Whereas pursuant to the circular dated August 3 , 2018 issued by SEBI on " Role of Sub - Broker vis - à - vis Authorised Person " , it is proposed to amend the Rules and Bye - Laws of BSE Ltd. ( " BSE " ) , as under , inviting public comments in terms of Securities Contracts ( Regulation ) Act, 1956:
Rules of BSE
( 1) Chapter IV Rule 3 ( 1 ) Misconduct - Vexatious complaints : If it or its agent/sub-broker remisier/ Authorized Person/ legal representative /employee brings before the relevant authority or a committee , complaint or suit which in the opinion of the relevant authority/committee is frivolous , vexatious or malicious ;
( 2) Chapter V – Rule 1.13 - Discontinuation of concept of Sub - Broker : Nothing contained in the Circular dated 3rd August , 2018 , issued by the Securities and Exchange Board of India with regard to discontinuation of Sub - Brokers as market intermediaries with effect from 1st April, 2019 , shall affect the rights and obligations which have accrued or have arisen or which may arise in future or any proceedings which are pending or which may be initiated in future , either in relation to the sub - broker , any activity of a sub - broker or dealings through sub - broker , and all such rights , obligations and/ or proceedings shall continue to be governed by the Rules , Bye - laws and Regulations of the Exchange relating to sub - broker , its activity or its dealings which may be applicable at the relevant time .
( 3) Bye - laws of BSE Chapter VI - Bye - law 2 ( i ) - Conditions for admission - A trading member shall not deal with sub-broker an Authorised Person who is not registered with the Exchange SEBI nor allow operation of its trading terminal at any office other than its registered office , branch offices and the offices of its registered Sub broker Authorised Person or such permitted places , in the manner prescribed by the Exchange .

(4) Chapter XIII - Bye - law ( 1 ) B - Reference to Arbitration - All claims , differences or disputes between the members and sub -broker Authorised Persons and between sub -broker-Authorised Persons and Constituents arising out of or in relation to dealings , contracts and transactions made subject to the Bye - laws , Rules and Regulations of the Exchange or with reference to anything incidental thereto or in pursuance thereof or relating to their validity , construction , interpretation , fulfilment or the rights , obligations and liabilities of the parties thereto and including any question of whether such dealings , transactions and contracts have been entered into or not shall be submitted to arbitration in accordance with the provisions of these Bye - laws and Regulations .
Provided however , in case of claims , differences and disputes to which sub-broker- an Authorised Person is a party , the member with whom such sub-broker-Authorised Person is associated shall be made a party to the proceedings along with the sub-broker- Authorised Person .
Explanation : For the purpose of these Bye - laws , sub -broker an Authorised Person will have the meaning assigned to the term in the Rules , Bye - laws and Regulations of the Exchange.under SEBI ( Steek Brokers and Sub- Brokers ) Regulations , 1992 and such sub -brokers who - have obtained registration from SEBI
(5) Chapter XIII - Bye - law ( 18 ) - Implementation of Arbitral Award - Notwithstanding anything contained in the Bye - laws , in cases where the arbitral award or appellate arbitral award is passed against a trading member and/or its sub - broker Authorised Person and in favour of a Constituent , the Exchange shall debit from the deposits or other monies of the trading member lying with the Exchange , the amount of award payable to the awardee together with interest payable , if any , till the date of debit and keep aside the said amount in a separate account to be dealt with in such manner as mentioned in Bye - law 19 .
Provided that , where the award is for the delivery of securities , the Exchange may consider the closing price of such securities on the Exchange as on the date of the award or such other date the relevant authority may specify to be reasonable , stating reasons for arriving at the value of such securities and award amount .
(6) Chapter XIII - Bye - law ( 19 ) ( a) Payment of Debit Account to Constituent's Arbitral Award: - Where the trading member/ sub-broker-Authorised Person chose not to prefer an appeal under these Bye - law within the time permissible there under , the amount debited under Bye- law 18 shall be paid , together with the interest earned thereon , to the awardee .
(7) Chapter XIII - Bye - law ( 19 ) ( b ) Payment of Debit Account to Constituent's Appellate Arbitral Award: Where an appeal is preferred by the trading member / sub-broker- Authorised Person under these Bye - law and the appellate arbitral tribunal makes an appellate arbitral award against the trading member / sub-broker Authorised Person the Exchange shall pay the awarded amount to the awardee from the amount debited under Bye - law 18 : -
(i ) where no application is made by the trading member/ sub- broker Authorised Person under Section 34 of the Arbitration and Conciliation Act , 1996 to challenge such arbitral award within the limitation period for making such application , upon expiry of such limitation period .

