबाबत संस्थास्तरावर स्वतंत्र नोंदवही ठेवण्यात यावी . त्याबाबतचा नमुना अ-१ , अ-२ , अ-३ , अ-४ सोबत जोडलेला आहे .

(६ ) मा. उच्च न्यायालयय, मुंबई यांनी रीट याचिका क्र. १ ९ ४२ / २०१३ दि बेसिन कॅथोलिक को- ऑप . बँक विरूद्ध महाराष्ट्र राज्य व इतर या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५ रोजी दिलेला आदेश विचारात घेऊन वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १ ९ ६० व नियम , १ ९ ६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

(७ ) वसुली अधिकारी यांनी नमूद प्रदान केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास , प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाही .

( ८ ) शासन निर्णय क्रमांक संकीर्ण . १५०४/ प्र.क्र.२३१ /१५ - स , दिनांक २३ नोव्हेंबर २००६ अन्वये विशेष वसुली अधिकाऱ्यांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

(९ ) वसुली अधिकाऱ्यास त्याच्या नावापुढे कोठेही " महाराष्ट्र शासन नियुक्त " आणि किंवा " सिव्हील कोर्ट " , " एक्झीक्युटीव्ह कोर्ट " या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही . त्या ऐवजी वसुली अधिकाऱ्यांनी त्यांच्या नावापुढे " वसुली अधिकारी (महाराष्ट्र सह. संस्था अधिनियम , १ ९ ६० व नियम, १ ९ ६१ चे नियम १०७ अन्वये) " असे लिहावे.

(१० ) वसुली अधिकाऱ्यास वसुलीसाठी वापर करण्यात येणाऱ्या वाहनावर " वसुली अधिकारी , असा फलक लावता येऊ शकेल. सहकारी बँक/पतसंस्था " (११ ) वसुली अधिकाऱ्याने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या / जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांचेकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही . संबंधित कर्जदार / जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी / पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१२ ) वसुली अधिकाऱ्यास , थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व सरचार्ज रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही .

(१३ ) सोबतच्या यादीप्रमाणे सर्व प्रकरणामध्ये जंगम जप्ती , स्थावर जप्ती , अपसेट प्राईज मंजुरी, जाहीर लिलाव व कलम १००/८५ अन्वयेची कार्यवाही हि नियमानुसार विहीत मुदतीत पूर्ण करण्यात यावी. विहीत मुदतीत उक्त कार्यवाही पूर्ण न केल्यास आपणांस दिनांक १ एप्रिल २०२३ पासून पुढील कालावधीसाठी कलम १५६ चे अधिकार प्रदान करण्यांत येणार नाही याची गांभीर्याने नोंद घ्यावी व त्याची सर्वस्वी जबाबदारी ही आपली राहील.

वरील अधिकाऱ्यांचे अंतिम वेतन प्रमाणपत्र व महाराष्ट्र कोषागार नियम, २३६ चा दाखला ( ना मागणी प्रमाणपत्र) महालेखापाल , महाराष्ट्र-१ , मुंबई , नागपूर -२ यांच्या कार्यालयास परस्पर पाठवावा , तसेच जे अधिकारी शासकीय निवासस्थानात राहत असतील , त्यांच्या निवृत्तीबाबत संबंधित कार्यकारी अभियंता यांच्या कार्यालयात कळवावे व आवश्यक दाखला मागवावा .

ज्या अधिकाऱ्यांबाबत महसूलहानी / विभागीय चौकशी कार्यवाही सुरू आहे किंवा प्रस्तावित आहे . अशा अधिकाऱ्यांच्या प्रकरणी होणाऱ्या निर्णयाच्या अधिन राहून निवृत्ती वेतन लाभाची कार्यवाही करावी.

संबंधित अधिकाऱ्यांस नियमित सेवानिवृत्तीवेतन व सेवालाभ देण्यास काही कारणास्तव विलंब होणार असल्यास तात्पूरते निवृत्तीवेतन व सेवालाभ देण्यासाठी महाराष्ट्र नागरी सेवा ( निवृत्ती वेतन ) नियम , १ ९ ८२ मधील नियम १२६/१३० नुसार आवश्यक कार्यवाही तात्काळ करावी .

क्रमांक एमसीओ-२०१ ९/ प्र.क्र. ०२ /नवि १४. मुख्याधिकारी गट-ब संवर्गातील , श्री . चंद्रकांत सोनावणे हे त्यांच्या दिनांक २० ऑगस्ट १९ ६१ या जन्म दिनांकानुसार दिनांक ३१ ऑगस्ट २०१ ९ (म.नं. ) रोजी नियत वयोमानानुसार शासकीय सेवेतून सेवानिवृत्त झाले आहेत.

२. श्री. चंद्रकांत सोनावणे यांचेविरूद्ध सुरू असलेल्या विभागीय चौकशीच्या प्रकरणाची कार्यवाही पुढे सुरू राहील. सदर प्रकरण तसेच , त्यांचेविरूद्ध अन्य विभागीय चौकशीची प्रकरणे प्रस्तावित असल्यास व त्यांचेविरूद्धच्या शिक्षेच्या अनुषंगाने न्यायिक प्रकरण सुरू/ प्रस्तावित असल्यास त्याबाबतची कार्यवाही पुढे सुरू राहील . त्याचप्रमाणे, त्यांचेकडून शासनाचे काही येणे बाकी असल्यास , त्यासंदर्भातील वसुलीच्या अधीन राहून्, श्री. सोनावणे यांना शासकीय सेवेतून नियत वयोमानानुसार दिनांक ३१ ऑगस्ट २०१ ९ ( म.नं. ) रोजीच्या सेवानिवृत्र्त्तास या अधिसूचनेद्वारे मान्यता देण्यात येत आहे.
