सांख्यिकी संग्रहण अधिनियम, २००८ .

क्रमांक असांसं १३२१/ ५५८ /प्र.क्र . ३१/ का-१४१७ . केंद्र शासनाच्या सांख्यिकी संग्रहण अधिनियम , २००८ च्या कलम ३ व ४ द्वारे (२०० ९ च्या कलम ७ द्वारे ) दिलेल्या अधिकाराचा वापर करून सांख्यिकी संग्रहण नियम , २०११ च्या नियम ५ व ७ अन्वये, महाराष्ट्र शासन खाली दिलेल्या अनुसूची १ मध्ये उल्लेख केलेल्या बाबींनुसार सांख्यिकी पाहणी , [ यापुढे अधिसूचनेत " वार्षिक उद्योग पाहणी २०१ ९ -२० ( राज्य नमुना) " असे संबोधले गेले आहे ] याद्वारे वस्तुनिर्माण व अनुषंगिक कार्ये या संबंधीची आकडेवारी गोळा करण्याचे आदेश देत आहे.

२. महाराष्ट्र शासन उपरोक्त आदेशासंदर्भात खाली दिलेल्या अनुसूची २ मध्ये उल्लेख केलेल्या अधिकाऱ्यांची राज्याच्या भौगोलिक क्षेत्रातील उद्योगासंबंधी सांख्यिकी माहिती गोळा करण्यासाठी सांख्यिकी अधिकारी म्हणून नियुक्ती करीत आहे .

३. संबंधित सांख्यिकी अधिकाऱ्याद्वारे प्राधिकृत केलेल्या व्यक्तींना प्रत्येक माहिती देणाऱ्या व्यक्तीद्वारे दिल्या गेलेल्या माहितीची पडताळणी , त्यासंबंधीच्या लेख्यांची / कागदपत्रांची पाहणी करणे व ते तपासणे तसेच आवश्यकतेनुसार त्या संबंधी स्पष्टीकरण मागणे या कामासाठी सांख्यिकी अधिकाऱ्याच्या कार्यक्षेत्रात नियुक्त केले जाईल . या प्रत्येक माहिती गोळा करण्यासाठी प्राधिकृत केलेल्या व्यक्तीकडे संबधित सांख्यिकी अधिकाऱ्याने त्यांना दिलेल्या छायाचित्रासह असलेले ओळखपत्र किंवा प्राधिकार पत्रसोबत असणार आहे.

४. वार्षिक उद्योग पाहणी २०१ ९ -२० ( राज्य नमुना) अंतर्गत माहिती देणाऱ्याकडून सोबत जोडलेल्या विहित नमुन्यात गोळा केलेल्या माहितीची योग्य ती छाननी व तपासणी केल्यानंतर अर्थ व सांख्यिकी संचालनालय, नियोजन विभाग, महाराष्ट्र शासन यांच्या अधिकाऱ्यांकडून माहितीचे संस्करण केले जाईल .

५. वार्षिक उद्योग पाहणी २०१ ९ -२० ( राज्य नमुना) च्या कोणत्याही कामाशी संबंधित सर्व व्यक्ती ह्या सांख्यिकी संग्रहण अधिनियम , २००८ ( २०० ९ च्या कलम ७ द्वारे ) तसेच सांख्यिकी संग्रहण नियम , २०११ मधील तरतुदींखाली अंमलात असतील . कोणत्याही सांख्यिकी अधिकाऱ्याला अधिनियमाच्या कलम ४ च्या उप- कलम (४ ) अथवा ( ६ ) नुसार कोणतेही अधिकार देण्यात आलेले नाहीत.

अनुसूची १

१. सांख्यिकी संकलन करण्याचा विषय व प्रयोजन. वार्षिक उद्योग पाहणी २०१८-१९ ( राज्य नमुना) द्वारे संघटित वस्तुनिर्माण (ज्यात उत्पादन प्रक्रिया , दुरूस्ती सेवा, वायू व पाणीपुरवठा आणि शीतगृहे या संबंधित कार्यांचा समावेश आहे ) क्षेत्राची वाढ , रचना व संरचना संबंधित सांख्यिकी आकडेवारी गोळा केली जाते .

२. सांख्यिकी संकलनासाठीचे भौगोलिक क्षेत्र. सांख्यिकी संग्रहण अधिनियम , २००८ अंतर्गत वार्षिक उद्योग पाहणी २०१९ -२० (राज्य नमुना ) ही संपूर्ण राज्यात केली जात आहे.

३. सांख्यिकी संकलनाची पध्दती. प्रत्येक सांख्यिकी अधिकारी त्याच्या कार्यक्षेत्रांतर्गत माहिती देणाऱ्यास सूचना पत्र निर्गमित करेल. या सूचना पत्रात ज्या दिनांकापर्यंत माहिती पुरवावयाची आहे तो दिनांक, ज्या अधिकारी / कार्यालयास माहिती पुरवावयाची आहे ते अधिकारी / कार्यालय , ज्या घटक / घटकांसाठी माहिती पुरवावयाची आहे तो/ ते घटक आणि माहिती ज्या नमुन्यात पुरवावयाची आहे असे नमुने (विहित नमुन्यातील प्रपत्र ) या बाबी दर्शविलेल्या असतील . सांख्यिकी अधिकारी सूचना पत्रात उल्लेखिलेल्या इतर अटींच्या अधीन राहून नमुन्यातील माहिती व आकडेवारी इलेक्ट्रॉनिक माध्यमातून नोंदविण्यासाठी माहिती देणाऱ्यास अनुमती देऊ शकतात.

