BY COMMISSIONER, MUNICIPAL CORPORATION
Modification under Section 37 of Maharashtra Regional And Town Planning Act, 1966.
No. NMC-TPD-451-2021.—
Whereas, the Revised Development Plan of Nagpur City prepared under the provisions of Maharashtra Regional and Town Planning Act, 1966, Section 31 (1) has been partially sanctioned by the Govt vide Urban Development Department Notification No. TPS-2496-2643-CR-300(a)-97-UD-9, dated 7th January 2000 and came into force from 1st March 2000. Excluded part of Development Plan has been sanctioned vide Govt. Notification No. TPS-2400-1628-CR-200-2000-UD-9, dated 10th September 2001 and came into force from dated 21st September 2001. Also Nagpur Municipal Corporation has been declared as the "Planning Authority" for Nagpur City except the area covered under seven schemes vide Govt. Notification No. TPS-2401-855-CR-76-UD-9, dated 27th February 2002.
However, as per the Government Notification No. TPS-2419-1419-CR No.154-2019-UD-9 dated 27th August 2019 under the Nagpur Improvement Trust Jurisdiction the planning of the seven schemes underद्धन्रु]क्ष् रू न् +रून् ॅ-+ न् ह्यम््र ान्म््र, क्ष् २६, २०२१/+रु ५, ॅ १९४३ ३ Nagpur Municipal Corporation has also been declared by the Government but as per the Govt. Notification No. TPS-2419-1419-CR No.154, (Bhag-1)-2019-CR-9, dated 9th April 2021 so the power has been given to implement seven projects under Nagpur Municipal Corporation and Nagpur Improvement Trust.
Within the limit of Nagpur Municipal Corporation since long there is no any clear cut policy about regularization of the encroachments to the encroachers on private lands, for issuing them the possession letters to the slum dwellers since much long time within the Nagpur Municipal Corporation limits, in regard with these lands there is no any implementation by the authorities. As a result of this the benefit of "House for Dishouse" Central Govt. scheme could not be given to the relevant encroachers.
Whereas, in view of implementation of said policy in Nagpur Municipal Corporation's jurisdiction by regularizing the private land which falls under "Notified Slum"for the existing encroachment of slum en- croachers and as per Govt. Resolution No. NMP-2019-CR. 34-UD-26, dated 11th September 2019 Nagpur Municipal Corporation has decided to modify the private and mix used lands for the purpose of "House for Dishouse"or (Public Housing) as per Section 37 of MRTP Act, 1966 and for this Nagpur Municipal Corpo- ration has passed the Resolution No. 33, dated 20th January 2021 to make the aforesaid modification.
As mentioned in the said Government Resolution, and slum encroachment situated on such private lands and in order to grant strips /patta to such slum encroachers in respect of slum situated on private land strips /patta are required to be allotted on such lands as per sanctioned Revised Development Scheme Plan of Nagpur City for private and mix used lands for slum dwellers "House for Dishoused" and (Public Housing) proceedings already commenced for such modifications in respect of Reservation for this pur- pose and on the basis of said sanction proposal, it has been informed by Nagpur Municipal Corporation that proceeding is required to be started for issuance of TDR to the land owners as per UDCPR, and acquisition of land initiated relating to encroachment made by slum dwellers on private lands.
There is huge number of encroachment of slum on private lands within the limits of Nagpur City, therefore, it is necessary to inspect their land ownership as per all Law relating to Land/Rules/Government Regulations, and after satisfaction, as well as taking into consideration regarding all kinds of proceedings/ cases filed in the court of law and considering the factual position, therefore, to take proceedings on received application for change in record in respect of ownership right, after obtaining the approval from Nagpur Municipal Corporation after verifying such encroachment and ownership documents only on such private and mix used lands which are Reserved for the Govt. scheme of "House for Dishoused"and (Public Housing) The Nagpur Municipal Corporation has passed a Resolution No. 33, on dated 20th January, 2021 to make the aforesaid modification as per Section 37 of the Maharashtra Regional and Town Planning Act, 1966.
The part Development Plan of Nagpur City showing the aforesaid modifications are kept open at the office of theTown Planning Department of Nagpur Municipal Corporation for inspection by public during office hours on all working days, the suggestions and objections which may be received to Municipal Corporation in respect of the said modification to the Development Plan within a period of one month from the date of publication of this notice, will be heard by the Municipal Commissioner, before submitting the said modification proposal, to the State Government for sanction.
