क्रमांक टीपीएस-१८२१/११६७/प्र.क्र. ९८/२०२१/नवि-१३.--ज्याअर्थी, भारतीय संविधानाच्या अनुच्ेद २४३-त मधील खंड-ग आणि महाराष्ट्र नियोजन समिती (रचना व कामे) अधिनियम, १९९९ चे कलम २ (ग) मधील तरतुदीनुसार प्राप्त अधिकारांचा वापर करून महाराष्ट्र शासनाने नगर विकास विभाग अधिसूचना क्रमांक टीपीएस-१८९९/११९१/प्र. क्र. ८०/९९/नवि-१३, दिनांक २३ जुलै १९९९ अन्वये, पुणे शहरासभोवतालचे काही क्षेत्र भारतीय संविधानाच्या भाग-९-अ च्या प्रयोजनार्थ पुणे महानगर प्रदेश म्हणून घोषित केले आहे ;
आणि ज्याअर्थी, महाराष्ट्र शासनाने अधिसूचना क्रमांक टीपीएस-१८१५/१२०४/१३/प्र. क्र. ८७/१५/नवि-१३, दिनांक ३१ मार्च २०१५ अन्वये उक्त अधिनियमाचे कलम ४२-क, ४२-ग व ४२-च अन्वये प्रदान केलेल्या शक्तींचा वापर करून पुणे महानगर क्षेत्रास, पुणे महानगर प्रदेश विकास क्षेत्र म्हणून उक्त अधिनियमाचे कलम ४२-क नुसार घोषित करून कलम ४२-ग नुसार या घोषित क्षेत्रासाठी पुणे महानगर प्रदेश विकास प्राधिकरण (यापुढे ज्याचा उल्लेख उक्त क्षेत्र विकास प्राधिकरण असा करण्यात आला आहे) गठित केले आहे ;
आणि ज्याअर्थी, महाराष्ट्र शासनाने दिनांक ४ डिसेंबर २०१५ रोजीच्या अधिसूचनेद्वारे, पुणे महानगर प्रदेश क्षेत्राची हद्द वाढवून सुधारित हद्दवाढ घोषित केली आहे. तसेच दिनांक १० ेब्रुवारी २०१६ रोजीच्या अधिसूचनेद्वारे, पुणे महानगर प्रदेश क्षेत्राची आणखी हद्द वाढवून सुधारित हद्दवाढ घोषित केली आहे. (यापुढे ज्याचा उल्लेख उक्त महानगर क्षेत्र असा करण्यात आला आहे);
आणि ज्याअर्थी, महाराष्ट्र राज्याचे राज्यपाल यांनी, महाराष्ट्र महानगर नियोजन समिती (रचना व कामे) (तरतुदी पुढे चालू ठेवणे) अधिनियम, १९९९ (सन २००० चा महा. अधि. क्र.५) च्या कलम २ च्या खंड-(क) अन्वये महानगर क्षेत्र म्हणून घोषित केलेल्या विवक्षित क्षेत्रांच्या उचित, सुव्यवस्थित व शीघ विकासाचे समन्वयन व पर्यवेक्षण करण्याच्या आणि अशा विकासाच्या योजना, प्रकल्प व परियोजना यांची अंमलबजावणी करण्याच्या प्रयोजनार्थ, अशा प्रदेशातील क्षेत्राकरिता प्राधिकरणे स्थापन करण्यासाठी आणि त्यांच्याशी संबंधित किंवा तदनुषंगिक बाबीसाठी तरतूद करण्याकरिता महाराष्ट्र महानगर प्रदेश विकास प्राधिकरण अध्यादेश, २०१६ (सन २०१६ चा महा. अध्या. क्र.११) दिनांक १३ जून २०१६ (यापुढे ज्याचा उल्लेख उक्त अध्यादेश असा करण्यात आला आहे) प्रख्यापित केला असून यानंतर तो महाराष्ट्र महानगर प्रदेश विकास प्राधिकरण अधिनियम, २०१६ (सन २०१७ चा महाराष्ट्र अधिनियम क्रमांक ३) मध्ये परिवर्तित झाला आहे ;

