क्रमांक टीपीबी.४३१८ / ६७८ /प्र. क्र.११४ / २०१ ९/नवि-११ . ज्याअर्थी , महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १ ९६६ (यापुढे याचा उल्लेख " उक्त अधिनियम " असा करणेत आलेला आहे ) चे कलम ३१ , पोट- कलम ( १ ) अन्वये प्राप्त अधिकारांचा वापर करुन राज्य शासनाने अधिसूचना क्र . टीपीबी.४३१७ / ६२ ९/प्र.क्र.११८ / २०१७ /वि.यो. / नवि-११ , दि. ८ मे २०१८ ( यापुढे याचा उल्लेख " उक्त अधिसूचना" असा करणेत आलेला आहे) द्वारे बृहन्मुंबई प्रारूप विकास योजना -२०३४ ( यापुढे याचा उल्लेख " उक्त विकास योजना " असा करणेत आलेला आहे) सह विकास नियंत्रण व प्रोत्साहन नियमावली-२०३४ ला उक्त अधिसूचनेसोबतचे परिशिष्ट -ब मध्ये दर्शविलेले सारभूत स्वरुपाचे फेरबदल (ई.पी. ) वगळून उक्त अधिसूचनेसोबतचे परिशिष्ट- अ मध्ये दर्शविलेल्या सुधारणेसह मंजूरी दिली आहे. आणि ज्याअर्थी शासनाने उक्त अधिसूचनेस समक्रमांकाचे शुद्धीपत्रक दि. २२ जून , २०१८ रोजी निर्गमित केले असून त्यानुसार उक्त विकास योजना दि. १ सप्टेंबर २०१८ पासून अंमलात आली आहे . आणि ज्याअर्थी, त्यानंतर शासनाने उक्त अधिसूचनेस समक्रमांकाचे शुद्धीपत्रक व पुरकपत्र दि. २ ९ जून, २०१८ रोजी पारित केले असून सदर शुद्धीपत्रक व पुरकपत्र महाराष्ट्र शासनाच्या राजपत्रात दिनांक ३० जून , २०१८ रोजी प्रसिद्ध करण्यात आले आहे;
आणि ज्याअर्थी , मुंबई महानगर प्रदेश विकास प्राधिकरणाने ( यापुढे याचा उल्लेख " एमएमआरडीए " असा करणेत आलेला आहे ) त्यांचे पत्र दि. ११ डिसेंबर २०१८ द्वारे न.भू.क्र. ६५७ ओ (पै ) आणि न.भू.क्र.८५३ (पै ) मौजे कांजूर पैकी ४३.७६ हेक्टर क्षेत्रफळाची जमीन " मेट्रो कार डेपो , संलग्न वापर आणि वाणिज्य " याकरीता आरक्षित करणेबाबत शासनास विनंती केली आहे ;
आणि ज्याअर्थी, शासनाने उक्त अधिनियमाचे कलम ४० ( १ ) ( सी ) अन्वये दिनांक २७ डिसेंबर २०१६ रोजीचे अधिसूचना सह दिनांक ४ नोव्हेंबर २०२० रोजीचे शुद्धीपत्रक व पुरकपत्राद्वारे मौजे कांजूर येथील मेट्रो कार डेपोसाठी एमएमआरडीए हे विशेष नियोजन प्राधिकरण म्हणून नियुक्त केलेल्या क्षेत्रातील , उक्त विकास योजना मंजूरीतून वगळलेल्या ठराविक सारभूत बदलांना (ई.पी. ) शासनाने दिनांक ०५ नोव्हेंबर २०२० रोजीचे अधिसूचनेद्वारे मंजूरी दिली आहे ;
