क्रमांक सीआरसी. २४२०/प्र.क्र. ७९/का. बारा.----महाराष्ट्र दिवाणी न्यायालय अधिनियम, (१८६९ चा १४) याचे कलम १४ आणि १९ याद्वारे प्रदान करण्यात आलेल्या अधिकारांचा आणि याबाबतीत त्यास समर्थ करणाया इतर सर्व अधिकारांचा वापर करून, आणि याबाबतीत यापूर्वी काढलेल्या सर्व अधिसूचना, जालना जिल्ह्यतील अंबड व घनसावंगी महसुली तहसिलाशी जेथवर संबंध असेल तेथवर, त्यांमध्ये अंशत: फेरबदल करून, महाराष्ट्र शासन, याद्वारे पुढीलप्रमाणे असे निदेश देत आहे की, दिनांक २१ फेब्रुवारी, २०२१ पासून,----

(क) जालना महसुली जिल्ह्यमध्ये अंबड येथे एक न्यायालय असेल आणि, अतिरिक्त जिल्हा न्यायाधीश हे उक्त न्यायालयाच्या अध्यक्षस्थानी असतील, आणि,

(ख) उक्त न्यायालयाच्या सर्वसाधारण अधिकारितेच्या स्थानिक सीमा, जालना जिल्ह्यतील अंबड व घनसावंगी महसुली तालुक्यांमध्ये समाविष्ट असलेल्या क्षेत्रांशी समव्यापी व समाविष्ट असतील, आणि,

(ग) अंबड व घनसावंगी महसुली तालुक्यांच्या संबंधात प्रमुख जिल्हा न्यायाधीश, जालना यांचे सर्व अधिकार, उक्त अधिनियमाच्या कलम ९ अन्वये प्रमुख जिल्हा न्यायाधिशांकडे निहित असलेल्या अधिकारांव्यतिरिक्त आणि त्यांस योग्य वाटतील अशी प्रकरणे अतिरिक्त जिल्हा न्यायाधीश, अंबड यांच्याकडे सोपविण्याच्या किंवा स्वत:हून निकाली काढण्याच्या किंवा सक्षम अधिकारीतेच्या इतर न्यायालयाकडे सोपविण्याच्या त्यांच्या अधिकारांखेरीज, अंबड येथील उक्त अतिरिक्त जिल्हा न्यायाधीश यांचेकडे निहीत असतील.

NOTIFICATION

MAHARASHTRA CIVIL COURTS ACT.

No. CRC. 2420/CR79/Desk XII.—In exercise of the powers conferred by Section 14 and 19 of the Maharashtra Civil Courts Act (XIV of 1869), and in partial modification of all other earlier notifications issued in this behalf, in so far as they relate to the revenue tehsils of Ambad and Ghansawangi in Jalna District, the Government of Maharashtra directs that, with effect from the 21st February, 2021,—

(a) there shall be a Court at Ambad in the revenue district of Jalna and the said Court shall be presided over by the Additional District Judge;

(b) the local limits of the ordinary jurisdiction of the said Court shall be co-extensive with and cover the areas comprising the revenue tehsils of Ambad and Ghansawangi in Jalna District; and

(c) all the powers of the Principal District Judge, Jalna in respect of the revenue tehsils of Ambad and Ghansawangi shall vest in the said Additional District Judge at Ambad except those vested in the Principal District Judge under section 9 of the said Act and except his power to assign to the Additional District Judge, Ambad or withdraw unto himself or to assign to another Court of competent jurisdiction, such matters as he thinks fit.

महाराष्ट्र दिवाणी न्यायालय अधिनियम.

