NOTIFICATION

WAQF ACT, 1995.

No. Waqf 2020/C.R.105/Desk-4.—Whereas, at present there are two Muslim Members of the Bar Council of Maharashtra and Goa ;

And whereas, out of the said two members, Advocate Asif Shaukat Qureshi was appointed as a Member on the Maharashtra State Board of Waqfs, Aurangabad from the category of "Muslim Members of the Bar Council of Maharashtra and Goa" mentioned in sub- clause (iii) of clause (b) of sub-section (1) of section 14 of the Waqf Act, 1995 (43 of 1995); vide Government Notification, Minorities Development Department, No.Waqf 2017/CR 85/Desk-4, dated 19th September 2017 and was subsequently removed vide Government Notification, Minorities Development Department No.Waqf 2019/CR 158/Desk-4, dated 4th December 2019 ;

And whereas, the Government of Maharashtra considers it expedient to fill the vacancy of the office of the member of the said Board created by removal of Advocate Asif Shaukat Qureshi ;

And whereas, the Government of Maharashtra is satisfied that it is not reasonably practicable to constitute an electoral college for the said category of "Muslim Members of the Bar Council of Maharashtra and Goa" mentioned in sub-clause (iii) of clause (b) and sub-section (1) of section 14 of the said Act.

Now therefore, in exercise of the powers conferred by sub-section (9) read with sub-clause (iii) of clause (b) of sub-section (1) and sub-section (3) of section 14 and section 21 of the Waqf Act, 1995 (43 of 1995), the Government of Maharashtra hereby nominates Advocate Ahmedkhan Usmankhan Pathan, Member of Bar Council of Maharashtra and Goa from the category of "Muslim Members of the Bar Council of concerned State" as a Member of the Maharashtra State Board of Waqfs having its headquarters at Panchakki, Aurangabad for remainder of the term of Advocate Asif Shaukat Qureshi, subject to the result of Writ Petition No.240 of 2020 filed in the Hon'ble High Court of Judicature at Bombay, Nagpur Bench.