आणि ज्याअर्थी, उक्त विकास योजनेत न. भू. क्र. ६५७ ओ (पै ) आणि न . भू. क्र. ८५३ (पै) मौजे कांजूर, ह्या जमिनी विविध सार्वजनिक प्रयोजनार्थ जसे बगिचा/ उद्यान, परवडणारी घरे , पुनर्वसन व पुनर्स्थापना, बेघरांसाठी निवारा , पोलीस स्टेशन , पोलीस कर्मचारी निवासस्थाने, महापालिका शाळा, विद्युत वहन व वितरण सुविधा , आणि विकास योजना रस्ते (यापुढे ज्याचा उल्लेख " उक्त जमीन " असा करण्यात आला आहे. ) ;

भाग एक (को.वि.पु . )- २७-१ २
महाराष्ट्रशासन राजपत्र असाधारण भाग एक- कोकण विभागीय पुरवणी, मार्च १० , २०२१/ फाल्गुन १ ९, शके १९ ४२ आणि ज्याअर्थी, एमएमआरडीए ने केलेली विनंती आणि बृहन्मुंबई महानगरपालिकेचा अहवाल विचारात घेता सदर प्रकरणी उक्त जमिनीचे आरक्षणात बदल करणे सार्वजनिक हिताचे दृष्टीने आवश्यक आहे , अशी शासनाची खात्री झाली आहे. आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम ३७ च्या पोट- कलम ( १ कक) अन्वये प्राप्त अधिकाराचा वापर करून शासनाने दिनांक ५ नोव्हेंबर , २०२० रोजीची सूचना त्यासोबतचे परिशिष्टामध्ये नमूद प्रस्तावित फेरबदलावर (यापुढे ज्याचा उल्लेख " प्रस्तावित फेरबदल " असा करण्यात आलेला आहे ) जनतेकडून हरकती/ सूचना मागविण्यासाठी प्रसिद्ध करण्यात आली होती आणि ज्याद्वारे प्रस्तावित फेरबदलाबाबत प्राप्त होणाऱ्या हरकती/ सूचनांवर संबंधितांना सुनावणी देण्याकरिता तसेच उक्त अधिनियमाच्या कलम ३७ ( १ कक) अन्वये विहित केलेली कार्यवाही पूर्ण करून प्रस्ताव शासनास सादर करणेसाठी उप संचालक, नगररचना , बृहन्मुंबई यांची अधिकारी (यापुढे ज्यांचा उल्लेख " उक्त अधिकारी " असा करण्यात आला आहे. ) म्हणून नियुक्ती करण्यात आली आहे ;
आणि ज्याअर्थी , प्रस्तावित फेरबदलाची सदर शासन सूचना दि. ५ नोव्हेंबर , २०२० ही महाराष्ट्र शासनाचे असाधारण राजपत्रात ६ नोव्हेंबर , २०२० रोजी प्रसिद्ध करण्यात आली होती आणि उक्त अधिकारी यांनी अधिनियमाचे कलम ३७ ( १ कक) अन्वये वैधानिक कार्यवाही पूर्ण करून दिनांक ४ फेब्रुवारी २०२१ व दिनांक ११ फेब्रुवारी २०२१ रोजीच्या पत्रान्वये त्यांचा अहवाल नगररचना संचालनालयामार्फत शासनाचे अंतिम मंजूरीसाठी सादर केला आहे ;
आणि ज्याअर्थी, उक्त अधिकारी यांनी सादर केलेला अहवाल विचारात घेता व संचालक, नगररचना , महाराष्ट्र राज्य, पुणे यांचेशी सल्ला- मसलत केल्यानंतर उक्त प्रस्तावित फेरबदल मंजूर करणे जनहिताच्या दृष्टीने आवश्यक आहे , असे शासनाचे मत झाले आहे.