४. ज्यांच्याकडून माहिती संकलित केली जाणार अशा माहिती देणाऱ्यांचे स्वरूप. - सांख्यिकी अधिकाऱ्यांमार्फत घटकाचा (अर्थात कोणताही कारखाना / उद्योग किंवा वीज वा वायू वा पाणीपुरवठा करणारी संस्था , किंवा विडी आणि सिगारेट कामगार (रोजगाराच्या अटी ) अधिनियम, १९ ६६ अंतर्गत नोंदणीकृत आस्थापना) (१ ९६६ चा क्रमांक ३२ ) मालक किंवा अधिकारी ज्याला सूचना पत्र दिले जाईल , त्यांना घटकासंबंधी माहिती उपलब्ध करून द्यावी लागेल .

एकाच समुहाच्या/व्यवस्थापनाच्या अंतर्गत असलेल्या दोन किंवा अधिक घटकांसंबंधी माहिती घटकनिहाय वेगवेगळी उपलब्ध होत नसल्यास आणि अशा सारख्या इतर शक्यता ज्या सूचना पत्रात नमूद केल्या आहेत अशा बाबतीत सांख्यिकी अधिकारी मालक अथवा ज्यांच्या ताब्यात तो घटक आहे त्या व्यक्तीकडून अशा घटकांची एकत्रित माहिती मागू शकतो.

५. सांख्यिकी संकलन करण्याचा अपेक्षित कालावधी.- सूचना पत्रात सूचनाकर्त्याद्वारे माहिती सादर करण्यापर्यंतचा दिनांक नमूद केलेला असेल व तो साधारणपणे जून , २०२१ ते नोव्हेंबर , २०२१ या कालावधी दरम्यान असेल.

६. संदर्भ कालावधी.- १ एप्रिल २०१९ ला सुरु होणारे व ३१ मार्च २०२० ला संपणारे आर्थिक वर्ष किंवा १ एप्रिल २०१ ९ आणि ३१ मार्च २०२० च्या दरम्यान कोणत्याही तारखेला संपणारे घटकाचे लेखावर्ष यासाठी माहिती उपलब्ध करून द्यावी लागेल.

७. गोळा केल्या जाणाऱ्या माहितीचे स्वरूप. - मागितलेल्य माहितीत सोबत जोडलेल्या विहित नमुन्यात गोळा करण्यात येईल. त्यात मत्ता व दायित्वे, रोजगार व रोजगारावरील खर्च, जमा, खर्च , निविष्टी, वापरलेला स्वदेशी किंवा आयात माल , मुख्य उत्पादन व उप उत्पादने, वितरणावरील खर्च इत्यादींचा समावेश आहे.

८. माहिती देणाऱ्याने ज्या भाषेत माहिती सादर केली पाहिजे ती भाषा.- माहिती देणारा सोबत जोडलेल्या नमुन्यात मराठी , हिंदी अथवा इंग्रजी भाषेमध्ये माहिती सादर करेल.

९. माहिती देणाऱ्यासाठी बंधने.- घटकाचा मालक किंवा पदाधिकारी ह्यास संबंधित सांख्यिकी अधिकाऱ्याकडून प्राप्त झालेल्या सूचना पत्रात नमूद केल्याप्रमाणे त्याचप्रकारे व त्यात दिलेल्या दिनांकापर्यंत माहिती सादर करावी लागेल. तसेच सांख्यिकी अधिकारी किंवा त्यांनी प्राधिकृत केलेल्या व्यक्तिस निरिक्षणासाठी संबंधित कागदपत्रे उपलब्ध करून द्यावी लागतील तसेच मागितलेल्या माहिती संदर्भात विचारलेल्या प्रश्नांस उत्तरे द्यावी लागतील .

१०. व्यवसायासंबधी कागदपत्रे व निरीक्षण होऊ शकतील अशा लेख्यांचे स्वरूप.- सांख्यिकी अधिकारी किंवा त्याने प्राधिकृत केलेली व्यक्ती घटकाच्या व्यवसायासंबंधीची कागदपत्रे, जसे ताळेबंद , नफा - तोटा पत्रक , हजेरी पत्रक , श्रम तासांची नोंदवही , वेतन पत्रक, संचालकांचा अहवाल अथवा घटकाद्वारे सादर केलेल्या माहितीच्या पृष्ठ्यर्थ/ समर्थनार्थ कोणत्याही अन्य वैधानिक दस्ताऐवजांचे निरिक्षण करू शकेल.

११. निरीक्षणाची पद्धत.- संबंधित सांख्यिकी अधिकारी किंवा त्यांनी प्राधिकृत केलेली व्यक्ती , घटकाच्या कारभारांचे लेखे तसेच इतर कागदपत्रे यांच्या आधारे घटकाकडून दिल्या गेलेल्या माहितीची सत्यता पडताळू शकेल तसेच संबंधित मालक अथवा अधिकारी किंवा घटकाच्या व्यवस्थापनाने प्राधिकृत केलेल्या व्यक्तीकडे त्या संबंधीचे स्पष्टीकरण मागेल .

COLLECTION OF STATISTICS ACт , 2008 .

No. DES . 1321/ 558/ C.R. 31/Desk - 1417 . In exercise of the powers conferred by sections 3 and 4 of the Collection of Statistics Act , 2008 ( 7 of 2009 ) read with rules 5 and 7 of the Collection of Statistics Rules , 2011 , the Government of Maharashtra hereby directs the collection of statistics on manufacturing and related activities through a statistical survey ( hereinafter referred to as "the Annual Survey of Industries 2019-20 ( State Sample ) " as per the details mentioned in Schedule - I appended hereto .

