भारताचे संविधान
क्र.सेप्रनि-२०१८ /प्र.क्र.१७ /२०१८ /जल -२ .- भारताच्या संविधानाच्या अनुच्छेद ३० ९ च्या परंतुकाद्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून, महाराष्ट्राचे राज्यपाल याद्वारे , महाराष्ट्र शासनाच्या मृद व जलसंधारण विभागाच्या अधिपत्याखालील महाराष्ट्र अभियांत्रिकी सेवेमधील जलसंधारण अधिकारी , ( स्थापत्य ) गट- ब ( अराजपत्रित ) या पदाच्या सेवा प्रवेशाचे विनियमन करण्यासाठी पुढील नियम करीत आहेत, ते असेः-
१. या नियमांना मृद व जलसंधारण विभागातील महाराष्ट्र अभियांत्रिकी सेवेमधील जलसंधारण अधिकारी , ( स्थापत्य ) गट - ब, ( अराजपत्रित ) ( सेवाप्रवेश ) नियम , २०२० असे संबोधण्यात येईल .
२. संदर्भानुसार दुसरा अर्थ अपेक्षित नसेल तर या नियमात, -
( क ) " आयुक्त" याचा अर्थ आयुक्त, मृद व जलसंधारण, महाराष्ट्र राज्य;
( ख ) " आयुक्तालय" याचा अर्थ आयुक्तालय , मृद व जलसंधारण, महाराष्ट्र राज्य;
(ग ) "स्थापत्य अभियांत्रिकी पदवी " याचा अर्थ सांविधानिक विद्यापीठाची स्थापत्य अभियांत्रिकीमधील पदवी किंवा शासनाने त्यास समकक्ष म्हणून घोषित केलेली अर्हता;
(घ ) " स्थापत्य अभियांत्रिकी पदविका " याचा अर्थ अखिल भारतीय तंत्रशिक्षण परिषद मान्यताप्राप्त स्थापत्य अभियांत्रिकी पदविका किंवा शासनाने त्यास समकक्ष म्हणून घोषित केलेली अर्हता;
(च ) "विभाग " याचा अर्थ मृद व जलसंधारण विभाग ;

(छ ) "शासन" याचा अर्थ महाराष्ट्र शासन;
( ज ) "जलसंधारण अधिकारी , ( स्थापत्य ) गट- ब ( अराजपत्रित ) " याचा अर्थ विभागाच्या अधिपत्याखालील राज्यस्तर यंत्रणेतील व जिल्हा परिषद यंत्रणेतील "जलसंधारण अधिकारी गट- ब ( अराजपत्रित ) " होय;
( झ ) "निवड समिती " याचा अर्थ आयुक्त , मृद व जलसंधारण यांच्या अध्यक्षतेखाली गठीत केलेली समिती .
३. महाराष्ट्र अभियांत्रिकी सेवा गट - ब मधील जलसंधारण अधिकारी , ( स्थापत्य ) गट- ब ( अराजपत्रित ) या पदावरील नियुक्ती, -
( क ) मंडळ अधिकारी जलसंधारण, ( स्थापत्य ) , गट- क हे पद धारण करणाऱ्या व त्या पदावर ३ वर्षांपेक्षा कमी नसेल इतकी नियमित सेवा झालेल्या व्यक्तीमधून ज्येष्ठता अधीन पात्रता या निकषावर योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल ; किंवा (ख ) खालील उमेदवारांतून निवड समितीमार्फत नामनिर्देशनाने, –
( १ ) ज्याचे वय एकोणीस वर्षांपेक्षा कमी नाही व अडतीस वर्षांपेक्षा जास्त नाहीः
परंतु असे की , मागासवर्गीय उमेदवारांच्या बाबतीत उच्च वयोमर्यादा पाच वर्षे शिथिलक्षम राहील; आणि ( २ ) ज्यांनी स्थापत्य अभियांत्रिकीमधील पदविका किंवा पदवी धारण केली आहे.
४. पदोन्नती व नामनिर्देशन याद्वारे करावयाच्या नेमणुका अनुक्रमे १०ः ९ ० या प्रमाणात करता येतील .
५. नामनिर्देशनाद्वारे नियुक्त करण्यात आलेली व्यक्ती एक वर्षाच्या कालावधीसाठी परिविक्षाधीन राहील. सदर परिविक्षाधीन कालावधी कमाल एक वर्षाकरिता वाढविता येईल . या पदावर नियुक्त करण्यात आलेल्या व्यक्तीस विभागीय परीक्षा उत्तीर्ण होणे आवश्यक असेल आणि शासनाने विहित केले असेल असे प्रशिक्षण घेणे आवश्यक असेल. या पदावर नियुक्त करण्यात आलेल्या व्यक्तीस परिविक्षाधीन कालावधी समाधानकारकरित्या पूर्ण करणे आवश्यक असेल . जर सदर व्यक्तीने परिविक्षाधीन कालावधी समाधानकारकरित्या पूर्ण केला नाही किंवा विभागीय परीक्षा उत्तीर्ण केली नाही किंवा सबंधित प्रशिक्षण पूर्ण केले नाही किंवा सदर व्यक्ती परिवीक्षा कालावधीत सदर पदासाठी योग्य नसल्याचे आढळून आल्यास सेवा समाप्त करण्यास पात्र राहील .
६. नियम ३ मधील पदावर नियुक्त करण्यात आलेल्या व्यक्तीस नियमानुसार हिंदी व मराठी भाषा परीक्षा , जर ती व्यक्ती आधीच या परीक्षा उत्तीर्ण नसेल तर अथवा अशा परीक्षा उत्तीर्ण होण्यापासून सूट देण्यात आली नसेल तर , उत्तीर्ण होणे आवश्यक असेल .
७. नियम ३ मधील पदावर नियुक्त करण्यात आलेल्या व्यक्तीस महाराष्ट्र शासनाच्या माहिती तंत्रज्ञान संचालनालयाने , वेळोवेळी विहित करण्यात आलेले संगणक हाताळणीविषयक प्रमाणपत्र विहित कालावधीत धारण करावे लागेल .
८. नियम ३ मधील पदावर नियुक्त करण्यात आलेली व्यक्ती महाराष्ट्र राज्यामध्ये कोठेही बदली होण्यास पात्र राहील .

