भारताचे संविधान.
क्रमांक आयपीए २११३ /प्र.क्र.१४९ /कार्यासन-१ . भारताच्या संविधानाच्या अनुच्छेद ३० ९ खालील परंतुकान्वये प्रदान केलेल्या शक्तींचा वापर करून व यासंदर्भातील सध्या अस्तित्वात असलेले सर्व नियम , आदेश किंवा संलेख यांचे अधिक्रमण करून महाराष्ट्राचे राज्यपाल, याद्वारे , महाराष्ट्र शासनाच्या विधि व न्याय विभागाच्या अधिपत्याखालील निबंधक, भागीदारी संस्था यांच्या आस्थापनेवरील निबंधक भागीदारी संस्था, उपनिबंधक, भागीदारी संस्था, गट- अ आणि सहायक निबंधक , भागीदारी संस्था , गट - ब ( राजपत्रित) या पदांच्या सेवाभरतीचे विनियमन करणारे पुढील नियम करीत आहेत , ते असे:-
१. या नियमांना " निबंधक, भागीदारी संस्था; उपनिबंधक, भागीदारी संस्था , गट-अ आणि सहायक निबंधक, भागीदारी संस्था, गट- ब (राजपत्रित ) (सेवाप्रवेश ) नियम, २०२१ " असे संबोधण्यात यावे.
२. या नियमांमध्ये, संदर्भानुसार दुसरा अर्थ अपेक्षित नसेल तर,-
(अ) " सहायक निबंधक" याचा अर्थ , भारतीय भागीदारी अधिनियम, १ ९ ३२ ( १ ९ ३२ चा ९ ) मधील कलम ५७ च्या उप - कलम ( २ ) अन्वये नियुक्त करण्यात आलेले सहायक निबंधक, भागीदारी संस्था ;
(ब) " आयोग" याचा अर्थ, महाराष्ट्र लोकसेवा आयोग ;
(क) " पदवी " याचा अर्थ, सांविधिक विद्यापीठाची पदवी आणि यामध्ये शासनाने त्यास समकक्ष म्हणून घोषित केलेली कोणतीही समकक्ष अर्हता याचा समावेश होतो ;
(ड) " उपनिबंधक" याचा अर्थ , भारतीय भागीदारी अधिनियम , १ ९ ३२ (१ ९ ३२ चा ९ ) मधील कलम ५७ च्या उप -कलम (२ ) अन्वये नियुक्त करण्यात आलेले उपनिबंधक , भागीदारी संस्था ;
(इ) "शासन" याचा अर्थ, महाराष्ट्र शासन ;
(फ) " निबंधक " याचा अर्थ , भारतीय भागीदारी अधिनियम , १ ९ ३२ (१ ९३२ चा ९ ) मधील कलम ५७ च्या उप - कलम ( १ ) अन्वये नियुक्त करण्यात आलेले निबंधक , भागीदारी संस्था.
३. निबंधक, भागीदारी संस्था या पदावरील नियुक्ती खालील मार्गाने करण्यात येईल , -
भाग चार-अ-१५९-१
(१) २
महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, सप्टेंबर २३ , २०२१ / आश्विन १ , शके १९ ४३
( अ) उपनिबंधक हे पद धारण करणाऱ्या व या पदावर किमान ३ वर्षे नियमित सेवा पूर्ण केलेल्या व्यक्तींमधून जेष्ठतेच्या अधीन निव्वळ गुणवत्ता व योग्यता या निकषावर योग्य व्यक्तीच्या पदोन्नतीने;
किंवा
(ब) शासन सेवेत समकक्ष पद धारण करणाऱ्या व विधि पदवी धारण करणाऱ्या योग्य व्यक्तींमधून बदलीने प्रतिनियुक्तीवर ;
किंवा
(क) खालील अटी पूर्ण करणाऱ्या व्यक्तींमधून नामनिर्देशनाने,
( i ) ज्यांचे कमाल वय अडतीस वर्षांपेक्षा जास्त नाही ;
परंतु मागासवर्गीय उमदेवार किंवा शासकीय सेवेत कार्यरत असलेल्या उमेदवारांच्या बाबतीत उच्च वयोमर्यादा पाच वर्षापर्यंत शिथिल राहील; आणि
(ii) ज्यांनी विधि पदवी धारण केली आहे; आणि
(iii ) ज्यांनी या खंडातील उपखंड ( ii ) मधील नियमानुसार विधि पदवी धारण केल्यानंतर शासकीय विभाग किंवा शासकीय कार्यालय किंवा स्थानिक प्राधिकरण यामध्ये कायद्याचा अर्थ लावणे किंवा अधिनियमांचे प्रशासन या कामाचा किमान दहा वर्षे प्रत्यक्ष अनुभव धारण केला आहे; किंवा
ज्यांनी उच्च न्यायालयामध्ये किंवा कोणत्याही दुय्यम न्यायालयामध्ये वकील म्हणून किमान सात वर्षे कामाचा प्रत्यक्ष अनुभव धारण केला आहे.
