क्रमांक आयडीसी -२०२० / ( ५१ )/ उद्योग -१४ . ज्याअर्थी , अनुसूचित उल्लेखिलेल्या क्षेत्रात महाराष्ट्र औद्योगिक विकास अधिनियम , १ ९६१ चे कलम २ खंड (ग ) ची अधिसूचना क्रमांक आयडीसी-२०२० / ( ५१ ) /उद्योग-१४ , दिनांक ६-१२ , फेब्रुवारी २०२० महाराष्ट्र शासनाच्या राजपत्रातील , भाग चार - ब , पृष्ठ क्र. १ ९ ते २० वर महाराष्ट्र शासनाने सदर अधिसूचनेला अनुसूचित उल्लेखिलेल्या क्षेत्रात महाराष्ट्र औद्योगिक विकास अधिनियम , १ ९ ६१ ( १ ९ ६२ चा महा तीन ) ( यापुढे ज्याचा उल्लेख " उक्त अधिनियम" असा करण्यात येईल ) चे कलम २ खंड ( ग ) , दिनांक ६ फेब्रुवारी २०२० रोजी अधिनियमाच्या कलम २ , खंड (ग) अन्वये औद्योगिक क्षेत्र म्हणून जाहीर केलेले आहे ;

आणि ज्याअर्थी , मौजे तळवली तर्फ सोनाळे , तालुका भिंवडी, जिल्हा ठाणे मधील औद्योगिक क्षेत्रातील, सदर परिशिष्टात नमुद केलेल्या औद्योगिक क्षेत्राच्या काही क्षेत्रफळामध्ये आणि महसूलच्या नोंदीनुसार औद्योगिक क्षेत्र घोषित करण्यास पुष्टी केलेल्या सर्व्हे क्रमांकाच्या क्षेत्रामध्ये (महसुली अभिलेख नमुना क्रमांक ७ व १२ ) व संपादनासाठी निश्चित केलेल्या क्षेत्रफळामध्ये तफावत असल्याचे महाराष्ट्र शासनाच्या निदर्शनास आणले गेले व ज्यामुळे सदर अधिसूचनेत दुरूस्ती होणे महाराष्ट्र शासनास गरजेचे वाटत असेल ;

तर , महाराष्ट्र सामान्य कलमे कायदा , १ ९ ०४ च्या कलम २१ सोबत वाचण्यात येणाऱ्या सदर अधिनियमाच्या कलम २ चे उप - कलम (ग) अन्वये प्रदान करण्यात आलेल्या अधिकारांतर्गत महाराष्ट्र शासन असे जाहीर करते की , दिनांक ०८ एप्रिल २०२१ पासून सदर अधिसूचनेत खालीलप्रमाणे बदल लागु झाले आहेत असे मानण्यात येईल .

AMENDMENT

MAHARASHTRA INDUSTRIAL DEVELOPMENT ACT , 1961 .

No. IDC . 2020 /( C.R.51)/IND-14.-Whereas , by the Government Notification , Industries , Energy and Labour Department No. IDC . 2020/ ( C.R.51 )/IND -14 , dated 6-12 February 2020 on Page No. 21-22 ( hereinafter referred to as " the said Act " ) issued in exercise of the powers conferred by sub- section ( 3 ) of section 1 of the Maharashtra Industrial Development Act , 1961( Mah . III of 1962 ) (hereinafter referred to as the said Act " ) , the Government of Maharashtra has appointed the 6th February 2020 to be the date from declared those areas as an industrial area under clause (g ) of section 2 of the said Act ;

And Whereas , it is brought to the notice of the Government of Maharashtra that there is a difference in the survey number's area of certain areas of the said industrial area and in the survey number's area confirmed for declaration of Industrial area as per revenue records ( in the forms VII and XII ) of Village Talavali Tarf Sonale in Taluka Bhivandi of District Thane , and the Government of Maharashtra considers it expedient to amend the said notification so as to mention the correct areas with respect to the said industrial area in the said notification ;

Now , therefore , in exercise of the powers conferred by sub- section ( G) of section 2 of the said Act read with section 21 of the Maharashtra General Clauses Act ( I of 1904) , and of all other powers enabling it in this behalf, the Government of Maharashtra hereby , with effect from the 8th April 2021 amends the said notification , as follows , namely : -

In the Schedule appended to the said notification-

( 1) On page No. 22 in the entries relating to Village Talavali Tarf Sonale , Taluka- Bhivandi , District - Thane .

