अधिसूचना
महाराष्ट्र ठेवीदारांच्या (वित्तीय संस्थामधील) हितसंबंधाचे संरक्षण अधिनियम, १९९९.
क्रमांक एमपीआय-४०२१ /प्र.क्र.११०/पोल-१२.–ज्याअर्थी, व्यंकटेश ग्रामीण बिगरशेती सहकारी पतसंस्था मर्या. सोनई, ता. नेवासा जि. अहमदनगर (यात यापुढे "उक्त वित्तीय संस्था" असा निर्देश करण्यात आला आहे) आणि या वित्तीय संस्थेचे संचालक, व्यवस्थापक व कर्मचारी यांनी ठेवीदारांकडून स्वीकारलेल्या ठेवी मुदतपूर्तीनंतर परत करण्यास कसूर केली आहे, अशा तक्रारी त्यांच्यांविरुद्ध बहुतांश ठेवीदारांकडून प्राप्त झालेल्या आहेत ;
आणि ज्याअर्थी, आरोपिंविरुद्ध, सोनई पोलीस स्टेशन, ता. नेवासा, जि. अहमदनगर, गु.र.नं.११/२०१८, भा.दं.वि. च्या कलम ४०६, ४२०, ४६७, ४६८, ४७१, १२० (ब) आणि महाराष्ट्र ठेवीदारांच्या (वित्तीय संस्थामधील) हितसंबंधी संरक्षण अधिनियम, १९९९ चे कलम ३, नुसार गुन्हा दाखल करण्यात आला आहे तसेच सोनई पोलीस स्टेशन, ता. नेवासा, जि. अहमदनगर, गु.र.नं.१५३/२०१८, भा.दं.वि. च्या कलम ४०६, ४२०, ४६७, ४६८, ४७१, १२० (ब) आणि महाराष्ट्र ठेवीदारांच्या (वित्तीय संस्थामधील) हितसंबंधी संरक्षण अधिनियम, १९९९ चे कलम ३, नुसार गुन्हा दाखल करण्यात आला आहे ;
आणि ज्याअर्थी, राज्य शासनाची अशी खात्री झाली आहे की, उक्त वित्तीय संस्था आणि त्यांचे संचालक ठेवीदारांना त्यांच्या ठेवी परत करण्याची शक्यता नाही म्हणून राज्य शासनाला अशा ठेवीदारांच्या हितसंबंधाचे रक्षण करावे लागेल ;

(१)
२ महाराष्ट्र शासन राजपत्र भाग असाधारण चार-ब, जून २४, २०२१/आषाढ ३, शके १९४३आणि ज्याअर्थी, यासोबत जोडलेल्या अनुसूचीत विर्िनदिष्ट केलेली मालमत्ता उक्त वित्तीय संस्थेकडून आणि त्यांच्या संचालकाकडून त्याचप्रमाणे उक्त वित्तीय संस्थेकडून गोळा केलेल्या ठेवींमधून संपादित करण्यात आलेली आहे असे अभिकथित आहे ;
त्याअर्थी आता, महाराष्ट्र ठेवीदारांच्या (वित्तीय संस्थामधील) हितसंबंधी संरक्षण अधिनियम, १९९९ (२००० चा महा.१६) (यात यापुढे ज्याचा "उक्त अधिनियम" असा निर्देश करण्यात आला आहे) याच्या कलम ४ चे पोट-कलम (१) व कलम ५ व कलम ८ याद्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून महाराष्ट्र शासन याद्वारे,–
(अ) अनुसूचीत विर्िनदिष्ट केल्याप्रमाणे, उक्त वित्तीय संस्थेची आणि त्यांचे संचालक, व्यवस्थापक व कर्मचारी यांच्या नावे असलेली मालमत्ता जप्त करीत आहे, आणि
(ब) उक्त वित्तीय आस्थापना आणि त्यांचे संचालक, व्यवस्थापक व कर्मचारी आणि त्यांचे कुटुंबीय /
नातेवाईक यांच्या जप्त केलेल्या मालमत्तेवर नियंत्रण ठेवण्यासाठी उप विभागीय दंडाधिकारी, अहमदनगर यांची
सक्षम प्राधिकारी म्हणून नियुक्ती करीत आहे.
उक्त अधिनियमान्वये नियुक्त करण्यात आलेल्या पदनिर्देशित न्यायालयातील सरकारी अभियोा न्यायालयात अर्ज दाखल करताना सक्षम प्राधिकायास आवश्यक ते सहाय्य करतील.

NOTIFICATION
MAHARASHTRA PROTECTION OF INTEREST OF DEPOSITORS (IN FINANCIAL ESTABLISHMENT) ACT, 1999.
No. MPI-4021/CR. 110 /Pol-12.– Whereas, complaints have been received from number of depositors against Vyankatesh Gramin Bigarsheti Sahkari Patsanstha Maryadit Sonai, Taluka- Nevasa, Dist. Ahmednagar (hereinafter referred to "as the said Financial Establishment" and so also Directors, Manager and Emplyees of the said financial establishment complaining that they have defaulted to return the said deposits made by the depositors after maturity ;
And whereas, an offence has been registered against the accused at Sonai Police Station, Taluka-Nevasa, Dist Ahmednagar Vide CR No.11/2018, under Indian Penal Code sections 406, 420,467, 468,471,120 (B), R/w sec. 3 of MPID Act, 1999, along with another offence has been registered against the accused at Sonai Police Station, Taluka-Nevasa, Dist. Ahmednagar Vide CR No.153/2018 under Indian Penal Code sections 406, 420,467, 468,471,120 (B) read with section 3 of MPID Act, 1999 ;
And whereas, the State Government is satisfied that the said Financial Establishment and its Directors are not likely to return the deposits to the depositors and hence the Government has to protect the interest of depositors ;
And whereas, the properties specified in the Scheduled appended hereto are alleged to have been acquired by the said Financial Establishment and its Directors from and out of the deposits collected by the said Financial Establishment ;
Now, therefore in exercise of the powers conferred by sub-section (1) of Section 4, Sub- section (1) of Section 5 and Section 8 of the Maharashtra Protection of Interest of Depositors (in Financial Establishment) Act, 1999, (Mah. XVI of 2000) (hereinafter referred to as the said Act) the Government of Maharashtra hereby:—
(a) attaches the properties of the said Financial Establishment and properties in the name of its Directors, Manager, Employees and their relatives as specified in the Schedule ; and
(b) appoints the Sub Divisional Officer, Magistrate Dist. Ahmadnagar to be
the Competent Authority to exercise control over the properties attached of the Financial Establishment and its Directors, Manager, Employees and their relatives.
The Public Prosecutor in designated Court appointed under the said Act shall render necessary assistance to the Competent Authority in filing the application before the Special Court.
