THE MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

Whereas, the Government in Urban Development Department vide Notification No. TPS-2299-1001- C.R.111-UD-9, dated 28 June 2002 has sanctioned the development plan for the Bramhapuri Town & came into force with effect from the 26-08-2002 and excluding part of the Development Plan has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2299-1001- C.R.111-UD-9, dated the 13-07-2005 (hereinafter referred to as "the said Development Plan") under section31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. Act. No. XXXVII of 1966) (hereinafter referred to as "the said Act");
द्धन्रु]क्ष् रू न् +रून् ॅ-+ न् ह्यम््र ान्म््र, त्र्ॅाम्न््र २४, २०२१/ त्र्ॅा ५, ॅ १९४२ ३And whereas, in the said Development Plan, out of area admeasuring 0.685 Hector of the total area 1.08 Hector of land bearing Survey No. 114 of Mouje Delanwadi are included in " Agriculture Zone" (hereinafter referred to as "the said Lands");
And whereas, the Bramhapuri Municipal Council being the Planning Authority (hereinafter re- ferred to as "the said Planning Authority"), vide its General Body Resolution No. 01, dated 09-10-2018 has resolved to delete the said Lands and include the same in Residential Zone and accordingly submit- ted a modification proposal to the Government, for its sanction as per the provisions of sub section (1) of section 37 of the said Act, (hereinafter referred to as "the Proposed Modification");
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune the Government is of opinion that the proposed Modification should be sanc- tion with some conditions;
And whereas, the said Lands Owners have deposited Rs. 25,400/- towards the 50% Government share of 5% premium amount as per the rate of the said lands as prescribed in the Annual Statement of Rates (ASR) for the year 2020-21 in the Government Treasury on 08-12-2020 through the Assistant Direcor of Town Planning, Chandrapur Branch, Chandrapur and remaining 50% of the 5% premium amount Rs. 25,400/- payable to the Planning Authority has been deposited with the Chief Officer, Bramhapuri Municipal Council on 18 February 2020;
Now therefore, in exercise of the powers conferred on it under sub section (2) of section 37 of the said Act, the Government hereby, sanctions the proposed Modification and for that purpose amends the aforesaid Notification dated 28-06-2002 as follows;
"In the Schedule of Modifications appended to the Notification dated 28-06-2002 sanctioning the said Development Plan, the following new entry shall be added after the last entry.—
ENTRY
"The out of area admeasuring 0.685 Hector of the total area 1.08 Hector of land bearing Survey No. 114 of Mouje Delanwadi is deleted from Agriculture Zone and is included in Residential Zone as shown on the plan.
Condition No. 1— If the land is proposed to be developed by way of plotted layout, then sale of plots under such layout shall be monitored by the Chief Officer, Bramhapuri Municipal Council in relation to development of basic amenities as per the stages given below.
(a) After final approval of layout sale of 25% of the total plots shall be permissible.
(b) After completion of 40% basic Amenities. sale of 50% of the total plots shall be permissible.
(c) After completion of 60% basic Amenities. sale of 75% of the total plots shall be permissible.
(d) After completion of 80% basic Amenities. sale of 90% of the total plots shall be permissible.
(e) After completion of 100% basic Amenities. sale of 100% of the total plots shall be permissible.
Condition No. 2— In addition to open space, necessary 10% additional Amenity Space shall be provided & handover to Municipal Council instate of T.D.R./F.S.I.
Condition No. 3— The area affected by 18.00 Mt. wide Development Plan Road is retained.
A copy of the Notification, along with the part plan showing the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Chief Officer, Bramhapur Municipal Council during office hours on all working days for a period of one month.
This Notification shall also be available on the Government web site - www.maharashtra.gov.in (Act and Rule).
