Notification

No. SPP-3120/732/CR 85/D-XIV.–– In exercise of the powers conferred by sub-section (8) of the Section 24 of the Code of Criminal Procedure, 1973 (Act No. II of 1974), the Government of Maharashtra, hereby appoints Adv. Ujjwala Pawar, as "Special Public Prosecutor" for conducting the MCOCO Special Case No. 23/2016 in the Hon'ble Sessions Court, Pune which is arising out of C. R. No. 267/2015 registered at Paud Police Station, District Pune.

Her appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment, Conditions of Service and Remuneration) Rules, 1984.

Lump sum fees of Rs. 30,000 (Rupees Thirty Thousand only) as quoted by Adv. Ujjwala Pawar has been already deposited by the Applicant Shri Sachin Sampat Miraghe to the Government, vide R.B.I. Challan No. 020520, dated 26th March 2021. The amount will be paid to Adv. Ujjwala Pawar after completion of the case.

The Government reserves the right to revoke/modify/annul the Order without assigning any reasons.

अधिसूचना कलम ११

क्रमांक भूसं/एसआर-१/२०२१.-- ज्याअर्थी, भूमी संपादन, पुनर्वसन व पुनर्वसाहत करताना उचित भरपाई मिळण्याचा आणि पारदर्शकतेचा हक्क अधिनियम, २०१३ (२०१३ चा ३०) याच्या कलम ३ च्या खंड (इ) च्या परंतुकाद्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून काढण्यात आलेली शासकीय अधिसूचना, महसूल व वन विभाग क्रमांक संकीर्ण-११/२०१४/प्र.क्र. ७७/अ/२, दिनांक १९ जानेवारी २०१५ (यात यापुढे जिचा निदश उक्त अधिसूचना असा करण्यात आला आहे) याद्वारे असे अधिसूचित केले आहे की, उक्त अधिनियमाच्या कलम ३ च्या (झेड अे) मध्ये व्याख्या केलेल्या एखाा सार्वजनिक प्रयोजनासाठी, एखाा जिल्ह्यातील ५०० हेक्टरपेक्षा अधिक नसेल इतक्या क्षेत्राकरिता जमीन संपादन करण्याच्या संबंधात अशा जिल्ह्याचा जिल्हाधिकारी हा उक्त अधिनियमाच्या प्रयोजनासाठी समुचित शासन असल्याचे मानण्यात येईल ;

आणि ज्याअर्थी, उक्त अधिसूचनेनुसार समुचित शासन असलेल्या जिल्हाधिकारी, सातारा यांना यासोबत जोडलेल्या अनुुसूची एकमध्ये अधिक तपशीलवार वर्णन केलेली जमीन (यात यापुढे ज्यांचा निदश, उक्त जमीन असा करण्यात आला आहे) सार्वजनिक प्रयोजनासाठी (यात यापुढे ज्याचा निदश उक्त सार्वजनिक प्रयोजन असा करण्यात आला आहे) आवश्यक आहे अथवा त्यांची आवश्यकता भासण्याची शक्यता आहे असे वाटते ज्याच्या स्वरूपाचे विवरण यासोबत जोडलेल्या अनुसूची दोनमध्ये दिलेले आहे आणि म्हणून उक्त अधिनियमाच्या कलम ११ च्या पोट-कलम (१) च्या तरतुदीन्वये याद्वारे असे अधिसूचित करण्यात येते की, उक्त जमिनींची उक्त सार्वजनिक प्रयोजनासाठी आवश्यकता भासण्याची शक्यता आहे ;

आणि ज्याअर्थी, प्रस्तावित भूमी संपादनाच्या अनुषंगाने बाधित व्यक्तींचे विस्थापन करण्यास भाग पाडणारी कारणे, यासोबत जोडलेल्या अनुसूची तीनमध्ये दिलेली आहेत (विस्थापन होणार असेल तर या अनुसूचीमध्ये कारणे नमूद करावीत);

आणि ज्याअर्थी, सामाजिक परिणाम निर्धारण सारांश यासोबत जोडलेल्या अनुसूची चारमध्ये दिलेला आहे ;

आणि ज्याअर्थी, कलम ४३ च्या पोट-कलम (१) अन्वये पुनर्वसन व पुनर्वसाहत या प्रयोजनासाठी नियुक्त केलेल्या प्रशासकाचा तपशील, यासोबत जोडलेल्या अनुसूची पाचमध्ये दिलेला आहे (नियुक्ती करणे आवश्यक असेल तर, या अनुसूचीमध्ये तपशील नमूद करावा).

