ORDER

No. TPS-2420-1348-C.R.13-2021-UD-9-2021.—

Whereas, the Revised Development Plan of Nagpur City has been partly sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496-2643-CR-300 (A)-97-UD-9, dated 7th January 2000 and finally sanctioned vide Notification No. TPS-2400-1628-CR-200-2000-UD-9, dated 10th September 2001 and has come into force with effect from 1st March 2000 & 21st September 2001 respectively (hereinafter referred to as " the said Development Plan ") under Section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") ;

And whereas, in the said Development Plan, the land bearing Khasra No. 246 (part) & 230 (part) area admeasuring about 2.038 HA of Mouja Zingabai Takali (hereinafter referred to as " the said reserved Land ") is reserved as " Site No. MNW-15 Fire Station " (hereinafter reffered to as " the said reservation ") and the Appropriate Authority for the said reservation is Nagpur Municipal Corporation (hereinafter referred to as " the said authority ";

And whereas, the said land has not been acquired by the said Authority within ten years from the date on which the said Development Plan came into force ;

And whereas, the owner of the land bearing Khasra No. 246/2, Plot Nos. 31, 32 & 32-A of Mauje Zingabai Takali admeasuring about 557.514 Sq. Mt. (hereinafter referred to as " the said Land ") more particularly described in Schedule appended hereto, out of the said reserved land, had issued a notice dated 23rd September 2015 under Section 127 (1) of the said Act (hereinafter referred to as " the said Notice ") to the said Authority ;

And whereas, even after service of the said Notice as afore said, the said land has not been acquired within a stipulated period from the date of the service of the said Notice under sub-section (1) of Section 127 of the said Act, intimated by the said authority vide its letter dated 27th April 2020 ;

And whereas, Hon'ble High Court in Writ Petition No. 3602-2018 & Application No. 3336-2019 file by the owner of the said land, vide its order dated the 18th September 2019 & dated 16th December 2019 held that the said reservation to the extend of the said land stands lapsed, under Section 127 of the said Act ;

And whereas, Now it becomes expendient to notify by an order Section 127 (2) of the said Act that the said Reservation on the said Land, in the said Development Plans has been lapsed ;

Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 127 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra hereby Notifies that, the said reservation on the said land stands lapsed and the land so released shall be available to the land owner for the purpose of Development as otherwise permissible in the case of adjacent land under the Development Plan.

(1) A copy of the Part Plan showing the area which is lapsed vide this order is available in the Office of the Commissioner, Nagpur Municipal Corporation, Nagpur during office hours on all working days for inspection of public up to one month.

(2) This Order shall also be available on the Government website. at www.urban.maharashtra.gov.in.

Whereas, Revised Development Plan of Nagpur City has been partly sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496-2643-CR-300(A)-97-UD-9, dated 7th January 2000 and finally sanctioned vide Notification No. TPS-2400-1628-CR-200-2000-UD-9, dated 10th September, 2001 & has come into force with effect from 1st March, 2000 & 21st September, 2001 respectively (hereinafter referred to as "the said Development Plan") under section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. And whereas, in the said Development Plan, the land bearing Khasara No. 135/3 (part), 135/4, 140/2 (part) area admeasuring about 1.2544 Ha. of Mouja Nara (hereinafter referred to as "the said reserved Land") is reserved as Site No. N-165 "NMC Naka" (hereinafter referred to as "the said reservation") and the Appropirate Authority for the said reserva- tion is Nagpur Municipal Corporation (hereinafter referred to as "said authority") ;

And whereas, the said land has not been acquired by the said authority within ten years from the date on which the said Development Plan came into force ;

And whereas, the owner of the land bearing Khasara No. 135/2 (Old), 135/17 (New) of Mouja Nara admeasuring about 0.19 Ha. (hereinafter referred to as "the said Land") more particularly described in Schedule appended hereto, out of the said reserved land, had issued a Purchase Notice dated 14th June 2012 under Section 49 of the said Act (hereinafter referred to as "the said Notice") to the said authority ;

And whereas, even after service of the said Notice as aforesaid, the said land has not been acquired within a stipulated period from the date of the service of the said Notice under sub-section 49 of the said Act ;

And whereas, Hon'ble High Court in Writ Petition No. 7264-2017 file by the owner of the said land, vide its order dated the 29th January 2018 held that the said reservation to the extend of the said land stands lapsed, U/s 127 of the said Act ;

And whereas, the said Reservation on the said Land, in the said Revised Development Plan has lapsed as per the Orders of the Hon'ble High Court in such matters.

Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 127 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra hereby Notifies that, the said reservation on the said land stands lapsed and the land so released shall be available to the landowner for the purpose of Development as otherwise permissible in the case of adjacent land under the Development Plan.

Whereas, the Nagpur Improvement Trust, being a Local Authority, has been permitted under section 2(15) of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act") to exercise the powers of a Planning Authority under the said Act for the entire area under its jurisdiction vide Government in Urban Development, Public Health and Housing Department's Notification No. TPS-2467-19866-M, dated 6th October, 1967 (hereinafter referred to as "the said Notification");

And whereas, the State Government in Urban Development Department vide Notification No. TPS-2401-855- C.R.76-UD-9, dated 27th February, 2002 (hereinafter referred to as "the said Revised Notification") in exercise of the powers conferred upon it by Section 2(15) of the said Act in supersession of the said Notification the Government has issued orders more particularly described in the said Revised Notification ;

And whereas, the State Government in Urban Development Department Notification No. TPS-2419-1419-C.R.154- 2019-UD-9, dated 27th August 2019 (hereinafter referred to as "the said Second Revised Notification") in exercise of the powers conferred upon it by Section 2(15) of the Said Act and in supersession of the said Notification the Government has issued the following revised orders :

(a) permits the Nagpur Municipal Corporation to exercise the powers of Planning Authority under the said Act in the entire area under its jurisdiction including the area covered by the Seven Schemes (more particularly described in the Notification) of the Nagpur Improvement Trust (NIT), and NIT will cease to exercise the powers of a Planning Authority under said Act.

(b) orders that, notwithstanding (a) above, in areas which come under the purview of Nagpur Municipal Corporation as Planning Authority, NIT will not be required to secure development permission from the Nagpur Municipal Corporation with regard to development undertaken by it in its capacity as development agency, and for this limited purpose, it shall function as Planning Authority for such developments. However, Nagpur Improve- ment Trust shall cease to function as planning authority on the lands belonging to NIT from the date of allotment of NIT plots to the allottees/buyers. Nagpur Municipal Corporation shall be the Planning Authority for all such plots allotted by the NIT.

And whereas, the State Government is of opinion that it is expedient and necessary to issue further revised orders to the said Second Revised Notification considering the present circumstances ;

Now, therefore, in exercise of the powers conferred upon it by Section 2(15) of the said Act, and in supersession of the said Second Revised Notification, the Government of Maharashtra hereby ;

(a) permits the Nagpur Municipal Corporation to exercise the powers of a Planning Authority under the said Act in the entire area under its jurisdiction and the area covered by the Smart City Mission under Mouje Pardi, Bharatwada, Punapur and Bhandewadi Town Planning Scheme No. 1 in Green Belt Control Scheme, except the areas covered by the following schemes of the Nagpur Improvement Trust (NIT), for which NIT will continue to exercise the powers of a Planning Authority under the said Act. :
