क्रमांक १३०५५ /म.वि.स./ह-१. महाराष्ट्र विधानमंडळ सदस्यांचे वेतन व भत्ते अधिनियम , १ ९ ५६ (सन १ ९ ५६ चा मुंबई अधिनियम ४९ ) याच्या कलम ८ , पोट- कलम ( १ ) , खंड ( अ) अन्वये स्थापन करण्यात आलेल्या संयुक्त समितीने , उक्त कलम ८ , पोट- कलम ( १ ) च्या खंड (ड) अन्वये तिला प्रदान करण्यात आलेल्या अधिकारांचा वापर करून व राज्य शासनाशी विचारविनिमय करून तिने तयार केलेले व उक्त कलम ८ , पोट- कलम (१ ) , खंड ( ई ) अन्वये आवश्यक असल्याप्रमाणे ज्यांना सभापती , महाराष्ट्र विधानपरिषद व उपाध्यक्ष, महाराष्ट्र विधानसभा यांनी संमती देऊन पुष्टी दिलेली आहे असे पुढील नियम सर्वसाधारण माहितीसाठी याद्वारे प्रसिद्ध करण्यात येत आहेत : ----
नियम
येईल. (१ ) संक्षिप्त नाव व प्रारंभ.- (१ ) या नियमांस महाराष्ट्र विधानमंडळ सदस्य ( वाहन चालकांची नेमणूक ) नियम , २०२१ असे म्हणता (२) हे नियम दिनांक १ जानेवारी , २०२१ रोजी अंमलात आले असल्याचे मानण्यात येईल .
( २ ) व्याख्या. ( १ ) संदर्भानुसार अन्यथा अपेक्षित नसेल तर , त्या नियमांत,-
(अ ) " अधिनियम " म्हणजे महाराष्ट्र विधानमंडळ सदस्यांचे वेतन व भत्ते अधिनियम ( सन १ ९ ५६ चा अधिनियम ४९ ) .
(ब) " वाहन चालक " म्हणजे अधिनियमाच्या कलम ६ , पोट-कलम ( ६ ) अन्वये सदस्याने त्याच्या स्वेच्छानिर्णयानुसार त्याच्या कुटुंबातील व्यक्ती व्यतिरिक्त वाहन चालक म्हणून नेमणूक केलेली व्यक्ती.
(२ ) या नियमांमध्ये अंतर्भूत असलेले परंतु येथे व्याख्या व अभिव्यक्ती न करण्यात आलेले शब्द यांचा अर्थ त्यांना अधिनियमात अनुक्रमे नेमून दिलेल्या अर्थानुसार असेल.

(३ ) वाहन चालकाची विनामुल्य सेवा.- प्रत्येक सदस्यास, अधिनियमातील व या नियमांतील तरतुदींच्या अधिन राहून त्याच्या पदावधीच्या कालावधीत वाहन चालकाची विनामूल्य सेवा मिळण्याचा हक्क असेल .
(४ ) नेमणुकीचा किंवा सेवासमाप्तीचा आदेश.- ( १ ) वाहन चालकाच्या बाबतीत नेमणुकीचा किंवा सेवासमाप्तीचा आदेश हा या नियमास जोडलेल्या नमुना " अ " मध्ये असेल. वाहन चालकाची नेमणूक ही त्याची सेवा अगोदरच समाप्त करण्यात आली नसल्यास सदस्याचा पदावधी एवढ्या मुदतीसाठीच असेल. सदस्य हा , यथास्थिती नेमणुकीच्या किंवा सेवासमाप्तीच्या आदेशाची एक प्रत , ज्या ठिकाणाहून ते आपले वेतन व भत्ते घेत असतील म्हणजेच अवर सचिव तथा आहरण व संवितरण अधिकारी , महाराष्ट्र विधानमंडळ सचिवालय , प्रधान सचिव, महाराष्ट्र विधानमंडळ सचिवालय आणि त्या वाहन चालकासही पाठवील .
( २ ) वाहन चालक म्हणून नेमलेली व्यक्ती , ही वैध वाहनचालक अनुज्ञप्ती ( लायसन्स) धारण करणारी असेल आणि तिचे वय साठ वर्षे पूर्ण झालेले नसेल आणि या दोन्ही गोष्टी वाहनचालकाची नेमणूक करणाऱ्या सदस्यांकडून प्रमाणित करण्यात येतील.
( ३ ) सदस्याचा पदावधी समाप्त होण्यापूर्वी अथवा सदस्याने त्याची सेवा समाप्त करण्यापूर्वी वाहन चालक म्हणून नियुक्त करण्यात आलेल्या व्यक्तीचे वय ६० वर्षे पूर्ण झाल्यास , वाहनचालक म्हणून त्या व्यक्तीची सेवा त्याच दिवशी आपोआप संपुष्टात येईल .
(५ ) वाहन चालकाचे पारिश्रमिक .- ( १ ) वाहन चालक हा , सदस्यांकडे जोपर्यंत काम करत असेल, तोपर्यंत त्यास अधिनियमातील खंड ( ६ ) च्या उप खंड ( ६ ) नुसार राज्य शासनाने वेळोवेळी निर्गमित केलेल्या आदेशाद्वारे विनिर्दिष्ट केलेले मानधन मिळण्याचा हक्क असेल. त्यास कोणताही प्रवास किंवा दैनिक भत्ता किंवा इतर कोणतेही भत्ते मिळण्याचा हक्क असणार नाही .
(६ ) वाहन चालक हा शासकीय कर्मचारी नसणे.- अधिनियम आणि या नियमान्वये वाहन चालक म्हणून नेमणूक केलेली व्यक्ती ही कोणत्याही कारणासाठी शासकीय कर्मचारी समजण्यात येणार नाही .