( i) In Serial No.28 in column ( 3) for " 0.537" read " 0.567" .

क्रमांक आयडीसी- २०२०/ (प्र.क्र . ५७४)/उ-१४ . ज्याअर्थी महाराष्ट्र औद्योगिक विकास अधिनियम, १ ९ ६१ (१ ९ ६२ चा महा. तीन ) चे कलम १ पोट - कलम ( ३ ) अन्वये करण्यात आलेली व महाराष्ट्र शासन राजपत्र, असाधारण, भाग चार - ब , दिनांक २६ जुलै २०१ ९ , पृष्ठे क्र. १ ते ४ वर प्रसिद्ध करण्यात आलेली शासनाचे उद्योग , ऊर्जा व कामगार विभागाचे क्र. आयडीसी-२०१ ९/ (प्र.क्र . ४२९ ) / उद्योग -१४ , दिनांक २६ जुलै २०१ ९ अन्वये उपरोक्त अधिनियमाच्या प्रकरण सहाचे उपबंध हे त्या अधिसूचनेत नमूद केलेले मौजे नवलाख उंब्रे, ता. मावळ, जि. पुणे येथील क्षेत्रास दिनांक २६ जुलै २०१ ९ या तारखेपासून लागू करणेत आलेल्या आहेत व उक्त क्षेत्र हे उक्त अधिनियमाच्या कलम २ खंड (ग ) अन्वये " औद्योगिक क्षेत्र " म्हणून जाहीर केलेले आहे.

आणि ज्याअर्थी , उपरोक्त अनुसूचीमध्ये जाहीर केलेल्या जमिनी त्याभागात समाविष्ट आहे. ( यापुढे याचा उल्लेख "उक्त जमीन" असा करण्यात येईल ;

आणि ज्याअर्थी, महाराष्ट्र औद्योगिक विकास महामंडळाकरिता उक्त जमिनी औद्योगिक क्षेत्र म्हणून विकासासाठी या जागेची आवश्यकता असल्याचे राज्य शासनाचे मत आहे ;

आणि ज्याअर्थी उक्त जमिनीच्या जमीन मालकांचे व त्यात हितसंबंध असलेल्या व्यक्तींचे म्हणणे अधिनियमांच्या कलम ३२ चे पोट - कलम ( २ ) प्रमाणे एकूण घेतलेले आहे व त्यानुसार राज्य शासनाने या कलमाच्या ३२ च्या अनुषंगाने उक्त जमीन संपादन करण्याचा निर्णय घेतला आहे .

त्याअर्थी, महाराष्ट्र औद्योगिक विकास अधिनियम , १९ ६१ चे कलम ३२ ( १ ) चा वापर करून सदर जमिनी उपरोक्त कारणासाठी संपादित केल्या असल्याबद्दलची ही नोटीस शासन या कलमा अन्वये प्राप्त अधिकारांचा वापर करून प्रसिद्ध करीत आहे.

NOTICE

MAHARASHTRA INDUSTRIAL DEVELOPMENT ACст, 1961 .

No. IDC - 2020 / ( C.R.574)/Ind-14.-Whereas by Government Notification , Industries , Energy and Labour Department , No. IDC - 2019/( C.R.429 ) Ind- 14 , dated the 26th July 2019 issued under sub- section ( 3 ) of section 1 of the Maharashtra Industrial Development Act , 1961 ( Mah . III of 1962 ) ( hereinafter referred to as " the said Act " ) , and published in the Maharashtra Government Gazette, Extraordinary , Part IV- B , dated 26th July, 2019 , on pages 5 to 8 the Government of Maharashtra has notified the 26th July , 2019 to be date from which the provisions of Chapter VI of the said Act , shall take effect in certain areas of village Navlakh Umbre in Taluka Maval , District Pune , mentioned in the Schedule appended to the said notification (hereinafter referred to as " the said area" ) and declared the said area as an industrial area under clause (g ) of section 2 of the said Act for the purposes of the said Act ;

And whereas , the land mentioned in the Schedule appended hereto ( hereinafter referred to as " the said lands" ) are situated in the said areas ;

And whereas , the State Government is of the opinion that the said lands are required by the Maharashtra Industrial Development Corporation for development as an Industrial Area ;

And Whereas , after considering the cause shown by the owners in the said lands and by other persons interested therein and after giving such owners and person an opportunity of being heard in pursuance notice issued under sub - section ( 2 ) of section 32 of the said Act , the State Government has decided to acquire the said lands in pursuance of the said section 32 .