त्याअर्थी, आता, असे घोषित करण्यात येत आहे की, उक्त अधिनियमाच्या कलम ११ च्या पोट-कलम (४) नुसार कोणतीही व्यक्ती ही अधिसूचना प्रसिद्ध झाल्याच्या दिनांकापासून ते उक्त अधिनियमाच्या प्रकरण ४ खालील कार्यवाही पूर्र्ण होईल त्या कालावधीपयत उक्त जमिनीचा अथवा तिच्या भागाचा कोणताही व्यवहार करणार नाही किंवा उक्त जमिनीवर कोणताही भार निर्माण करणार नाही.

परंतु उक्त जमिनीच्या अथवा तिच्या भागाच्या मालकाने अर्ज केल्यावर, जिल्हाधिकायास विशेष परिस्थितीची कारणे लेखी नमूद करून अशा मालकास उपरोक्त तरतुदीच्या प्रवर्तनातून सूट देता येईल.

परंतु आणखी असे की, जर कोणत्याही व्यक्तीने या तरतुदीचे बुद्धीपुरस्सर उल्लंघन केल्यामुळे तिला झालेल्या कोणत्याही हानीची किंवा क्षतीची जिल्हाधिकायांकडून भरपाई दिली जाणार नाही.

तसेच, उक्त अधिनियमाच्या कलम ११ च्या पोट-कलम (५) नुसार जिल्हाधिकारी भूमी संपादन, पुनर्वसन व पुनर्वसाहत करताना उचित भरपाई मिळण्याचा व पारदर्शकतेचा हक्क (महाराष्ट्र) नियम, २०१४ (यात यापुढे ज्याचा निदश उक्त नियम असा करण्यात आला आहे) याच्या नियम १० च्या उपनियम (३) द्वारे विहित केल्याप्रमाणेे भूमी अभिलेखाच्या अयावतीकरणाचे काम हाती घेणार असल्याचे व पूर्ण करणार असल्याचे देखील घोषित करण्यात येत आहे ;

आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम ३ च्या खंड () अन्वये, समूचित शासन असलेला जिल्हाधिकारी, उक्त अधिनियमाखालील जिल्हाधिकायांची काय पार पाडण्यासाठी उपविभागीय अधिकारी तथा भूसंपादन अधिकारी, वाई उपविभाग, वाई यांना पदनिदशित करीत आहे.

प्रकल्पाचे नाव : धोम-बलकवडी प्रकल्पासाठी कवठे केंजळ उपसा सिंचन योजना.

प्रकल्प कार्याचे वर्णन : धोम-बलकवडी प्रकल्पांतर्गत मौजे खानापूर, तालुका वाई येथील कवठे केंजळ उपसा सिंचन योजनेच्या मुख्य वितरण हौदासाठी सक्तीचे भूसंपादन करणेबाबत प्रस्ताव.

समाजाला मिळणारे लाभ : (अ) कवठे केंजळ उपसा सिंचन योजनेअंतर्गत मौजे शेंदूरजणे, तालुका वाई येथे धोम डावा कालवा कि. मी. क्रमांक १४ (सा. क्र. १२/१२५) येथे पंपगृह प्रस्तावित आहे. या योजनेअंतर्गत दोन टप्पात मिळून एकूण पाणी १०१ मी. उंचीपयत उपसा करून तेथून बंद पाईपद्वारे गुरुत्व पद्धतीने वाई तालुक्यातील २७ गावांमधील ४७८० हेक्टर क्षेत्रास सिंचन लाभ देणे नियोजित आहे.

(ब) प्रकल्पाच्या लाभक्षेत्रातील पीक क्षेत्रामध्ये वाढ होणार असलेने स्थानिक लोकांना रोजगार उपलब्ध होणार आहे.

(क) प्रकल्पाच्या लाभक्षेत्रामध्ये ऊसासारख्या नगदी पिकामुळे साखर कारखानदारीत लाक्षणिक वाढ संभवते. तसेच पाण्याच्या नियमित उपलब्धतेमुळे कृषी आधारित विविध उत्पादन प्रक्रिया व कारखानदारीस चालना मिळणार आहे.

