क्र. आयडीसी. २०२१/ ( १८३ ) /उद्योग- १४. - ज्याअर्थी, अनुसूचित उल्लेखिलेल्या क्षेत्रात महाराष्ट्र औद्योगिक विकास अधिनियम, १ ९ ६१ चे प्रकरण सहाची अधिसूचना क्रमांक आयडीसी. २०२१/ ( १८३ )/उद्योग- १४ , दिनांक १५ एप्रिल , २०२१ महाराष्ट्र शासनाच्या राजपत्रातील भाग चार- ब पृष्ठ क्र. १ ते २ वर महाराष्ट्र शासनाने सदर अधिसूचनेच्या अनुसूचित उल्लेखिलेल्या क्षेत्रात महाराष्ट्र औद्योगिक विकास अधिनियम , १ ९ ६१ ( १ ९ ६२ चा महा.तीन ) (यापुढे ज्याचा उल्लेख उक्त अधिनियम असा करण्यात येईल) चे कलम सहा, दिनांक १५ एप्रिल , २०२१ अंमलात आणले होते व उक्त अधिनियमाच्या आधारे मौजे जामगाव, तालुका रोहा , जिल्हा रायगड उक्त अनुसूचित नमूद केलेले क्षेत्र अधिनियमाच्या कलम २ , खंड (ग) अन्वये औद्योगिक क्षेत्र म्हणून जाहीर केलेले आहे ;
ज्याअर्थी, मौजे जामगाव, तालुका रोहा, जिल्हा रायगड या गावातील काही सर्व्हे नंबर मधील क्षेत्र संयुक्त मोजणी अंती कमी जास्त झाले असल्याचे संयुक्त मोजणी अहवालावरून निदर्शनास आले असल्यामूळे सदर सर्व्हे नंबरच्या क्षेत्रामध्ये बदल झाला असल्याने प्रकरण -६ मध्ये दुरुस्ती करणे आवश्यक आहे ;

भाग चार-ब-१ २ महाराष्ट्र शासन राजपत्र भाग चार - ब गुरुवार ते बुधवार, सप्टेंबर ९-१५ , २०२१/ भाद्र १८-२४, शके १ ९ ४३ तर, महाराष्ट्र सामान्य कलम कायदा, १९ ०४ च्या कलम २१ सोबत वाचण्यात येणाऱ्या उक्त अधिनियमाच्या कलम १ , उप - कलम ३ आणि कलम २ चे उप - कलम (ग) अन्वये प्रदान करण्यात आलेल्या अधिकारांतर्गत महाराष्ट्र शासन असे जाहीर करते की दिनांक ९ सप्टेंबर २०२१ पासून सदर अधिसूचनेत खालील प्रमाणे बदल लागू झाले आहेत असे मानण्यात येईलः -

Amendment
MAHARASHTRA INDUSTRIAL DEVELOPMENT ACT , 1961 .
No. IDC . 2021 / (183 )/ Ind . 14. Whereas , the Government of Maharashtra , by the Government Notification, issued by the Industry, Energy and Labour Department , No. IDC . 2021 / ( 183 )/ Ind . 14 , dated 15th April, 2021 , published in the Maharashtra Government Gazette , Part IV - B , dated the 15th April , 2021 at pages 3 to 4 (hereinafter referred to as " the said Notification " ) , issued in exercise of the powers conferred by sub- section ( 3 ) of section 1 of the Maharashtra Industrial Development Act, 1961 (Mah. III of 1962 ) , appointed the 15th April , 2021 to be the date from which the provisions of Chapter- VI of the said Act shall take effect in certain areas of villages Jamgaon , in Roha Taluka in Raigad District and declare to be an industrial area under clause (g) of section 2 of the said Act for the purposes of the said Act ;
And Whereas , in the joint measurement report of villages Jamgaon , in Roha Taluka in Raigad District there are differences shown in some survey numbers areas which is less or more , it is necessary to amend the area of said notification ;
Now, therefore , in exercise of the powers conferred by sub- section (3) of section 1 and clause (g) of section 2 of the said Act read with section 21 of the Maharashtra General Clauses Act (I of 1904) , and of all other powers enabling it in this behalf, the Government of Maharashtra hereby , with effect from the 9th September 2021 amends the said notification , as follows , namely :-

