ORDER
No. D.T.P.-D.P. Khamgaon(R)-Sec-127(2)-Order-TPV-6-3866.—
Whereas, the Revised Development Plan of Original limit of Khamgaon Municipal Council has been sanctioned under the provisions of Section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Director of Town Planning, Maharashtra State, Pune vide Notification No. D.P. Khamgaon(R)-TPV-6-2562, dated 30th April 1992 (hereinafter referred to as "the said Notifi- cation") and the same has came into the force with effect from 01-11-1993 (hereinafter referred to as "the said sanctioned Development Plan");
And whereas, in the said Sanctioned Development Plan, the land bearing S. No. 29 & 34 of Mouza Sutala Khurd is reserved for Reservation No. 100 "Primary School, Secondary School & Play Ground" admeasuring an area approximately 1.70 Ha. (hereinafter referred to as "the said Reservation") for which Appropriate Authority is Municipal Council, Khamgaon (hereinafter referred to as "the said Appropriate Authority");
And whereas, the land under said reservations have not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said sanctioned Development Plan came into force;
And whereas, on behalf of the concerned land owners of S. No. 34/1 at Mou. Sutala Khurd, Adv. G. K. Mundhada had served a notice in respect of 0.47 Ha. area affected by the said Reservation (hereinafter referred to as "the said Land") under Section 127 (1) of the said Act (hereinafter referred to as "the said Notice") on the said Appropriate Authority on 9-07-2015, which was received by the said Appropriate Authority on 13-07-2015 ;
And whereas, the said land under the said reservation is not acquired or no steps for acquisition of the said land as required under Section 127 (1) of the said Act has been taken by the said Appropriate Authority, within a stipulated period from the date of service of the said notice under Section 127 (1) of said Act ;
And whereas, the Chief Officer, Khamgaon Municipal Council vide letter No. 600/2021, dated 02-07-2021 has communicated that, the notification under Section 126 (4) has not been published & the Hon'ble High Court, Mumbai, Nagpur Bench on 28-02-2018 in Writ Petition No. 860/2017 has declared that the said Reservation on the said land is lapsed;
And whereas, the Joint Director of Town Planning, Amravati Division, Amravati vide its letter No. 933,dated 03-08-2021 has submitted report stating that, the said land is affected by the said Reservation and as per the order mentioned above of the Hon'ble High Court, Mumbai, Nagpur Bench, it is necessary to issue order under Section 127 (2) of the said Act ;
And whereas, after considering the above facts in respect of the said reservation on the said land in the said sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is on the opinion that, it is necessary to issue the order under Section 127 (2) of the said Act, regarding the lapsing of the said reservation partly on the said land ;
४ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, रू]क्ष्दन् १६-२२, २०२१/ २५-३१, ॅ १९४३And whereas, the Government in Urban Development Department under Section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 1-12-2016 has delegated the powers exercisable by it to take action under Section 127 (2) of the said Act , to the Director of Town Planning, Maharashtra State, Pune in respect of Development Plans undertaken by all Municipal Councils /Nagar Panchayats / Zilla Parishad as a Planning Authority.
Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as mentioned in the Schedule hereinafter hereby notify the lapsing of the said reservation partly in respect of the said land under Section 127(2) of the said Act and for that purpose amends the said Notification of the said sanctioned Development Plan, as follows .
After the last entry in the Schedule of Modifications accompanying the said Notification of the said Sanctioned Development Plan, the following new entry shall be added.—

ORDER
No. D.T.P.-D.P. Warud(R+A)-Sec-127(2)-Order-TPV-VI-3867.—
Whereas, the Development Plan of Warud Municipal Council [Revised + Additional] has been partly sanctioned under the provisions of Section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government in Urban Development Department vide its Notification No. TPS-2803-1896-CR-8(A)-2004-UD-30, dated 15-07 2005 (hereinafter referred to as "the said No- tification") and came into force with effect from 01-09-2005, while Republished Development Plan of Excluded Part of Warud has been sanctioned vide Notification No. TPS-2806-379-CR-243-2006-UD-30, dated 06-06-2007 and came ino force with effect from 16-07-2007 (hereinafter referred to as "the said Sanctioned Development Plan");
And whereas, in the said Sanctioned Development Plan, the lands bearing S. No. 390 (Part), S. No. 393 (Part), & S. No. 397 (Part),of Mouza Warud is reserved for Site No. 12 "Parking" (hereinafter referred to as "the said Reservation") for which Appropriate Authority is Municipal Council, Warud (hereinafter referred to as "the said Appropriate Authority");
And whereas, the land under said reservation has not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said Sanctioned Revised Development Plan came into force;
And whereas, the concern Land Owners (hereinafter referred to as "the said Land Owner") of the land bearing S. No. 393 (Part) Mouza Warud (hereinafter referred to as "the said Land") under the said reservation had served a notice, dated 18-12-2017 under Section 127 (1) of the said Act, (hereinafter referred to as "the said Notice") on the said Appropriate Authority which was received on dated 11-06-2018 ;
And whereas, the said land is not acquired or no steps as required under Section 127(1) of the said Act have been taken by the said Appropriate Authority, within a stipulated period from the date of service of the said notice ;
And whereas,the General Body Meeting Warud Municipal Council has given approval for the proposal of deletion of reservation on the said land vide Resolution No. 113, dated 30-12-2018 and accordingly the Chief Officer, Municipal Council, Warud vide letter No 1907, dated 10-09-2020 has communicated its no objection for lapsing of the said Reservation ;
And whereas, as per the revised report of the Joint Directior of Town Planning, Amravati Division, Amravati vide letter No. 960, dated 04-08-2021, it is clarified that area admeasuring 0.47 Ha.of the said land is affected by the said Reservation ;
And whereas, after considering the above facts in respect of the said reservation of the said land in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order under Section 127 (2) of the said Act, regarding the lapsing of the said reservation partly of the said land ;
And whereas, the Government in Urban Development Department under Section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 1-12-2016 has delegated the powers exercisable by it under Section 127 (2) of the said Act , in respect of Development Plans of all Municipal Councils /Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune ;

After the last entry in the Schedule of Modifications accompanying the said Notification of the said Sanctioned Development Plan, the following new entry shall be added.—

Note : (1) The said land so released from the said reservtion shall become available to the said land owner for the purpose of development as othrwise permissible in the case of adjacent land under the said sanctioned Development Plan.
(2) A copy of the part plan of the said Sanctioned Development Plan showing the area of the said land which is lapsed from the said reservations, is available in the office of the Chief Officer, Municipal Council, Warud district Amravati during office hours on all working days for inspection to public up to one month.
(3) This Order shall also be published on the Directorate's official web site www.dtp.maharashtra.gov.in.