CONSTITUTION OF INDIA
No.SPN - 2018 / C.R.17 / 2018 / Jal - 2.-In exercise of the powers conferred by the proviso to article 309 of the Constitution of India , the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the post of Water Conservation Officer , (Civil ) Group - B , ( Non- Gazetted) in the Maharashtra Service of Engineers , under the Soil and Water Conservation Department , Government of Maharashtra , namely : -
1. These rules may be called the Water Conservation Officer , ( Civil) Group - B , (Non- Gazetted ) , in the Maharashtra Service of Engineers , under the Soil and Water Conservation Department (Recruitment ) Rules , 2020 .
2. In these rules unless the context requires otherwise , -
( a) " Commissioner " means the Commissioner , Soil and Water Conservation , Maharashtra State ;
(b) " Commissionerate " means the Commissionerate of Soil and Water Conservation , Maharashtra State ;
(c) " Civil Engineering Degree " means a Degree in Civil Engineering of a Statutory University or any other qualification declared by Government to be equivalent thereto ;
( d) " Civil Engineering Diploma " means Diploma obtained in Civil Engineering from All India Council for Technical Education or any other qualification declared by Government to be equivalent thereto;
(e) "Department " means the Soil and Water Conservation , Department of the Government of Maharashtra ;
(f) "Government " means the Government of Maharashtra;
(g) "Water Conservation Officer , ( Civil ) Group-B ( Non - Gazetted ) " means Water Conservation Officer , Group- B ( Non- Gazetted ) of State and Zilla Parishad level under the Department ;
(h) " Selection Committee " means the Committee constituted under the Chairmanship of Commissioner .
3. Appointment to the post of Water Conservation Officer , ( Civil) Group- B ( Non - Gazetted ) , in the Maharashtra Service of Engineers shall be made either ,
(a) by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of Circle Officer , Water Conservation ( Civil ) Group- C and having completed not less than three years of regular service on the post ; or
(b) by nomination through Selection Committee from amongst the persons who ,- (i) are not less than nineteen years of age and not more than thirty - eight years ofage:
Provided that , the upper age limit may be relaxed by five years for a candidate belonging to Backward Class Categories ; and
(ii) possess either Diploma or Degree in Civil Engineering .

4. Appointment to the post made by promotion and by nomination shall be in the ratio of 10:90 , respectively .
5. A person appointed to the post by nomination shall be on probation for a period of one year . Probation period may be extended maximum upto one year . A person appointed on the post shall be required to pass the Departmental Examination and undergo such training ( if any prescribed) by Government in that behalf. A person appointed to the post shall be required to complete probation period satisfactorily. If he does not complete the probation period satisfactorily or does not pass the Departmental Examination or does not attend respective training or is not found suitable for the post during the probation period , he shall be liable to be terminated from the service .
6. A person appointed to the post shall be required to pass the examinations in Hindi and Marathi Languages according to the Rules made in that behalf, unless he has already passed or has been exempted from passing those examinations .
7. A person appointed to post shall possess a Certificate in Computer Operation prescribed by the Directorate of Information Technology , Government of Maharashtra , from time to time .
8. A persons appointed to the post shall be liable for transfer anywhere in the State of Maharashtra .
