THE MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

No. TPS-2418-1533-C.R.303-2018-UD-9.—

Whereas, Development Plan of Umred (Revised and Additional Area) City has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2498-287-CR-25-1998-UD-9, dated 08-07-2003 and has came into force with effect from 25-08-2003 (hereinafter referred to as "the said Development Plan") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act");

And whereas, in the said Development Plan, land bearing Survey No. 545 to 559, 562 & 563 admea- suring about 29.89 Hectare of Mouje Umred (hereinafter referred to as "the said Land") are included in No Development Zone (Agricultural) (hereinafter referred to as "the said Zone");

And whereas, the Umred Municipal Council, Umred being the Planning Authority (hereinafter referred to as "the said Planning Authority"), vide its General Body Resolution No. 187, dated 26-02-2016 has resolved to delete said land from the said Zone and to include the same in Residential Zone by Inclusive Proposal. Accordingly after following all the legal procedure as per the provisions of sub-sec- tion (1) of Section 37 of the said Act, submitted a modification proposal to the Government, for its sanc- tion, (hereinafter referred to as "the said Proposed Modification");

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the proposed modification, should be sanc- tioned with some changes ;

And whereas, out of the said lands the Land Owner of the Survey No. 555, 558 & 559 have deposited premium amount as per Government Policy worked out as per the 5% rate of the said land as prescribed in the Annual Statement of Rates (ASR) for the year 2020-2021. Therefore, Government has issued Notification for this area under Section 37(2) of Maharashtra Regional and Town Planning Act, 1966 on dated 9th December, 2020 ;

And whereas, out of the land under the said proposed modification, the Land Owner of the Survey No. 545/1, 545/2, 546, 547/1, 551, 552, 553/1A, 553/1C, & 553/1D of Mouje Umred as per the Govern- ment Policy have deposited Rs. 9,81,886 towards the 50% Government share of premium amount worked out as per the 5% rate of the land rates prescribed in the Annual Statement of Rates (ASR) for the year 2020-21 in the Government Treasury through the Assistant Director of Town Planning, Nagpur Branch, Nagpur and remaining 50% of the premium amount Rs. 9,81,886 payable to the Planning Authority has been deposited with the Chief Officer, Umred Municipal Council, Umred. The owner of the land bear- ing Survey No. 547/2, 548, 549, 550, 553/1B, 553/2, 554 & 557 have not deposited the premium for the said proposed modification ;

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the said Proposed Modification and for that purpose amends the aforesaid Notification dated the 08-07-2003 as follows ;

"In the Schedule of Modifications appended to the Notification dated 08-07-2003 sanctioning the said Development Plan, the following new entry shall be added after the last entry."—

The said proposed modification proposal of land bearing Survey No. 545 to 559, 562 & 563 of Mouje Umred is sanctioned as follows,—

1. The land out of Survey No. 545/1, 545/2, 546, 547/1, 551, 552, 553/1A, 553/1C & 553/1D of Mouje Umred are deleted from No Development Zone (Agricultural) and included in Residential Zone.

And whereas, in the said Development Plan, land bearing Survey No. 525, 526, 527 & 529/1 admea- suring 5.00 Hectare of Mouje Umred (hereinafter referred to as "the said Land") are included in Agricul- tural, partly Residential Zone & 36.00 Mt. proposed Development Plan Road (hereinafter referred to as "the said Zone");

And whereas, the Umred Municipal Council, Umred being the Planning Authority (hereinafter referred to as "the said Planning Authority"), vide its General Body Resolution No. 201, dated 30-12-2017 has resolved to delete said lands from Agricultural Zone and to include the same in Residential Zone.

Accordingly after following all the legal procedure as per the provisions of sub-section (1) of Section 37 of the said Act, submitted a modification proposal to the Government, for its sanction, (hereinafter re- ferred to as "the said Proposed Modification");

And whereas, the Land Owner of the said lands are including in Agricultural Zone have deposited Rs. 8,45,152 towards the 50% Government share of 5% premium amount as per the value of the said land as prescribed in the Annual Statement of Rates (ASR) for the year 2021-2022 in the Government Treasury on 23/07/2021 through the Assistant Director of Town Planning, Nagpur Branch, Nagpur and remaining 50% of the 5% premium amount Rs. 8,45,152 payable to the Planning Authority has been deposited with the Chief Officer, Umred Municipal Council, Umred on 30/07/2021 ;

"In the Schedule of Modifications appended to the Notification dated 08-07-2003 sanctioning the said Development Plan, the following new entry shall be added after the last entry."—

ENTRY

The land bearing Survey No. 525, 526, 527 & 529/1 of Mouje Umred, the land under proposed 36.00 Mt. Development Plan Road is retained & the lands under Agricultural Zone are deleted from Agricul- tural Zone and included in Residential Zone as shown on the plan, subject to the conditions mentioned specified below,—

Condition No. 1 — In addition to 10% compulsory open space, requisite 10% Amenity space shall be provided in the layout as per the prevailing Development Control Regulations for Umred.

Condition No. 2 — It is compulsory for the land owner / developer, to provide all the Basic Amenities required for the land under modification at his own cost.

Condition No. 3 — It shall be compulsory for the land owner to provide necessary Mineral Water Sup- ply for the said modification at his own cost.

Condition No. 4 — If the land is proposed to be developed by way of plotted layout, then sale of plots under such layout shall be monitored by the Chief Officer, Umred Municipal Council, Umred in relation to development of basic amenities as per the stages given below.—

(a)After final approval of layout sale of 25% of the total plots shall be permissible.

(b) After completion of 40% basic amenities. sale of 50% of the total plots shall be permissible.

(d) After completion of 80% basic amenities. sale of 90% of the total plots shall be permissible.

(e)After completion of 100% basic amenities. sale of 100% of the total plots shall be permissible.

If Group housing Scheme is proposed in the layout, then Occupation Certificate shall not be given by Chief Officer, Umred Municipal Council, Umred unless all the basic amenities are fully developed;

A copy of the Notification, along with the part plan showing the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Chief Officer, Umred Municipal Council, Umred during office hours on all working days for a period of one month.
