Declaration of Intention prepare Revised Development Plan of Sewagram (N.M.C.) as per
Section 23 (1) read with Section 38 of Maharashtra Regional and Town Planning Act, 1966
No. ZPW-GP-F-SDP-WS-1773-2021.—
The Development Plan of Sewagram (N.M.C) has been sanctioned by the Director of Town Planning Maharashtra State, Pune Vide Notification No. D.P. Sewagram (N.M.C.)/TPV-vi/7691, date 19/12/1989 and came into force w.e.f. date 15/07/1990. As per the Section 38 of Maharashtra Regional and Town Plan- ning Act, 1966 Development Plan has to be revise at least once in twenty years from the dated on which a Development Plan has come into operation.
Hence, the Zilla Parishad, Wardha by its Resolution No.-06, dated 23/06/2021 has given consent to declare its intention to revise Sewagram (N.M.C.) Development Plan as per provision of Section 23 (1) read with Section 38 of Maharashtra Regional and Town Planning Act, 1966. Accordingly, this notice is being published.
The Plan Showing boundary of the area included in Development Plan of Sewagram (N.M.C.) is kept open for inspection by the public on office working days, during office hours at the office of Zilla Parishad, Wardha/Gram Panchayat, Sewagram, Warud, Barbadi, Kamathwada, Nandora as per required under Section 23 (2) of the Maharashtra Regional and Town Planning Act, 1966.
Any suggestion/ objection of the public in this regard, may be forwarded in writing to the Chief Execu- tive Officer, Zilla Parishad, Wardha within a period of 60 (Sixty) days from the date of publication of this notice in Maharashtra Government Gazette. The suggestion/objection shall be duly considered while preparing the Development Plan.

Where as, the Revised Regional Plan of Nagpur Region (hereinafter referred to as "the said Regional Plan") has been sanctioned by the Government vide Urban Development Department's Notification No.TPS-४ द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, रू]क्ष्दन् १६-२२, २०२१/ २५-३१, ॅ १९४३ 2496/1505/CR-273/96/UD-9, Dated the 6th May, 2000 under Section 15 of the Maharashtra Regional and Town Planning Act, 1966 (Mah.XXXVII of 1966) (hereinafter referred to as "the said Act") and has come into force with effect from the 15th July, 2000;
Whereas, Government vide Resolution No. TPS 1815/CR-49/15/UD-13, dated 6th May,2015 issued directive under Section 154 of the Maharashtra Regional and Town Planning Act, 1966 regarding the procedure to be followed under Section 20 of the said Act for making changes in the use of land in the ares of sanctioned Regional Plans under the said Act and issued order to follow revised procedure related to above directives vide Govt. Resolution No. TPS-1815/C.No.49/15/UD-13, Dated-04.01.2016; and in exercise of the powers conferred by sub-section (1) of Section 151 of the said Act, the Government vide its notification No. TPS-1815/CR-49/15/UD-13, Dated 06/05-2015, delegated the powers exercisable by it under the provisions of Section 20 (3) & 20 (4) of the said Act, (subject to conditions mentioned therein) to the Divisional Joint Director of Town Planning for Nagpur Administrative Division;
And whereas, land admeasuring approx 11.21 hectare bearing Survey No. 154/1/A, 155, 156/B/1, 157, 158, 159,160, 161, 162 A/ 2/ 3, 162 /A/3, 162/C/3 of Mouza- Manegaon, Tah. Saoner, District-Nagpur & land admeasuring approx 4.0 hectare bearing Survey No. 413, 414, 415, 416 of Mouza- Malegaon, Tah. Saoner, District- Nagpur total land admeasuring approx 15.21 hectare (hereinafter referred to as "the said Area") is included in 'Agriculture Zone' of proposal Land Use Plan in the sanctioned Regional Plan of Nagpur;
And whereas, the "Proposal Scrutiny & Sanctioning Committee" established under the above mentioned Government Resolution, after consulting to the Director of Town Planning, Maharashtra State, Pune, is of the opinion that the said Area should be deleted from "Agriculture Zone" and should be included in "Residential Zone" in accordance with the provisions of sub-section (2) of Section 20 of the said Act, subject to following conditions---
(1) It will be binding for the applicant to pay requisite premium and to follow conditions laid down in the above said Government Resolutions.
(2) At the time of submission of layout plan, it will be binding for the applicant to propose minimum 23.0 mt. wide Buffer Zone with adjoining existing industry.
(3) It will be binding for the applicant's to follow recommendations prescribed in letter dated 13-08- 2020 issued by Senior Geologist, G.S.D.A. regarding sufficient water availability.
Now, therefore, under the power delegated by the Govt. in this regard, suggestions/objections with reasons are invited from General Public in accordance with Notice u/s 20 (3) of said Act in respect of proposed modification within 30 days from the date of publication of this notice in the Maharashtra Govern- ment gazette;

Modification under Section 37 of Maharashtra Regional And Town Planning Act, 1966.
No. NMC-TPD-903-2021.—
Whereas, the Revised Development Plan of Nagpur City prepared under the provisions of Mahrashtra Regional and Town Planning Act, 1966, Section 31(1) has been partially sanctioned by the Govt. vide Urban Development Department Notification No. TPS-2496-2643-CR-300(a)-97-UD-9, Date 7th January 2000 and came into force from 1st March 2000. Excluded part of development plan has been sanctioned Vide Govt. Notification No. TPS-2400-1628-CR- 200-2000-UD-9, Dated 10th September 2001 and came into force from Date 21st September 2001. Also Nagpur Municipal Corporation has been declared as the "Planning Authority" for Nagpur City except the area covered under seven schemes vide Govt. Notification No. TPS-2401-855-CR-76-UD-9, Date 27th February 2002.
However, as per the Government Notification No. TPS-2419-1419-CR-No. 154-2019-UD-9, Date 27th August 2019 under the Nagpur Improvement Trust Jurisdiction the Planning of the seven schemes under Nagpur Municipal Corporation has also been declared by the Government but as per the Govt. Notification No. TPS-2419-1419-CR-No.154 (Bhag-1)-2019-CR-9, Dated 09-04-2021 so the power has been given to implement seven projects under Nagpur Municipal Corporation and Nagpur Improvement Trust.
"In the sanctioned Development Plan of Nagpur City. The land bearing C.T.S. No. 327 at Mouza-Dhantoli, Nazul Plot No. 30, Area 925 Sqm. land to be deleted Residential Zone and included in Commercial Zone. As per Section 37(1) of the Maharashtra Regional and Town Planning Act, 1966.
The Nagpur Municipal Corporation has passed the Resolution No. 98, dt. 22-06-2021 has to make the aforesaid modificationn. The part plan of Development Plan of Nagpur City showing the aforesaid modification are kept open at the office of the Town Planning Deptt. of Nagpur Municipal Corporation for inspection by public during office hours on all working days. The suggestions and objections which may be received to Municipal Corporation in respect of the said modification to the Development Plan within a period of one month from the date of publication of this notice, will be heard by the Municipal Commissioner before submitting the said modification proposal, to the State Government for sanction.
