Whereas, the Regional Plan of Amravati Region (hereinafter referred to as "the said Regional Plan") has been sanctioned by Government Urban Development Department under Section 15(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") vide Notification No. TPS- 2887-CR-196-UD-13, dated the 29th May1993 and has come into force with effect from the 15th August 1993 ;
And whereas, in the peripheral plan of Amravati in the said Regional Plan, the land admeasuring10.72 Ha. bearing Survey No. 6/1Part, 6/2Part, 6/3Part area 0.81 Ha., 8/1b, 8/1d, 8/2, 8/3, 8/4 Area 7.77 Ha. and Sr. No. 9/1, 9/2 area 2.14 Ha. of Mouje Kathora Bu., Ta. & Dist. Amravati, as shown on the part plan (hereinafter referred to as "the said land") is included in Agriculture Zone ;
And whereas, Government has constituted Zone Change Committee (hereinafter referred to as "the said Committee") vide Notification No. TPS-1815-CR-49-15-UD-13, dated 6th May 2015 for zone change proposals of sanctioned Regional Plan up to the Limit of 10.00 Ha. to 25.00 Ha. of land.
And whereas, said committee's meeting was held on 8th June 2021; and after consulting the committee members "said Committee" is of the opinion that the said land in accordance with the provisions of sub-section (2) of Section 20 of the said Act. should be deleted from Agricultural Zone and include in Residential Zone, subject to following condition. (hereinafter referred to as the "Proposed Modification").
Condition No. 1 : While preparing the layout in respect of the said land under modification, apart from the compulsory 10% open space, 10% space shall be kept for public amenities. (This ame- nity space can be developed by the Land owner/Developer for the same purpose. ) Condition No. 2 : It shall be the responsibility of the concerned Land Owner/Developer to provide all basic infrastructure i.e. access Roads, Water Supply, Power Supply etc. in the said land under modification.
Condition No. 3 : It shall be the responsibility of the Land Owner/Developer to pay premium as decided by the Government vide order No. TPS-1815-CR-49-15-UD-13, dated 6th May 2015, dated 11th June 2015 and dated 4th January 2016 also it is necessary to Pay premium on the entire land under this proposal.
Condition No. 4 : If, the said land under modification are proposed to be developed by way of plotted layout, then sale of plots shall be monitored by the Collector, in relation to development of civic amenities as per the stages given below.—
(i) After final approval of layout Sale of 25% of total Plots shall be permissible.
(ii) After completion of 40% of civic Amenities Sale of 50% of total Plots shall be permissible. (iii) After completion of 60% of civic Amenities Sale of 75% of total Plots shall be permissible. (iv) After completion of 80% of civic Amenities Sale of 90% of total Plots shall be permissible. (v) After completion of 100% of civic Amenities Sale of 100% of total Plots shall be permissible.
Condition No. 5 : If, Group Housing Scheme is proposed in the lay-out, then the occupancy certificate shall not be given unless civic amenities specified by the Collector are fully developed. Condition No. 6 : A 12.00 mt. wide service road shall be provided parallel to the existing Walgaon-Revasa- Kathora-Nandgaon Peth S.H. No, 47.