मी, श्री. /श्रीमती यांची दिनांक पासून माझा वाहन चालक म्हणून, महाराष्ट्र विधानमंडळ सदस्यांचे वेतन व भत्ते अधिनियम ( सन १ ९ ५६ चा ४ ९ ) मधील खंड ( ६ ) च्या उप खंड ( ६ ) आणि महाराष्ट्र विधानमंडळ सदस्य (वाहन चालकांची नेमणूक) नियम, २०२१ मधील नियम ४ अन्वये नेमणूक करीत आहे.
मी असे प्रमाणित करतो की, या पदासाठी आवश्यक असलेली किमान पात्रता म्हणजे ते/ त्या वैध वाहनचालन अनुज्ञप्ती (लायसन्स) धारण करीत असून दिनांक रोजी त्यांचे वय वर्षे साठ पूर्ण झालेले नाही .
त्यांचा वाहनचालन अनुज्ञप्ती (लायसन्स) क्रमांक असा असून ते दिनांक रोजीपर्यंत वैध आहे.

THEMAHARASHTRA LEGISLATURE MEMBER'S SALARIES AND ALLOWANCES ACT , 1956
No. 13055 /MLS/H - 1.- The following rules which have been made by the Joint Committee constituted under clause ( a ) of sub - section (1) of section 8 of the Maharashtra Legislature Members ' Salaries and Allowances Act (XLIX of 1956 ), in exercise of the powers confered by clause ( d) of sub - section ( 1) of the said section 8 , in consultation with the State Government and approved and confirmed by the Chairman of the Maharashtra Legislative Council and the Deputy Speaker of the Maharashtra Legislative Assembly , as required under clause ( e ) of sub - section ( 1) of the said section 8 , are hereby published for general information :-
RULES
1. Short title and commencement .- ( 1) These rules may be called the Maharashtra Legislature Members ' (Appointment of Driver ) Rules , 2021 .
(2) These rules shall be deemed to have come into force on the 1st day of January 2021 .
2. Definitions . ( 1) In these rules , unless the context otherwise requires ,- (a) "Act" means the Maharashtra Legislature Members ' Salaries and Allowances Act (XLIX of 1956 ) ;
(b) "Driver" means a person not being a member of the family of the Member who is appointed by the Member at his discretion as a driver under sub - section (6) of section 6 of the Act.
(2) The words and expressions used in these rules but not defined herein shall have the same meaning as respectively assigned to them under the Act .
3. Free service of Driver . Every Member shall subject to the provisions of the Act and these rules be entitled free of charge to the services of a driver throughout his term of office .
4. Appointment or termination order . ( 1 ) The appointment or termination order in respect of a driver shall be in Form 'A' appended to these rules . The appointment of driver , unless , terminated earlier shall be co - terminus with the term of office of the Member . The member shall forward a copy of the appointment order or the termination order to the Under Secretary cum Drawing and Disbursing Officer , from where the Member draws his salary and allowances , the Principal Secretary , Maharashtra Legislature Secretariat and the Driver .
(2 ) The person appointed as driver shall hold valid driver's license and should not have completed sixty years of age and both these shall be certified by the Member appointing the driver .
(3) If the person appointed as driver completes 60 years of his age before the completion of the term of office of the Member or is terminated by the Member during his term of office , the services of the driver shall automatically be terminated the same day.
5. Remuneration of Driver . ( 1) The Driver shall be entitled to such a remuneration as may be specified by order issued by the State Government , from time to time , under sub- section 6 of section 6 of the Act as long as he is working with the Member He shall not be entitled to any travelling or daily allowance or any other allowances .
6. Driver not a Government Servant . A person appointed as driver under the Act and these rules shall not be treated as a Government Servant for any purpose .