2. The Government of Maharashtra hereby appoints the Officer as also his assignees in offices , mentioned in Schedule - II appended hereto , as statistics officers in respect of the geographical units mentioned therein for the purpose of collecting statistics with reference to the aforesaid direction .

3. The persons authorized by the concerned statistics officer shall , engage , in the jurisdiction of the statistics officer , in verification of information furnished by each informant , for inspecting relevant records , and for seeking clarifications , as may be necessary. Each person authorised to collect information shall carry a photo identity card or a letter of authorization issued by the concerned statistics officer .

4. The statistics collected in the Form appended herewith in respect of the Annual Survey of Industries 2019-20 ( State Sample ) furnished by the informants , after due verification and scrutiny , shall be processed by officials working at the Directorate of Economics and Statistics , under the Planning Department of Government of Maharashtra .

5. All the persons engaged in any activity in respect of the 'Annual Survey of Industries 2019-20 ( State Sample )' are governed by the provisions of the Collection of Statistics Act , 2008 (No.7 of 2009 ) and the Collection of Statistics Rules , 2011 , framed thereunder . No power has been delegated to any statistics officer under sub- section ( 4) or ( 6 ) of section 4 of the Act .

Schedule - I

1. Subject and purpose for collection of statistics.- Statistics relating to the growth , composition and structure of organized manufacturing sector , comprising activities related to manufacturing processes , repair services , gas and water supply and cold storage , is collected through Annual Survey of Industries 2019-20 ( State Sample) .

2. Geographical area for collection of statistics . The Annual Survey of Industries 2019-20 (State Sample ) shall be conducted in the whole State of Maharashtra .

3. Method of data collection.- A notice shall be issued by each statistics officer to informants under his jurisdiction , indicating therein the date by which , the officer or office to whom , the unit or units for which , and the forms in which information is required to be furnished . The statistics officer may permit an informant to file the information in electronic form , subject to such other conditions that he may specify in the notice .

4. Nature of informants from whom data may be collected. The owner or occupier of a unit (i.e. , a factory or an electricity or gas or water supply undertaking or an establishment registered under the Beedi and Cigar Workers ( Conditions of Employment ) Act , 1966 ) ( No 32 of 1966 ) to whom the notice has been issued by a statistics officer shall furnish information about the unit .

The statistics officer may require an owner or occupier to furnish consolidated information in respect of two or more units under single management in case information is not separately available for individual unit and subject to such other conditions , as he may specify , in the notice .

5. Period during which collection of statistics may be completed . The date for submission of information by each informant shall be mentioned in the notice and it would generally fall during the period from June , 2021 to November , 2021 .

6. Reference period . Information is required to be furnished for the financial year commencing from the 1st April 2019 and ending on the 31st March 2020 or for the accounting year of a unit ending on any date between the 1st April 2019 to 31st March 2020 .

7. Nature of information to be collected . The information required shall be collected in the Form appended herewith. The Form contains the assets and liabilities , employment and labour cost , receipts , expenses , input items - indigenous and imported , products and by - products , distributive expenses , etc. of a unit .

8. Form and language in which information is to be furnished by informant . An informant shall furnish the information in the Form appended herewith either in Marathi , Hindi or English language .

9. Obligation of informant.- An owner or occupier of a unit shall furnish information in the manner and by the date mentioned in the notice received by him from the concerned statistics officer . He shall also furnish relevant records for inspection and answer the questions in relation to the information sought , as may be required by the statistics officer or a person authorized by him .

10. Nature of business records and other records which may be inspected . The business records of a unit , such as balance sheet , profit and loss account , muster rolls , attendance register, labour register , pay rolls , Director's report or any other legal document in support of the information furnished by the unit may be inspected by the statistics officer or a person authorized byhim.

11. The manner of inspection . The concerned statistics officer or a personperson authorized by him may verify the information furnished by a unit on the basis of business records and other records of the unit and seek clarifications from the concerned owner or occupier or a person authorized by the management of the unit .

भारताचे संविधान.

क्रमांक मबाआ-२०१४ /प्र. क्र.२७८ /का-७ . भारताच्या संविधानाच्या अनुच्छेद ३० ९ च्या परंतुकान्वये प्रदान करण्यात आलेल्या अधिकारांचा वापर करून आणि त्याबाबतीत करण्यात आलेले सर्व विद्यमान नियम , आदेश व संलेख अधिक्रमीत करून महाराष्ट्राचे राज्यपाल याव्दारे , महाराष्ट्र शासनाच्या , महिला व बाल विकास विभागाच्या प्रशासकीय नियंत्रणाखालील महिला व बाल विकास आयुक्तालयाच्या अधिपत्याखालील जिल्हा परिविक्षा अधिकारी, अधीक्षक/ अधीक्षिका, निरीक्षक प्रमाणित शाळा व संस्था ( कनिष्ठ ) , मुख्य अधिकारी , कार्यकारी सचिव (जिपअ संवर्ग) , कार्यालय अधीक्षक , परिविक्षा अधिकारी , उप अधीक्षक, सहायक निरीक्षक प्रमाणित शाळा, प्रमुख लिपीक, अधीक्षक, वरिष्ठ लिपीक, सांख्यिकी सहायक, कनिष्ठ लिपीक, कनिष्ठ सहायक व एकात्मिक बाल विकास सेवा योजना आयुक्तालयाच्या अधिपत्याखालील मुख्यसेविका किंवा पर्यवेक्षिका या गट - क मधील पदावरील सेवाप्रवेशाचे विनियमन करणारे पुढील नियम तयार करीत आहेत: - १. या नियमांना, महिला व बाल विकास आयुक्तालय आणि एकात्मिक बाल विकास सेवा योजना आयुक्तालयाच्या अधिपत्याखालील गट-क मधील या पदांचे सेवा प्रवेश नियम, २०२१ असे म्हणावे.