Condition No. 8 : The level of the proposed access road to be joined to the main existing road shall be kept 15.00 cm. lower than the level of the said main road. The culvert below the proposed access road shall be constructed as a 1000mm. dia. Pipe culvert and there should be no obstruction to the outflow of water from the road surface into the nearby nallah.
Condition No. 9 : A target of plantation of minimum 100 tree alongside the road shall be complied with. Condition No. 10 : It shall be binding to procure a permission for construction of an access road to be joined to the existing main road from the Public Works Department, Amravati Office. Condition No. 11 : For rural / non-urban area a building line at a distance of 40.00 mt. and for commercial purpose a control line at a distance of 50.00 mt. respectively from the centre line of a road having a status of a State Highway shall be maintained.
Condition No. 12 : The applicant submitted an indemnity bond for making necessary arrangement of rain water harvesting system for recharge of the ground water. The Owner / Developer do the necessary arrangement about this.
Condition No. 13 : As per the letter dated 23rd April 2021 issued by the Grampanchayat Kathora Bu., it shall be the responsibility of the concerned developer to provide water supply to the residents in the layout or submit the proposal of water supply scheme to concern de- partment through Grampanchayat Kathora Bu.
In case of non-compliance, layout Approval and Non-Agriculture permission shall be liable to be cancelled.
And, whereas, the notice for the Proposed Modification, under the powers conferred by Section 20(3) of the said Act, was published by the Member Secretary, Zone Change Committee, Amravati vide Notice No. R.P. Amt.-Sect-20(3)-C.R.B. (1)- Meeting-11-JDTPAMT-697-2021, Dated 15th June 2021 inviting objections and suggestions from the general public and the Assistant Director of Town Planning, Amravati Branch was appointed as the "Officer" (hereinafter referred to as the "Said Officer") to hear the suggestions and objections received within the stipulated period only and to submit his report on the same to the Member Secretary, Zone Change Committee, Amravati ;
And, whereas, the said Officer submitted his report to the Member Secretary, Zone Change Committee, Amravati vide his letter dated 6th August 2021;
And, whereas, the said committee's meeting was held on 8th September 2021 and after consulting the Member Secretary, Zone Change Committee, Amravati & committee members on the report of the said officer, and the "said committee" is of the opinion that the said land should be deleted from Agricultural Zone and include in Residential Zone subject to certain condition ;
And, whereas, as per zone change policy of Government, the owners of the said land have deposited the premium for the area 10.72 Ha. bearing Survey No. 6/1Part, 6/2Part, 6/3Part area 0.81 Ha., S. No. 8/1b, 8/1d, 8/2, 8/3, 8/4 Area 7.77 Ha. and Sr. No. 9/1, 9/2 area 2.14 Ha. of Mouje Kathora Bu., Ta. & Dist. Amravati, in the Government Account Head on 30th September 2021, so Condition No. 3 is fulfilled.
And, whereas, Government by Order No. TPS-1815-CR-49-15-UD-13, dated 11th June 2015 has delegated power to the Joint Director of Town Planning of respective Division to notify under sub-section (4) of Section 20 of said Act ;
Now, therefore, in exercise of the power conferred under sub-section (4) of Section 20 of the said act, the Joint Director of Town Planning, Amravati Division, Amravati hereby sanctioned the proposed Modification in respect of the said land and for that purpose amends the above referred notification dated the 29th May 1993 as follows :-
" In the Schedule of Modifications appended to the Notification dated the 29th May 1993 sanctioning the said Regional Plan, the following new entry shall be added after the last entry.—"

"In the said Regional Plan, the land admeasuring10.72 Ha. bearing Survey No. 6/1Part, 6/2Part, 6/3Part area 0.81 Ha., S. No. 8/1b, 8/1d, 8/2, 8/3, 8/4 Area 7.77 Ha. and Sr. No. 9/1, 9/2 area 2.14 Ha. of Mouje Kathora Bu., Ta. & Dist. Amravati, should be deleted from agricultural zone and included in Residential Zone subject to certain conditions :-" Condition No. 1 : While preparing the layout in respect of the said land under modification, apart from the compulsory 10% open space, 10% space shall be kept for public amenities.

Condition No. 2 : It shall be the responsibility of the concerned Land Owner/Developer to provide basic infrastructure i.e. access Roads, Water Supply, Power Supply etc. in the said land under modification.
Condition No. 3 : A 12.00 mt. wide service road shall be provided parallel to the existing Walgaon-Revasa- Kathora-Nandgaon Peth S.H. No, 47.
Condition No. 4 : There should be no obstruction whatsoever to the proposed road widening of the existiong Walgaon-Revasa-Kathora-Nandgaon Peth S.H. No, 47.
Condition No. 5 : The level of the proposed access road to be joined to the main existing road shall be kept 15.00 cm. lower than the level of the said main road. The culvert below the proposed access road shall be constructed as a 1000mm. dia. Pipe culvert and there should be no obstruction to the outflow of water from the road surface into the nearby nallah.
Condition No. 6 : A target of plantation of minimum 100 tree alongside the road shall be complied with. Condition No. 7 : It shall be binding to procure a permission for construction of an access road to be joined to the existing main road from the Public Works Department, Amravati Office.

(i) After final approval of layout Sale of 25% of total Plots shall be permissible. (ii) After completion of 40% of civic Amenities Sale of 50% of total Plots shall be permissible. (iii) After completion of 60% of civic Amenities Sale of 75% of total Plots shall be permissible. (iv) After completion of 80% of civic Amenities Sale of 90% of total Plots shall be permissible. (v) After completion of 100% of civic Amenities Sale of 100% of total Plots shall be permissible.
Condition No. 12 : If, Group Housing Scheme is proposed in the lay-out, then the occupancy certificate shall not be given unless civic amenities specified by the Collector are fully developed.
In case breach of any of the above conditions, layout Approval and non-agriculture permission shall be liable to be cancelled.
A copy of the part plan showing the above sanctioned modification shall be kept open for inspection by general public during office hours on all working days for a period of one month at the following offices :-