बाधीत व्यक्तींचे विस्थापन करण्यास भाग पाडणारी कारणे

संपादन करणेत येणाया क्षेत्रामध्ये जमीन येत असल्यामुळे गावठाण विस्थापित होत नाही. तसेच बाधित गटांचे संपूर्ण क्षेत्र संपादन होत नाही.

त्यामुळे बाधित व्यक्तींचे विस्थापन करण्याचा प्रश्न उदभवत नाही.

(सामाजिक प्रभाव निर्धारण अभ्यास करणाया अभिकरणाने दिलेला) सामाजिक प्रभाव निर्धारणांचा सारांश

सदरचा प्रकल्प ग्रामीण पायाभूत सुविधांतर्गत येत असल्याने त्यास भूसंपादन अधिनियम, २०१३ आणि महाराष्ट्र शासनाच्या दिनांक १३ मार्च २०१५ रोजी प्रसिद्ध झालेल्या राजपत्रानुसार, सामाजिक प्रभाव निर्धारणापासून सूट देण्यात आलेली आहे.

नियुक्त केलेल्या प्रशासकाचा तपशील

(अ) प्रशासक म्हणून नियुक्त करण्यात आलेल्या अधिकायाचे पदनाम : लागू नाही.

समाजाला मिळणारे लाभ : (अ) या प्रकल्पामुळे प्रकल्पाच्या लाभक्षेत्रामध्ये बारमाही पाण्याची सोय होणार असल्याने नगदी पिके घेणे शक्य होऊन लोकांचा आर्थिक व सामाजिक स्तर उंचावून विकास दर वाढणार आहे. तसेच या प्रकल्पामुळे लाभ क्षेत्रातील पाणी टंचाई दूर होणार आहे.

आणि, ज्याअर्थी, नमूद केलेल्या परीक्षा केंांच्या परिसरात कायदा व सुव्यवस्थेचा प्रश्न निर्माण होऊ नये, यासाठी वर नमूद केलेल्या परीक्षा केंांचे परिसरात व त्या सभोवतालच्या १०० मीटर परिसरात क्रिमिनल प्रोसिजर कोड, १९७३ चे कलम १४४ मधील तरतुदी लागू करणे आवश्यक झाले आहे. अशी माझी खात्री झाली आहे.

त्याअर्थी, मी, सुनील थोरवे, अपर जिल्हादंडाधिकारी, सातारा क्रिमिनल प्रोसिजर कोड, १९७३ चे कलम १४४ मधील तरतुदीनुसार मला असलेल्या अधिकारान्वये दिनांक १४ मार्च २०२१ रोजी सकाळी ०८.३० वाजलेपासून ते ०७.०० वाजेपयत सातारा जिल्ह्यातील उपरोक्त नमूद केलेल्या केंांचे परिसरात व त्या सभोवतालचे १०० मीटर परिसरात परीक्षार्थी परीक्षेसाठी नेमलेले अधिकारी/कर्मचारी, सुरक्षा अधिकारी/ कर्मचारी यांना वगळून इतर व्यक्तींना प्रवेश करणेस या आदेशान्वये मनाई करीत आहे. तसेच दोन किंवा दोन पेक्षा अधिक व्यक्तींना एकत्र येण्यास मनाई करीत आहे. तसेच शाळा/महाविालयाचे परिसरातील सार्वजनिक टेलिोन/एस.टी.डी. बुथ/आय.एस.डी. बुथ/ॅक्स केंावर मोबाईल, वायरलेस सेट, ट्रान्झीस्टर, रेडिओ, कॅल्क्युलेटर, लॅपटॉप परीक्षा केंांच्या १०० मीटर पयतचे परिसरात वापरणेस व जवळ बाळगणेस, तसेच परीक्षा केंात नेण्यास मनाई करीत आहे.