२. या नियमांमध्ये , संदर्भानुसार दुसरा अर्थ अपेक्षित नसेल तर , -

(क) " आयुक्तालय " याचा अर्थ महिला व बाल विकास आयुक्तालय असा आहे.

(ख) " पदवी " याचा अर्थ सांविधानिक विद्यापीठाची पदवी असा आहे .

(ग) " विभाग " याचा अर्थ महाराष्ट्र शासनाचा महिला व बाल विकास विभाग असा आहे.

(घ) " शासन " याचा अर्थ महाराष्ट्र शासन असा आहे .

३. आयुक्तालयाच्या अधिपत्याखालील गट " क " मधील जिल्हा परिविक्षा अधिकारी , अधीक्षक , अधीक्षिका, निरीक्षक प्रमाणित शाळा व संस्था ( कनिष्ठ) , मुख्य अधिकारी , कार्यकारी सचिव ( जिपअ संवर्ग ) या पदावरील नियुक्ती ; -

आयुक्तालयाच्या अधिपत्याखालील गट " क " मधील परिविक्षा अधिकारी / उप अधीक्षक किंवा सहायक निरीक्षक प्रमाणित शाळा पद धारण करणाऱ्या व्यक्तींच्या एकत्रित जेष्ठता सूचीमधून व त्या पदावर तीन वर्षांपेक्षा कमी नसेल इतकी नियमित सेवा करणाऱ्या योग्यतेच्या अधीनतेने व जेष्ठतेच्या आधारे योग्य व्यक्तींच्या पदोन्नतीव्दारे करण्यात येईल .

४. आयुक्तालयाच्या अधिपत्याखालील गट " क " मधील कार्यालय अधीक्षक या पदावरील नियुक्ती ; -

आयुक्तालयाच्या अधिपत्याखालील गट " क " मधील प्रमुख लिपीक/ अधिक्षक पद धारण करणाऱ्या व्यक्तींच्या एकत्रित जेष्ठता सूचीमधून व त्या पदावर तीन वर्षांपेक्षा कमी नसेल इतकी नियमित सेवा करणाऱ्या योग्यतेच्या अधीनतेने व जेष्ठतेच्या आधारे योग्य व्यक्तींच्या पदोन्नतीव्दारे करण्यात येईल .

५. (१ ) आयुक्तालयाच्या अधिपत्याखालील गट " क " मधील परिविक्षा अधिकारी / उप अधीक्षक किंवा सहायक निरीक्षक प्रमाणित शाळा या पदावरील नियुक्ती; -

(क) पुढील उमेदवारांमधून पदोन्नतीद्वारे,-

आयुक्तालयाच्या अधिपत्याखालील गट " क " मधील मुख्यसेविका हे पद धारण करणाऱ्या व त्या संवर्गात तीन वर्षांहून कमी नसेल इतकी नियमित सेवा पूर्ण करणाऱ्या तसेच सेवाप्रवेशोत्तर परीक्षा उत्तीर्ण झालेल्या व्यक्तींच्या एकत्रित जेष्ठता सूचीमधून योग्यतेच्या अधीनतेने व जेष्ठतेच्या आधारे योग्य व्यक्तींच्या पदोन्नतीव्दारे करण्यात येईल ,

किंवा,

(ख ) पुढील उमेदवारांमधून निवडीद्वारे, -

आयुक्तालयाच्या अधिपत्याखालील गट " क " मधील वरिष्ठ लिपीक / सांख्यिकी सहायक हे पद धारण करणाऱ्या व त्या संवर्गात पाच वर्षांपेक्षा कमी नसेल इतकी नियमित सेवा पुर्ण करणाऱ्या तसेच सेवाप्रवेशोत्तर परीक्षा उत्तीर्ण झालेल्या व्यक्तीमधून मर्यादीत विभागीय परिक्षेच्या निकालाच्या आधारे तयार केलेल्या गुणवत्ता यादीतील गुणवत्तेच्या आधारे योग्य व्यक्तींच्या निवडीद्वारे करण्यात येईल, भाग चार-अ-५ २८

किंवा,

(ग) पुढील उमेदवारांमधून नामनिर्देशनाद्वारे , -

( एक) ज्यांचे एकवीस वर्षांपेक्षा कमी वय नसलेल्या आणि अडतीस वर्षांपेक्षा जास्त वय नसलेल्या, परंतु आरक्षित प्रवर्गातील व्यक्तींच्या बाबतीत वयाची मर्यादा पाच वर्षांपर्यंत शिथील करण्यात येईल ; आणि

(दोन) ज्यांनी पदवी धारण केली असेल.

( २ ) या नियमाच्या उप नियम ( १ ) येथे नमूद केलेल्या आयुक्तालयाच्या अधिपत्याखालील गट " क " मधील परिविक्षा अधिकारी / उपअधीक्षक किंवा सहायक निरीक्षक प्रमाणित शाळा या पदावर पदोन्नतीने, निवड पद्धतीने व नामनिर्देशनाने करावयाच्या नियुक्तीचे प्रमाण २५:२५:५० असे राहील .