एच-८६, भाग एक-असा. (पु.वि.पु.)--- ६२ महाराष्ट्र शासन राजपत्र, भाग एक-असाधारण -- पुणे विभागीय पुरवणी, २७ जुलै २०२१ / श्रावण ५, शके १९४३ आणि ज्याअर्थी, उक्त अध्यादेशाचे कलम ३ चे उप-कलम (१) आणि उक्त अधिनियमाचे कलम ४२-क, ४२-ग, ४२-च अन्वये प्रदान अधिकारांचा वापर करून शासन नगर विकास विभाग अधिसूचना क्रमांक पीआरडी-३३१६/प्र.क्र. ५४/नवि-७, दिनांक ११ जुलै २०१६ अन्वये उक्त महानगर क्षेत्रासाठी, विशेष करून त्या अधिसूचनेसोबत जोडलेल्या अनुसूचीमध्ये नमूद केलेल्या क्षेत्राकरिता, पुणे महानगर प्रदेश विकास प्राधिकरणाची स्थापना करण्यात आली आहे (यापुढे ज्याचा उल्लेख उक्त प्रदेश विकास प्राधिकरण असा करण्यात आला आहे) आणि उपरोक्त दिनांक ३१ मार्च २०१५, दिनांक ४ डिसेंबर २०१५ व दिनांक १० ेब्रुवारी २०१६ रोजीच्या अधिसूचना विखंडित करण्यात आल्या आहेत;
आणि ज्याअर्थी, उक्त महानगर क्षेत्राचा उचित, सुव्यवस्थित विकास होण्यासाठी, उक्त अधिनियमाचे कलम ४० (१) (घ) अन्वये व त्या अनुषंगाने प्राप्त इतर अधिकारांचा वापर करून शासन नगर विकास विभाग अधिसूचना क्रमांक टीपीएस-१८१७/प्र.क्र. १७३/१७/नवि-१३, दिनांक १८ जानेवारी २०१८ अन्वये, त्या अधिसूचनेसोबत जोडलेल्या अनुसूचीमध्ये नमूद केलेले क्षेत्र, पुणे महानगर प्रदेश विकास प्राधिकरणाकरिता अधिसूचित क्षेत्र म्हणून विनिर्दिष्ट करण्यात आले असून या अधिसूचित क्षेत्रासाठी पुणे महानगर प्रदेश विकास प्राधिकरणाची, त्याच्या स्थापनेपासून म्हणजेच दिनांक ३१ मार्च २०१५ पासून विशेष नियोजन प्राधिकरण म्हणून नियुक्ती करण्यात आली आहे ;
आणि ज्याअर्थी, महाराष्ट्र शासनाने नगर विकास विभाग अधिसूचना क्रमांक पीएमसी-२०२०/प्र. क्र. ३२२/नवि-२२, दिनांक ३० जून २०२१ अन्वये, त्यासोबत जोडलेल्या अनुसूची-१ मध्ये नमूद एकूण २३ महसुली गावांचा (यापुढे ज्यांचा उल्लेख उक्त २३ गावे असा करण्यात आला आहे) पुणे महानगरपालिका हद्दीत समावेश करून पुणे महानगरपालिकेची हद्द सुधारित करण्यात आली आहे ;
आणि ज्याअर्थी, उक्त प्रदेश विकास प्राधिकरणाच्या प्रस्तावानुसार, उक्त २३ गावे ही प्रादेशिक योजना क्षेत्रामध्ये समाविष्ट असून, प्रादेशिक योजनेमध्ये दुय्यम स्वरूपाचे रस्ते ( ) प्रस्तावित केलेले नाहीत. जागेच्या उपलब्धतेनुसार रस्ते विकसित झाले असून त्यांची आखणी नियोजनबद्ध नाही व रुंदी आवश्यकतेनुसार कमी आहे. प्रादेशिक योजनेमध्ये विविध सार्वजनिक वापरासाठी आरक्षणे प्रस्तावित न केल्याने सार्वजनिक सोयी-सुविधा विकसित झालेल्या नाहीत. अशा प्रकारे सदर २३ गावांतील क्षेत्र हे अविकसित स्वरूपात असून याठिकाणचा विकास हा योजनाविरहित व अनियंत्रित स्वरूपाचा झाल्याचे दिसून येते ;
आणि ज्याअर्थी, उक्त नमूद वस्तुस्थितीचा विचार करता, पुणे महानगरपालिका हद्दीतील उक्त २३ गावांचे अविकसित क्षेत्र अधिसूचित करून त्याकरिता उक्त प्रदेश विकास प्राधिकरणाची विशेष नियोजन प्राधिकरण म्हणून नियुक्ती करणे आवश्यक असल्याचे शासनाचे मत झाले आहे.
आता त्याअर्थी, उक्त अधिनियमाचे कलम ४० (१) व कलम ४० (१) (घ) अन्वये प्राप्त अधिकारांचा उपयोग करून राज्य शासन याद्वारे असे घोषित करीत आहे की.--
पुणे महानगरपालिका हद्दीतील खालील परिशेष्ट-अ मध्ये नमूद २३ गावांचे अविकसित क्षेत्र अधिसूचित करून त्याकरिता पुणे महानगर प्रदेश विकास प्राधिकरणाची विशेष नियोजन प्राधिकरण म्हणून नियुक्ती करण्यात येत आहे.

