क्रमांक संकीर्ण ०४२१ /प्र.क्र .३४ / २०२१ /एसडी-२ः- महाराष्ट्र माध्यमिक व उच्च माध्यमिक शिक्षण मंडळे अधिनियम , १ ९ ६५ (१ ९ ६५ चा महा .४१ ) याच्या कलम ३७ च्या पोट- कलम ( २ ) तसेच कलम ३६ द्वारे प्रदान केलेल्या अधिकारांचा वापर करून, महाराष्ट्र शासन, महाराष्ट्र राज्य माध्यमिक व उच्च माध्यमिक शिक्षण मंडळाशी विचारविनिमय केल्यानंतर , याद्वारे , महाराष्ट्र माध्यमिक व उच्च माध्यमिक शिक्षण मंडळे विनियम , १९ ७७ यामध्ये पुढीलप्रमाणे सुधारणा करीत आहे : -
१. (१ ) या विनियमांस, महाराष्ट्र माध्यमिक व उच्च माध्यमिक शिक्षण मंडळे ( सुधारणा) विनियम , २०२१ असे म्हणावे .
( २ ) ते, दिनांक २५ मार्च , २०२१ पासून अंमलात आले असल्याचे मानण्यात येईल .
२. महाराष्ट्र माध्यमिक व उच्च माध्यमिक शिक्षण मंडळे विनियम , १ ९ ७७ ( यात यापुढे ज्याचा निर्देश , " मुख्य विनियम " असा केला आहे ) याच्या विनियम ४१ मधील,-
( १ ) पोट विनियम ( १ ) मध्ये, -
(अ) खंड( अ) मध्ये, -
( एक ) " मार्च किंवा एप्रिल मधील परीक्षेच्या " या मजकुराऐवजी " मार्च मधील परीक्षेच्या किंवा मंडळाने विहित केलेल्या कालावधीत आयोजित करावयाच्या परीक्षेच्या " हा मजकूर दाखल करण्यात येईल ;
( दोन ) " ५ फेब्रुवारी " या मजकुराऐवजी " ३१ जानेवारी " हा मजकूर दाखल करण्यात येईल ;
( तीन ) परंतुकातील , परिच्छेद अ व ब यांऐवजी , पुढील परिच्छेद दाखल करण्यात येतील : ---
" अ . जर तो आगामी जुलै - ऑगस्ट मधील परीक्षेला किंवा मंडळाने निर्धारित केलेल्या कालावधीत घ्यावयाच्या परीक्षेला बसू इच्छित असेल तर , त्याची उपस्थिती मधील कमतरता क्षमापित करून , त्यास परीक्षेस बसण्याची मुभा देण्यात येईल; किंवा
(१)