६. आयुक्तालयाच्या अधिपत्याखालील गट " क " मधील प्रमुख लिपीक/ अधीक्षक या पदावरील नियुक्ती ; -

आयुक्तालयाच्या अधिपत्याखालील गट " क " मधील वरिष्ठ लिपीक/ सांख्यिकी सहायक पद धारण करणाऱ्या व सदर पदावर तीन वर्षांपेक्षा कमी नसेल इतकी नियमित सेवा पुर्ण करणाऱ्या व्यक्तींच्या एकत्रित जेष्ठता सूचीमधून योग्यतेच्या अधीनतेने , जेष्ठतेच्या आधारे व अर्हताकारी परीक्षा उत्तीर्ण झालेल्या योग्य व्यक्तीची पदोन्नतीव्दारे नियुक्ती करण्यात येईल.

७. ( १ ) एकात्मिक बाल विकास सेवा योजनेतंर्गत गट " क " मधील मुख्यसेविका/ पर्यवेक्षिका या पदावरील नियुक्ती एकतर ; - (क) पुढील उमेदवारांमधून निवडीद्वारे, -

एकात्मिक बाल विकास सेवा योजनेतंर्गत " मानसेवी अंगणवाडी सेविका " किंवा " मिनी अंगणवाडी सेविका " या पदावर कार्यरत असणाऱ्या दहा वर्षाहून कमी नसेल इतकी नियमित सेवा करणाऱ्या आणि ४५ वर्षांपेक्षा जास्त वय नसलेल्या व या नियमातील पोट नियम ( ख ) ( दोन ) मध्ये विहित केलेली अर्हता धारण करणाऱ्या महिला उमेदवारांमधून मर्यादीत विभागीय परीक्षेच्या गुणांकानुसार निवडीव्दारे करण्यात येईल .

किंवा

(ख) पुढील उमेदवारांमधून नामनिर्देशनाद्वारे , -

(एक) ज्यांचे एकवीस वर्षापेक्षा कमी वय नसलेल्या आणि अडतीस वर्षांपेक्षा जास्त वय नसलेल्या, परंतु आरक्षित प्रवर्गातील व्यक्तींच्या बाबतीत वयाची मर्यादा पाच वर्षांपर्यंत शिथील करण्यात येईल; आणि

(दोन) ज्यांनी पदवी धारण केली असेल .

( २ ) या नियमाच्या उप नियम ( १ ) येथे नमूद केलेल्या आयुक्तालयाच्या अधिपत्याखालील गट " क " मधील मुख्यसेविका/पर्यवेक्षिका पदांवरील नियुक्ती ही नामनिर्देशनाने व निवडीव्दारे अनुक्रमे प्रमाण ५०:५० असेल.

८. (१ ) आयुक्तालयाच्या अधिपत्याखालील गट " क " मधील वरिष्ठ लिपीक/ सांख्यिकी सहायक या पदावरील नियुक्ती एकतर; - (क) पुढील उमेदवारांमधून पदोन्नतीद्वारे,-

आयुक्तालयाच्या अधिपत्याखालील गट " क " मधील कनिष्ठ लिपीक / कनिष्ठ सहायक हे पद धारण करणाऱ्या व त्या संवर्गात तीन वर्षापेक्षा कमी नसेल इतकी नियमित सेवा पुर्ण करणाऱ्या एकत्रित सेवाजेष्ठता सूचीमधून योग्यतेच्या अधीनतेने व ज्येष्ठतेच्या आधारे , योग्य व्यक्तींच्या पदोन्नतीव्दारे करण्यात येईल .

किंवा

(ख) पुढील उमेदवारांमधून नामनिर्देशनाद्वारे ,-

(एक) ज्यांचे एकवीस वर्षापेक्षा कमी वय नसलेल्या आणि अडतीस वर्षापेक्षा जास्त वय नसलेल्या, परंतु आरक्षित प्रवर्गातील व्यक्तींच्या बाबतीत वयाची मर्यादा पाच वर्षांपर्यंत शिथिल करण्यात येईल; आणि

(दोन) ज्यांनी पदवी धारण केली असेल .

( २ ) या नियमाच्या उप नियम ( १ ) येथे नमूद केलेल्या आयुक्तालयाच्या अधिपत्याखालील गट " क " मधील वरिष्ठ लिपीक/ सांख्यिकी सहायक या पदांवरील नियुक्ती पदोन्नतीने व नामनिर्देशनाने अनुक्रमे ५०:५० प्रमाण असेल.

२९ महाराष्ट्रशासन राजपत्र भाग चार - अ, गुरुवार ते बुधवार, जून १० - जून १६ , २०२१ /ज्येष्ठ २०-२६ , शके १ ९ ४३ ९. ( १ ) आयुक्तालयाच्या अधिपत्याखालील गट " क " मधील कनिष्ठ लिपीक/ कनिष्ठ सहायक या पदावरील नियुक्ती,- (क) पुढील उमेदवारांमधून पदोन्नतीद्वारे ; -