Notification
Maharashtra Regional and Town Planning Act, 1966
No. TPS-1821/1167/CR-98/2021/UD-13.––Whereas, in exercise of the powers conferred by Clause (c) of the Article 243-P of the Constitution of India and by Clause (c) of Section 2 of the Maharashtra Metropolitan Planning Committee (Constitution and Functions) Act, 1999, the Government of Maharashtra in Urban Development Department vide Notification No.TPS-1899/1191/CR-80/99/UD-13, dated 23rd July 1999, declared some area around Pune City, as the "Pune Metropolitan Area" for the purpose of Part IX-A of the Constitution of India ;
and whereas, in exercise of the powers conferred by Sections 41-A, 42-C and 42-F of the said Act, the Government of Maharashtra vide Notification No. TPS-1815/1204/13/CR-87/15/UD-13, dated४ महाराष्ट्र शासन राजपत्र, भाग एक-असाधारण -- पुणे विभागीय पुरवणी, २७ जुलै २०२१ / श्रावण ५, शके १९४३ 31st March 2015 declared the Pune Metropolitan Area as a "Pune Metropolitan Region Development Area, under Section 42-A of the said Act and thereof constituted "Pune Metropolitan Area Region Development Authority" (hereinafter referred to as "the said Area Development Authority"), for this declared area ;
and whereas, Government of Maharashtra vide Notification, dated 4th December 2015, has extended the limits and revised the limits of Pune Metroplitan Region Area. Also, vide Notification dated 10th February 2016, Government has further extended the limits and revised the limits of Pune Metropolitan Region Area (hereinafter referred to as "the said Metropolitan Area") ;
and whereas, the Governor of Maharashtra has promulgated the Maharashtra Metropolitan Region Development Authority Ordinance, 2016 (Mah. Ord. XI of 2016) (hereinafter referred to as "the said Ordinance") on 13th June 2016, to provide for establishment of the Authorities for certain areas declared as Metropolitan Areas under Clause (c) of Section 2 of the Maharashtra Metropolitan Planning Committees (Constitute and Functions) (Continuatioin of Provisions) Act, 1999 (Mah. V of 2000), for the purpose of co-ordinating and supervising the proper orderly and rapid development of the said area in such regions and of executing projects and schemes for such development, and to provide for connected therewith or incidental thereto; which is thereafter converted into the Maharashtra Metropolitan Region Development Authority Act, 2016 (Mah. Act 3 of 2017) ;
and whereas, in exercise of the powers conferred by sub-section (1) of Section 3 of the said Ordinance and Section 42-A, 42-C, 42-F, of the said act, vide Government in Urban Development Department Notification No.PRD-3316/CR-54/UD-7, dated 11th July 2016, Pune Metropolitan Region Development Authority has been established for the said Metropolitan Area, more specifically described in the Schedule appended thereto (hereinafter referred to as "the said Region Development Authority") and above mentioned notifications dated 31st March 2015, dated 4th December 2015 and dated 10th February 2016 has been rescinded ;
and whereas, for proper and well planned development of the said Metropolitan Area, in exercise of the powers conferred by Section-40 (1) (d) of the said Act, the Government in Urban Development Department, vide Notification No. TPS-1817/CR-173/17/UD-13, dated 18th January 2018, has specified the area, more specifically described in the Schedule appended thereto, to be the "Notified Area" for Pune Metropolitan Region Development Authority and appointed Pune Metropolitan Region Development Authority as Special Planning Authority for such notified area from the date of its establishment i.e. 31st March 2015 ;
and whereas, the Government of Maharashtra vide Urban Development Department Notification No. PMC-2020/C.R.322/UD-22, dated 30th June 2021 has altered the limits of Pune Municipal Corporation by including the 23 villages (hereinafter referred to as "the said 23 villages") as mentioned in the Schedule-I appended therein ;
and whereas, as per the proposal of the said Region Development Authority, the said 23 villages are included in Regional Plan and no secondary and Collector roads are proposed in the Regional Plan. The roads are developed as per land availability and with no planned alignment also widths are not as per requirement. As reservations for various public purposes are not proposed in the Regional Plan, no public amenities are developed. Thus, area of the said 23 villages is of undeveloped nature and development in this area is unplanned and in uncontrolled manner ;
and whereas, considering the above facts, the Government is of the opinion that, the undeveloped area of the said 23 villages in Pune Municipal Corporation limits should be notified and for this area Pune Metropolitan Region Development Authority should be appointed as a Special Planning Authority ;
Now therefore, in exercise of the powers conferred by Section 40 (1) and Section 40 (1) (d) of the said Act, the Government of Maharashtra hereby declares that.––
"Area of the said 23 villages in the Pune Municipal Corporation Limits, as mentioned in the Appendix - A appended hereto, is notified and Pune Metropolitan Region Development Authority is appointed as the Special Planning Authority for this area.
