No. SPP.2021/U.O.R.45/D-XIV.—In exercise of the powers conferred by sub-section (8) of the section 24 of the Code of Criminal Procedure, 1973 (Act No.II of 1974), the Government of Maharashtra hereby appoints, Adv. Prakash L. Shetty, as "Special Public Prosecutor" for conducting the case in Hon'ble Session Court, Mumbai and Hon'ble High Court, Mumbai which is arising out of E.O.W. C.R. No. 21/2015 (Mata Ramabai Ambedkar Marg Police Station, Mumbai C.R.No.86/2015) registered at Economic Offences Wing, Mumbai.

2. The fees of Adv. Prakash L. Shetty, Special Public Prosecutor shall be paid by Home Department as per the fee schedule agreed by the Home Department and approved by this department. 3. His appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment, Conditions of Service and Remuneration) Rules, 1984.

4. The Government reserves right to revoke/modify/annul the order without assigning any reasons.

Sangita Phad, as "Special Public Prosecutor" for conducting the Special Case No.559/ 2020 pending before Hon'ble Sessions Court, Thane, which is arising out of C.R.No.377/2020 registered at Mahatma Phule Chowk Police Station, Kalyan, Dist. Thane.

2. Her appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment, Conditions of Service and Remuneration) Rules, 1984.

3. Lumpsum fees of Rs. 40,000/- (Rupees Forty Thousand only) as quoted by Adv. Sangita Phad has been already deposited by the applicant Smt. Mittal Jignesh Thakkar to the Government, vide R.B.I. Challan No. 3654 dated 1st July 2021. The amount will be paid to Adv. Sangita Phad after Completion of the case.

Umeshchandra Yadhav-Patil, as "Special Public Prosecutor" for conducting the Sessions case No.166/2015 in Sessions Court, Mumbai which is arising out of C.R.No.81/2012 registered at D.C.B.C.I.D. Mumbai (Azad Maidan Police Station C.R.No.133/2012).

(१) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास आवश्यक ती चौकशी करून आवश्यकता भासल्यास सदरचे प्रदान केलेले अधिकार तात्काळ काढून घेण्यात येतील.

(२) सदरचे अधिकार सहकार कायदा कलम ९१ कलम ९८ व कलम १०१ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांनी या कार्यालयाने दिनांक ३१ ऑक्टोबर २०१८ रोजी निर्गमीत केलेल्या परिपत्रकानुसार दरमहा विहीत नमुन्यात कर्ज वसुलीची माहिती जिल्हा उप निबंधक, सहकारी संस्था, पुणे ग्रामीण यांना सादर करावी.

(४) वसुली अधिकार प्रदान केलेल्या व्यक्तीची बदली झाल्यास किंवा सदर व्यक्ती सेवानिवृत्त झाल्यास किंवा सदर व्यक्तीस सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(५) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(६) शासन निर्णय क्रमांक संकीर्ण १५०४/प्र.क्र.२३१/१५-स, दिनांक २३ नोव्हेंबर २००६ अन्वये वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही. त्याऐवजी या कार्यालयाचे परिपत्रक दिनांक ६ जून २०१९ मध्ये निश्चित केलेल्या बँकेच्या नावाच्या मोहेरेचा वापर करण्यात यावा.

(७) वसुली अधिकायास त्याच्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" आणि/किंवा ""सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायांनी त्यांच्या नावापुढे ""वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये)"" असे लिहावे.

(८) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर " वसुली अधिकारी, दि बारामती सहकारी बँक लि., बारामती, जि. पुणे"" असा फलक लावता येईल.

(९) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांच्याकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१०) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसुलपात्र रक्कम व या कार्यालयाचे कलम १५६ आणि त्याखालील नियम १०७ अन्वये आदेश दिनांक ६ एप्रिल २०१८ मध्ये नमूद केल्याप्रमाणे व दराने अंमलबजावणी खर्चाची रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

(११) या कार्यालयाचे दिनांक ३१ ऑक्टोबर २०१८ रोजीच्या परिपत्रकीय सुचनांचे वसुली अधिकारी यांनी तंतोतंत पालन करावे. बँकेचे मुख्य कार्यकारी अधिकारी यांनी दरमहा वसुली अधिकायांचे कामकाजाचा कर्जदारनिहाय आढावा परिपत्रकातील प्रपत्र-पाच मध्ये नमूद केल्याप्रमाणे घ्यावा.

(१२) वसुली अधिकारी यांनी निर्गमित करावयाच्या नोटीस/आदेश/घोषणा यामध्ये त्यांना अधिकार प्रदान केलेल्या या आदेशाचा संदर्भ नमूद करावा. वसुली अधिकारी यांनी नोटीसा बजावताना नोटीसीमध्ये त्यांचे नाव, पदनाम व भ्रमणध्वनी क्रमांक नमूद करणे आवश्यक आहे.