ब . जर तो पुढील मार्चमधील परीक्षेला किंवा मंडळाने निर्धारित केलेल्या कालावधीत आयोजित करावयाच्या परीक्षेला बसू इच्छित असेल तर , तो पुढील शैक्षणिक वर्षाच्या पहिल्या भागात किंवा दुसऱ्या भागात किंवा दोन्ही भागात मिळून एकत्रितपणे उपस्थिती मधील कमतरता भरून काढील . " .
( ब) खंड ( क) मध्ये, " यथास्थिति , १० फेब्रुवारी किंवा १० सप्टेंबर रोजी " या मजकुराऐवजी " मंडळाने निर्धारित केलेल्या दिनांकास " हा मजकूर दाखल करण्यात येईल ;
( क) खंड ( क) नंतर , पुढील खंड जादा दाखल करण्यात येईल : --
" (ड) राज्य मंडळाच्या अध्यक्षास , जो उमेदवार , पुढील कोणत्याही कारणांमुळे, एकतर पहिल्या किंवा दुसऱ्या अथवा दोन्ही सत्रांमध्ये मिळून किमान ७५ टक्के उपस्थितीची अट पूर्ण करू शकत नसेल अशा उमेदवाराच्या बाबतीत, संबंधित माध्यमिक शाळा प्रमुखाच्या आणि संबंधित विभागीय मंडळाच्या अध्यक्षाच्या शिफारशीवरून , पोट विनियम ( ब ) मध्ये विनिर्दिष्ट केल्याप्रमाणे १५ टक्क्यांपेक्षा अधिक अनुपस्थिती क्षमापित करता येईल : ---
(अ) उमेदवाराचे दीर्घकालीन आजारपण ;
कारणे ; (ब) ज्यामुळे उमेदवारास दीर्घकाळासाठी बाहेरगावी अथवा परदेशात जाणे भाग पडलेले असेल अशी अनपेक्षित (क) नैसर्गिक आपत्ती ; आणि
(ड) त्यांच्या स्वरूपानुसार जी खरी आहेत अशी अन्य कोणतीही कारणे.
अशा उमेदवारांच्या बाबतीत , दोन्ही सत्रात स्वतंत्रपणे किमान ५० % उपस्थिती असणे किंवा अपवादात्मक प्रकरणी, दोन्ही सत्रे मिळून एकत्रितपणे ५० % उपस्थिती असली पाहिजे आणि दोन्ही सत्रे मिळून एकत्रितपणे ५० % पेक्षा कमी असलेली उपस्थिती , कोणत्याही परिस्थितीत क्षमापित केली जाणार नाही . " ;
( २ ) पोट- विनियम ( १ ) नंतर, पुढील पोट विनियम समाविष्ट करण्यात येईल : -
" ( १अ) माध्यमिक शालांत प्रमाणपत्र (इ . १० वी) परीक्षेला बसणारे उमेदवार , साथीचे आजार , नैसर्गिक आपत्ती किंवा तत्सम कारणे यामुळे , पोट- विनियम ( १ ) च्या खंड ( अ ) मध्ये विहित केल्याप्रमाणे , किमान उपस्थितीची अट पूर्ण करीत नसतील तर , राज्य मंडळाची परीक्षा समिती , राज्य शासनाच्या पूर्व मान्यतेने, अशा उमेदवारांची उपस्थितीतील कमतरता , अंशतः किंवा पूर्णतः क्षमापित करण्यासाठी सक्षम असेल . " .
३. मुख्य विनियमांच्या विनियम ८८ मध्ये, -
(१ ) पोट विनियम ( १ ) मध्ये, -
(अ) खंड( अ) मध्ये,-
(एक) " मार्च किंवा एप्रिल परीक्षेच्या " या मजकुराऐवजी " फेब्रुवारी - मार्च मधील परीक्षेच्या किंवा मंडळाने विहित केलेल्या कालावधीत आयोजित करावयाच्या परीक्षेच्या " हा मजकूर दाखल करण्यात येईल ;
( दोन ) " ५ फेब्रुवारी " या मजकुराऐवजी " ३१ जानेवारी " हा मजकूर दाखल करण्यात येईल ;
(तीन) परंतुकातील , परिच्छेद अ व ब यांऐवजी , पुढील परिच्छेद दाखल करण्यात येतील : ---
" अ . जर तो आगामी जुलै -ऑगस्ट मधील परीक्षेला किंवा मंडळाने निर्धारित केलेल्या कालावधीत घ्यावयाच्या परीक्षेला बसू इच्छित असेल तर , त्याची उपस्थिती मधील कमतरता क्षमापित करून , त्यास परीक्षेस बसण्याची मुभा देण्यात येईल ; किंवा

(ब ) खंड (क ) मध्ये, " १० फेब्रुवारी , किंवा यथास्थिति , १० सप्टेंबरपर्यंत " या मजकुराऐवजी " मंडळाने निर्धारित केलेल्या दिनांकास हा मजकूर दाखल करण्यात येईल ;

( क) खंड ( क ) नंतर , पुढील खंड जादा दाखल करण्यात येईल : --
" (ड) तथापि , राज्य मंडळाच्या अध्यक्षास , जो उमेदवार , पुढील कोणत्याही कारणांमुळे , एकतर पहिल्या किंवा दुसऱ्या अथवा दोन्ही सत्रांमध्ये मिळून किमान ७५ टक्के उपस्थितीची अट पूर्ण करू शकत नसेल अशा उमेदवाराच्या बाबतीत , संबंधित कनिष्ठ महाविद्यालयाच्या प्रमुखाच्या आणि संबंधित विभागीय मंडळाच्या अध्यक्षाच्या शिफारशीवरून, पोट विनियम (ब ) मध्ये विनिर्दिष्ट केल्याप्रमाणे १५ टक्क्यांपेक्षा अधिक अनुपस्थिती क्षमापित करता येईल-
( अ) उमेदवाराचे दीर्घकालीन आजारपण ;
( ब) ज्यामुळे उमेदवारास दीर्घकाळासाठी बाहेरगावी अथवा परदेशात जाणे भाग पडलेले असेल अशी अनपेक्षित कारणे ;
(क) नैसर्गिक आपत्ती ; आणि
(ड) त्यांच्या स्वरूपानुसार जी खरी आहेत अशी अन्य कोणतीही कारणे .
अशा उमेदवारांच्या बाबतीत , दोन्ही सत्रात स्वतंत्रपणे किमान ५० % उपस्थिती असणे किंवा अपवादात्मक प्रकरणी , दोन्ही सत्रे मिळून एकत्रितपणे ५० % उपस्थिती असली पाहिजे आणि दोन्ही सत्रे मिळून एकत्रितपणे ५० % पेक्षा कमी असलेली उपस्थिती , कोणत्याही परिस्थितीत क्षमापित केली जाणार नाही . " ;
(२ ) पोट- विनियम ( १ ) नंतर, पुढील पोट- विनियम समाविष्ट करण्यात येईल : --
" ( १ अ ) उच्च माध्यमिक शालांत प्रमाणपत्र (इ.१२ वी) परीक्षेला बसणारे उमेदवार , साथीचे आजार , नैसर्गिक आपत्ती किंवा तत्सम कारणे यामुळे , पोट- विनियम ( १ ) च्या खंड ( अ) मध्ये विहित केल्याप्रमाणे , किमान उपस्थितीची अट पूर्ण करीत नसतील तर , राज्य मंडळाची परीक्षा समिती, राज्य शासनाच्या पूर्व मान्यतेने , अशा उमेदवारांची उपस्थितीतील कमतरता, अंशतः किंवा पूर्णतः क्षमापित करण्यासाठी सक्षम असेल . " .