क्रमांक डीसी/एमएजी-२/एसआर-८९/२०२०.---- ज्याअर्थी, सातारा जिल्ह्यातील महाबळेश्वर तालुक्यातील किल्ले प्रतापगडाच्या पायथ्याशी असलेल्या अझलखान कबरीच्या कथित उदात्तीकरणाच्या मुावरून गतकाळात विविध हिंदुत्ववादी संघटनांकडून आंदोलने करण्यात आलेली आहेत. यावरून यापूर्वी सातारा शहर, महाबळेश्वर, भुइज पोलीस ठाणेस आंदोलनकत्याविरुद्ध गुन्हे दाखल करण्यात आलेले आहेत. त्यामुळे अझलखान कबर परिसर कायदा व सुव्यवस्थेच्या ष्टीने अत्यंत संवेदनशील आहे. किल्ले प्रतापगड येथे सन २००४ पासून शासनात शिवप्रताप दिन साजरा केला जात आहे. शिवप्रताप दिन साजरा करण्यावरून हिंदुत्ववादी संघटनांच्या भावना तीव्र असल्याचे दिसून सदर शिवप्रताप दिन उत्सव व अझलखान कबरीचे कथित उदात्तीकरण अशा कोणत्याही मुावरून सदर संघटना कायदा व सुव्यवस्थेचा प्रश्न निर्माण करण्याची शक्यता नाकारता येत नसलेने तसेच प्रतापगड कबरी लगतचे अनधिकृत बांधकाम काढण्याच्या मा. उच्च न्यायालयाच्या निर्णयाची शासनाकडून मुदतीत अंमलबजावणी होत नसलेची भावना झालेने यावरून सर्व हिंदुत्ववादी संघटनांमध्ये असंतोष निर्माण झालेला आहे. त्यामुळे हिंदुत्ववादी संघटनांकडून कायदा व सुव्यवस्थेचा प्रश्न निर्माण होण्याची शक्यता असलेने या ठिकाणी पोलीस अधीक्षक, सातारा यांचेकडील पत्र क्रमांक जिविशा/अझलखान कबर/१७४५९/२०१४, दिनांक १ डिसेंबर २०१४ अन्वये सविस्तर अहवाल देऊन किल्ले प्रतापगड येथील अझलखान कबरी सभोवतालचे ३०० मीटर अंतरापयत सी.आर.पी.सी. १९७३ चे कलम १४४ प्रमाणे प्रतिबंधात्मक आदेश जारी करणेबाबत विनंती केली होती. त्यानुसार इकडील कार्यालयाकडील आदेश क्रमांक डीसी/एमएजी/२/कावि-१८४१/२०१४/एसआर-४०/१४, दिनांक १ डिसेंबर २०१४ अन्वये, दिनांक २ डिसेंबर २०१४ चे ००.०० वाजलेपासून ते दिनांक ३० जानेवारी २०१५ चे २४.०० वाजेपयत प्रतापगड, तालुका महाबळेश्वर येथील अझलखान कबरी सभोवताली ३०० मीटर परिसरात सी.आर.पी.सी. १९७३ चे कलम १४४ अन्वये प्रतिबंधात्मक आदेश जारी केला होता.

त्यानंतर वेळोवेळी सदर ठिकाणी पोलीस अधीक्षक यांचे अहवालास अनुसरून कलम १४४ अन्वये आदेश पारित करणेत आले आहेत. तसेच आता वाचा क्रमांक ७ अन्वये पोलीस अधीक्षक, सातारा यांची प्रतिबंधात्मक आदेशाची मुदत दिनांक ३१ डिसेंबर २०२० रोजी संपत असलेने पुढील कालावधीसाठी आदेश काढणेबाबतची विनंती केली आहे.

क्रमांक पोसआ/पुणे शहर/२९६६/२०२१.-- ज्याअर्थी, पुणे शहरात जनतेच्या मागण्यांसाठी विविध राजकीय पक्ष, सामाजिक संघटना, मोच, धरणे, निदर्शने, बंद पुकारणे व उपोषणासारखे आंदोलनाचे आयोजन करतात. शहर परिसरात ठिक-ठिकाणी महानगरपालिकांच्या वतीने अनधिकृत बांधकाम हटविण्याच्या कार्यवाहीच्या वेळेस कायदा व सुव्यवस्थेचा प्रश्न निर्माण होण्याचा संभव आहे. दिनांक १४ मे २०२१ रोजी रमजान ईद, अक्षय तृतीया व धर्मवीर संभाजीराजे जयंती (तारखेप्रमाणे) आहे. पुणे शहर पोलीस आयुक्तालयाचे कार्यक्षेत्रामध्ये कायदा व सुव्यवस्था राखण्याचे ष्टिकोनातून महाराष्ट्र पोलीस अधिनियम, सन १९५१ चे कलम ३७ (१) (३) चे मनाई आदेश जारी करण्यास विनंती आहे ;

त्याअर्थी, माझी खात्री झाली आहे की, पुणे शहर पोलीस आयुक्तालय कार्यक्षेत्रात शांतता व सुव्यवस्था राखणेकामी महाराष्ट्र पोलीस अधिनियम, सन १९५१ च्या कलम ३७ (१), (३) अन्वये प्रतिबंधात्मक आदेश करणेस पुरेसे व सबळ कारण आहे.

