भारताचे संविधान .
क्रमांक सेप्रनि. २०१८/ प्र.क्र .१६ ( भाग -१ ) / २०१८/ जल -२ . भारताच्या संविधानाच्या अनुच्छेद ३० ९ च्या परंतुकाद्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून आणि अस्तित्वात असलेले सर्व विद्यमान नियम , आदेश किंवा अनुदेश अधिक्रमीत करून , महाराष्ट्राचे राज्यपाल याद्वारे , महाराष्ट्र शासनाच्या मृद व जलसंधारण विभागाच्या प्रशासकीय नियंत्रणाखालील , महाराष्ट्र अभियांत्रिकी सेवा मधील " उप विभागीय जलसंधारण अधिकारी , (स्थापत्य) गट-" अ " व अन्य तत्सम पदे , जलसंधारण अधिकारी , (स्थापत्य) गट- " ब " ( राजपत्रित) " या पदाच्या सेवा प्रवेश नियमाचे विनियमन करण्यासाठी पुढील नियम करीत आहेत , ते असे :-
१. या नियमांना मृद व जलसंधारण विभागातील महाराष्ट्र अभियांत्रिकी सेवा , मधील " उप विभागीय जलसंधारण अधिकारी , (स्थापत्य) गट- " अ " व अन्य तत्सम पदे , जलसंधारण अधिकारी , (स्थापत्य) गट " ब " (राजपत्रित) " पदांचे सेवा प्रवेश नियम , २०२१ असे संबोधण्यात येईल .
२. या नियमात संदर्भानुसार दुसरा अर्थ अपेक्षित नसेल तर , -
(क) " शासन" याचा अर्थ महाराष्ट्र शासन ;
(ख) " आयोग" याचा अर्थ महाराष्ट्र लोकसेवा आयोग ;
(ग) " विभाग " याचा अर्थ मृद व जलसंधारण विभाग ;
(घ) "आयुक्त" याचा अर्थ आयुक्त, मृद व जलसंधारण , महाराष्ट्र राज्य ;
भाग चार-अ- ९९ --१
(१) २
महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, जून २४ , २०२१ / आषाढ ३ , शके १ ९ ४३
(च) "आयुक्तालय " याचा अर्थ आयुक्तालय , मृद व जलसंधारण , महाराष्ट्र राज्य ;
(छ) " स्थापत्य अभियांत्रिकी पदवी " याचा अर्थ स्थापत्य अभियांत्रिकी मधील पदवी अथवा सक्षम प्राधिकरणाने घोषीत केलेली अन्य समकक्ष अर्हता ;
(ज) " स्थापत्य अभियांत्रिकी पदवीका" याचा अर्थ स्थापत्य अभियांत्रिकी मधील पदवीका अथवा सक्षम प्राधिकरणाने घोषीत केलेली अन्य समकक्ष अर्हता ;
(झ) " उप विभागीय जलसंधारण अधिकारी , (स्थापत्य) गट - अ व अन्य तत्सम पदे " याचा अर्थ उप विभागीय जलसंधारण अधिकारी /सहायक आयुक्त ( जलसंधारण) / सहायक आयुक्त दक्षता व गुणनियंत्रण (जलसंधारण)/ सहायक प्रादेशिक जलसंधारण अधिकारी / सहायक गुणनियंत्रण अधिकारी (जलसंधारण) / सहायक जिल्हा जलसंधारण अधिकारी / उप विभागीय जलसंधारण अधिकारी , जिल्हा परिषद (लघु पाटबंधारे) ;
(ञ) " जलसंधारण अधिकारी गट (ब) (राजपत्रित ) " याचा अर्थ विभागाच्या अधिपत्याखालील राज्यस्तर यंत्रणेतील व जिल्हा परिषद यंत्रणेतील " जलसंधारण अधिकारी गट- ब (राजपत्रित) " होय ;
(ट) "जलसंधारण अधिकारी गट (ब) (अराजपत्रित) " याचा अर्थ विभागाच्या अधिपत्याखालील राज्यस्तर यंत्रणेतील व जिल्हा परिषद यंत्रणेतील " जलसंधारण अधिकारी गट - ब (अराजपत्रित) " होय ;
३. महाराष्ट्र अभियांत्रिकी सेवा , गट- " अ " मधील " उप विभागीय जलसंधारण अधिकारी , (स्थापत्य) व अन्य तत्सम पदे" या पदावरील नियुक्ती,-
(अ) जलसंपदा विभागामधून मृद व जलसंधारण विभागाकडे विकल्पाद्वारे आलेल्या तसेच विभागाच्या अधिपत्याखालील जिल्हा परिषद यंत्रणेतील सहायक अभियंता , श्रेणी-२ व शाखा अभियंता हे पद धारण करणाऱ्या व सदर पदावर तीन वर्षांपेक्षा कमी नाही इतकी नियमित सेवा केलेल्या व्यक्तीमधून ज्येष्ठता अधीन पात्रता या निकषावर खाली नमूद केलेल्या प्रमाणात योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल.
