(cid:२७०)मांक न(cid:५३५)दणी-२०१९/१५६१/(cid:२९०).(cid:२७०).४१७/म-१(धोरण).–न(cid:५३५)दणी अधिनियम, १९०८ (१९०८ चा १६), अधिनियम, महारा(cid:२०५)(cid:२८०) रा(cid:१८२)यास लागू असताना, (cid:१९०)या(cid:१८०)या कलम ७८ (cid:१८०)या खंड (क) (cid:४६२)ारे (cid:२९०)दान के ले(cid:२०२)या अधिकारांचा आणि याबाबतीत (cid:१९०)यास समथ(cid:१७१) करणा(cid:२०१)या इतर सव(cid:१७१) अधिकारांचा वापर क(cid:४७२)न,महारा(cid:२०५)(cid:२८०) शासन, या(cid:४६२)ारे, संलेखा(cid:१८०)या न(cid:५३५)दणीसाठी, कलम ७८ अ(cid:१९४)वये तयार के ले(cid:२०२)या व शासकीय अधिसूचना, महसूल विभाग, (cid:२७०). न(cid:५३५)दणी-१५५८/६७७३१-एन, दिनांक १७ जुलै १९६१ (यात यापुढे (cid:१८२)याचा निद(cid:५१५)श, "उ(cid:१७५)त अधिसूचना" असा के ला आहे) अ(cid:१९४)वये (cid:२९०)सि(cid:४५७) के ले(cid:२०२)या शु(cid:२०२)का(cid:१८०)या त(cid:१७५)(cid:१९०)यात पुढील(cid:२९०)माणे सुधारणा करीत आहे आणि उ(cid:१७५)त अधिनियमा(cid:१८०)या कलम ७९ (cid:४६२)ारे आव(cid:२०४)यक अस(cid:२०२)या(cid:२९०)माणे ते (cid:२९०)सि(cid:४५७) करीत आहे :–
उ(cid:१७५)त अधिसूचनेम(cid:१९३)ये, फी (cid:१८०)या त(cid:१७५)(cid:१९०)यामधील,
(एक) अनु(cid:१८०)छेद एक म(cid:१९३)ये, –
(क) खंड (२) मधील, " गहाणखत (खालील टीप १ व २ पहा)" हा मजकू र वगळ(cid:१८९)यात येईल ;
(ख) खंड (४) नंतर, पुढील खंड जादा दाखल कर(cid:१८९)यात येईल :–
"(५) गहाणखता(cid:१८०)या (खालील टीप १ व २ पहा) व उ(cid:१७५)त अधिनियमा(cid:१८०)या कलम ८९ख अ(cid:१९४)वये मालकी ह(cid:१७५)क विलेख नि(cid:१६९)ेपित क(cid:४७२)न दिले(cid:२०२)या गहाणखता(cid:१८०)या सूचने(cid:१८०)या बाबतीत, न(cid:५३५)दणी शु(cid:२०२)क, कमाल पंधरा हजार (cid:४७१)पयांस अधीन राहू न, अशा संलेखा(cid:४६२)ारे (cid:२९०)तिभूत के ले(cid:२०२)या रकमे(cid:१८०)या ०.५ ट(cid:१७५)के दराने, आकार(cid:१८९)यात येईल.";

भाग चार -अ-९४–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, जून १५, २०२१/ज्येष्ठ २५, शके १९४३ (ग) टीप ६७ नंतर, पुढील टीप जादा दाखल कर(cid:१८९)यात येईल :–
" टीप ६८.– जे(cid:२०३)हा उ(cid:१७५)त अधिनियमा(cid:१८०)या कलम ८९क म(cid:१९३)ये विनि(cid:५२४)द(cid:२०५)ट के ले(cid:२०२)या (cid:१९४)यायालयाकडून (cid:५२३)कवा अधिका(cid:२०१)यांकडून (cid:२९०)ा(cid:१९५)त झाली असेल ते(cid:२०३)हा, (cid:१९४)यायालया(cid:१८०)या हु कू मना(cid:१९९)यां(cid:१८०)या (cid:५२३)कवा आदेशां(cid:१८०)या (cid:५२३)कवा उ(cid:१७५)त अधिनियमा(cid:१८०)या कलम ८९क म(cid:१९३)ये विनि(cid:५२४)द(cid:२०५)ट के लेले कोण(cid:१९०)याही (cid:२९०)कारचे द(cid:२०६)तऐवज (cid:५२३)कवा संलेख यां(cid:१८०)या (cid:२९०)ती, दाखल के (cid:२०२)यावर, कोणतेही शु(cid:२०२)क, आकार(cid:१८९)यायो(cid:१७७)य असणार नाही.";
(दोन) अनु(cid:१८०)छेद दहा क (आ(cid:५२४)टकल ए(cid:१७५)स ए) वगळ(cid:१८९)यात येईल.

NOTIFICATION
REGISTRATION ACT, 1908.
No. RGN-2019/1561/C.R.No.417/M-1(Dhoran).– In exercise of the powers conferred by clause (a) of section 78 of the Registration Act, 1908 (XVI of 1908), in its application to the State of Maharashtra, and of all other powers enabling it in that behalf, the Government of Maharashtra hereby, amends the Table of Fees prepared under section 78 and published under the Government Notification, Revenue Department, No. RGN-1558/67731-N, dated the 17th July 1961 (hereinafter referred to as the "said Notification"), for registration of instruments and publishes the same as required by section 79 of the said Act, as follows, namely :–
In the said Notification, in Table of Fees.
(i) in Article 1,–
(a) in clause (2), the words, brackets and figures "Mortgage (See Notes 1 and 2 below)" shall be deleted ;
(b) after clause (4), the following shall be added, namely :–
"(5) The registration fees in case of mortgage (See Notes 1 and 2 below) and notice of intimation of mortgage by depositing title deeds under section 89B of the said Act shall be levied at the rate of 0.5 per cent. of the amount secured by such instrument, subject to maximum of fifteen thousand rupees.";
(c) after Note 67, the following note shall be added, namely :–
"Note 68.– No registration fees shall be chargeable on filing of any copies of court decrees or orders or any type of document or instrument specified in section 89A of the said Act when received from the Court or the officers specified in the said section 89A.";
(ii) Article XA shall be deleted.
