MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
ORDER
No. D.T.P.-D.P. Warud [O(R)+A.]-Sec 127(2)-Notification-TPV-VI-3780-2021.—
Whereas, the Development Plan of Warud Municipal Council [Original (Revised) + Additional] has been partly sanctioned under the provisions of Section 31(1) of the Maharashtra Regional & Town Planning Act. 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act.") by the Government in Urban Development Department vide its Notificaiton No. TPS-2803/1896/CR-8(A)/2004-UD-30, Dated 15th July 2005 & came into force with effect from 1st September 2005, while republished Development Plan of Excluded Part of Warud has been sanctioned vide Notifica- tion No. TPS-2806/379/CR-243/2006-UD-30, Dated 6th June 2007 (hereinafter referred to as "the said Notification'' ) & came into force with effect from 16th July 2007 (hereinafter referred to as "the said Sanctioned Development Plan") ;
And whereas, in the said Sanctioned Development Plan, the lands bearing S.No. 177 (Part) & S.No. 186 (Part) of Mouza Warud is reserved for Site No. 45 "Burial Ground" (hereinafter referred to as " the said Reservation") for which Appropriate Authority is Municipal Council, Warud (hereinafter referred to as " the said Appropriate Authority");
And whereas, the land under said reservation has not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said sanctioned Development Plan came into force ;
And whereas, the concern land owners (hereinafter referred to as "the said Land Owners") of the lands under the said reservation in respect of (i) S.No.177/5C (Part), (ii) S.No.177/6 (Part) & (iii) S.No.186/3 (Part) of Mouza Warud (hereinafter referred to as "the said Lands") have served a notice under Section 127(1) of the said Act, (hereinafter referred to as "the said Notice") on the said Appropriate Authority on dated 27th September 2018 ;
And whereas, the said lands are not acquired of no steps as required under Section 127(1) of the said Act has been taken by the said Appropriate Authority, within a stipulated period from the date of service of the said notice ;
And whereas, the Chief Officer, Municipal Council, Warud vide letter No. 2289/2020, dated 9th November 2020 has communicated its no objection for lapsing of the the said reservation ;
And whereas, as per the revised report of the Joint Director of Town Planning, Amravati Division, Amravati vide letter No. 959, dated 4th August 2021 it is clarified that the lands bearing (i) S.No.177/5C (Part), (ii) S.No.177/6 (Part) & (iii) S.No. 186/3 (Part) of Mouza Warud, of which areas admeasuring 0 17 Ha., 0 3876 Ha. & 0 29 Ha. respectively are affected by the said reservation ;
And whereas, after considering the above facts in respect of the said reservation on the said lands in the said sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order under Section 127(2) of the said Act, regarding the lapsing of the said reservation on the said lands ;
And whereas, the Government in Urban Development Department under Section 151 of the said Act, vide Resolution No. TPS-1813/3211/CR-508/UD-13, dated 1st December 2016, has delegated the powers exercisable by it under Section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the Developmemt Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune ;