क्रमांक सीआरसी. २०२०/प्र.क्र. ७९/का. बारा.----महाराष्ट्र दिवाणी न्यायालय अधिनियम, (१८६९ चा १४) याचे कलम २१, २२ अ व २३ याद्वारे प्रदान करण्यात आलेल्या अधिकारांचा आणि याबाबतीत त्यास समर्थ करणाया इतर सर्व अधिकारांचा वापर करून ; आणि याबाबतीत यापूर्वी काढलेल्या सर्व अधिसूचनांचा जेथवर त्या जिल्हा न्यायालय, जालना यांना दुय्यम असणाया दिवाणी न्यायालय, वरिष्ठ स्तर, जालना यांच्याशी जेथवर संबंध असेल तेथवर, त्यांमध्ये अंशत: फेरबदल करून, महाराष्ट्र शासन, याद्वारे पुढीलप्रमाणे निदेश देत आहे की, दिनांक २१ फेब्रुवारी, २०२१ पासून,----

(क) जालना जिल्ह्यमध्ये अंबड येथे जिल्हा न्यायालय, जालना यास दुय्यम असलेले एक दिवाणी न्यायालय असेल ;

(ख) दिवाणी न्यायाधीश (वरिष्ठ स्तर) हे, उक्त न्यायालयाच्या अध्यक्षस्थानी असतील आणि ते अंबड येथे आपले न्यायालय भरवतील ;

(ग) दिवाणी न्यायाधीश (वरिष्ठ स्तर), अंबड यांच्या सर्वसाधारण अधिकारितेच्या स्थानिक सीमांमध्ये जालना जिल्ह्यतील अंबड आणि घनसावंगी महसुली तहसिलांचा समावेश असेल आणि यापूर्वी, दिवाणी न्यायाधीश (वरिष्ठ स्तर), जालना यांच्या सर्वसाधारण अधिकारीतेच्या स्थानिक सीमांमध्ये ज्यांचा समावेश करण्यात आला होता अशी क्षेत्र उक्त तहसिलामधून वगळण्यात येतील.

MAHARASHTRA CIVIL COURTS ACT.

No. CRC 2020/CR79/Desk XII.—In exercise of the powers conferred by Section 21, 22 A and 23 of the Maharashtra Civil Courts Act (XIV of 1869), and of all other powers enabling it in this behalf; and in partial modification of all earlier notifications issued in this behalf, in so far as they relate to the Court of Civil Judge, Senior Division, Jalna subordinate to the District Court, Jalna, the Government of Maharashtra, hereby, with effect from 21st February, 2021; directs that,—

(a) there shall be a Civil Court at Ambad subordinate to the District Court, Jalna in Jalna District;

(b) the said Court shall be presided over by the Civil Judge, Senior Division, who shall hold his Court at Ambad; and

(c) the local limits of the ordinary jurisdiction of the Civil Judge, Senior Division, Ambad shall comprise revenue tehsils of Ambadand Ghansawangi in Jalna District and the said tehsils which were heretofore included within the local limits of the ordinary jurisdiction of the Civil Judge, Senior Division, Jalna shall be excluded therefrom.

क्रमांक सीआरसी २०२०/प्र.क्र. ७९/का. बारा.----हिंदू विवाह अधिनियम, १९५५ (१९५५ चा २५) याच्या कलम ३ च्या खंड (ख) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा आणि याबाबतीत त्यास समर्थ करणाया इतर सर्व अधिकारांचा वापर करुन; आणि याबाबतीत यापूर्वी काढलेल्या सर्व अधिसूचनांचा, त्या जालना जिल्ह्यतील अंबड आणि घनसावंगी तहसिलाशी जेथवर संबंध असेल तेथवर, त्यांमध्ये अंशत: फेरबदल करून, महाराष्ट्र शासन, याद्वारे दिनांक २१ फेब्रुवारी २०२१ पासून, जालना जिल्ह्यतील दिवाणी न्यायालय (वरिष्ठ स्तर), अंबड यांस, महाराष्ट्र दिवाणी न्यायालय अधिनियम, (१८६९ चा १४) याअन्वये स्थापन करण्यात आलेल्या अंबड व घनसावंगी येथील दिवाणी न्यायालय, कनिष्ठ स्तर यांच्या सर्वसाधारण अधिकारितेच्या स्थानिक सीमांमध्ये येणाया उक्त अधिनियमाखालील प्रकरणांवर कार्यवाही करण्याची अधिकारिता असल्याचा विनिर्देश करीत आहे.

NOTIFICATION

HINDU MARRIAGE ACT, 1955.