त्याअर्थी, मी, डॉ. रवीं शिसवे, पोलीस सह-आयुक्त, पुणे शहर वर नमूद अ.नं. २ च्या आदेशान्वये मला प्रदान केलेल्या अधिकारांचा वापर करून व महाराष्ट्र पोलीस अधिनियम, सन १९५१ च्या कलम ३७ (१), (३) अन्वये प्राप्त झालेल्या अधिकारांचा वापर करून पुणे शहर पोलीस आयुक्तालय कार्यक्षेत्रात दिनांक ४ मे २०२१ रोजीचे ००.०१ वा. पासून ते दिनांक १७ मे २०२१ रोजीचे २४.०० वा. पयत १४ दिवसांसाठी खालील नमूद केलेली कृत्ये करण्यास या आदेशान्वये मनाई करीत आहे.

(अ) कोणताही दाहक पदार्थ अथवा स्ोटक पदार्थ, ज्वलनशील वपदार्थ बरोबर नेणे.

(ब) दगड अथवा शस्त्रे किंवा अस्त्रे, सोडावयाची अस्त्रे किंवा ेकावयाची हत्यारे अगर साधने बरोबर नेणे, जमा करणे व तयार करणे.

(क) शस्त्रे, सोटे, भाले, तलवारी, दंड, काठा, बंदुका व शारीरिक इजा करण्यासाठी वापरात येईल अशी कोणतीही वस्तू बरोबर नेणे.

(ड) कोणत्याही इसमाचे चित्राचे, प्रतिकात्मक प्रेताचे, पुढायांच्या चित्राचे, प्रतिमेचे प्रदर्शन व दहन करणे.

(इ) मोठाने अर्वाच्य घोषणा देणे, वा वाजविणे.

() ज्यामुळे सभ्यता अगर नीतिमत्ता यास धोका पोहचेल किंवा राज्याची सुरक्षितता धोक्यात येईल किंवा राज्य उलथवून देण्यास प्रवृत्त करेल अशी आवेशपूर्ण भाषणे करणे किंवा आविर्भाव करणे, कोणतेही जिन्नस तयार करून त्याचा जनतेत प्रसार करणे या कृत्यांवर बंदी घालीत आहे.

(ग) ज्यायोगे वरील परिसरात कायदा व सुव्यवस्था धोक्यात येईल अशा पध्दतीने महाराष्ट्र पोलीस अधिनियम सन १९५१ च्या कलम ३७ (१), (३) विरुद्ध वर्तन करणे.

कोरोना विषाणूचा संसर्ग साखळी तोडण्यासाठीचा भाग म्हणून महापालिका आयुक्त, पुणे यांचे आदेशानुसार (मआ/साप्रवि/८३९, दिनांक ३० एप्रिल २०२१) ब्रेक द चेन कालावधी दिनांक १ मे २०२१ सकाळी ०७.०० वाजलेपासून ते दिनांक १५ मे २०२१ रोजीचे सकाळी ०७.०० वाजेपयत पुणे महानगरपालिका कार्यक्षेत्रात लागू राहील असे आदेशित केले आहे. तसेच सदर कालावधीत कोव्हिड-१९ या आजाराच्या प्रसारास प्रतिबंध करण्यासाठी उपाययोजना व मार्गदर्शक सूचना निर्गमित केलेल्या आहेत. त्यातील सर्व नियम, अटी, शर्ती व तरतुदी या आदेशास लागू राहतील. तसेच वरील आदेशाचे अनुषंगाने नव्याने शासनाकडून व शासकीय यंत्रणांकडून लागू होणारे आदेश व त्यातील तरतुदीही लागू राहतील.

उपरोक्त आदेशाचे पालन करणे पुणे शहरातील नागरिकांना बंधनकारक राहील.

महाराष्ट्र पोलीस अधिनियम, सन १९५१ च्या कलम ३७ चे पोट-कलम (३) पाच किंवा पाचपेक्षा जास्त लोकांचा जमाव करण्यास पोलीस आयुक्त, पुणे शहर यांचे पूर्वपरवानगीशिवाय सभा घेणेस किंवा मिरवणूक काढणेस बंदी घालीत आहे.

