क्रमांक एमपीआय ०२१५/ प्र. क्र. ६४/ पोल-१२.—ज्याअर्थी, सुपर पॉवर इन्वेस्टमेंट स(cid:५२८)व्हसेस इंडिया लि.

औरंगाबाद (यात यापुढे उक्त वित्तीय संस्था असा निर्देश करण्यात आला आहे) आणि या वित्तीय संस्थेचे संचालक यांनी ठेवीदारांकडून स्वीकारलेल्या ठेवी मुदतपूर्तीनंतर परत करण्यास कसूर के ली आहे, अशा तक्रारी त्यांच्याविरुद्ध बहुतांश ठेवीदारांकडून प्राप्त झालेल्या आहेत ;

आणि ज्याअर्थी, आरोपींविरुद्ध, गुन्हा पो .स्टे. जवाहरनगर, औरंगाबाद शहर येथे दाखल असून त्याचा गुरनं. १८७/२०१४ कलम ४२०, ४०६, ४६५, ४६८, ४७१, १०९, ११४, १२० (ब), ३४ भा.दं.वि, कलम ३ व ४ MPID ॲक्ट १९९९, सह कलम ६६ (डी) IT ॲक्ट सह प्राईज चिटस ॲण्ड मनी सक्यु र्लेशन स्किम (बँनिग) ॲक्ट १९७८ चे कलम ४, ५, ६ प्रमाणे गुन्हा दाखल आहे.

आणि ज्याअर्थी, राज्य शासनाची अशी खात्री झाली आहे की, उक्त वित्तीय संस्था आणि त्यांचे संचालक ठेवीदारांना त्यांच्या ठेवी परत करण्याची शक्यता नाही म्हणून राज्य शासनाला अशा ठेवीदारांच्या हितसंबंधाचे रक्षण करावे लागेल ;

आणि ज्याअर्थी, यासोबत जोडलेल्या अनुसूचीत विनिर्दिष्ट के लेली मालमत्ता उक्त वित्तीय संस्थेकडून आणि त्यांच्या संचालकाकडून त्याचप्रमाणे उक्त वित्तीय संस्थेकडून गोळा के लेल्या ठेवींमधून संपादित करण्यात आलेली आहे असे अभिकथित आहे ;

(१)भाग चार-ब--८६-१

त्याअर्थी आता, महाराष्ट्र ठेवीदारांच्या (वित्तीय संस्थामधील) हितसंबंधी संरक्षण अधिनियम, १९९९ (२००० चा महा.१६) (यात यापुढे ज्याचा उक्त अधिनियम असा निर्देश करण्यात आला आहे) याच्या कलम ४ चे पोट कलम (१) व कलम ५ व कलम ८ या(cid:४६२)ारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून महाराष्ट्र शासन या(cid:४६२)ारे —

(क) अनुसूचीत विनिर्दिष्ट के ल्याप्रमाणे, उक्त वित्तीय संस्थेची आणि त्यांचे संचालक यांच्या नावे असलेली मालमत्ता जप्त करीत आहे,

उक्त अधिनियमान्वये नियुक्त करण्यात आलेल्या पदनिर्देशित न्यायालयातील सरकारी अभियोक्ता न्यायालयात अर्ज दाखल करताना सक्षम प्राधिकाऱ्यास (उपविभागिय अधिकारी, नाशिक यांस) आवश्यक ते सहा(cid:२००)य करतील.

NOTIFICATION

MAHARASHTRA PROTECTION OF INTEREST OF DEPOSITORS (IN FINANCIAL ESTABLISHMENT) ACT, 1999.

No. MPI- 0215/CR. 64/Pol-12.—Whereas, complaints have been received from number of depositors against Super Power Investment Services India Ltd. Aurangabad. (hereinafter referred to "as the said Financial Establishment) and so also Chairman, Directors and Manager of the said financial establishment complaining that they have defaulted to return the said deposits made by the depositors after maturity;

And whereas, an offence has been registered against the accused at Jawaharnagar Police Station, Aurangabad city CR No.187/2014, booked under Indian Penal Code sections 420, 406, 465, 468, 471, 109, 114, 120(B) and 34 Criminal Procedure Code read with of with MPID Act 1999, U/s 3 with 66(D) of I.T. Act, and Sections 4, 5, 6 of Price Chits and Money Circulation Scheme Act, 1978.

And whereas, the State Government is satisfied that the said Financial Establishment and its Chairman, Directors and Manager are not likely to return the deposits to the depositors and hence the Government has to protect the interest of depositors;

And whereas, the properties specified in the Schedule appended hereto are alleged to have been acquired by the said Financial Establishment and its Chairman, Directors and Manager from and out of the deposits collected by the said Financial Establishment;

Now, therefore in exercise of the powers conferred by sub-section (1) of section 4, sub-section (1) of section 5 and section 8 of the Maharashtra Protection of Interest of Depositors (in Financial Establishment) Act, 1999 (Mah. XVI of 2000) (hereinafter referred to as the said Act) the Government of Maharashtra hereby;

(a) attaches the properties of the said Financial Establishment and properties in the name of its Chairman, Directors and Manager and their relatives as specified in the Schedule; and The Public Prosecutor in designated Court appointed under the said Act shall render necessary assistance to the Competent Authority (Sub Divisional Officer, Nashik) in filing the application before the Special Court.