सहायक अभियंता , श्रेणी-२ - ५० टक्के
शाखा अभियंता
- ५० टक्के
परंतु असे की, विहित केलेल्या प्रमाणानुसार एखाद्या संवर्गात पात्र अधिकारी उपलब्ध न झाल्यास , सदर पदांवर दुसऱ्या संवर्गातून पदोन्नतीने नियुक्ती करण्यात येईल .
परंतु आणखी असे की, सहायक अभियंता , श्रेणी -२ व शाखा अभियंता या संवर्गातील अधिकारी " उप विभागीय जलसंधारण अधिकारी , ( स्थापत्य) व अन्य तत्सम पदे " या संवर्गात पदोन्नत झाल्यानंतर अथवा त्या संवर्गात पात्र अधिकारी उपलब्ध होत नसल्यास , या नियमाच्या नियम (ब) मध्ये विहित तरतुदीनुसार पदोन्नतीने नियुक्ती करण्यात येईल ;
किंवा
(ब) " जलसंधारण अधिकारी , (स्थापत्य) गट- ब (राजपत्रित) " हे पद धारण करणाऱ्या व त्या पदावर ३ वर्षांपेक्षा कमी नसेल इतकी नियमित सेवा झालेल्या व्यक्तीमधून ज्येष्ठता अधीन पात्रता या निकषावर योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल ;
किंवा
(क) महाराष्ट्र लोकसेवा आयोगामार्फत महाराष्ट्र अभियांत्रिकी सेवा ( सार्वजनिक बांधकाम विभाग व पाटबंधारे विभाग ) गट - अ करिता घेण्यात येणाऱ्या संयुक्त स्पर्धा परिक्षेद्वारे पुढील अटी पूर्ण करणाऱ्या व्यक्तीमधून नामनिर्देशनाने नियुक्ती करण्यात येईल : -
(एक) एकोणीस वर्षापेक्षा कमी वय नसलेल्या आणि खुल्या वर्गातील व्यक्तींसाठी अडतीस वर्षांपेक्षा जास्त वय नसलेल्या आणि मागासवर्गीय व्यक्तींसाठी त्रेचाळीस वर्षापेक्षा जास्त वय नसलेल्या; आणि
(दोन) ज्यांनी स्थापत्य अभियांत्रिकी पदवी धारण केली आहे .

४. महाराष्ट्र अभियांत्रिकी सेवा , गट- " ब " (राजपत्रित) मधील जलसंधारण अधिकारी , (स्थापत्य) या पदावरील नियुक्ती ,- (अ) विभागाकडे विकल्प दिलेले जलसंपदा विभागाकडील कनिष्ठ अभियंते तसेच विभागाच्या अधिपत्याखालील जिल्हा परिषद यंत्रणेतील कनिष्ठ अभियंते यांना पुढील तक्त्यामध्ये ठरवून दिलेल्या निकषांनुसार जलसंधारण अधिकारी गट- ब (राजपत्रीत) या पदावर दर्जोन्नती देण्यात येईल ;
अ.क्र .
