THE MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No. TPS-2619/114/CR-16/UD-30-2019.—
Whereas, the Revised Development Plan of Shegaon City, Dist.-Buldana has been sanctioned by the Director of Town Planning, Maharashtra State, Pune under Section 31 of Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") vide Notification No. D.S. Shegaon-TPV-6-2755 dated 26th April 1994 and it has come into force with effect from the 1 August 1994 (hereinafter referred to as "the said Development Plan") ;
And whereas, in the said Development Plan, land admeasuring 6.86 H. A. out of Survey 219/3 and land admeasur- ing 1.02 H. A. out of Survey 222/1 Mouja Shegaon, (Total 7.86 H. A.) (hereinafter referred to as "the said land") is affected by partly Agriculture/No Development Zone, partly Residential Zone, partly 30 m. and 18 m. wide proposed Development Plans roads and partly by Site No. 80 "Children's Park" (hereinafter referred to as "the said Development Plan proposals") ;
And whereas, Shegaon Municipal Council (hereinafter referred to as "the said Council ") after following all the legal formalities stipulated under Section 37(1) of the said Act, has submitted to the Government for its sanction aद्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, +रू]क्ष् १९-२५, २०२१/रम् २८- ३, ॅ १९४३ ३ proposal for modification to the said Development Plan so as to change the user of the land affected by No Development Zone out of the said land, to that of "Public Utility".
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, the Government is of opinion that excluding the lands affected by partly Residential Zone, partly 30 m. and 18 m. wide proposed Development Plan roads and partly by Site No. 80 "Children's Park" out of the said land, remaining land affected by the Agriculture/No Development Zone should be deleted from the Agriculture/No Development Zone and included in "Public Semipublic Zone", and accordingly the modification should be sanctioned.
And whereas, the Land owners of the said land have deposited Rs. 4,67,000 towards the 50% Government share of 5% premium amount as per the rate of said land as perscribed in the Annual Statement of Rates (ASR) for the year 2020-21 in the Government Treasury on 15-2-2021, through the Assistant Director of Town Planning, Buldana Branch, Buldana and the remaining 50% of the 5% premium amount of Rs. 4,67,000 has been deposited with the Shegaon Municipal Council, Shegaon on 26-2-2021.
Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government of Maharashtra hereby sanction the said proposed Modification with the terms and conditions mentioned below and for that purpose amends the above said modification dated the 26-4-1994 as follows :—
" In the Schedule of Modification appended to the Notification sanctioning the said Development Plan, the follow- ing new entry shall be added after the last entry.":—

"Out of the land admeasuring 6.86 H. A. out of Survey 219/3 and land admeasuring 1.02 H. A. out of Survey 222/1 Mouja Shegaon, (Total 7.86 H.A.) excluding the lands affected by partly Residential Zone, Partly 30 m. and 18 m. wide proposed Development Plan, roads and partly by Site No. 80 "Children's Park", the remaining land affected by the Agriculture/No Development Zone is deleted from the Agriculture/ No Development Zone and included in "Public Semipublic Zone".
A copy of the part plan showing the aforesaid sanctioned modification shall be available in the office of the Chief Officer, Shegaon Municipal Council during office hours on all working days for inspection of public for a period of one month.
This Notification shall also be published on the Govt. website www.maharashtra.gov.in/Acts & Rules.