आणि त्याअर्थी, उक्त अधिनियमाच्या कलम ३७ चे पोट - कलम ( १ कक) ( ग) अन्वये प्रदत्त असलेल्या अधिकाराचा वापर करून शासन याद्वारे उक्त प्रस्तावित फेरबदलास खालीलप्रमाणे मंजूरी देत आहे: -
(अ ) ( 1 ) The reservation of " Garden/ Park, ( ROS 1.5 ) ( 7Nos . ) Affordable Housing ( RR2.2 ) ( 3Nos. ), Rehabilitation and Resettlement ( RR2.1 ) , Homeless Shelter ( RSA 2.9 ) , Police Station ( RPU3.1 ) , Police StaffQuarters ( RR1.2) , Municipal School ( RE1.1 ) , Electricity Transmission and Distribution facility ( RPU5.2) and 27.45m , 18.30m . ( 5 Nos ) , 13.40m . ( 2Nos) wide Development Plan Roads " on land bearing CTS No. 657A ( Part) and CTS No. 853 ( Part) of Village Kanjur having area admeasuring approximately 43.76 Ha. are deleted and the land so deleted is entirely reserved for " Metro Car Depot , Casting yard and other Metro uses " as shown on plan subject to following conditions.
Conditions: -
(i ) It is necessary to obtain permission for CRZ point of view from concern Authority i.e. MCZMA/ MoEF in respect of land under CRZ .
( ii ) The scientific mitigation measures be taken during contraction and operation of Car Depot .
( iii ) It will be binding for compliance of orders of Hon'ble High Court/Supreme Court in respect of aboveland .
(2) Due to above modification necessary changes that are required to be made in the Development Planroad pattern for proper connectivity in the nearby vicinity area are accordingly modified and sanctioned as shown on plan .
(ब) सदरहू अधिसूचना शासन राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून सदर फेरबदल अंमलात येईल .
(क) आयुक्त, बृहन्मुंबई महानगरपालिका यांना निर्देशित करण्यात येते की , उक्त विकास योजना मंजूरीच्या अधिसूचनेसोबत जोडलेल्या फेरबदलाच्या अनुसूचीमध्ये शेवटच्या नोंदीनंतर वर " अ " मधील नविन नोंद समाविष्ट करावी.
३ महाराष्ट्रशासन राजपत्र असाधारण भाग एक-कोकण विभागीय पुरवणी, मार्च १० , २०२१/ फाल्गुन १ ९ , शके १ ९४२ उक्त फेरबदल दर्शविणाऱ्या भाग नकाशाची प्रत सर्वसाधारण जनतेच्या निरीक्षणासाठी प्रमुख अभियंता ( विकास नियोजन ) , बृहन्मुंबई महानगरपालिका , महापालिका मार्ग , फोर्ट , मुंबई ०१ यांचे कार्यालयात सर्व कामकाजाच्या दिवशी कार्यालयीन वेळेत उपलब्ध राहील.
सदर अधिसूचना महाराष्ट्र शासनाच्या www.maharashtra.gov.in (कायदा / नियम ) या वेबसाइटवर प्रसिद्ध करण्यात येत आहे .

NOTIFICATION
No. TPB . -4318/ 678 /CR - 114/2019/ UD - 11. - Whereas , in exercise of the powers conferred by sub- section ( 1 ) of Section 31 of the Maharashtra Regional and Town Planning Act , 1966 ( hereinafter referred to as " the said Act ") , the State Government vide Notification No. TPB - 4317 /629/CR - 118/ 2017/ DP /UD - 11 , Dt . 8th May 2018 ( hereinafter referred to as " the said Notification ") has accorded sanction to the Draft Development Plan - 2034 of Greater Mumbai ( hereinafter referred to as " the said Development Plan") alongwith the Development Control and Promotion Regulations - 2034 for Greater Mumbai with modifications shown in SCHEDULE - A appended to the said Notification excluding the substantial modifications as shown in SCHEDULE - B appended to the said Notification . And whereas , Government has issued a corrigendum of even numberdt . 22nd June , 2018 to the said Notification , as per which the said Development Plan has came into force from 1st September , 2018. And whereas , thereafter Government has issued a Corrigendum and Addendum of even numberdt . 29th June , 2018 to the said Notification , which is published in the Government Gazettedt . 30th June , 2018 ;
"And whereas , Mumbai Metropolitan Region Development Authority ( hereinafter referred to as "MMRDA " ) vide letter dated 11th December 2018 has requested the Government to reserve land admeasuring 43.76 hectare bearing CTS No. 657A ( Part ) and CTS 853 ( Part ) of Village Kanjur for " Metro CarDepot , allied uses and Commercial " .;
And whereas , Government of Maharashtra vide Notification dated 5th November 2020 has sanctioned certainexcluded part of the said Development Plan included in the Special Planning Authority ( SPA ) area ofMMRDA for Metro car depot at Kanjur declared under section 40( 1 ) ( c) of the said Act vide Notification dated 27th December 2016 read with corrigendum and addendum dated 4th November 2020.