गट -ब (अराजपत्रित) पदावरून गट- ब (राजपत्रित) पदावर दर्जोन्नती मिळण्यासाठी आवश्यक सेवाकाळ (३)

मृद व जलसंधारण विभागाकडे समावेशन झालेले अभियंते तसेच जिल्हा परिषद (लघु पाटबंधारे) विभागातील अभियंते (२)
१ .
५ वर्षे
ज्यांनी ३ वर्षाची पदविका व त्याहून उच्च अर्हता धारण केलेले सरळसेवाप्रविष्ट कनिष्ठ अभियंते .
७ वर्षे
२.
ज्यांनी २ वर्षाची पदविका किंवा तत्सम अर्हता धारण केलेले सरळसेवाप्रविष्ट कनिष्ठ अभियंते
१० वर्षे
३.
स्थापत्य अभियांत्रिकी सहायक /मंडळ जलसंधारण अधिकारी पदावरून कनिष्ठ अभियंता पदावर पदोन्नतीने कार्यरत असलेले , परंतु वरील अ.क्र.१ व २ येथे नमून अर्हता धारण करित नसलेले कनिष्ठ अभियंते .
परंतु आणखी असेही की, वरील तक्त्यामध्ये दर्शविण्यात आल्याप्रमाणे या संवर्गात पात्रतेनुसार संबंधित कनिष्ठ अभियंते दर्जोन्नत झाल्यानंतर अथवा दर्जोन्नतीद्वारे संबंधित पात्र अधिकारी उपलब्ध न झाल्यास या नियमाच्या नियम " ब " मध्ये विहीत तरतूदीनुसार पदोन्नतीने नियुक्ती करण्यात येईल .
किंवा
(ब) आयुक्तालयाच्या अधिपत्याखालील , जलसंधारण अधिकारी गट- ब , (अराजपत्रित) हे पद धारण करणाऱ्या व त्यापदावर तीन वर्षांपेक्षा कमी नसेल इतकी नियमित सेवा झालेल्या व्यक्तींमधून जेष्ठता अधीन पात्रता या निकषावर योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल .
किंवा
(क) महाराष्ट्र लोकसेवा आयोगामार्फत महाराष्ट्र अभियांत्रिकी सेवा (सार्वजनिक बांधकाम विभाग व पाटबंधारे विभाग) करिता घेण्यात येणाऱ्या संयुक्त स्पर्धा परिक्षेद्वारे पुढील अटी पूर्ण करणाऱ्या व्यक्तीमधून नामनिर्देशनाने नियुक्ती करण्यात येईल : -
(१ ) ज्याचे वय एकोणीस वर्षांपेक्षा कमी नाही व अडतीस वर्षापेक्षा जास्त नाही ;
परंतु असे की, मागासवर्गीय उमेदवारांच्या बाबतीत उच्च वयोमर्यादा पाच वर्षे शिथिलक्षम राहील ;
(२) ज्यांनी स्थापत्य अभियांत्रिकी पदवी धारण केलेली आहे;
४. नियम ३ (ब) , ३ (क) , ४ (ब) व ४ (क) येथील पदोन्नतीने व नामनिर्देशनाने करावयाची नियुक्ती अनुक्रमे ७५ : २५ या प्रमाणात करण्यात येईल .

५. नियम ३ व ४ येथे नमूद केलेल्या पदावर नामनिर्देशाद्वारे नियुक्ती करण्यात आलेली व्यक्ती दोन वर्षांच्या कालावधीसाठी परिविक्षाधीन राहील . सदर परिवीक्षा कालावधी कमाल एक वर्ष वाढविता येईल. सदर व्यक्ती परिविक्षाधीन कालावधी समाधानकारकरित्या पूर्ण करील व या कालावधीत शासनाकडून त्याबाबतीत विहित करण्यात येईल असे प्रशिक्षण घेईल व विहित केलेली विभागीय परीक्षा उत्तीर्ण होईल , जर सदर व्यक्तीने परिविक्षाधीन कालावधी समाधानकारकरित्या पूर्ण केला नाही किंवा विभागीय परिक्षा उत्तीर्ण केली नाही किंवा प्रशिक्षण पूर्ण केले नाही किंवा काम करण्यासाठी सुयोग्य आढळून आली नाही तर अशा व्यक्तीच्या सेवा पूर्व सूचनेशिवाय समाप्त करण्यात येतील.
