क्रमांक वक्फ २०२१ / प्र.क्र.१२ /कार्यासन-४. ज्याअर्थी, महाराष्ट्र शासनाने वक्फ अधिनियम , १ ९९ ५ ( १ ९९ ५ चा ४३ ) यामधील कलम १४ च्या पोट - कलम ९ आणि पोट- कलम १ मधील खंड ( क) अन्वये प्रदान करण्यात आलेल्या शक्तींचा वापर करून , शासन अधिसूचना, अल्पसंख्याक विकास विभाग , क्र .वक्फ २०१९/प्र.क्र.१२१ /कार्यासन-४ , दिनांक १३ सप्टेंबर २०१ ९ अन्वये श्री. महेमूद महेबूब शेख यांची " नगररचना किंवा व्यवसाय व्यवस्थापन , सामाजिक कार्य , वित्तीय किंवा महसूल , कृषि आणि विकास कार्य यामध्ये व्यवसायिक अनुभव असलेली व्यक्ति" या संवर्गातून , पनचक्की, औरंगाबाद येथे मुख्यालय असलेल्या महाराष्ट्र राज्य विधानमंडळावर (यापुढे ज्याचा उल्लेख " उक्त मंडळ " म्हणून करण्यात येईल ) पाच वर्षाचा कालावधी किंवा पुढील आदेश , यापैकी जे अगोदर घडेल ते , पर्यंत सदस्य म्हणून नामनिर्देशन केले होते ;
आणि ज्याअर्थी, महाराष्ट्र शासनाने , शासन अधिसूचना, अल्पसंख्याक विकास विभाग , क्र. वक्फ २०२० /प्र.क्र .८/कार्यासन -४ , दिनांक ४ मार्च २०२० ( यापुढे ज्याचा उल्लेख " उक्त अधिसूचना " म्हणून करण्यात येईल ) अन्वये श्री . महेमूद महेबूब शेख यांची उक्त मंडळावर सदस्य म्हणून करण्यात आलेली नियुक्ती रद्द केली होती ;
आणि ज्याअर्थी, उक्त अधिसूचना दिनांक ४ मार्च २०२० ला श्री. महेमूद महेबूब शेख यांनी मा. मुंबई उच्च न्यायालयात याचिका क्र . ३९ ८४ /२०२० अन्वये आव्हान दिले होते आणि मा. मुंबई उच्च न्यायालयाने त्यांच्या दिनांक २४ फेब्रुवारी २०२१ च्या आदेशान्वये उक्त अधिसूचना दिनांक ४ मार्च २०२० रद्द केली होती ;
आणि ज्याअर्थी , महाराष्ट्र शासनाने मा. सर्वोच्च न्यायालयात विशेष अनुमती याचिका क्र.११६५२ / २०२१ दाखल केली होती व मा. सर्वोच्च न्यायालयाने त्यांच्या दिनांक ६ ऑगस्ट २०२१ च्या अंतरिम आदेशान्वये मा. उच्च न्यायालयाच्या दिनांक २४ फेब्रुवारी २०२१ च्या आदेशाची अंमलबजावणी स्थगित केली आहे ;
आणि ज्याअर्थी, श्री . महेमूद महेबूब शेख यांची उक्त मंडळावर सदस्य म्हणून करण्यात आलेली नियुक्ती रद्द केल्यामुळे रिक्त झालेली उक्त मंडळावरील सदस्याची जागा भरणे महाराष्ट्र शासनाला इष्ट वाटत आहे ;

त्याअर्थी आता , वक्फ अधिनियम , १ ९९ ५ (१ ९९ ५ चा ४३ ) यामधील कलम १४ च्या पोट- कलम ९ आणि पोट- कलम १ मधील खंड (क) अन्वये प्रदान करण्यात आलेल्या शक्तींचा वापर करून व मा. सर्वोच्च न्यायालयातील विशेष अनुमती याचिका क्र.११६५२ / २०२१ च्या अंतिम निकालाच्या अधीन राहून , महाराष्ट्र शासन याद्वारे, श्री . समीर गुलामनबी काझी , केके हाऊस, काझी मस्जिद जवळ , काझीनगर , जालना रोड, बीड यांचे, " नगररचना किंवा व्यवसाय व्यवस्थापन , सामाजिक कार्य , वित्तीय किंवा महसूल , कृषि आणि विकास कार्य यामध्ये व्यवसायिक अनुभव असलेली व्यक्ति " या संवर्गातून पनचक्की , औरंगाबाद येथे मुख्यालय असलेल्या महाराष्ट्र राज्य वक्फ मंडळावर सदस्य म्हणून नामनिर्देशन करत आहे.

NOTIFICATION
WAQF ACT , 1995 .
No. Waqf 2021/C.R.12/Desk-4 .- Whereas , the Government of Maharashtra has vide Government Notification , Minorities Development Department , No. Waqf 2019/C.R.121/ Desk - 4 , dated the 13thSeptember 2019 , issued in exercise of the powers conferred by sub - section (9) and clause (c) of sub - section ( 1) of section 14 of the Waqf Act, 1995 (43 of 1995) , nominated Shri Mahemud Mahebub Shaikh, from the category of " Muslims , who has professional experience in town planning or business management , social work , finance or revenue , agriculture and development activities " , to be the member of the Maharashtra State Board of Waqfs ( hereinafter referred to as "the said Board ") , having its headquarters at Panchakki , Aurangabad for a period of five years from the date of publication of the said notification or until further orders , whichever is earlier ;
And whereas , the Government of Maharashtra has vide Government Notification , Minorities Development Department, No. Waqf 2020/C.R.8 / Desk-4 , dated the 4th March 2020 ( hereinafter referred to as " the said notification ") , cancelled the appointment of Shri Mahemud Mahebub Shaikh , as a member ofthe said Board ;
And whereas , the said notification dated the 4th March 2020 was challenged by Shri Mahemud Mahebub Shaikh , before the Hon'ble High Court , Judicature at Bombay in Writ Petition No.3983 of 2020 and the Hon'ble High Court has , in its order dated the 24th February 2021 quashed and set aside the said notification dated the 4th March 2020 ;
And whereas , the State of Maharashtra has filed the Special Leave Petition No.11652 of 2021 in the Hon'ble Supreme Court and the Hon'ble Supreme Court has vide its interim order dated the 6thAugust 2021 stayed the operation of the order of the Hon'ble High Court , dated the 24th February 2021 ;
And whereas , the Government of Maharashtra considers it expedient to fill the vacancy of the office ofthe member of the said Board created by cancellation of the appointment of Shri Mahemud Mahebub Shaikh;
Now , therefore , in exercise of the powers conferred by sub - section (9) and clause ( c) of sub- section (1) of section 14 of the Waqf Act , 1995 (43 of 1995) , the Government of Maharashtra hereby nominates Shri Sameer Gulamnabi Kazi , KK House , Near Kazi Masjid , Kazinagar , Jalna Road , Beed , from the category of "Muslims , who has professional experience in town planning or business management , social work , finance or revenue , agriculture and development activities " , as a member of the Maharashtra State Board of Waqfs , having its headquarters at Panchakki , Aurangabad subject to the final decision of the Hon'ble Supreme Court in the Special Leave Petition No. 11652/2021 .