बीएसई लिमिटेड चे नियम व उपविधी
ज्याअर्थी " अधिकृत व्यक्तीच्या दृष्टीने सब - ब्रोकरची भूमिका " यावर सेबीतर्फे जारी केलेल्या परिपत्रक दिनांक ०३ ऑगस्ट , २०१८ चे अनुषंगाने , प्रतिभूति संविदा ( विनियम ) कायदा १ ९ ५६ च्या बाबतीत सार्वजनिक टिप्पण्या मागणी करून बीएसई लिमिटेड (" बीएसई " ) चे नियम व उपविधीमध्ये खालीप्रमाणे सुधारणा करण्याचे प्रस्तावित आहे .
बीएसई चे नियम : -
(१ ) प्रकरण IV - नियम ३ ( १ ) गैरवर्तन त्रासदायक तक्रारी: जर तो किंवा त्याचा एजंट / रिमाइझर / अधिकृत व्यक्ती / कायदेशीर प्रतिनिधी / कर्मचारी हे संबंधित प्राधिकरण किंवा समितीसमोर तक्रार किंवा दावा जी संबंधित प्राधिकरण / समितीच्या मते क्षुल्लक, त्रासदायक किंवा दुर्भावनायुक्त आहे अशी तक्रार किंवा दावा करणे;
(२ ) प्रकरण V नियम १.१३ उप - दलालाची संकल्पना बंद करणे दिनांक १ एप्रिल २०१ ९ पासून बाजार मध्यस्थी म्हणून उप - दलालाची संकल्पना बंद करण्याबाबत सिक्युरिटीज अँड एक्स्चेंज बोर्ड ऑफ इंडिया यांनी जारी केलेल्या परिपत्रक दिनांक ३ ऑगस्ट २०१८ मध्ये काहीही समाविष्ट नसले तरी , जर हक्क व जबाबदाऱ्या ज्या उपार्जित किंवा उपस्थित किंवा भविष्यात उद्भवलेल्या आहेत किंवा कोणतीही कार्यवाही जी एकतर उप - दलाल, उप- दलालाची कोणतीही कार्यवाही किंवा उप- दलालद्वारे व्यवहार संबंधी प्रलंबित आहे किंवा भविष्यात सुरूवात होईल , असे सर्व हक्क , जबाबदाऱ्या आणि/ किंवा कार्यवाह्या संबंधित वेळी लागू असलेल्या उप- दलाल , त्यांच्या कृती किंवा त्याचे व्यवहार संबंधी शेअर बाजाराचे नियम, उपविधी व नियमावलीद्वारे शासित केल्या जातील .
(३ ) बीएसईचा उपविधी प्रकरण VI उपविधी २ ( i ) प्रवेश घेण्याच्या अटी कोणताही व्यापारी सदस्य हा शेअर बाजारामध्ये नोंदणीकृत नसलेल्या अधिकृत व्यक्तीशी व्यवहार करणार नाही किंवा शेअर बाजाराने विहित केल्याप्रमाणे त्याचे नोंदणीकृत कार्यालय , शाखा कार्यालय व त्याचे नोंदणीकृत अधिकृत व्यक्तीचे कार्यालये सोडून इतर कोणत्याही कार्यालयात त्याचे व्यापार ठिकाण चालविण्यास परवानगी देणार नाही.
(४) प्रकरण XIII - उपविधी ( १ ) ब लवादाचा संदर्भ : बाजाराच्या उपविधी , नियम व नियमावली च्या अधीन राहून केलेले व्यापार , कंत्राट व व्यवहार च्यामुळे किंवा संबंधी उत्पन्न होणारे सदस्य आणि अधिकृत व्यक्ती यांच्यामधील आणि अधिकृत व्यक्ती व घटक यांच्यामधील सर्व प्रकारचे दावे , मतभेद किंवा विवाद किंवा त्यासंबंधी काहीही किंवा त्याच्या अनुषंगाने किंवा त्याची वैधता , रचना , अर्थ , परिपूर्ति किंवा यातील पक्षकारांचे हक्क, बंधने व दायित्वे यासह असे व्यापार, व्यवहार व कंत्राट झालेले आहेत किंवा कसे याबाबत कोणताही प्रश्न हे प्रस्तुत उपविधी व नियमावलीच्या तरतुदी नुसार लवादास सादर करावेत.
परंतु तथापि दावे , मतभेद व विवाद ज्यात अधिकृत व्यक्ती पक्षकार आहे अशा प्रकरणात , सदस्य ज्यासोबत असा अधिकृत व्यक्ती संबंधित आहे त्यास अधिकृत व्यक्तीसोबत कार्यवाहीत पक्षकार बनवावे.
स्पष्टीकरण : या उपविधीच्या उद्देशाकरीता , अधिकृत व्यक्ती बाजाराच्या नियम , उपविधी आणि नियमावली अधीन नियुक्त केलेल्या अटी प्रमाणे असेल .
(५ ) प्रकरण XIII - उपविधी ( १८ ) लवाद निवाड्याची अंमलबजावणी: - उपविधी मध्ये काहीही अंतर्भूत असले तरी , जर लवाद निवाडा किंवा अपील लवाद निवाडा हा एखाद्या व्यापारी सदस्य आणि / किंवा त्याच्या अधिकृत व्यक्ती विरूद्ध व एखाद्या घटकाच्या लाभात पारीत केला असेल तर शेअर बाजाराने नावे करण्याच्या दिनांकापर्यंत निवाडा धारकास देय निवाडा रक्कम यासह असेल तर देय व्याज बाजारामध्ये ठेवलेल्या व्यापारी सदस्याच्या ठेवी किंवा इतर पैशांमधून नावे करावी आणि उपविधी १ ९ मध्ये नमूद केल्याप्रमाणे व्यवहार करावयाच्या स्वतंत्र खात्यामध्ये सदर रक्कम बाजुला ठेवावी .
परंतु, जर सुरक्षेच्या वितरणासाठी सदर निवाडा असेल तर बाजार अशी सुरक्षा व निवाडा रकमेचे मूल्यास येण्याकरीता कारणे नमूद करून निवाड्याच्या दिनांक रोजी किंवा वाजवी असल्याचे संबंधित प्राधिकरण नमूद करेल त्याप्रमाणे अशा इतर दिनांकास बाजारावरील अशा सुरक्षेची बंद किंमत ग्राह्य धरू शकेल .
(६ ) प्रकरण XIII- उपविधी ( १ ९ ) (अ) घटकास डेबिट खात्याचा भरणा लवाद निवाडा: - जेथे व्यापारी सदस्य / अधिकृत व्यक्तीने त्या उपविधी अंतर्गत त्याखालील अनुज्ञेय कालावधीत अपील न करण्यास निवडले असेल तर उपविधी १८ अंतर्गत नावे केलेली रक्कम ही निवाडाधारकास त्यावरील देण्यात येणाऱ्या व्याजासह देण्यात येईल .