७. नियम ३ व ४ येथे नमूद पदावर नियुक्त झालेल्या व्यक्तीने , याबाबतीत करण्यात आलेल्या नियमानुसार, हिंदी व मराठी भाषा परीक्षा , अगोदरच उत्तीर्ण केलेल्या नसतील किंवा त्या परीक्षा उत्तीर्ण होण्यापासून तिला सूट मिळालेली नसेल , तर तिला सदर परीक्षा उत्तीर्ण करणे आवश्यक राहील .
८. नियम ३ व ४ येथे नमूद पदावर नियुक्ती झालेल्या व्यक्तीने महाराष्ट्र शासनाच्या माहिती व तंत्रज्ञान संचालनालयाने वेळोवेळी विहित केलेले संगणक संचलन प्रमाणपत्र धारण करणे आवश्यक राहील.
९ . नियम ३ व ४ येथे नमूद केलेल्या पदावर नियुक्ती झालेली व्यक्ती महाराष्ट्र राज्यामध्ये कोठेही बदलीस पात्र असेल .

CONSTITUTION OF INDIA .
No.RR - 2018/ C.R.16 (PART - 1)/2018/Jal-2.- In exercise of the powers conferred by the proviso to article 309 of the Constitution of India , and in supersession of all the existing rules , orders or instruments issued in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating the recruitment to the post of Sub - Divisional Water Conservation Officer ( Civil) , Group - A and other equivalent posts , Water Conservation Officer ( Civil ) , Group-B (Gazetted) in the Maharashtra Engineering Services , under the administrative control of the Soil and Water Conservation Department of Government of Maharashtra , namely :-
1. These rules may be called the Sub - Divisional Water Conservation Officer ( Civil ) , Group -A and other equivalent posts , Water Conservation Officer ( Civil ) , Group -B ( Gazetted) in the Maharashtra Engineering Services ( Recruitment ) Rules , 2021 .
2. In these rules unless the context otherwise requires ,-
(a) " Civil Engineering Degree " means Degree in Civil Engineering of a statutory University or any other equivalent qualification recognised by the competent authority;
(b) " Civil Engineering Diploma " means Diploma in Civil Engineering of a statutory University or any other equivalent qualification recognised by the competent authority ;
(c) " Commission " means Maharashtra Public Service Commission ;
(d) " Commissioner" means Commissioner , Soil and Water Conservation , Maharashtra State ;
(e) " Commissionerate " means Commissionerate , Soil and Water Conservation , Maharashtra State ;
(f) "Department" means Soil and Water Conservation Department , Government of Maharashtra ;
(g) "Government" means the Government of Maharashtra ;
(h) " Sub - Divisional Water Conservation Officer ( Civil ) and other equivalent posts " means Sub - Divisional Water Conservation Officer ( Civil ) , or Assistant Commissioner , ( Water Conservation ) , Assistant Commissioner , Vigilance and Quality Control ( Water Conservation) or Assistant Regional Water Conservation Officer or Assistant Quality Control Officer ( Water Conservation) and Assistant District Water Conservation Officer or Deputy Divisional Water Conservation Officer , Zilla Parishad ( Minor Irrigation ) ;
(i) "Water Conservation Officer ( Civil) , Group - B " ( Gazetted ) means "Water Conservation Officer , Group- B ( Gazetted ) of State and Zilla Parishad level under the Department;
(j) "Water Conservation Officer ( Civil ) , Group- B " ( Non - Gazetted ) means "Water Conservation Officer , Group- B ( Non- Gazetted ) of State and Zilla Parishad level under the Department .

