क्रमांक खाक्षेस २०१६/प्र.क्र. २५१ (एल.बी.५१ ) -एक्स /रस्ते-८ . ज्याअर्थी, महाराष्ट्र महामार्ग अधिनियम (१ ९ ५५ चा ५५ ) (यात यापुढे ज्याचा निर्देश "उक्त अधिनियम" असा करण्यात आला आहे ) याच्या कलम १५ च्या पोट - कलम ( २ ) तसेच उक्त कलमाच्या पोट-कलम ( ३ ) आणि कलम १७ याद्वारे प्रदान करण्यात आलेल्या अधिकारांचा , आणि याबाबतीत त्यास समर्थ करणाऱ्या इतर सर्व अधिकारांचा वापर करून , महाराष्ट्र शासनाने , शासन अधिसूचना, सार्वजनिक बांधकाम विभाग , क्रमांक खाक्षेस -२०१६/प्र.क्र. २५१ (एल.बी.४६ )-एक्स/रस्ते -८ , दिनांक १.०१.२०२१ ( यात यापुढे जिचा निर्देश "उक्त अधिसूचना" असा करण्यात आला आहे) द्वारे, सार्वजनिक प्रयोजन असलेल्या हिंदु हृदयसम्राट बाळासाहेब ठाकरे महाराष्ट्र समृद्धी महामार्ग [ राज्य महामार्ग (विशेष) क्र . २ ] (यात यापुढे ज्याचा निर्देश "उक्त महामार्ग " असा करण्यात आला आहे) याचे बांधकाम, देखभाल , व्यवस्थापन किंवा कार्यान्वयन करणे यांसाठी , उक्त अधिसुचनेसोबत जोडलेल्या अनुसूचीमध्ये नमूद केलेली जमीन संपादित करण्याचा उद्देश घोषित केला होता ; आणि उक्त अधिसूचनेसोबत जोडलेल्या अनुसूचीमध्ये ज्यांच्या जमिनी समाविष्ट आहेत, अशा, उक्त जमीन मालकांकडून किंवा जमिनींच्या हितसंबंधित व्यक्तींकडून, उक्त अधिसूचना शासन राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून एकवीस दिवसांच्या आत हरकती व सूचना प्राधिकृत अधिकारी तथा उपजिल्हाधिकारी ( सामान्य प्रशासन) जिल्हा ठाणे यांच्याकडे मागविल्या होत्या.
आणि ज्याअर्थी, प्राधिकृत अधिकारी तथा उपजिल्हाधिकारी ( सामान्य प्रशासन) जिल्हा ठाणे यांनी जमीन मालकांकडून आणि जमिनींच्या हितसंबंधित व्यक्तींकडून, त्याबाबतीत प्राप्त हरकती आणि सूचना विचारात घेऊन, उक्त अधिनियमाच्या कलम १८ च्या पोट - कलम ( १ ) मध्ये तरतूद केल्याप्रमाणे , त्याच्या अहवाल राज्य शासनास सादर केला आहे .

आणि ज्याअर्थी, महाराष्ट्र शासनाने, उक्त अहवाल विचारात घेऊन , या अधिसुचनेसोबत जोडलेल्या अनुसूचीमध्ये विनिर्दिष्ट केलेली जमीन उक्त महामार्गाचे बांधकाम, देखभाल, व्यवस्थापन किंवा कार्यान्वयन करणे यासाठी आवश्यक असल्याचे ठरविले आहे .
त्याअर्थी, आता, महाराष्ट्र महामार्ग अधिनियम ( १ ९ ५५ चा ५५ ) याच्या कलम १८ च्या पोट - कलम ( १ ) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा, आणि याबाबतीत त्यास समर्थ करणाऱ्या इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र शासन, याद्वारे , या अधिसूचनेसोबत जोडलेल्या अनुसूचीच्या रकाना ( २ ) मध्ये विनिर्दिष्ट केलेल्या गावांच्या बाबतीत, त्या अनुसूचीच्या रकाना ( ३ ) मध्ये नमूद केलेला भूसंपादन क्रमांक / गट क्रमांक असलेल्या जमिनी , त्या अनुसूचीच्या रकाना ( ४ ) मध्ये विनिर्दिष्ट केलेले क्षेत्र हे , उक्त महामार्गाचे बांधकाम, देखभाल , व्यवस्थापन किंवा कार्यान्वयन करणे यासाठी संपादित करण्यात येईल असे घोषित करीत आहे.

NOTIFICATION
MAHARASHTRA HIGHWAYS ACT .
No. PPP - 2016/CR- 251 ( L.B.51) -X/Road- 8 . Whereas , in exercise of the powers conferred by sub - section (2) of section 15 read with sub - section ( 3 ) of the said section 15 and section 17 of the Maharashtra Highways Act ( LV of 1955 ) ( hereinafter referred to as " the said Act " ) , and all other powers enabling it in that behalf, the Government of Maharashtra had , vide Government Notification , Public Works Department , No. PPP - 2016/CR- 251 ( L.B.46 ) -X/Road - 8 , dated the 1st January , 2021 (hereinafter referred to as " the said notification " ) , declared its intention to acquire the land as mentioned in the Schedule appended to the said notification , for a public purpose i.e. for building , maintenance , management or operation of the Hindu Hriday Samrat Balasaheb Thackeray Maharashtra Samruddhi Mahamarg [State Highway ( Special ) No. 2 ] ( hereinafter referred to as "the said Highway" ) ; and invited the objections and suggestions from the land owners or persons interested in the said land , whose lands are included in the Schedule appended to the said notification to the Sub - Divisional Officer , Authorized Officer , Deputy Collector ( General Administration) District Thane , within twenty - one days from date of the publication of the said notification, in the Official Gazette ;
And whereas , the said Deputy Collector ( General Administration) and Authorized Officer District Thane , has , after considering the objections and suggestions received from the land owners and persons interested thereof , submitted its report to the State Government as provided in sub - section ( 1) of section 18 of the said Act ;
And whereas , the Government of Maharashtra has , after considering said report , decided that the land specified in the Schedule appended to this notification is required for building , maintenance , management or operation of the said Highway;
Now , therefore , in exercise of the powers conferred by sub - section ( 1) of section 18 of the Maharashtra Highways Act (LV of 1955) , and of all other powers enabling it in this behalf, the Government of Maharashtra , hereby declares that in respect of the villages specified in column (2) of the Schedule appended hereto , the land bearing Survey Numbers /Gat Numbers mentioned in column ( 3 ) thereof, the area specified in column (4 ) of that Schedule shall be acquired for building , maintenance , management or operation of the said Highway .
