[महाराष्ट्र प्रादेशिक नगररचना अधिनियम, १९६६ चे कलम ३७ (१) अन्वये]

ज्याअर्थी, महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६ (यापुढे याचा उल्लेख " उक्त अधिनियम " असा केलेला आहे) चे कलम ४० च्या पोट-कलम १क अन्वये महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६ चे प्रकरण ६ च्या तरतुदी लागू आहेत असे कोणतेही क्षेत्र व महाराष्ट्र औद्योगिक विकास महामंडळास (यापुढे यांचा उल्लेख " उक्त महामंडळ " असा केलेला आहे) हस्तांतरण करण्यात आलेले शासकीय जमिनीचे क्षेत्र, या क्षेत्राकरिता महाराष्ट्र औद्योगिक विकास महामंडळ हे विशेष नियोजन प्राधिकरण असेल असे मानण्यात आलेले आहे ;
ज्याअर्थी, उक्त्त महामंडळाने सन १९६२ मध्ये १,३५००० चौ.मी. चे पृथक क्षेत्र (Isolated Area) महामंडळाच्या पिंपरी-चिंचवड औद्योगिक क्षेत्रानजीक बिजलीनगर येथे पाणीपुरवठा योनजेसाठी संपादित केले आहे, या क्षेत्रावर विविध बांधकामे करून पाणीपुरवठा योजना कार्यान्वीत करण्यात आली होती, तसेच सदर क्षेत्र पिंपरी-चिंचवड महानगरपालिकेच्या हद्दीमध्ये समाविष्ट होवून पिंपरी-चिंचवड महानगरपालिकेच्या मंजूर विकास योजनेमध्ये समाविष्ट झाले आहे आणि आता सदर जागेवर आरक्षण क्र. १९२ (शाळा) व १९३ (महापालिका इस्पितळ व दवाखाना) आणि सामायिक सुविधा (जलशुद्धीकरण केंद्र विभाग) ही आरक्षणे आहेत ;
ज्याअर्थी, महामंडळाने संपादित केलेले पृथक क्षेत्र हे इतर रहिवासी व व्यापारी वापराने वेढले आहे, महामंडळाची पाणीपुरवठा योजना अन्य ठिकाणाहून सुरू केली आहे व सदर पृथक क्षेत्र वापराविना पडून आहे आणि म्हणून सदर महामंडळाने सदर पृथक क्षेत्र इतर वापराकरिता जसे की आणि व्यापारी वापराकरिता देण्याचे ठरवले आहे ;
ज्याअर्थी सदर महापालिकेच्या विकास योजनेच्या भागामध्ये शाळेसाठी आरक्षण क्र. १९२ (क्षेत्र १ हे.) दवाखान्यासाठी व सामायिक सुविधा (जलशुद्धीकरण केंद्र) यासाठी आरक्षण क्र. १९३ (१ एकर) सदर पृथक क्षेत्रावर आहे. सदर जागेची मालकी महामंडळकडे आहे व सदर पृथक क्षेत्रासाठी उक्त्त महामंडळ हे विशेष नियोजन प्राधिकरण असून सदर क्षेत्रातील काही क्षेत्र सहकारी गृहनिर्माण संस्थेसाठी निवासी वापराकरिता व काही क्षेत्र व्यापारी वापराकरिता वाटप करण्याचे प्रस्तावित असल्याने पिंपरी-चिंचवड महानगरपालिकेच्या मंजूर विकास योजनेमध्ये फेरबदल करून सदर पृथक क्षेत्र जे उक्त्त महामंडळाने संपादित केले आहे, त्यावरील आरक्षणे रद्द करून उक्त्त महामंडळाच्या रहिवासी व व्यापारी वापराकरिता आरक्षित करण्याचे प्रस्तावित आहे ;
महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, एप्रिल २८, २०२१/वैशाख ८, शके १९४३ २ज्याअर्थी, उक्त्त महामंडळाने संचालक मंडळाच्या दिनांक ४ फेब्रुवारी २०२१ रोजी झालेल्या ३८८ व्या बैठकीतील ठराव क्र. ६१५० नुसार उक्त्त आरक्षण क्र. १९२ (क्षेत्र १ हे.) व आरक्षण क्र. १९३ (१ एकर) रद्द करून ते क्षेत्र महामंडळाच्या निवासी व व्यापारी वापराकरिता उक्त्त अधिनियमाच्या कलम ११५ व कलम ३७ अन्वये कार्यवाही करून आरक्षित करण्याचे ठरवले आहे.
आणि ज्याअर्थी, उक्त्त अधिनियमाच्या कलम ११५ व कलम ३७ (१) अन्वये सदर फेरबदलासंबंधी जनतेकडून हरकती व सूचना मागविण्यासाठी सूचना प्रसिद्ध करणे आवश्यक आहे.
त्याअर्थी, महाराष्ट्र औद्योगिक विकास महामंडळ उक्त्त अधिनियमाच्या कलम ११५ व कलम ३७ अंतर्गत शासन राजपत्रात शाळेसाठी आरक्षण क्र. १९२ (१ हे.) व महापालिका इस्पितळ, दवाखाना व सामायिक सुविधा (जलशुद्धीकरण केंद्र) यासाठी आरक्षण क्र. १९३ (१ एकर) क्षेत्र पिंपरी-चिंचवड महानगरपालिकेच्या मंजूर विकास योजनेतून वगळण्यासाठी ३० दिवसांच्या आत हरकती/सूचना मागवण्यासाठी सूचना प्रसिद्ध करीत आहे. सदर सूचना महामंडळाचा www.midcindia.org या संकेत स्थळावर उपलब्ध करून देण्यात आली आहे. पिंपरी-चिंचवड महानगरपालिकेच्या मंजूर विकास योजनेतील प्रस्तावित आरक्षण रद्द करण्याची सदर सूचना जनतेच्या तपासणीसाठी कार्यालयीन वेळेत खालील कार्यालयात उपलब्ध आहे.

