अधिसूचना
क्रमांक एमएफएल. ०२२१/प्र.क्र.२५/राऊशु-२.----ज्याअर्थी, मुंबई मोहाफुले नियम, १९५० यामध्ये आणखी सुधारणा करण्याकरिता पुढील नियम तात्काळ अंमलात आणण्यात यावेत आणि म्हणून महाराष्ट्र दारुबंदी अधिनियम (१९४९ चा पंचवीस) च्या कलम १४३ च्या पोट-कलम (३) च्या परंतुकाद्वारे तरतूद केल्याप्रमाणे पूर्व प्रसिद्धी शिवाय हे नियम तयार करण्यात यावेत, असे महाराष्ट्र शासनास वाटते.
त्याअर्थी, आता, महाराष्ट्र दारुबंदी अधिनियम, कलम १४३ च्या पोट-कलम (२) मधील खंड (ब) आणि (क) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा आणि याबाबतीत त्यास समर्थ करणाया इतर सर्व अधिकारांचा वापर करून महाराष्ट्र शासन, मुंबई मोहाफुले नियम, १९५० यात सुधारणा करण्यासाठी पुढील नियम करीत आहे, ते असे :----
१. या नियमांना, मुंबई मोहाफुले (सुधारणा) नियम, २०२१ असे संबोधण्यात यावे. २. मुंबई मोहाफुले नियम, १९५० (यापुढे ज्यांचा उल्लेख " प्रधान नियम " असा करण्यात आला आहे) नियमातील नियम ७-अ नंतर खालील नियम समाविष्ट करण्यात येत आहे.
" ७--ब. नियम ५ अंतर्गत मंजूर केलेली अनुज्ञप्ती ही जिल्हाधिकारी किंवा प्राधिकृत अधिकायाच्या मान्यतेने जिल्ह्यतील इतर जागी स्थलांतरीत करता येईल.
३. प्रधान नियमातील नियम ८ ऐवजी, खालीलप्रमाणे नियम अंतभर्ूत करण्यात येत आहे.
" ८. मोहाफुले गोळा करण्याकरिता कोणत्याही परवान्याची आवश्यकता नाही. "
४. प्रधान नियमातील नियम ९ वगळण्यात येत आहे.

७. प्रधान नियमातील नियम १२ वगळण्यात येत आहे.
८. प्रधान नियमातील नियम १३ वगळण्यात येत आहे.
९. प्रधान नियमातील नियम १४ ऐवजी खालीलप्रमाणे नियम अंतभर्ूत करण्यात येत आहे.
" १४. मोहाफुलाची वाहतूक करण्याकरिता कोणत्याही परवान्याची आवश्यकता नाही. "
१०. प्रधान नियमातील नियम १५ वगळण्यात येत आहेत.
११. प्रधान नियमांच्या शेवटी असलेले नमुने " एमएफ--३ ", " एमएफ--४ " व " एमएफ--५ " वगळण्यात येत आहेत.
१२. प्रधान नियमांच्या शेवटी असलेल्या अनूसूची ऐवजी खालील अनुसूची समाविष्ट करण्यात येत आहे.

No. MFL.0221/CR No 25/EXC-2 .----Whereas, the Government of Maharashtra considered that the following rule further to amend the Bombay Mhowra Flowers Rules, 1950, shall be brought into force at once, and therefore, the rules shall be made without previous publication as provided by the proviso to sub-section (3) of section 143 of the Maharashtra Prohibition Act, 1949 (XXV of 1949);
Now, therefore, in exercise of the powers conferred by clause (b) and (k) of sub-section (2) of section 143 of the Maharashtra Prohibition Act, 1949 (XXV of 1949) and of all other powers enabling it in this behalf, the Government of Maharashtra hereby, makes the following rules, as follows, namely :----
1. These rules may be called the Bombay Mhowra Flowers (Amendment) Rules, 2021.
2. After rule 7-A of Bombay Mhowra Flowers Rules, 1950 (hereinafter referred to as "the Principal Rules"), the following rule shall be inserted, namely:----
" 7-B. The licence granted under rule 5 may be allowed to shift within the same district with the approval of the Collector or the authorized officer."
3. For rule 8 of the Principal Rules, the following rule shall be substituted, namely:----
"8. No permit for the collection of mhowra flowers shall be required."
4. Rule 9 of the Principal Rules shall be deleted.
5. Rule 10 of the Principal Rules shall be deleted.
6. For rule 11 of the Principal Rules, the following rule shall be substituted, namely:----
"11. No permit for the purchase of mhowra flowers shall be required."
7. Rule12 of the Principal Rules shall be deleted.
8. Rule 13 of the Principal Rules shall be deleted.
9. For rule 14 of the Principal Rules, the following rule shall be substituted, namely:----
"14. No permit for the transport of mhowra flowers shall be required."
10. Rule 15 of the Principal Rules shall be deleted.