NOTIFICATION
MAHARASHTRA SECONDARY AND HIGHER SECONDARY EDUCATION BOARDS ACT , 1965 .
No. Misc . 0421 /CR.34/ 2021 / SD - 2.- In exercise of the powers conferred by sub- section (2) of section 37 read with section 36 of the Maharashtra Secondary and Higher Secondary Education Boards Act , 1965 ( Mah . XLI of 1965) , the Government of Maharashtra , after consultation with the Maharashtra State Board of Secondary and Higher Secondary Education , is hereby amends the Maharashtra Secondary and Higher Secondary Education Boards Regulation , 1977 , as follows , namely: -
1. ( 1) These regulations may be called the Maharashtra Secondary and Higher Secondary Education Boards (Amendment) Regulations , 2021 .
(2) They shall be deemed to have come into force on the 25th March 2021 .
2. In regulation 41 of the Maharashtra Secondary and Higher Secondary Education Boards Regulations , 1977 ( hereinafter referred to as the " the Principal Regulations " ) ,—
(1) in sub - regulation (1) ,-
(a) in clause ( a) ,-
(i) for the words "March or April Examinations " the words "March Examination or Examination to be held at the period as decided by the Board" shall be substituted ;
(ii) for the figure , letters and words "5th of February " the figures , letters and words " 31st of January" shall be substituted ;
(iii) in the proviso , for the paragraphs A and B , the following shall be substituted, namely :-
" A. If he intends to appear for the upcoming July -August Examination or Examination to be held at the period as decided by the Board , he will be allowed to appear for the Examination by condoning the deficiency in attendance; " or "B. If he intends to appear for the next March Examination or Examination to be held at the period as decided by the Board , he shall fulfill the deficiency in attendance during first part or second part or during both parts in total of the next academic year . " .
(b) in clause ( c) , for the figures , letters and words " 10th February or 10th September , as the case may be , " the words "the dates decided by the Board , " shall be substituted;
(c) after clause ( c) , the following clause shall be added , namely :-
" (d) The Chairman of the State Board , on recommendation of the Head of the Secondary school concerned and the Chairman of the Divisional Board concerned , may condone the deficiency in attendance beyond 15 % specified in clause (b), in respect of a candidate who could not fulfill the requirement of minimum attendance of 75 % either in the first or second or in both terms , for any of following reasons , namely :-
(a) prolonged illness of the candidate ;
(b ) unforeseen reasons which compel the candidate to go outstation or abroad for the long period ;

(c) natural calamities ; and
(d) any other reasons which are genuine in their nature .
For such candidates 50 % attendance in both terms separately or in exceptional cases 50 % attendance in both terms together is must and attendance less than 50 % in both terms together cannot be condoned under any circumstances . " ;
(2) after sub - regulation ( 1) , the following sub - regulation shall be inserted , namely : - "(1A) In case of Epidemic illness , Natural disaster or similar reasons , if candidates , appearing for Secondary School Certificate Examination ( 10th) , do not fulfill the requirement of minimum attendance as prescribed in clause ( a) , of sub- regulation ( 1 ) the Examination committee of the State Board is competent to condone the deficiency in attendance of such candidates partly or fully , with the prior approval of the State Government . "
3. In regulation 88 of the principal Regulations :-
(1) in sub -regulation (1) ,—
(a) in clause ( a ) ,—
(i) for the words "March or April Examinations " the words "February-March Examination or Examination to be held at the period as decided by the Board " shall be substituted ;
(ii) for the figure , letters and words " 5th of February" the figures , letters and words " 31st of the January" shall be substituted ;
(iii) in the proviso , for the paragraphs A and B , the following shall be substituted , namely :-
"A. If he intends to appear for the upcoming July-August Examination or Examination to be held at the period as decided by the Board , he will be allowed to appear for the Examination by condoning the deficiency in attendance ; or

" .