या संदर्भात काही हरकत/सूचना असल्यास त्या लेखी स्वरूपात मुख्य नियोजक, महाराष्ट्र औद्योगिक विकास महामंडळ उद्योग सारथी, महाकाली गुंफा मार्ग, अंधेरी (पूर्व), मुंबई-९३ या पत्यावर सदर जाहीर सूचना महाराष्ट्र शासनाच्या राजपत्रात प्रसिद्ध झाल्यापासून ३० दिवसांच्या आत कळवाव्यात. राजपत्रात सूचना प्रसिद्ध झाल्यापासून ३० दिवसांच्या आत प्राप्त हरकती/सूचना विचारात घेऊन प्रारूप विकास आराखडा शासनाच्या मंजुरीसाठी सादर करण्यात येईल.

Notice
[Under section 37(1) of Maharashtra Regional and Town Planning Act, 1966]

Whereas, the Government of Maharashtra in exercise of powers by sub-section 1 of section 40 of Maharashtra Regional Town Planning Act, 1966 (hereinafter referred to as the "said Act") has appointed Maharashtra Industrial Development Corporation (MIDC) as a Special Planning Authority (hereinafter referred to as "the said Corporation") over any area where Chapter VI of the Maharashtra Industrial Development Act,1961 applies or any other area comprising Government land transferred to the Maharashtra Industrial Development Corporation ;
Whereas, the said Corporation has acquired an isolated area admeasuring 1,35,000 sqm. in Bijlinagar near Pimpri-Chinchwad Industrial Area for the purpose of water supply scheme to Pimpri-Chinchwad Industrial Area in year 1962. Accordingly various structures were constructed and water supply scheme was effected on said land parcel. Further, these lands were included in Pimpri-Chinchwad Municipal Corporation limit as per sanctioned Development Plan of Pimpri- Chinchwad Municipal Corporation and there are reservation No. 192 (School) and 190 (Municipal Hospital and Dispensary) and public utility (Water treatment works) zone on the said land parcel ;
Whereas, the isolated land pocket acquired by the said Corporation is now surrounded by various other activities viz, residential and commercial use; the water supply scheme of the said Corporations is also now relocated and land is idle and hence, the Said Corporation has proposed to utilize these lands for other purposes i.e. residential land requirement to said Corporation in order to allot a plot to co-operative housing society of employees of the said Corporation as well as commercial use;
Whereas the said land is reserved as per the sanctioned Development Plan of Pimpri- Chinchwad Municipal Corporation, there are reservations No. 192 for school (1Ha) and reservation No. 193 (1Acre) for dispensary as well as public utility (Water treatment works) on the said land.
However as per record of the said Corporation, possession of said land is with the said Corporation and therefore Special Planning Authority in the said case is the said Corporation. As the plot is proposed to be allotted to co-operative housing society, i.e. for residential use as well as some land parcel is to be reserved for commercial use, it is necessary to carry out modification to sanctioned Development Plan of Pimpri-Chinchwad Municipal Corporation under section 37 of the said Act. It is proposed to cancel the said reservations in the Development Plan of Pimpri- Chinchwad Municipal Corporation on the land which has been acquired by the said Corporation and proposed to be reserved for residential and commercial use of the said Corporation.
Whereas, it is resolved by the said Corporation in its Board Meeting No. 388 dated 4th February 2021 vide resolution No. 6150 to carry out modification proposal to delete reservation No. 192 for school (1Ha) and reservation No. 193 (1Acre) on the land acquired by the said Corporation for water supply scheme and reserve it for residential and commercial use of the said Corporation after carrying out procedure laid down under section 115 and section 37 of the said Act. Therefore, Maharashtra Industrial Development Corporation hereby publishes Notice u/s 115 read with 37 of the said Act for deletion of reservation No. 192 for school (1Ha) and reservation No. 193 (1 acre) for Municipal Hospital dispensary as well as Public Utility (Water treatment महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, एप्रिल २८, २०२१/वैशाख ८, शके १९४३ ४ works zone) total admeasuring 135000 sqm. which is acquired by the said Corporation from sanctioned Development Plan of Pimpri-Chinchwad Municipal Corporation for inviting suggestion/ objection from citizens with reasons thereof within 30 days. The notice is made available on the Website of the said Corporation i.e. www.midcindia.org. The plan showing proposed deletion in sanctioned Development plan of Pimpri-Chinchwad Municipal Corporation is kept open for inspection of the citizens during office hours at the following office :—

Suggestions/objections if any in Writing shall be submitted to the office of the Chief Planner of Maharashtra Industrial Development Corporation, Udyog Sarathi, Mahakali Caves Road, Andheri (E.), Mumbai 400 093. Within the period of 30 days from the date of publication of the Notice in Maharashtra Government Gazette. Suggestions/objections received within stipulated Period of 30 days from the date publication of the Notice in Maharashtra Government Gazette shall only be considered after considering the suggestions/objections received; the draft master plan shall be submitted to the Government for approval.