आयुक्तालयाच्या अधिपत्याखालील " गट- ड " मधील कोणतेही पद धारण करणाऱ्या व त्या पदावर ३ वर्षांपेक्षा कमी नसेल इतकी नियमित सेवा पुर्ण केलेल्या व या नियमातील खंड (ख ) च्या उप खंड (दोन) व ( तीन ) मध्ये विहित केलेली अर्हता धारण करणाऱ्या व्यक्तीच्या एकत्रित सेवाजेष्ठता सूचीमधून मधून जेष्ठतेच्या अधिन, पात्रता या निकषावर योग्य व्यक्तींच्या पदोन्नतीने नियुक्ती करण्यात येईल ,

किंवा

(ख) पुढील उमेदवारांमधून नामनिर्देशनाव्दारे ; -

(दोन) ज्यांनी पदवी धारण केली असेल ; आणि

(तीन) ज्यांनी मराठी टंकलेखनाचे किमान ३० श.प्र.मि. वेग मर्यादेचे किंवा इंग्रजी टंकलेखनाचे किमान ४० श.प्र.मि. वेग मर्यादेचे शासकीय वाणिज्य प्रमाणपत्र किंवा संगणक टंकलेखनाचे प्रमाणपत्र धारण केलेले आहे,

किंवा

(ग) अनुकंपा तत्त्वावर निवड करण्यासाठी शासनाने वेळोवेळी निर्गमित केलेल्या आदेशांनुसार , खंड ( ख ) च्या उप खंड ( दोन ) व (तीन ) मध्ये विहित केलेली अर्हता धारण करीत असलेल्या उमेदवारांची अनुकंपा तत्त्वावर नियुक्तीने ;

किंवा

(घ) गट क मधील वाहन चालक या पदावर किमान तीन वर्षांपेक्षा कमी नाही इतकी नियमित सेवा पूर्ण केलेल्या व खंड ( ख ) च्या उपखंड ( दोन ) व ( तीन ) मध्ये विहित केलेली अर्हता धारण करणाऱ्या व कनिष्ठ लिपीक/ कनिष्ठ सहायक पदावर येण्यास इच्छुकता दिलेल्या व्यक्तीमधून जेष्ठता अधिन पात्रता या निकषावर योग्य व्यक्तींच्या कायमस्वरुपी संवर्ग बदलीने नियुक्ती देता येईल . वाहन चालक या पदावरुन नियुक्ती दिलेल्या व्यक्तीची कनिष्ठ लिपीक/कनिष्ठ सहायक पदावरील सेवाजेष्ठता कनिष्ठ लिपीक / कनिष्ठ सहायक पदावरील नियुक्तीच्या दिनांकापासून निश्चित करण्यात येईल .

( २ ) नियम ९ येथे नमुद केलेल्या पदावर पदोन्नतीने , अनुकंपा तत्त्वावरील नियुक्तीसह नामनिर्देशनाने व वाहन चालकामधून कायमस्वरुपी बदलीने करावयाची नियुक्ती यांचे प्रमाण ४०:५०:१० असे राहील :

परंतु असे की , पदोन्नतीने किंवा वाहन चालकामधून कायम स्वरुपी बदलीने नियुक्तीसाठी विहीत अर्हता धारण करणारे उमदेवार उपलब्ध नसल्यास नियुक्ती प्राधिकाऱ्यांना पदोन्नतीचे व वाहन चालकामधून कायम स्वरुपी बदलीचे प्रमाण शिथील करून उमेदवारांची नामनिर्देशनाने नियुक्तीकरता येईल .

१०. नियम ५, ७ , ८ व ९ येथे नमुद केलेल्या पदावर नियुक्त झालेल्या व्यक्तीने नियमानुसार " सेवाप्रवेशोत्तर परीक्षा " विहित कालावधीत व संधीत उत्तीर्ण व्हावे लागेल किंवा प्रचलित नियमानुसार सेवाप्रवेशोत्तर परीक्षा उत्तीर्ण होण्यापासून तिला सुट मिळणे आवश्यक राहील .

११. नियम ३ , ४ , ५, ६ , ७ , ८ , ९ येथे नमूद पदावर नियुक्त होणाऱ्या व्यक्तीने हिंदी भाषा परीक्षा व मराठी भाषा परीक्षा या दोन्ही परीक्षांसंदर्भात शासनाने वेळोवेळी केलेल्या नियमांनुसार सदर दोन्ही भाषा परीक्षा उत्तीर्ण केली असणे अथवा या दोन्ही भाषा परीक्षा उत्तीर्ण होण्यापासून सूट मिळविलेली असणे आवश्यक राहील किंवा सदर दोन भाषा परीक्षा नियुक्तीपूर्वी उत्तीर्ण केलेल्या नसतील तर , दोन्ही भाषा परीक्षा नियमात नमूद केलेल्या विहित मुदतीत सदर दोन्ही भाषा परीक्षा उत्तीर्ण होणे आवश्यक राहील अन्यथा विहित मुदतीनंतर परीक्षा उत्तीर्ण होईपर्यंत वार्षिक वेतनवाढ अनुज्ञेय राहणार नाही . तसेच वरिष्ठ पदावर पदोन्नती अनुज्ञेय राहणार नाही.