क्रमांक ४सआ/कायदा/क १५६/कॉसमॉस बँक/११३३/२०२१.--------महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ अन्वये मला प्रदान करण्यात आलेल्या शक्तीचा वापर करून मी, शैलेश कोतमिरे, अपर निबंधक (प्रशासन), सहकारी संस्था, महाराष्ट्र राज्य, पुणे, या आदेशान्वये दि कॉसमॉस को-ऑपरेटिव्ह बँक लि., (मल्टीस्टेट शेडयुल्ड बँक), पुणे या बहुराज्यीय सहकारी बँकेचा प्रस्ताव दिनांक १० मे २०२१ अनुसार उक्त बँकेच्या खालील अधिकायांस त्यांच्या नावापुढे दर्शविलेल्या कार्यक्षेत्रासाठी, सदर बहुराज्यीय सहकारी बँकेमध्ये विलीन करण्यात आलेल्या सहकारी बँकांनी विलिनीकरणापूर्वी वितरित केलेल्या कर्जाची वसुली करणेसाठी, महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १०१ व कलम ९१ अन्वये प्राप्त केलेल्या वसुली दाखल्यांची महाराष्ट्र सहकारी संस्था नियम, १९६१ चा नियम १०७ अनुसार वसुली अधिकायामार्फत अंमलबजावणी करणेसाठी, कसुरदाराची मालमत्ता जप्त करून तिची विक्री करून रकमा वसूल करण्याचे निबंधकाचे अधिकार खालील अटीस अधीन राहून दिनांक ३१ मार्च २०२२ पयर्ंत प्रदान करीत आहेत :—

(१) वसुली अधिकारी यांना सदरचे अधिकार सुशिलकुमार नहाटा सहकारी बँक लि., भुसावळ व को-ऑपरेटिव्ह बँक ऑफ अहमदाबाद, शाखा मुंबई या सहकारी बँका दि कॉसमॉस को-ऑपरेटिव्ह बँक लि., (मल्टीस्टेट शेडयुल्ड बँक), पुणे या बहुराज्यीय बँकेत विलीन होण्यापूर्वी सदर बँकांनी प्राप्त केलेल्या अथवा विलीनीकरणाच्या दिनांकास दाखल असलेल्या महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १०१ व कलम ९१ अंतर्गत प्रकरणापुरतेच वापरता येतील अन्यथा इतर प्रकारे सदर अधिकारांचा वापर करता येणार नाही.

(२) सदरचे अधिकार महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १०१ व ९१ अन्वये प्राप्त वसुली दाखल्यांची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांनी मालमत्तेच्या वाजवी किंमतीस (अपसेट प्राईज) निबंधकाची पूर्वमान्यता घेणे आणि मालमत्तेची विक्री कायम करणे या कामी या कार्यालयाचे परिपत्रक जा.क्र. ना.बँका/डी-४/अपसेट प्राईज व विक्री कायम/२०१५/८७०, दिनांक १७ एप्रिल २०१५ अनुसार संबंधित जिल्हा उप निबंधक, सहकारी संस्था, यांची मान्यता घ्यावी. संबंधित जिल्हा उप निबंधक, सहकारी संस्था, यांनी उक्त बँकेच्या वाजवी किंमतीस (अपसेट प्राईज) पूर्व मान्यता देणे आणि मालमत्तेची विक्री कायम करणेसंबंधी प्रस्तावाबाबत महाराष्ट्र सहकारी संस्था नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार उचित कार्यवाही करावी.

(४) वसुली अधिकारी यांनी दरमहा या कार्यालयाचे परिपत्रक दिनांक २४ जून २०१६ अन्वये विहीत केलेल्या नमुन्यात "अ-३", "अ-४" व "ब" कर्ज वसुलीची माहिती संबंधित जिल्हा उप निबंधक, सहकारी संस्था, पुणे यांचे कार्यालयास सादर करावी.

(५) अधिकार प्रदान केलेल्या वसुली अधिकारी असलेल्या व्यक्तीची बदली झाल्यास किंवा सदर व्यक्ती सेवानिवृत्ती झाल्यास किंवा सदर व्यक्तीस सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(६) मा. उच्च न्यायालय, मुंबई यांनी रिट याचिका क्रमांक १९४२/२०१३, दि बेसिन कॅथोलिक को-ऑप. बँक लि., विरुद्ध महाराष्ट्र राज्य व इतर या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५ रोजी दिलेला आदेश विचारात घेऊन वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

(७) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(८) शासन निर्णय क्रमांक संकिर्ण १५०४/प्र.क्र. २३१/१५ स, दिनांक २३ नोव्हेंबर २००६ अन्वये वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

(९) वसुली अधिकायास त्याच्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" आणि किंवा "" सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायंानी त्यांच्या नावापुढे ""वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये )"" असे लिहावे.