(७ ) प्रकरण XIII - उपविधी ( १ ९ ) ( ब) घटकाला डेबिट खात्याची भरणा अपिल लवाद निवाडा जेथे या उपविधी अंतर्गत व्यापारी सदस्य / अधिकृत व्यक्ती यांनी एखादे अपिल केल्यास आणि जर अपिल लवाद प्राधिकरणाने व्यापारी सदस्य / अधिकृत व्यक्ती यांच्या विरुध्द अपील लवाद निवाडा केल्यास, शेअर बाजार उप - कायदा १८ अंतर्गत डेबिट केलेल्या रकमेतून निवाडा धारकास निवाडा रक्कम अदा करेल;
(i ) जेथे कोणताही अर्ज असा अर्ज करण्याच्या मर्यादित कालावधीच्या आत असा लवाद निवाडा आव्हानित करण्यास लवाद व सलोखा कायदा १ ९९ ६ चे कलम ३४ अंतर्गत व्यापारी सदस्य / अधिकृत व्यक्ती यांनी केला असेल , असा मर्यादित कालावधी संपल्यावर .
प्रस्तावित नियम व उपविधी वरील कोणत्याही टिप्पण्या देण्यास इच्छुक असलेला कोणताही व्यक्ती हा खालील पत्त्यावर सूचनेच्या तारखेपासून १० दिवसांच्या आत निवेदन पाठवू शकतो .
टीपः- इंग्रजी आणि मराठी भाषांतरातील नियम व उपविधी मध्ये कोणतीही विसंगती आढळल्यास इंग्रजी भाषांतरातील नियम व उपविधी ग्राह्य धरले जातील.