Now, therefore , in exercise of the powers conferred by sub - section ( 1 ) of section 32 of the said Act , the Government of Maharashtra hereby publishes this notice for acquiring the said lands for the purpose aforesaid .

आणि ज्याअर्थी, यासोबत जोडलेल्या अनुसूचीत उल्लेखिलेल्या मौजे केळवली , वांगणी , घोडीवली , कांढरोली , नावंढे , मानकिवली , हाळखुर्द , अंजरुण , तालुका खालापूर व मौजे तळवली, तालुका कर्जत व जिल्हा रायगड येथील काही जमिनी अधिसूचनेच्या अनुसूचीत उल्लेखिलेल्या क्षेत्रात औद्योगिक क्षेत्राच्या विकासासाठी आवश्यक नाहीत असे महाराष्ट्र सरकारचे मत झाले आहे.

त्याअर्थी , उक्त अधिनियमाच्या कलम १ , पोट- कलम ( ३ ) व कलम २ , खंड (ग) अन्वये प्रदान केलेल्या शक्तींचा वापर करून व महाराष्ट्र जनरल क्लॉजेस अॅक्ट च्या कलम २१ सह वाचावे ( १ ९ ०४ चा -१ ) चा संदर्भ घेऊन महाराष्ट्र शासन याद्वारे खालील उल्लेख केलेल्या क्षेत्रात ज्या गोष्टी झाल्या आहेत किंवा ज्या गोष्टी करावयाच्या ठरविल्या आहेत त्या सोडून महाराष्ट्र औद्योगिक विकास अधिनियम , १ ९ ६१ चे कलम प्रकरण सहा , दिनांक ८ एप्रिल २०२१ पासून रद्द करीत आहे, आणि सदर क्षेत्र हे जाहीर केलेल्या औद्योगिक क्षेत्राचा भाग राहणार नाही .

No. IDC 2019 /( C.R.612 )/( IND14 ) .-Whereas , by the Government Notification , Industries , Energy and Labour Department , No. IDC . 2007 /( 718 )/Ind- 14 , dated the 22nd September 2015 (hereinafter referred to as " the said notification " ) , issued under sub- section ( 3 ) of section 1 of the Maharashtra Industrial Development Act , 1961 ( Mah.III of 1962 ) (hereinafter referred to as "the said Act " ) , the Government of Maharashtra has appointed the 23rd September 2015, to be the date from which the provisions of Chapter VI of the said Act shall take effect in certain areas in villages Kelvali , Vangni , Ghodivali , Kandroli , Navandhe , Mankivali , Halkhurd , Anjarun , Taluka Khalapur & Village Talavali , Taluka Karjat of District Raigad , mentioned in the Schedule appended to the said notification (hereinafter referred to as " the said area " ) and declared the said area as an industrial area under clause (g ) of section 2 of the said Act ;

And whereas , the Government of Maharashtra is of the opinion that the said areas of the Villages Kelvali , Vangni , Ghodivali , Kandroli , Navandhe , Mankivali , Halkhurd , Anjarun , Taluka Khalapur & Village Talavali , Taluka Karjat of District Raigad , mentioned in the Schedule appended to the said notification are not required for the purpose of development as an industrial area .

Now , therefore , in exercise of the powers conferred by the first proviso to sub - section ( 3 ) of section 1 and clause (g ) of section 2 of the Maharashtra Industrial Development Act , 1961 read with section 21 of the Maharashtra General Clauses Act ( I of 1904 ) , and of all other powers enabling it in this behalf, the Government of Maharashtra hereby , with effect from the dated 8th April 2021 declares that the provisions of Chapter VI of the said Act shall cease to be in force in the said areas and the said areas shall not be the industrial area so declared , except as respects things done or omitted to be done before that date .