(१०) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर ""वसुली अधिकारी, दि कॉसमॉस को-ऑपरेटिव्ह बँक लि.

(मल्टीस्टेट शेडयुल्ड बँक), पुणे "" असा फलक लावता येऊ शकेल.

(११) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांच्याकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१२) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व या कार्यालयाचे कलम १५६ अन्वयेचे आदेश दिनांक ६ एप्रिल २०१८ मध्ये नमूद केलेप्रमाणे व दराने अंमलबजावणी खर्चाची रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

(१३) वसुली अधिकारी यांनी निर्गमीत करावयाच्या नोटीस/आदेश/घोषणा यामध्ये त्यांना अधिकार प्रदान केलेल्या व आदेशाचा संदर्भ नमूद करावा.

(१४) एका वसुली अधिकायाकडे १०० पेक्षा जास्त वसुली प्रकरणे देण्यात येऊ नयेत.

(१५) वसुली अधिकारी यांना प्रदान केलेल्या अधिकारांची उपरोक्त मुदत संपणेपूर्वी तीन महिनेचे आत अधिकाराचे नुतनीकरण करणेसाठीचा प्रस्ताव, नुतनीकरणाच्या समर्थनार्थ आवश्यक त्या कागदपत्रांसह सादर करणे बंधनकारक राहील.

सदरचा आदेश आज दिनांक २ जून २०२१ रोजी माझे सही शिक्केसह व कार्यालयीन मुद्रेसह दिला आहे.

(१) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार कर्ज वसुलीची कार्यवाही करावी. कर्जवसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास आवश्यक ती चौकशी करून आवश्यकता भासल्यास सदरचे प्रदान केलेले अधिकार तात्काळ काढून घेण्यात येतील.

(२) सदरचे अधिकार सहकार कायदा कलम १०१ व कलम ९८ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांनी या कार्यालयाने दिनांक ३१ ऑक्टोबर २०१८ रोजी निर्गमीत केलेल्या परिपत्रकानुसार दरमहा विहीत नमुन्यात कर्ज वसुलीची माहिती जिल्हा उप निबंधक, सहकारी संस्था, मुंबई-१ यांना सादर करावी.

(४) वसुली अधिकार प्रदान केलेल्या व्यक्तीची बदली झाल्यास किंवा सदर व्यक्ती सेवानिवृत्ती झाल्यास किंवा सदर व्यक्तीस सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(६) शासन निर्णय क्रमांक संकीर्ण. १५०४/प्र.क्र.२३१/१५-स, दिनांक २३ नोव्हेंबर २००६ अन्वये वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

(७) वसुली अधिकायास त्याच्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" आणि किंवा ""सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्या ऐवजी वसुली अधिकायांनी त्यांच्या नावापुढे ""वसुली अधिकारी (महाराष्ट्र सह. संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये)"" असे लिहावे.

(८) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर " वसुली अधिकारी, यशवंत सहकारी बँक लि. मुंबई (नोंदणी रद्द)"" असा फलक लावता येईल.

(९) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांचेकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(११) या कार्यालयाचे दिनांक ३१ ऑक्टोबर २०१८ रोजीच्या परिपत्रकीय सूचनांचे वसुली अधिकारी यांनी तंतोतत पालन करावे. बँकेचे मुख्य कार्यकारी अधिकारी यांनी दरमहा वसुली अधिकायांचे कामकाजाचा कर्जदारनिहाय आढावा परिपत्रकातील प्रपत्र पाच मध्ये नमूद केल्याप्रमाणे घ्यावा.

(१२) वसुली अधिकारी यांनी निर्गमित करावयाच्या नोटीस/आदेश/घोषणा यामध्ये त्यांना अधिकार प्रदान केलेल्या या आदेशाचा संदर्भ नमूद करावा.

(१३) वसुली अधिकारी यांनी निर्गमीत करावयाच्या नोटीस/आदेश/घोषणा यामध्ये त्यांना अधिकार प्रदान केलेल्या या आदेशाचा संदर्भ नमूद करावा. वसुली अधिकारी यांनी नोटीस बजावताना नोटीसीमध्ये त्यांचे नाव व पदनाम व भ्रमणदूरध्वनी क्रमांक नमूद करणे आवश्यक आहे.

(६) शासन निर्णय क्रमांक संकीर्ण. १५०४/प्र.क्र.२३१/१५-स, दिनांक २३ नोव्हेंबर २००६ अन्वये वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही. त्याऐवजी या कार्यालयाचे परिपत्रक दिनांक ६ जून २०१९ मध्ये निश्चित केलेल्या बँकेच्या नावाच्या मोहेरेचा वापर करण्यात यावा.

(८) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर " वसुली अधिकारी, जनसेवा सहकारी बँक लि., हडपसर, पुणेे"" असा फलक लावता येईल.