3. Appointment to the post of " Sub - Divisional Water Conservation Officer , ( Civil ) Group -A and other equivalent posts " in the Maharashtra Engineering Service , Group - A shall be made ,- (a) by promotion in specified proportion as mentioned below on the basis of seniority subject to fitness from the amongst the officers of Water Resources Department those who have given their options to the Department and the officers in Zilla Parishad Cadre who have completed not less than three years regular service on that post : -
50 %
1. Assistant Engineer Grade - II
50% :
2. Sectional Engineer
Provided that , if the suitable person is not available as per specified proportion from Assistant Engineer , Grade - II cadre then , these all remaining posts may be filled by promotion from Sectional Engineer cadre and vice versa :
Provided further that , if suitable persons are not available in above mentioned two cadres , the promotion to the said post shall be made as per clause (b) ; or
(b) by promotion on the basis of seniority subject to fitness from amongst the persons holding the post of Water Conservation Officer ( Civil ) , Group - B ( Gazetted ) under the Commissionerate and have completed not less than three years of regular service on that post; or
(c) by nomination from combined competitive examination held by the commission for recruitment of engineers in the Maharashtra Engineering Service , Group -A ( PWD and Irrigation Department ) from amongst the candidates who ,-
(i) are not less than nineteen years of age and not more than thirty -eight years of age :
Provided that , the upper age limit may be relaxed upto five years in case of a candidate belonging to Backward Class Category:
(ii) possesses a Degree in Civil Engineering .
4. Appointment to the post of "Water Conservation Officer , ( Civil) in the Maharashtra Engineering Service , Group- " B " ( Gazetted) , -
( a) shall be made by promotion after upgradation from amongst the Junior Engineers from Water Resources Department , who have given their options to the Department and those who are working in the Zilla Parishad, Minor Irrigation , as per the criteria mentioned in the Table below :-

10 years Appointed to post of Civil Engineer ( Assistant ) and Circle Officer , Water Conservation , and promoted as Junior Engineer and those does not qualified as mentioned above at serial numbers 1 and 2 .

Provided that , after promotion after upgradation of all Junior Engineers as mentioned in the Table , promotion shall be made as per clause (b ) ; or
(b) by promotion on the basis of seniority subject to fitness from amongst the persons holding the post of Water Conservation Officer Group - B ( Non- Gazetted ) under the Commissionerate and have completed not less than three years regular service on that said post; or
(c) by nomination from combined competitive examination held by the Commission for recruitment of engineers in the Maharashtra Engineering Service , Group -A ( PWD and Irrigation Department ) from amongst the candidates who ,-
(i) are not less than nineteen years of age and not more than thirty - eight years of age :
Provided that , the upper age limit may be relaxed upto five years in case of candidates belongs to Backward Class Category;
(ii) possess a Degree in Civil Engineering ;
5. A person appointed to post mentioned in clauses ( b ) and ( c) of rule 3 and in clauses (b) and (c) of rule 4, by promotion and nomination shall be made in the ratio of 75 : 25 , respectively .
6. A person appointed by nomination to the post mentioned in clause ( c) of rule 3 and clause ( c) of rule 4 , shall be on probation for a period of two years and it shall be extended upto one year if required and during the probation period , he shall undergo such training and pass such Departmental examination as may be prescribed by the Government in that behalf and if concerned person does not complete probation period satisfactorily or who fails Departmental examination or does not attend respective training or not found able to work shall be liable to be terminated from Government Service .
7. A person appointed to any post of the mentioned in rules 3 and 4 shall be required to pass examinations in Hindi and Marathi according to rules made in that behalf unless he has already passed or has been exempted from passing those examinations .
8. A person appointed to the post mentioned in rules 3 and 4 shall possess a Certificate in Computer Operation prescribed by the Directorate of Information and Technology , Government of Maharashtra , from time to time.
9. A person appointed to any of the posts mentioned in rules 3 and 4 shall be liable for transfer anywhere in the State of Maharashtra .