वरील संपूर्ण आदेश हा शासनाच्या सेवेतील व्यक्तींना व ज्यांना आपल्या वरिष्ठांच्या आदेशानुसार कर्तव्यपूर्तीसाठी हत्यार बाळगणे आवश्यक आहे त्यांना लागू होणार नाही.

महाराष्ट्र शासन, राजपत्र असाधारण भाग-१ मध्य उप-विभाग यांचेकडील अधिसूचना क्रमांक ३ मधील पान क्रमांक ४ मधील ौजदारी दंड प्रक्रिया संहिता, १९७३ चा क्रमांक एमएससी-१२७४/व्ही-ए मधील आदेशाने ौजदारी दंड प्रक्रिया संहिता १९७३ (-१९७४) चे कलम २१ अन्वये विशेष पोलीस महानिरीक्षक यांना विशेष कार्यकारी दंडाधिकारी म्हणून नियुक्त करून कलम १४४ चे विशेष अधिकार प्रदान केलेले आहेत.

त्याअर्थी, मी, डॉ. रवीं शिसवे, पोलीस सह-आयुक्त, पुणे शहर तथा विशेष प्राधिकृत कार्यकारी दंडाधिकारी म्हणून शासनाच्या दिनांक १ एप्रिल १९७४ चे अधिसूचनेद्वारे प्राधिकृत अधिकारी म्हणून पुणे शहर पोलीस आयुक्तालयाचे कार्यक्षेत्रात ौजदारी दंड प्रक्रिया संहिता कलम १४४ (१) (३) अन्वये दिनांक १ मे २०२१ रोजीचे ०७.०० वाजलेपासून ते दिनांक १५ मे २०२१ रोजीचे ०७.०० वाजेपयत अत्यावश्यक कारण/ अत्यावश्यक सेवा वगळता नागरिकांना घराबाहेर पडण्यास संपूर्णत: प्रतिबंध (संचारबंदी) करण्यात येत असल्याबाबतचा मनाई आदेश जारी करीत आहे.

सदर मनाई आदेशात आयुक्त महानगरपालिका, पुणे यांनी निर्गमित केलेल्या उपरोक्त आदेशातील सर्व अटी व शर्ती, अत्यावश्यक/ जीवनावश्यक सेवा तसेच वस्तू याबाबतच्या सवलती व इतर निबध समाविष्ट असतील.

सदर आदेशाचे उल्लंघन करणारी व्यक्ती भारतीय दंड विधान संहिता कलम १८८, साथरोग अधिनियम १८९७ मधील तरतुदी व प्रचलित कायांन्वये शिक्षेस पात्र राहील.

उपरोक्त ठिकाणी सर्व संबंधितांना आदेशापूर्वी स्वतंत्र नोटिस बजावणी शक्य नसल्याने ौजदारी दंड प्रक्रिया संहिता, १९७३ चे कलम १४४ (२) अन्वये प्राप्त अधिकारांनुसार सदरचा आदेश एकर्ती काढण्यात आलेला आहे. याबाबतची माहिती प्रसारमाध्यमे, पोलीस स्टेशन, सहायक पोलीस आयुक्त तसेच परिमंडळीय पोलीस उप आयुक्त कार्यालय यांचे नोटिस बोर्डवर नागरिकांचे सुविधेसाठी उपलब्ध करून देण्यात येत आहे.

सदरचा आदेश हा माझ्या सही शिक्क्यानिशी आज दिनांक ३० एप्रिल २०२१ रोजी दिलेला आहे.

क्रमांक गृह-१/कार्या-६/एमएजी/बंदी आदेश/एसआर-१०/२०२१.---- ज्याअर्थी, पोलीस अधीक्षक, सांगली यांनी सांगली जिल्हा स्थलसीमा हद्दीत कायदा व सुव्यवस्था परिस्थिती अबाधित राहावी, याकरिता प्रतिबंधात्मक उपाययोजनेचा एक भाग म्हणून सांगली जिल्हा स्थलसिमा हद्दीत महाराष्ट्र पोलीस कायदा, १९५१ चे कलम ३७ (१), (३) अन्वये संपूर्ण सांगली जिल्हा स्थलसीमा हद्दीत बंदी आदेश लागू करणेबाबत वाचावे क्रमांक २ अन्वये विनंती करून त्यासाठी खालील कारणे माझे निदर्शनास आणून दिलेली आहेत आणि माझी तशी खात्री झालेली आहे.