१२. नियम ३, ४ , ५ , ६ , ७ , ८ , ९ येथे नमूद पदावर नियुक्त होणाऱ्या व्यक्तीने संगणक अर्हता प्रमाणपत्रासंदर्भात शासनाने वेळोवेळी केलेल्या नियमांनुसार , संगणक अर्हता प्रमाणपत्र धारण करणे अथवा सदर प्रमाणपत्र धारण करण्यापासून सूट मिळविलेली असणे आवश्यक राहील किंवा संगणक अर्हता प्रमाणपत्र धारण केलेले नसल्यास , याबाबतच्या नियमात नमूद केलेल्या विहित मुदतीत सदर प्रमाणपत्र धारण करणे आवश्यक राहील . अन्यथा संगणक प्रमाणपत्र धारण करेपर्यंत वार्षिक वेतनवाढ अनुज्ञेय राहणार नाही . तसेच वरिष्ठ पदावर पदोन्नती अनुज्ञेय राहणार नाही. भाग चार-अ- ५ अ ३०

महाराष्ट्रशासन राजपत्र भाग चार - अ, गुरुवार ते बुधवार , जून १० -जून १६ , २०२१/ज्येष्ठ २०-२६ , शके १ ९ ४३ १३. नियम ५ , ७ , ८ , ९ येथे नमूद पदावर नामनिर्देशनाद्वारे नियुक्त होणाऱ्या व्यक्तीने , महाराष्ट्र नागरी सेवा ( लहान कुटुंबाचे प्रतिज्ञापत्र ) नियम , २००५ मधील तरतुदीनुसार व त्याबाबत वेळोवेळी करण्यात येणाऱ्या नियमानुसार , नियुक्तीच्या वेळी लहान कुटुंबाचे प्रमाणपत्र सादर करणे आवश्यक राहील अन्यथा सदर व्यक्ती शासकीय सेवेसाठी अनर्ह ठरेल .

१४. नियम ३ , ४ , ५ , ६ , ७ , ८ व ९ मध्ये नमूद केलेल्या पदावर नियुक्त केलेले व्यक्ती महाराष्ट्र राज्यात कोठेही बदली केली जाण्यास पात्र असतील.

NOTIFICATION

CONSTITUTION OF INDIA .

No. MBA- 2014/C.R.278/D - VII . In exercise of the powers conferred by the proviso to article 309 of the Constitution of India , and in supersession of all existing rules , orders or instruments made in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating the recruitment to the posts of District Probation Officer , Superintendent , Inspector of Certified School and Institutions ( Junior) , Chief Officer , Executive Secretary ( in DPO Cadre ) , Office Superintendent , Probation Officer , Deputy Superintendent , Assistant Inspector of Certified School , Head Clerk, Superintendent , Senior Clerk , Statistical Assistant , Junior Clerk , Junior Assistant , Group- C under the Commissionerate of Women and Child Development and the posts of Mukhya - sevika or Supervisor under the Commissionerate of Integrated Child Development Services Scheme under the administrative control of the Women and Child Development Department , Government of Maharashtra , namely : -

1. These rules may be called the Posts Group- C under the Commissionerate of Women and Child Development and the Commissionerate of Integrated Child Development Services Scheme (Recruitment) Rules , 2021 .

2. In these rules , unless there is anything repugnant in the subject or context ,- (a) " Commissionerate " means the Commissionerate of Women and Child Development ;

(b) " Degree " means a degree of any Statutory University or recognised University ;

( c) " Department " means the Department of Women and Child Development , Government of Maharashtra ;

(d) " Government " means the Government of Maharashtra .

3. Appointment to the posts of District Probation Officer , Superintendent , Inspector Certified School and Institutions ( Junior) , Chief Officer or Executive Secretary ( in DPO Cadre ) , Group -C under the Commissionerate , shall be made by promotion on the basis of combined seniority of a suitable person , from amongst the persons holding the posts of Probation Officer or Deputy Superintendent , Group - C under the Commisionerate and having not less than three years regular service on those posts .

4. Appointment to the post of Office Superintendent , Group- C under the Commissionerate shall be made by promotion of a suitable person , on the basis of combined seniority , from amongst the persons holding the posts of Head Clerk or Superintendent , Group - C under the Commisionerate and having not less than three years regular service on those posts .

5. ( 1 ) Appointment to the post of Probation Officer , Deputy Superintendent or Assistant Inspector of Certified School Group-C under the Commissionerate shall be made either , - (a) by promotion of a suitable person , on the basis of combined seniority subject to fitness , from amongst the persons holding the post of Mukhya - sevika , Group - C under the Commissionerate of Integrated Child Development Services Scheme and having not less than three years regular service on that post and who have passed the Post Recruitment Examination ; or

(b) by selection of a suitable person on the basis of merit , from the merit list prepared on the basis of result of Limited Departmental Examination. Persons holding the posts of Senior Clerk or Statistical Assistant , Group- C under the Commissionerate , having not less than five years regular service in that cadre and who have passed the post recruitment examination shall be considered eligible for appearing for such Limited Departmental Examination ; or (c ) by nomination from amongst the persons who , - ३२

(ii) possess a degree .

(2) Appointments to the posts of Probation Officer , Deputy Superintendent or Assistant Inspector of Certified School under the Commissionerate mentioned in sub - rule ( 1 ) of this rule by promotion , selection and nomination shall be made in the ratio of 25:25:50 , respectively.

6. Appointment to the posts of Head Clerk or Superintendent , Group - C under the Commissionerate shall be made by promotion of a suitable person, on the basis of combined seniority , from amongst the persons holding the posts of Senior Clerk or Statistical Assistant , Group -C under the Commisionerate and who have passed necessary Qualifying Examination for the said posts of Senior Clerk or Statistical Assistant and having not less than three years regular service on those posts .