And whereas , as per the said Development Plan , the land bearing CTS No. 657A( Part ) and CTS No. 853(Part) ofVillage Kanjur , Mumbai is reserved for various public purposes such as Garden / Park , Affordable Housing , Rehabilitation and Resettlement , Homeless Shelter , Police Station , Police Staff Quarters , Municipal School , Electricity Transmission and Distribution facility and Development Plan Roads ( hereinafter referred to as " the said land ") ;
And whereas , considering the request of MMRDA and Report of the Municipal Corporation of Greater Mumbai , the Govt . is satisfied that in the public interest it is expedient to change reservations , land use in respect of portion of the said land and Development Plan road pattern for proper connectivity in the nearby vicinity , and whereas , in exercise of the powers conferred under Sub - Section ( 1AA ) of Section 37 of the said Act , Government had issued Notice of even no . dated 5th November , 2020 for inviting suggestions/ objections from the general public with regard to "the proposed modification " ( hereinafter referred to as "theproposed modification " ) as mentioned in the Schedule appended to the said Notice and appointed the ५ महाराष्ट्रशासन राजपत्र असाधारण भाग एक- कोकण विभागीय पुरवणी, मार्च १० , २०२१/फाल्गुन १ ९, शके १९ ४२ Deputy Director of Town Planning , Gr. Mumbai as the Officer ( hereinafter referred to as " the said Officer " ) to complete the procedure as stipulated under Section 37 ( 1AA) of the said Act and to submit a Report on the objections / suggestions received in respect of the proposed modification to the Government after giving hearing to the concerned persons ;
And whereas , the said Notice dated 5th November , 2020 was published in the Maharashtra Government Gazette ( Extra - Ordinary Gazette ) dated 6th November , 2020 and the said Officer has submitted his report vide letterdt . 4th February 2021 and dated 11th February 2021 through the Director of Town Planning , Maharashtra State , after completing the legal procedure stipulated under Section 37 ( 1AA ) ofthe said Act ;
And whereas , after considering the Report of the said Officer and after consulting the Director of Town Planning , Maharashtra State , the Government is of the opinion that the proposed modification is required to be sanctioned as proposed with certain conditions .
Now, therefore , in exercise of the powers conferred upon it under section 37 ( 1AA) ( c) of the said Act , the Government hereby Sanctions the proposed modification as given below: -
(A) ( 1 ) The reservation of " Garden / Park , ( ROS 1.5) ( 7 Nos . ) Affordable Housing ( RR2.2 ) (3Nos . ) , Rehabilitation and Resettlement ( RR2.1 ) , Homeless Shelter ( RSA 2.9 ) , Police Station ( RPU3.1 ) , Police StaffQuarters ( RR1.2) , Municipal School ( RE1.1 ) , Electricity Transmission and Distribution facility ( RPU5.2) and 27.45m , 18.30m . The part plan showing the said modification shall be kept open for inspection by the general public during the office hours on all working days for the period of one month in the office of the Chief Engineer (DevelopmentPlan ) , Greater Mumbai Municipal Corporation.
This Notification shall also be published on the Government website www.maharashtra.gov.in (Acts/ Rules )
