ORDER
No. D.T.P.-D.P. Risod(O.L.R.&E.L.)-Sec-127(2)-Order-TPV-6-3076-2021.—
Whereas, the Revised Development Plan of Original limit & Extended limit of Risod Municipal Council has been partly sanctioned under the provisions of Section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government of Maharashtra, Urban Development Department vide its Notification No. TPS-4105-1353-CR-209(A)-2005-UD-30, dated 04th August 2006 (hereinafter referred to as "the said Notification") and the same has came into the force with effect from 01-10- 2006 (hereinafter referred to as "the said Sanctioned Revised Development Plan");
And whereas, in the said Sanctioned Development Plan, the land bearing S. No. 460 (Part) & S. No. 462 (part) of Mouza Risod is reserved for Reservation No. 19 "Garden" admeasuring an are a approximately 1.41 HA. &४ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, ा २९-+रू]क्ष् ४, २०२१/रम् ७-१३, ॅ १९४३ Reservation No. 17 "Library" admeasuring an are a approximately 0.05 HA. (hereinafter referred to as "the said Reservations") & 18.00 mt. wide Development Plan Road on North Side or Reservation No. 17 & 15.00 mt. wide Development Plan Road on North Side of Reservation No. 19 (hereinafter referred to as "the said Road") for which Appropriate Authority is Municipal Council, Risod (hereinafter referred to as "the said Appropriate Authority");
And whereas, the land under said Reservation & said Roads have not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan came into force;
And whereas, the Land Owners Shri Jagnnathappa Kashinathappa Jirvankar & Shri Madhavrao Narayanrao Gunge (hereinafter referred to as "the said Land Owners") of the lands under the said reservations & said Roads in respect of an area admeasuring 2.00 HA. & 0.82 HA. of S.No.462 (Part) & S.No.460 (Part) respectively (hereinaf- ter referred to as "the said Lands") of Mouza Risod, had served a Notice under Section 127 (1) of the said Act, (hereinafter referred to as "the said Notice") on the said Appropriate Authority on dated 30-12-2016, which was received by the said Appropriate Authority on 31-12-2016 ;
And whereas, the part area of the said lands under the said reservations & the said roads are not acquired or no steps for acquisition of the part area of the said lands under the said reservations & the said roads as required under Section 127 (1) of the said Act has been taken by the Appropriate Authority, within a stipulated period from the date of service of the said notice under Section 127 (1) of said Act, by the said Appropriate Authority;
And whereas, the Chif Officer, Municipal Council, Risod vide letter No. 71/2020, dt. 28-01-2020 has submitted proposal to the Director of Town Planning, Maharashtra State, Pune through proper channel for issuing order under Section 127(2) of the said Act, mentioned therin that the Municipal Council has not undertaken any land acquisition process in respect of the said reservations & the said roads ;
And whereas, the Joint Director of Town Planning, Amravati Division, Amravati vide letter No. 888, dated 18- 09-2020 has submitted report stating that part area of said lands of the said land owners is affected by the said reservations & the said roads and the said Appropriate Authority has not taken any action to acquire the said lands and therefore the said reservations on part area of said lands have been lapsed under provision of Section 127 of the said act ;
And whereas, it is confirmed from the 7/12 extracts, part plan of Development Plan & measurement plans submitted by the Assistant Dirctor of Town Planning, Washim Branch Washim vide letter No. 160, dt. 04-03-2021, that the part area of the said lands of the said land owners are affected by the said Reservation & the said Roads as specified in the Schedule hereinafter ;
And whereas, after considering the above facts in respect of the said Reservations & the said Roads on the part area of the said land in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order under Section 127 (2) of the said Act, regarding the lapsing of the said Reservations & the said Roads on the part area of the said lands as specified in the Schedule hereinafter ;
And whereas, the Government in Urban Development Department under Section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 1-12-2016 has delegated the powers exercisable by it to take action under Section 127 (2) of the said Act, to the Director of Town Planning, Maharashtra State, Pune in respect of Development Plans undertaken by all Municipal Councils/NagarPanchayats/Zillha Parishad as a Planning Authority ;

(2) The connectivity between the said roads has been severed due to part area of the said lands being lapsed from the said roads. Therefore, it will be necessary for the Risod Municipal Counil to take appropriate action regarding acquisition of the part area of the said lands of these two roads in terms of transportation and conncetivity.
(3) A copy of the part plan showing the area which is lapsed from the said reservations, is available in the office of the Chief Officer, Municipal Council, Risod during office hours on all working days for inspection to public up to one month.
(4) This Order shall also be published on the Directorate's official web site www.dtp.maharashtra.gov.in.

Modification under section 37 (1) of Maharashtra Regional and Town Planning Act, 1966.
No. NPB-Const.-D-952-2021.—
Whereas, Development plan of Barshitakli has been sanctioned by Director Town Planning,Maharashtra State, Pune Notification No. D.P. Barshitakli-TPV-4-4764 dated 11-2-1989 and has came into force with effect from 1st Decem- ber 1989, for public interest.
And Whereas, the Nagar Panchayat, Barshitakli vide its resolution No. 03, dated 10 June 2021 has decided some Modification in the development Plan as follows;
(1) In the said Development Plan area of 6.40 ha of Survey No. 291 Mauja Barshitakli jirayat is included as Reservation No. 26 for Tahsil Office and other Govt. Offices out of this 4.34 Ha is proposed to be deleted and included in the Residential Zone for housing of beneficiary led Construction (B.L.C. Vertical) under Pardhan Mantri Awas Yojna.
(2) In the said Development Plan Survey No. 76 Mauja Barshitakli jirayat is included in Agricultural Zone. Out of this 2.78 Ha is proposed to be deleted and included in the Residential Zone for housing of beneficiary led Construction (B.L.C. Vertical) under Pardhan Mantri Awas Yojna.
And Whereas, the Plan of the proposed Modification has been kept in the Office of the Nagar Panchayat, Barshitakli for inspection of the public during office hours.
Now, therefore, any person having objection or suggestion regarding proposed Modification may communicate in writing to the Nagar Panchayat, Barshitakli within one month from the date of publication of this Gazette Notification. It shall be considered by the Nagar Panchayat, Barshitakli before submitting the proposal of modification to Government for sanction.