7. ( 1 ) Appointment to the post of Mukhya - sevika or Supervisor , Group - C under the Commissionerate of Integrated Child Development Services Scheme , shall be made either , - (a) by selection of a suitable person on the basis of merit from the merit list prepared on the basis of the Limited Departmental Examination . Women who are working as the Honorary Anganwadi Sevika or Mini Anganwadi Sevika under the Integrated Child Development Services Scheme , who are not more than forty five years of age , having not less than ten years regular service on those posts and who possess an educational qualification as specified in sub - clause ( ii ) of clause (b ) of this sub - rule shall be considered eligible for appearing for such Limited Departmental Examination .

(b) by nomination from amongst the persons who , -

( i) are not less than twenty - one years of age and not more than thirty - eight years of age:

Provided that , the upper age limit shall be relaxed upto five years in case of persons belonging to reserved categories ; and

(ii) possess a degree .

(2) Appointment to the post of Mukhya - sevika or Supervisor mentioned in sub - rule ( 1 ) of this rule by selection and nomination shall be made in the ratio of 50:50 , respectively .

8. ( 1) Appointment to the posts of Senior Clerk or Statistical Assistant , Group- C under the Commissionerate shall be made either , -

(a) by promotion of a suitable person , on the basis of combined seniority subject to fitness , from amongst the persons holding the posts of Junior Clerk or Junior Assistant , Group-C under the Commissionerate and having not less than three years regular service on those posts and who has passed Post Recruitment Examination for the said posts of Junior Clerk or Junior Assistant ;

(b) by nomination from amongst the persons who , -

age: (i) are not less than twenty - one years of age and not more than thirty- eight years of Provided that , the upper age limit shall be relaxed upto five years in case of persons belonging to reserved categories ; and

( ii) possess a degree .

(2) Appointment to the posts of Senior Clerk or Statistical Assistant mentioned in sub- rule ( 1 ) of this rule by promotion and nomination shall be made in the ratio of 50:50 , respectively .

३३ महाराष्ट्रशासन राजपत्र भाग चार- अ, गुरुवार ते बुधवार, जून १० -जून १६ , २०२१/ज्येष्ठ २०-२६ , शके १९ ४३ 9. ( 1 ) Appointment to the posts of Junior Clerk or Junior Assistant Group- C , under the Commissionerate shall be made either, -

(a) by promotion on the basis of combined seniority from amongst persons holding any post in Group - D under the Commissionerate and the Commissionerate of Integrated Child Development Services Scheme and having continuous service on the said posts in Group-D for not less than three years and who possess qualifications mentioned in sub - clauses ( ii ) and ( iii) of clause ( b ) of this sub - rule ; or

(b) by nomination from amongst the persons who , -

age : ( i) are not less than twenty- one years of age and not more than thirty - eight years of Provided that , the upper age limit shall be relaxed upto five years in case of persons belonging to reserved categories ; and

( ii) possess a degree ; and

( iii) possess Government Commercial Certificate with a speed of not less than thirty words per minute in Marathi Typing or forty words per minute in English Typing ; or (c) by appointment of a suitable person on compassionate ground , in accordance with the orders issued in this behalf by the Government , from time to time , who possess qualifications specified in sub - clauses ( ii ) and ( iii ) of clause ( b ) of this sub - rule ;

(d) by permanent cadre transfer of a suitable person , on the basis of seniority subject to fitness , from amongst the persons holding the post of Driver , Group - C under the Commissionerate or the Commissionerate of Integrated Child Development Services Scheme who prefer the post of Junior Clerk or Junior Assistant having completed not less than three years of regular service on the post of Driver and possess qualifications mentioned in sub- clauses ( ii ) and ( iii ) of clause ( b ) of this sub- rule . The seniority of Drivers on the post of Junior Clerk or Junior Assistant shall be fixed from the date of their appointment to the post of Junior Clerk or Junior Assistant .

(2) Appointment to the post of Junior Clerk or Junior Assistant mentioned in sub - rule ( 1 ) of this rule shall be made by promotion , nomination including appointment on compassionate ground and permanent transfer from Driver cadre , in the ratio of 40:50:10 , respectively:

Provided that , if suitable candidates possessing prescribed qualifications for promotion or by permanent transfer from Driver cadre are not available , the Commissionerate may relax the ratio for appointment by promotion and by permanent transfer from Driver cadre and may appoint the candidates by nomination .

10. A person appointed to the posts mentioned in rules 5 , 7 , 8 or 9 shall be required to pass the Post Recruitment Examination according to the rules made in that behalf unless he has been exempted from passing that examination .

11. A person appointed to the post mentioned in rules 3 , 4 , 5 , 6 , 7 , 8 or 9 shall be required to pass the examinations in Marathi and Hindi Languages according to the rules made in that behalf, unless he has already passed or has been exempted from passing those examinations . A person shall not be eligible for annual increment or for the promotion , until he passes those examinations .

12. A person appointed to the post mentioned in rules 3 , 4 , 5 , 6 , 7 , 8 or 9 should possesses a Knowledge of Computer Operations as per the rules prescribed by the Government , from time to time, within the stipulated period , unless he has been exempted therefrom .

A person shall not be eligible for annual increment or for the promotion , until he possess such a Knowledge of Computer Operations as per the rules prescribed by the Government in that behalf.

A person shall not be eligible for appointment by nomination , to the post mentioned in rules 5 , 7 , 8 or 9 unless he submits a declaration of Small Family as per the provisions of the Maharashtra Civil Services ( Small Family Declaration ) Rules , 2005 or any other rules made by the Government in that behalf, from time to time .

14. A person appointed on the post mentioned in rules 3, 4, 5 , 6 , 7 , 8 or 9 shall be liable for transfer anywhere in State of Maharashtra .