No. CRC. 2020/C.R. 79/Desk XII.—In exercise of the powers conferred by clause (b) of section 3 of the Hindu Marriage Act, 1955 (25 of 1955), in its application to the State of Maharashtra and of all other powers enabling it in this behalf; and in partial modification of all earlier notifications issued in this behalf, in so far as they relate to the Ambad and the Ghansawangi Tehsils of Jalna District, the Government of Maharashtra hereby, with effect from the 21st February 2021, specifies the Court of Civil Judge, Senior Division at Ambad in Jalna District, as having jurisdiction in respect of the matters to be dealt with under the said Act within the local limits of ordinary jurisdiction of Court of Civil Judge, Junior Division, Ambad and Ghansawangi established under the Maharashtra Civil Courts Act, (XIV of 1869).

फौजदारी प्रक्रिया संहिता, १९७३.

क्रमांक सीआरसी. २०२०/प्र. क्र. ७९/का. बारा.----फौजदारी प्रक्रीया संहिता, १९७३ (१९७४ चा २) महाराष्ट्र राज्यात अंमलात असताना, त्यांच्या कलम ७ (३) तसेच कलम ९ द्वारे प्रदान करण्यात आलेल्या आणि याबाबतीत त्यास समर्थ करणाया इतर सर्व अधिकारांचा वापर करून; आणि याबाबतीत पूर्वी काढलेल्या सर्व शासकीय अधिसूचनांचा जालना जिल्ह्यतील अंबड आणि घनसावंगी महसूली तालुक्यांशी त्यांचा जेथवर संबंध असेल, तेथवर, त्यामध्ये अंशत: फेरबदल करुन, महाराष्ट्र शासन, उच्च न्यायालय, मुंबई यांच्याशी विचारविनिमय करून, याद्वारे दिनांक २१ फेब्रुवारी २०२१ पासून जालना जिल्ह्यतील अंबड व घनसावंगी महसूली तहसिलाकरीता एक उप सत्र विभाग निर्माण करीत आहे आणि उक्त उप सत्र विभागाच्या हद्दीमध्ये उद्भवणाया प्रकरणांची न्यायचौकशी करण्यासाठी अतिरिक्त सत्र न्यायाधिश ज्यांचे अध्यक्ष असतील, असे उप विभाग सत्र न्यायालय अंबड येथे स्थापन करीत आहे. प्रमुख सत्र न्यायाधिश, जालना हे अंबड उप सत्र विभागाचे देखिल अतिरिक्त सत्र न्यायाधिश असतील आणि त्यांना, उक्त उप सत्र विभागामध्ये प्रकरणांतील अधिकार स्वत:हून काढून घेण्याचे किंवा सलग अधिकारितेच्या इतर कोणत्याही न्यायालयास नेमून देण्याचे किंवा, त्यांस योग्य वाटतील अशी कोणतीही प्रकरणे, अंबड येथील अतिरिक्त सत्र न्यायाधिश यांचेकडे सोपविण्याचे अधिकार असतील.

NOTIFICATION

CODE OF CRIMINAL PROCEDURE, 1973.

No. CRC. 2020/C.R. 79/Desk XII.—In exercise of the powers conferred by section 7(3) read with section 9 of the Code of Criminal Procedure, 1973 (2 of 1974), in its application to the State of Maharashtra, and of all other powers enabling it in this behalf; and in partial modification of all earlier notifications issued in this behalf, in so far as they relate to the revenue tehsils of Ambad and Ghansawangi in the Jalna District, the Government of Maharashtra, after consultation with the High Court of Judicature at Bombay, hereby creates, with effect from the 21st February 2021, a Sessions Sub division for the revenue tehsils of Ambad and Ghansawangi in Jalna District and establishes a Court of Sessions at Ambad, to be presided over by the Additional Sessions Judge, for trial of cases arising within the limits of the said sessions sub division. The Principal Sessions Judge, Jalna shall also be the Additional Sessions Judge for the Ambad sessions sub division and shall have the powers to withdraw unto himself or to assign to any other court of competent jurisdiction, cases from the said sessions sub division, or to assign unto the Additional Sessions Judge at Ambad, any such cases as he thinks fit.
