No. 76/MT - HP/43/2019.-WHEREAS , the Commission had declared to hold the General Election to Lok Sabha , 2019 vide its Notification No.464/EPS/2019 (3 ) dated 28th March 2019for 43- Madha Parliamentary Constituency of Maharashtra State and Santosh Balasaheb Bichukale had contested the aforesaid election ;
AND WHEREAS , as per Section 77 ( 1 ) of the Representation of the People Act , 1951 , every candidate at election shall , either by himself/herself or by his/her election agent , keep a separate and correct account of all expenditure in connection with the election incurred or authorized by him/her or by his /her election agent between (the date on which he has been nominated ) and the date of declaration of the result thereof, both dates inclusive and as per Section 78 of the Representation of the People Act , 1951 , every contesting candidate at an election shall , within thirty days from the date of election of the returned candidate lodge account of his/her election expenses with the District Election Officer ( DEO ) which shall be in a true copy of the account kept by him/her or by his /her election agent under Section 77 ;
AND WHEREAS , as per the report under rule 89 (2 ) of the Conduct of Elections Rules , 1961 , submitted by the District Election Officer and Collector , Solapur District , Maharashtra , through the Chief Electoral Officer's letter . ELR - 2019/CR 804/19/33 dated 15th September 2019 , Santosh Balasaheb Bichukale contesting candidate from 43- Madha Parliamentary Constituency of Maharashtra , has failed to lodge any account of his /her election expenses as required by law ;

AND WHEREAS , on the basis of the reports of the District Election Officer , Solapur District , Maharashtra , a Show Cause Notice dated 15th November 2019 was issued by the Election Commission of India under Sub Rule ( 5 ) of Rule 89 of the Conduct of Elections Rules , 1961 to Santosh Balasaheb Bichukale for non submission of account of Election expenses ;
AND WHEREAS , as per Sub Rule ( 6 ) of Rule 89 of the Conduct of Elections Rules , 1961 , through the above said Show Cause Notice dated 15th November 2019 , Santosh Balasaheb Bichukale was directed to submit his /her representation in writing in the Commission explaining the reason for non submission of accounts and also to lodge his/her accounts of election expenses/ rectify the defects in his /her accounts and submit the same to the District Election Officer concerned within 20 days from the date of receipt of the notice ;
AND WHEREAS , the said notice was received by the mother of Santosh Balasaheb Bichukale on 27th November 2019. Acknowledgement receipt obtained from the candidate's mother has been submitted to the Commission by District Election officer and Collector , Solapur District vide his letter No. Election/Desk/ 16/Misc/RR/ 1743/ 2019 dated 2nd December 2019 ;
AND WHEREAS , in the supplementary report submitted by DEO , Solapur vide his letter No. Election/Desk/ 16 /Misc/RR/ 283/ 2020 dated 31st July 2020 , it has been stated that Santosh Balasaheb Bichukale has not submitted the election expenses ;
AND WHEREAS , the Commission satisfied that Santosh Balasaheb Bichukale has failed to lodge an account of election expenses and has no good reason or justification for the failure ;
AND WHEREAS , Section 10 A of the Representation of the People Act , 1951 stipulates that : - " If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses within the time and in the manner required by or under this Act ; and
(b) has no good reason or justification for the failure , the Election Commission shall , by order published in the Official Gazette , declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order . "
NOW THEREFORE , in pursuance of Section 10 A of the Representation of the People Act , 1951 , the Election Commission of India hereby declares Santosh Balasaheb Bichukale , resident of 35 - Bhadkamkar Nagar , Near Police Colony , Phaltan , Tal . Phaltan , Dist- Satara , Pin- 415 523 , the contesting candidate for the General Election to the Lok Sabha Election , 2019from 43- Madha Parliamentary Constituency of the State of Maharashtra to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order .