आगामी काळात उदभवू शकणारी कायदा व सुव्यवस्थेची स्थिती.--

कोविड-१९ : सध्या राज्यामध्ये तसेच सांगली जिल्ह्यामध्ये कोरोना रोगाचा प्रादुर्भाव वाढत असून कोरोना रुग्णांच्या संख्येत वाढ होत आहे. सदर कोरोना विषाणूच्या प्रादुर्भावास प्रतिबंध करणेकरिता राज्य शासनाने नुकत्याच नवीन मार्गदर्शक सूचना जारी केल्या आहेत. त्यामध्ये सार्वजनिक कार्यक्रम, धार्मिक व राजकीय कार्यक्रम, मिरवणुका, गर्दी होणारी आंदोलने यासह इतर कार्यक्रमांना प्रतिबंध व काही कार्यक्रमांना अटी व शर्ती घालून परवानगी देण्याबाबत सूचित केले आहे. त्यामुळे सार्वजनिक कार्यक्रम व आंदोलनांना परवानगी देताना अथवा नाकारताना पोलीस प्रशासन व नागरिकांमध्ये वाद विवाद होण्याची शक्यता नाकारता येत नाही.

मराठा आरक्षण : मराठा समाजास शिक्षण व नोकरीमधील आरक्षणाबाबत मा. सर्वाेच्च न्यायालयाने स्थगिती दिली आहे व सदर आरक्षणासंदर्भात मा. सर्वाेच्च न्यायालय, नवी दिल्ली येथे दिनांक ८ मार्च २०२१ रोजी सुनावणी होणार आहे. त्यामध्ये मराठा आरक्षण संदर्भातील याचिकाकत व न्यायाधीश यांचेत समोरासमोर होणार आहे. सुनावणी दरम्यान मराठा आरक्षण मुावर सकारात्मक चर्चा न झाल्यास त्यातून वादविवाद निर्माण होऊन पूर्वीपेक्षा तीव्र स्वरूपाची आंदोलने होण्याची शक्यता नाकारता येत नाही.

एआरपीप्रमाणे अापपयत काही कारखान्यांनी शेतकयांना ऊस दर दिलेला नाही, त्या कारणावरून तसेच शेतकयांच्या इतर मागण्यांकरिता स्वाभिमानी शेतकरी संघटनेच्या वतीने विविध स्वरूपाची आंदोलने होत आहेत. भविष्यातही ऊसाची रक्कम एकरकमी मिळावी याकरिता विविध शेतकरी संघटनांकडून उग्र स्वरूपाची आंदोलने केली जाण्याची शक्यता आहे.

संसदेत पारित केलेल्या कृषी विधेयकांना देशातील/राज्यातील शेतकरी/शेतकरी संघटना/राजकीय पक्षांकडून विधेयके रद्द व्हावीत तसेच कें सरकारने सातत्याने पेट्रोल, डिझेल, गॅसचे दरात वाढ केल्याने सर्वसामान्य जनतेमध्ये नाराजी असून सदर दरवाढीविरोधात विविध राजकीय पक्ष, संघटना यांचेकडून कें सरकारच्या विरोधात विविध प्रकारची आंदोलने करण्यात येत आहेत.

लॉकडाऊन काळातील वाढीव वीजबिले मा करावीत याकरिता आंदोलने करण्यात येत आहेत.

अखिल भारतीय किसान सभा यांचे वतीने शासनात जिल्ह्यात महामार्गाची जी कामे सुरू आहेत. त्याकरिता ज्या शेतकयांच्या जमिनी अधिग्रहित केल्या आहेत, अशा महामार्गावरील बाधित शेतकयांना जमिनीचा योग्य मोबदला मिळावा या व इतर मागण्यांकरिता आंदोलने करण्यात येत आहेत.

ओबीसी समाजास जनगणनेनिहाय आरक्षण मिळावे या करिता ओबीसी समाजातील विविध संघटनांकडून आंदोलने करण्यात येत आहेत.

आगामी सण/उत्सव

(१) महाशिवरात्री.-- सांगली जिल्ह्यात विविध ठिकाणी दिनांक ११ मार्च २०२१ रोजी महाशिवरात्री उत्सव साजरा करण्यात येणार आहे.

(२) धर्मवीर संभाजी महाराज बलिदान मास.-- श्री. संभाजीराव भिडे (गुरुजी) संस्थापक, अध्यक्ष, शिवप्रतिष्ठान हिंदुस्तान यांचे नेतृत्वाखाली प्रतिवर्षाप्रमाणे दिनांक ११ मार्च २०२१ ते दिनांक ११ एप्रिल २०२१ अखेर सांगली जिल्ह्यामध्ये धर्मवीर संभाजी महाराज बलिदान मास साजरा करण्यात येणार आहे.

