क्रमांक आयोग-२०२१/प्र.क्र.१३६/मावक.----महाराष्ट्र राज्य मागासवर्ग आयोग अधिनियम, २००५ (२००६ चा महा. ३४) च्या कलम ९ च्या पोट-कलम (१) चे खंड (च) अन्वये प्रदान करण्यात आलेल्या अधिकारांचा वापर करून, महाराष्ट्र शासन याद्वारे, सदर अधिनियमाद्वारे गठीत करण्यात आलेल्या महाराष्ट्र राज्य मागासवर्ग आयोगास, स्थानिक स्वराज्य संस्थांमधील आरक्षणाशी संबंधित विर्िनदिष्ट कामे पार पाडण्यासाठी सर्मपित आयोग म्हणून घोषित करीत असून त्यानुसार मा. सर्वोच्च न्यायालयाने विकास किसनराव गवळी विरुद्ध महाराष्ट्र शासन व इतर या रिट याचिका (सिव्हिल) क्रमांक ९८०/२०१९, मध्ये दिनांक ४ मार्च, २०२१ रोजी दिलेल्या निर्णयातील परिच्छेद क्रमांक १२ विचारात घेऊन या आयोगाकडे खालील कामे/जबाबदाया सोपविण्यात येत आहेत.
कार्यकक्षा
१. सद्य:स्थितीत राज्यातील स्थानिक स्वराज्य संस्थांच्या हद्दीतील मागासवर्गपणाचे स्वरुप आणि परिणाम यांची काटेकोर तपासणी करणे.
२. अभिलेखे, अहवाल, सर्वेक्षण आणि इतर उपलब्ध माहितीच्या आधारे राज्यातील ग्रामीण भागात म्हणजे गाव/तालुका/जिल्हानिहाय तसेच नागरी भागात महानगरपालिका/नगरपालिका/ नगरपरिषदांमध्ये वॉर्डनिहाय मागासवर्गीय लोकसंख्येचे एकूण लोकसंख्येशी असलेले प्रमाण निश्चित करणे.
३. शासनाकडून वेळोवेळी यासंदर्भात निर्देशित करण्यात येणाया इतर प्रकरणांची तपासणी करणे.
४. राज्य शासनास वस्तुस्थिती व निरीक्षणे नोंदवून त्याद्वारे योग्य त्या शिफारशीसह अहवाल सादर करणे.
याशिवाय आयोग ------
(अ) आयोगाच्या मते, त्यांचा हेतू साध्य करण्यासाठी सहाय्यभूत ठरेल अशी माहिती किंवा आकडेवारी, योग्य त्या नमुन्यात आणि स्वरुपात आवश्यक आणि योग्य आहे, असे वाटत असल्यास, ती माहिती केंद्र व राज्य शासनाची कार्यालये, सार्वजनिक उपक्रमे, आस्थापना, विद्यापिठे आणि इतर संस्था किंवा प्राधिकरणे, संघटना किंवा व्यक्तिगत स्वरुपात प्राप्त करून घेईल.

भाग चार--ब--१९६--१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, जून २९, २०२१/आषाढ ८, शके १९४३ (ब) आयोगास, वस्तुनिष्ठ माहितीचे पृथ:करण करण्यासाठी आणि परिणामकारी आणि गुणवत्तापूर्ण कार्यवाही करण्यासाठी, ज्या ज्या वेळी आवश्यक वाटेल, त्या त्या वेळी, तज्ञ किंवा संशोधक यांच्याबरोबर बैठकांद्वारे मार्गदर्शन घेईल तसेच नामांकित संशोधन संस्था यांचे सहाय्य घेईल.
(क) आयोगास, काही माहिती किंवा आकडेवारी किंवा दस्तऐवज किंवा अन्य स्वरुपातील माहिती प्राप्त करून घेणे आवश्यक किंवा सोईस्कर वाटत असल्यास राज्यातील संबंधित भाग/भागांस भेट देईल किंवा उप समिती/उप समित्या किंवा प्रतिनिधी/प्रतिनिधींची नेमणूक करेल.
(ड) आयोगास तपासादरम्यान व्यक्तिगतरीत्या प्राप्त झालेले दावे व पुरावे योग्य वाटल्यास नोंदवून घेईल.

NOTIFICATION
MAHARASHTRA STATE COMMISSION FOR BACKWARD CLASSES ACT, 2005.
No. CBC-2021/C.R.136/BCW.—In exercise of the powers conferred by clause (f) of sub-section (1) of section 9 of the Maharashtra State Commission for Backward Classes Act, 2005 (Mah.
XXXIV of 2006), the Government of Maharashtra hereby declares that, the Maharashtra State Commission for Backward Classes, a Commission constituted under this Act, as a dedicated Commission to perform certain functions relating to reservation in local bodies and for that purpose entrusts the following functions/Terms of reference in view of Paragraph No.12 of the Judgment dated 4th March 2021, delivered by Hon'ble Supreme Court in Writ Petition (Civil) No. 980/2019 filed by Vikas Kisanrao Gavli Vs. State of Maharashtra and Ors.
Terms of reference
1. To conduct contemporaneous rigorous inquiry into nature and implications of the backwardness qua local bodies, within the State.
2. To ascertain proportion of population of Backward Class of Citizens, in rural areas i.e., Village/Taluka/Districtwise and in urban areas i.e., Wardwise in Municipal Corporation/Municipal Council/Nagar Panchayat in the State of Maharashtra, on the basis of records, reports, survey and other available data.
3. To investigate such other matters as the State Government may hereafter refer to the Commission in this context.
4. To submit a report to the State Government by recording the facts and observations and thereby making suitable recommendations.
Further the Commission may –
(a) Obtain such information or statistics as they may consider necessary or relevant for their purpose in such form and manner as they may think appropriate from the Central and State Government Offices, public sector undertakings, establishments, Universities and other institutions and such other authorities, organizations or individuals as may in the opinion of the Commission be of assistance to them.
(b) Avail advice of experts and researchers by holding meetings with them and also get assistance of recognized research institutions as and when felt essential for analysis of the empirical data and also for the efficient and qualitative functioning of the Commission.

(d) Record the evidences and contentions lead by the individuals as and when found necessary during the course of investigation.