क्र.आयडीसी. २०२१ /प्र.क्र.१८३/उद्योग १४. -ज्याअर्थी महाराष्ट्र औद्योगिक विकास अधिनियम, १९ ६१ ( सन १ ९ ६२ चा महाराष्ट्र तीन ) यांच्या कलम १ , पोट - कलम ( ३ ) अन्वये करण्यात आलेली व महाराष्ट्र शासन असाधारण राजपत्र, भाग चार-ब , दिनांक १५ एप्रिल २०२१ , पृष्ठ क्रं. १ ते २ वर प्रसिद्ध करण्यात आलेली महाराष्ट्र शासनाचे उद्योग , ऊर्जा व कामगार विभागाचे क्रं.आयडीसी. २०२१/ (प्र.क्र.१८३ ) उद्योग-१४ , दिनांक १५ एप्रिल २०२१ , अन्वये उपरोक्त अधिनियमाच्या प्रकरण सहाचे उपबंध हे त्या अधिसूचनेत नमूद केलेले "मौजे जामगाव, तालुका रोहा, जिल्हा रायगड " येथील क्षेत्रास दिनांक १५ एप्रिल २०२१ या तारखेपासून लागू करणेत आलेल्या आहेत व उक्त क्षेत्र हे उक्त अधिनियमाच्या कलम २ खंड (ग ) अन्वये , " औद्योगिक क्षेत्र" , म्हणून जाहीर केलेले आहे ;
आणि ज्याअर्थी, उपरोक्त अनुसूचीमध्ये जाहीर केलेल्या जमिनी त्याभागात समाविष्ट आहे . ( यापुढे याचा उल्लेख "उक्त जमीन" असा करण्यात येईल. ) ;
आणि, ज्याअर्थी महाराष्ट्र औद्योगिक विकास महामंडळाकरिता उक्त जमिनी औद्योगिक क्षेत्र म्हणून विकासासाठी या जागेची आवश्यकता असल्याचे राज्य शासनाचे मत आहे ;
आणि, ज्याअर्थी उक्त जमिनीच्या जमीन मालकांचे व त्यात हितसंबंध असलेल्या व्यक्तींचे म्हणणे अधिनियमांच्या कलम ३२ चे पोट - कलम ( २ ) प्रमाणे एकूण घेतलेले आहे व त्यानुसार महाराष्ट्र शासनाने या कलमाच्या ३२ चे पोट - कलम ( १ ) च्या अनुषंगाने उक्त जमीन संपादन करण्याचा निर्णय घेतला आहे .
त्याअर्थी, महाराष्ट्र औद्योगिक विकास अधिनियम , १ ९ ६१ चे कलम ३२ ( १ ) चा वापर करून सदर जमिनी उपरोक्त कारणासाठी संपादित केल्या असल्याबद्दलची ही नोटीस महाराष्ट्र शासन या कलमा अन्वये प्राप्त अधिकारांचा वापर करून प्रसिद्ध करीत आहे.

Notice
MAHARASHTRA INDUSTRIAL DEVELOPMENT ACT , 1961 .
No. IDC . 2021 /( C.R.183 ) /IND 14. Whereas by Government of Maharashtra has by the Government Notification, Industries , Energy and Labour Department , No. IDC . 2021 / ( C.R.183 ) /IND 14, dated the 15th April 2021 , issued under sub - section ( 3) of section 1 of the Maharashtra Industrial Development Act , 1961 (Mah. III of 1962 ) ( hereinafter referred to as " the said Act " ) , and published in the Maharashtra Government Gazette , Extraordinary , Part IV- B, dated 15th April 2021 , on pages 3-4 notified the 15th April 2021 to be the date from which the provisions of Chapter VI of the said Act , shall take effect in certain areas of village , ' Jamgaon ' in Taluka , ' Roha ' , District , "Raigad " , mentioned in the Schedule appended to the said notification ( hereinafter referred to as " the said area " ) and declared the said area as an industrial area under clause (g ) of section 2 of the said Act for the purposes of the said Act;
And whereas , the lands mentioned in the Schedule appended hereto ( hereinafter referred to as " the said lands ") are situated in the said areas ;
And whereas , the State Government is of the opinion that the said lands are required by the Maharashtra Industrial Development Corporation for development as an Industrial Area ;
And whereas , after considering the cause shown by the owners in the said lands and by other persons interested therein and after giving such owners and person an opportunity of being heard in pursuance of notice issued under sub- section ( 2) of section 32 of the said Act , the Government of Maharashtra has decided to acquire the said lands in pursuance of the said section ( 1 ) of section 32;
Now, therefore, in exercise of the powers conferred by sub - section ( 1) of section 32 of the said Act , the Government of Maharashtra hereby publishes this notice for acquiring the said lands for the purpose aforesaid .