(४) मनुष्य अगर प्रेत अगर त्यांच्या प्रतिमा अगर आकृती यांचे प्रदर्शन करणे.

(५) मोठाने अर्वाच्य घोषणा देणे, अर्वाच्य गाणी गाणे, वाे वाजविणे, नकला, निदर्शने करणे.

(६) ज्याच्या योगाने वरील ठिकाणी शांतता व सुव्यवस्था आणि सार्वजनिक मालमत्तेस धोका निर्माण होईल किंवा सभ्यतेला बाधा येईल अशा पद्धतीने हावभाव करणे, लक, चित्रे किंवा चिन्हे तयार करणे, त्यांचे प्रदर्शन करणे आणि प्रसारित करणे.

(७) जिल्ह्यात पाच किंवा त्यापेक्षा अधिक व्यक्तींस सार्वजनिक ठिकाणी व रस्त्यावर एकत्र जमण्यास मनाई करणेत येत आहे.

(८) सदरचा आदेश कायदेशीर कर्तव्य बजावीत असलेल्या शासकीय कर्मचारी व धार्मिक विधी यांना लागू राहणार नाही.

क्रमांक एमएजी/कोरोना/प्रतिबंध क्षेत्र अधि./कावि-१०३/२०२१.---- ज्याअर्थी, आपत्ती व्यवस्थापन कायदा, २००५ मधील कलम २५ अन्वये जिल्हा आपत्ती व्यवस्थापन प्राधिकरणाची स्थापना करण्यात आलेली आहे व त्यातील पोट-कलम २(अ) नुसार मा. जिल्हादंडाधिकारी हे प्राधिकरणाचे पदसिद्ध अध्यक्ष आहेत. कोरोना विषाणूचा प्रादुर्भाव रोखण्याच्या अनुषंगाने मा. जिल्हाधिकारी यांनी भारतीय साथरोग नियंत्रण अधिनियम, १८९७ व आपत्ती व्यवस्थापन अधिनियम, २००५ अन्वये विविध प्रतिबंधात्मक आदेश निर्गमित केलेले आहेत. तसेच ौजदारी प्रक्रिया संहिता १९७३ चे कलम १४४ अन्वये बंदी आदेश पारित केलेले आहेत.

ज्याअर्थी, वाचले क्रमांक ५ अन्वये मौजे आरग, तालुका मिरज या गावच्या हद्दीत कोरोना बाधित रुग्ण आढळून आले असलेबाबत या कार्यालयास कळविले आहे, त्या पाश्र्वभूमीवर परस्पर संपर्कामुळे या विषाणूचा संसर्ग व प्रसार होण्याची शक्यता घेता मानवी जीविताला, आरोग्याला अथवा सुरक्षिततेला धोका उत्पन्न होऊ शकतो त्यामुळे मौजे आरग, तालुका मिरज येथील ज्या भागात कोरोना विषाणू बाधित रुग्ण आढळून आले होते त्या भागामध्ये पुनश्च विषाणूचा संसर्ग व प्रसार होऊ नये यासाठी सदर भागातील जनतेच्या हालचालींवर व प्रतिबंधित क्षेत्रातून बाहेर जाणे व बाहेरून प्रतिबंधित क्षेत्रात प्रवेश करण्यात प्रतिबंध करणे आवश्यक आहे, असे माझे मत झालेले आहे.

No. RB-2/ADM/RR/206/2021.— In exercise of the powers of the State Government under the provision to sub-Section (1) of section 4 of the Maharashtra Land Revenue Code, 1966 (Maharashtra XLI of 1966), delegated to me by Government Notification, Revenue and Forests department, No. TLC-1076/63926/ M-6, dated 1st July 1976. I, Mosammi Chougule-Barde, In-charge Additional Collector of Sangli District hereby with effect from 19th March 2021 constitute the New Village namely Wajegaon. Out of original village Chinchani of Kadegaon taluka of the Sangli District to be a village to be called Wajegaon in the Kadegaon taluka of the said district having the limits specified in the schedule here to appended.

The residents of the new village Wajegaon shall have right over assigned land of the residuary Chinchani village for the purpose of grazing land, cremation ground and threshing floor for all public utility.