कुनप/ बांधकाम/विकास पर / २२४ ९ / २०२० . शासनाने नगर विकास शासन निर्णय क्र. एमयुपी . २०१४ / सी. आर . २०५ / नवि १ ९ , दिनांक १० ऑगस्ट २०१५ रोजी कुडाळ नगरपंचायत अस्तित्वात आलेली आहे. सबब नव्याने अस्तित्वात आलेल्या नगरपंचायतीच्या क्षेत्रात सुसंबद्ध विकास करण्यासाठी विकास योजना तयार करणे आवश्यक असल्याने नगरपंचायत , कुडाळ जिल्हा सिंधुदुर्ग सर्वसाधारण सभा ठराव क्र. ८ दिनांक २६ ऑक्टोबर २०१८ अन्वये सदरहू नगरपंचायतीच्या क्षेत्राधिकारातील महाराष्ट्र प्रादेशिक व नगररचना अधिनियम , १ ९ ६६ चे कलम २३ (१ ) अन्वये कुडाळ शहराचा भौगोलिक माहिती प्रणाली ( GIS ) द्वारे विकास योजना तयार करण्याचा इरादा जाहीर केलेला आहे .
कुडाळ नगरपंचायतच्या कक्षेखाली येणाऱ्या व ज्यासाठी विकास योजना करावयाची आहे . त्या क्षेत्राच्या नकाशावर अध्यक्ष / मुख्याधिकारी नगरपंचायत कुडाळ यांची स्वाक्षरी आहे . असा नकाशा कुडाळ नगरपंचायत कार्यालयात कार्यालयीन वेळेत महाराष्ट्र प्रादेशिक व नगररचना अधिनियम , १ ९ ६६ चे कलम २३ (२ ) अन्वये नागरिकांना पाहण्यासाठी प्रकाशित केलेला आहे .
ज्या नागरिकांना विकास योजनेसंबंधी काही सूचना अगर हरकती असतील , त्यांनी ही सूचना महाराष्ट्र शासनाच्या राजपत्रात प्रसिद्ध होईल त्या दिनांकापासून ( ६० ) दिवसांच्या आत त्यांच्या सूचना अगर हरकती कुडाळ नगरपंचायतीकडे लेखी स्वरूपात द्याव्यात कुडाळ नगरपंचायत , विकास योजनेबाबत योग्य तो विचार करेल .

GENERAL NOTICE
कुनप/बांधकाम/विकास पर/ २२४९ / २०२० .- Government Notification Urban Development Department , No. MUP- 2014/C.R.205/UD -19 , dated the 10th August 2015 has established Kudal new Nagar Panchayat . The notification has been published in Maharashtra Government Gazette , Extra- ordinary Part 1A General sub - division dated the 1st March 2014 .
Kudal Nagar Panchayat under its general body resolution No. 8 , dated the 26th October 2018 declared its intention to prepare Development plan of Kudal Nagar Panchayat limit as per provision of section 23 ( 1 ) of the Maharashtra Regional and Town Planning Act , 1966. The copy of the plan showing the area for which the development plan is to be prepared is displayed and kept open for the inspection of the public on all working days during office hours at the office of Kudal Nagar Panchayat , Kudal as required under section 23 ( 2 ) of the Maharashtra Regional and Town Planning Act , 1966 .
Suggestion/objections if any are invited from the public and which should be communicated in writing within 60 days from the date of publication of intention in Maharashtra Government Gazette for Consideration by the Nagar Panchayat Under section 23 ( 1 ) of Maharashtra Regional and Town Planning Act , 1966 .

Notice is hereby given to all users of Railway lines and premises situated on the completed section of the under noted section of the South Central Railway that the 25000 Volts , 50 HZ , A.C Overhead Traction wires will be energized on or after the date specified against the section . On and from the same date the over Head traction line shall be treated as LIVE at all times and no unauthorized person shall approach or work in the proximity of the said Over head lines .

"WARNING TO ROAD USERS"
It is notified for information of the public that in connection with introduction of 25KV AC Electric Traction over the section Vikarabad (Excl ) - Parli vaijnath ( Incl) section section of South Central Railway, height gauges have been erected at all the level crossing with clear height of 4.78m above Road level with a view to prevent loads of excessive height from coming into contact or dangerous proximity to LIVE traction wire ( Contact wire), which shall be at a height of minimum of 5.5m above the rail level at level crossings .
Public are hereby notified to observe the height specified above for the purpose of loading vehicles and to see that the loads carried in Road vehicles do not infringe the height gauges under any circumstances .
The dangers of a load of excessive height are as follows:
1. Danger to the height gauge and consequent obstruction to the road as well as the Railway line.
2. Danger to the material or equipment carried or the vehicle itself.
3. Danger of fire and risk of life due to contact with or dangerous proximity to the conductors.