आदेश
सं. 76/एम.टी.-एच.पी./ 43/ 2019 .-यतः , आयोग ने महाराष्ट्र के 43 - माधा संसदीय निर्वाचन क्षेत्र के लिए अपनी अधिसूचना सं. -464 / EPS / 2019 ( 3 ) दिनांक 28 मार्च 2019 के द्वारा लोकसभा के साधारण निर्वाचन , 2019 आयोजित करने की घोषणा की थी और संतोष बालासाहेब बिचुकाले पूर्वोक्त निर्वाचन में निर्वाचन लड़े / लड़ीं थे ;
और यतः , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 77 ( 1 ) के अनुसार , निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी या तो स्वयं या अपने निर्वाचन एजेंट द्वारा , ( वह तिथि जब उसे नाम - निर्देशित किया गया है) और (उसके परिणाम की घोषणा की तिथि) , दोनों तारीखें सम्मिलित , के बीच उसके द्वारा या उसके निर्वाचन एजेंट द्वारा उपगत या अधिकृत निर्वाचन संबंधी सभी खर्चों का एक पृथक और सही लेखा रखेगा और लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी को दर्ज करेगा जो धारा 77 के अंतर्गत उसके द्वारा अथवा उसके निर्वाचन एजेंट द्वारा रखे गए लेखे की सत्य प्रतिलिपि होगी ;
और यतः , निर्वाचनों का संचालन नियम, 1961 , के नियम 89 (2 ) के अधीन , मुख्य निर्वाचन अधिकारी के दिनांक 15 सितंबर 2019 के पत्र सं . ELR-2019/ CR 804/19/33 के जरिए प्राप्त , जिला निर्वाचन अधिकारी , सोलापुर जिला, महाराष्ट्र द्वारा प्रस्तुत रिपोर्ट के अनुसार, महाराष्ट्र के 43 - माधा संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी , संतोष बालासाहेब बिचुकाले, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में असफल रहे / रहीं हैं ;
और यतः , जिला निर्वाचन अधिकारी , सोलापुर जिला, महाराष्ट्र, की रिपोटों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम ( 5 ) के तहत निर्वाचन व्यय का लेखा दाखिल करने में असफल रहने पर संतोष बालासाहेब बिचुकाले को दिनांक 15 नवंबर 2019 को कारण बताओ नोटिस जारी किया गया था ;
और यतः , निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम ( 6 ) के अनुसार, दिनांक 15 नवंबर 2019 के उपर्युक्त कारण बताओ नोटिस के माध्यम से, संतोष बालासाहेब बिचुकाले को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखे न प्रस्तुत कर पाने का कारण स्पष्ट करते हुए आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करें और निर्वाचन व्यय का अपना लेखा भी दाखिल करें अपने लेखे में त्रुटियों को सही करें और उसे संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें ;
और यतः , संतोष बालासाहेब बिचुकाले की माता द्वारा उक्त नोटिस दिनांक 27 नवंबर 2019 को प्राप्त किया गया था । अभ्यर्थी की माता से प्राप्त पावती रसीद , जिला निर्वाचन अधिकारी एवं कलेक्टर , सोलापुर जिला द्वारा दिनांक 2 दिसंबर 2019 के अपने पत्र सं. Election/Desk / 16/ Misc./RR/1743/2019 द्वारा आयोग को प्रस्तुत कर दी गई है ;
और यतः, जिला निर्वाचन अधिकारी , सोलापुर द्वारा दिनांक 31 जुलाई 2020 के अपने पत्र सं . Election/ Desk/ 16 /Misc . /RR/ 283 / 2020 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह कहा है कि संतोष बालासाहेब बिचुकाले , ने निर्वाचन का लेखा प्रस्तुत नहीं किया और यतः, भारत निर्वाचन आयोग का यह समाधान हो गया है कि संतोष बालासाहेब बिचुकाले निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और असफलता के लिए उनके पास कोई समुचित कारण या न्यायोचित्य नहीं है ;
और यतः , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 क में यह अनुबंधित किया गया है कि : -
" यदि निर्वाचन आयोग का यह समाधान हो जाता है कि कोई व्यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है , दाखिल करने में असफल रहा है ; तथा
(ख) उसके पास उस असफलता के लिए कोई समुचित कारण या न्यायोचित्य नहीं है ,

तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरहित घोषित करेगा और ऐसा कोई भी व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरहित होगा " ।
अब इसीलिए, लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 क के अनुसरण में भारत निर्वाचन आयोग एतद्वारा महाराष्ट्र राज्य के 43- माधा संसदीय निर्वाचन क्षेत्र से लोकसभा के साधारण निर्वाचन, 2019 में निर्वाचन लड़ने वाले अभ्यर्थी , संतोष बालासाहेब बिचुकाले, निवासी- 35- भडकमकर नगर , पोलीस कोलोनी के पास , फलटन. ता. फलटन. जिला सतारा , पिन-415523 , को संसद के किसी भी सदन या राज्य या संघ राज्य-क्षेत्र की विधानसभा अथवा विधान परिषद के लिए सदस्य चुने जाने या होने के लिए इस आदेश की तारीख से तीन वर्ष की अवधि के लिए निरहित घोषित करता है ।
