MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966 :—
No. TPS-4117/1689/CR-132/UD-30-2017.—
Whereas, the Development Plan of Malegaon City, Dist.-Washim has been sanctioned by the Government under Section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") vide Notification No. 2586/CR-31-109/UD-01, dated 4th September 1986 and has come into force with effect from dated 31st October 1987 (hereinafter referred to as "the said Development Plan") ;
द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, रू]क्ष्दन् २-८, २०२१/ ११-१७, ॅ १९४३ ३And whereas, according to the proposals of the said Development Plan, area admeasuring 0.96 Ha. in land bearing Gut No. 195 of City Malegaon (hereinafter referred to as "the said land") is reserved as "Site No. 5 -Play Ground" (hereinafter referred to as "the said reservation") ;
And whereas,Order dated 07-06-2017 in PIL No. 177 of 2016 passed by the Hon'ble High Court of Judicature at Nagpur Bench, has stated that the appopriate steps in terms of Section 37 of the said Act will be required to be taken by the Government to delete the said land from the said reservation and reserve the same for "Civil & Criminal Court, Building and Residence of Judge", and necessary steps as per the law are required to be taken by the Government to complete the process of allotment, if possible within a period of four month.
And whereas, as per the provisions of Section 37(1) of the said Act the Municipal Council, Malegaon vide its letter dated 25-09-2017, has submitted the proposal to the Government for sanction, so as to delete the said land from the said reservation, and to reserve the same for "Civil & Criminal Court Building and Residentce of Judge" (hereinafter referred to as " the Proposed Modification ") ;
And whereas, Government vide direction U/s 154 (1) of the said Act, bearing No. 432001-2442-C.R.260-2001-UD- 11, dated 29-08-2003, has directed to all the Corporations and Municipal Council, to obtain sanction of the Hon'ble Cabinet for modification of reservation of playground.
And whereas, the proposed modification proposal was submitted to the Hon'ble Cabinet on dated 15-01-2020.
And whereas, as the Hon'ble Cabinet made following suggestions :–
(1) Before sanctioning the proposed modification, to check if the alternate land is available.
(2) If alternate land is not available, to check whether it is possible to allot alternate land for play ground having same area as of the said reservation.
And whereas, as the process of allotment of alternate land for the purpose of "Civil & Criminal Court, Building and Residence of Judge" is being carried out by the Revenue Department.
And whereas, considering the above situation and after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, the Government is of the opinion that the said modification needs to be rejected ;
Now, therefore, in exercise of powers conferred by sub-section (2) of Section 37 of the said Act, the Government of Maharashtra hereby refuses to accord sanction to the said Modification.
This Notification shall be kept open for inspection by the general public during office hours in the office of the Chief Officer, Malegaon Municipal Council, Malegoan.
This Notification shall also be published on the Govt. website www.maharashtra.gov.in