४. उपनिबंधक या पदावरील नियुक्ती खालील मार्गाने करण्यात येईल :-
(अ ) सहायक निबंधक हे पद धारण करणाऱ्या व या पदावर किमान तीन वर्षे नियमित सेवा पूर्ण केलेल्या व्यक्तीमधून जेष्ठतेच्या अधीन निव्वळ गुणवत्ता व योग्यता या निकषावर योग्य व्यक्तीच्या पदोन्नतीने ;
किंवा
(ब) शासन सेवेत समकक्ष पद धारण करणाऱ्या व विधि पदवी धारण करणा- या योग्य व्यक्तींमधून बदलीने प्रतिनियुक्तीवर.
५. सहायक निबंधक या पदावरील नियुक्ती खालील मार्गाने करण्यात येईल: -
( अ) अधीक्षक हे पद धारण करणाऱ्या व या पदावर किमान तीन वर्षे नियमित सेवा पूर्ण केलेल्या आणि विधि पदवी धारण करणाऱ्या व्यक्तींमधून जेष्ठता अधीन पात्रता या निकषावर योग्य व्यक्तीच्या पदोन्नतीने ;
किंवा
(ब) शासन सेवेत समकक्ष पद धारण करणाऱ्या व विधि पदवी धारण करणाऱ्या योग्य व्यक्तींमधून बदलीने प्रतिनियुक्तीवर ;
किंवा
(क) खालील अटी पूर्ण करणा-या व्यक्तींमधून नामनिर्देशनाने ,-
( i ) ज्यांचे कमाल वय अडतीस वर्षांपेक्षा जास्त नाही;
परंतु मागासवर्गीय उमदेवार किंवा शासकीय सेवेत कार्यरत असलेल्या उमेदवारांच्या बाबतीत उच्च वयोमर्यादा पाच वर्षापर्यंत शिथिल राहीलः आणि
(ii ) ज्यांनी विधि पदवी धारण केली आहे; आणि
(iii) ज्यांनी या खंडातील उपखंड ( ii ) मधील अर्हता धारण केल्यानंतर, शासकीय विभाग, स्थानिक प्राधिकरण यामध्ये कायद्याचा अर्थ लावणे किंवा अधिनियमाचे प्रशासन या कामाचा किमान तीन वर्षे इतका प्रत्यक्ष अनुभव धारण केला आहे ; किंवा ज्यांनी उच्च न्यायालयामध्ये किंवा कोणत्याही दुय्यम न्यायालयामध्ये वकील म्हणून किमान तीन वर्षे इतका प्रत्यक्ष कामाचा अनुभव धारण केला आहे .
६. नियम ५ मध्ये नमूद केलेल्या पदावर पदोन्नतीने व नामनिर्देशनाने अनुक्रमे १५:८५ या प्रमाणात नियुक्त्या करण्यात येतील.
७. नियम ३ व ५ मध्ये नामनिर्देशनाने नियुक्त केलेल्या व्यक्ती दोन वर्षाच्या कालावधीसाठी परिवीक्षाधीन राहतील . परिवीक्षा कालावधी एक वर्षापर्यंत अथवा शासनाने विहित केलेल्या प्रचलित धोरणानुसार वाढविता येईल. या पदांवर नियुक्त केलेल्या व्यक्तीने परिवीक्षा ३ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, सप्टेंबर २३ , २०२१ / आश्विन १, शके १ ९ ४३
कालावधी समाधानकारकरित्या पूर्ण करणे आवश्यक राहील. जर त्याने परिवीक्षा कालावधी यशस्वीरित्या पूर्ण केला नाही किंवा तो सदर पदासाठी योग्य नसल्याचे आढळून आल्यास त्याची सेवा समाप्त करण्यास पात्र राहील.
८. नियम ३ व ५ मध्ये नमूद केलेल्या पदांवर नियुक्त व्यक्तीने, त्याबाबत करण्यात आलेल्या नियमानुसार हिंदी व मराठी भाषा परीक्षा अगोदरच उत्तीर्ण केल्या नसतील किंवा त्या परिक्षा उत्तीर्ण होण्यापासून सूट मिळाली नसेल तर त्याला सदर परीक्षा उत्तीर्ण होणे आवश्यक राहील.
९. नियम ३ व ५ मध्ये नमूद पदांवर नियुक्त झालेल्या व्यक्तींने, महाराष्ट्र शासनाच्या माहिती व तंत्रज्ञान संचालनालयाने वेळोवेळी विहित केलेले संगणक हाताळणीमध्ये निपुण असल्याचे प्रमाणपत्र धारण करणे आवश्यक राहील .
१०. नियम ५ मध्ये नमूद पदावर नियुक्त केलेली व्यक्ती, महाराष्ट्र राज्यात कोठेही बदली केली जाण्यास पात्र राहील.
११. या नियमामध्ये काहीही अंतर्भूत असले तरी, शासनाच्या मते नियम ५ मधील नियुक्तीसाठी सेवेची निकड असल्यास शासनास , नियम ६ मध्ये विहित केलेले प्रमाण शिथिल करून आयोगाच्या सल्लामसलतीने या पदावर नियुक्त्या करता येतील.

NOTIFICATION
CONSTITUTION OF INDIA.
No.IPA 2113 / C.R. 149/Desk - 1.-In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all existing rules , orders or instruments made in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the posts of Registrar of Firms , Deputy Registrar of Firms , Group -A and Assistant Registrar of Firms , Group - B ( Gazetted) on the establishment of Registrar of Firms under the Law and Judiciary Department of the Government of Maharashtra , namely :-
1. These Rules may be called the Registrar of Firms , Deputy Registrar of Firms , Group -A and Assistant Registrar of Firms , Group - B ( Gazetted) ( Recruitment ) Rules , 2021 .
2. In these Rules , unless the context requires otherwise ,-
(a) "Assistant Registrar" means the Assistant Registrar of Firms , appointed under sub - section ( 2 ) of section 57 of the Indian Partnership Act , 1932 ( IX of 1932 ) ;
(b) " Commission " means the Maharashtra Public Service Commission;
(c) "Degree" means a degree of a statutory University and it includes any other qualification declared by the Government to be equivalent thereto ;
(d) "Deputy Registrar" means the Deputy Registrar of Firms appointed under sub - section ( 2 ) of section 57 of the Indian Partnership Act , 1932 ( IX of 1932 ) ;
(e) "Government " means the Government of Maharashtra ;
(f) "Registrar" means the Registrar of Firms appointed under sub - section ( 1 ) of section 57 of the Indian Partnership Act , 1932 ( IX of 1932 ) .
3. Appointment to the post of Registrar shall be made either ,
(a) by promotion of a suitable person on the basis of strict selection with due regard to seniority subject to fitness , from amongst the persons holding the post of Deputy Registrar , having completed not less than three years regular service in that post ;
or
(b) by transfer on deputation of a suitable person holding equivalent post in the Government service and possessing a degree in Law;
or
(c) by nomination from amongst the persons , who ,-
(i) is not more than thirty - eight years of age :
Provided that the upper age limit shall be relaxed by five years in case of candidates belonging to backward class category or candidates already in the Government Service; and

(iii) posses practical experience of interpretation of law or administration of Acts in the Government Office or Government Department or Local Authority for a period of not less than ten years after acquiring the qualification mentioned in sub - clause ( ii ) of this clause; or
has practised as an Advocate in the High Court or any sub - ordinate Court for a period of not less than seven years .
4. Appointment to the Post of Deputy Registrar shall be made either ,
(a) by promotion of a suitable person on the basis of strict selection with due regard to seniority subject to fitness , from amongst the persons holding the post of Assistant Registrar having not less than three years regular service in that post ;
or
(b) by transfer on deputation of a suitable person holding equivalent post in the Government Service and possessing a degree in Law .
5. Appointment to the post of Assistant Registrar shall be made either ,-
(a) by promotion of a suitable person on the basis of seniority subject to fitness , amongst the persons holding the post of Superintendent having completed not less than three years regular service in that post and possessing a degree in Law;
or
(b) by transfer on deputation of a suitable person holding equivalent post in the Government Service and possessing a degree in Law ;
or
(c) by nomination from amongst the persons , who ,-
(i) is not more than thirty- eight years of age:
Provided that , the upper age limit shall be relaxed by five years in case of belonging to backward class category candidates or candidates already in Government Service ; and
(ii) posses degree in Law; and
( iii) posses practical experience of interpretation of law or administration of Acts in a Government Office or Government Department or Local Authority for a period of not less than three years after acquiring the qualification mentioned in sub - clause (ii) of this clause; or
has practised as an Advocate in the High Court or any sub - ordinate Court for a period of not less than three years .
6. Appointment by promotion and nomination to the post mentioned in Rule 5 shall be in the ratio of 15:85 .
7. A person appointed by nomination to the posts mentioned in rules 3 and 5 shall be on probation for a period of two years . The probation period may be extended maximum upto one year . A person appointed to the said posts shall complete the probation period satisfactorily . If a person does not complete the prescribed probation period satisfactorily , his services shall be liable to be terminated .
8. A person appointed to the posts mentioned in rules 3 and 5 shall be required to pass examinations in Hindi and Marathi languages according to the rules made in that behalf, unless he has already passed or has been exempted from passing those examinations .

9. A person appointed to the posts mentioned in rules 3 and 5 shall possess a certificate in Computer Operation prescribed by the Directorate of Information Technology , Government of Maharashtra, from time to time .
10. A person appointed to the posts mentioned in rules 4 and 5 shall be liable to be transferred anywhere in the State of Maharashtra .
11. Notwithstanding anything contained in these rules , if in the opinion of the Government , the exigencies of services so require , the Government may wherever necessary make appointment to the post mentioned in rule 5 in relaxation of rule 6 with the consultation of Maharashtra Public Service Commission .
