In exercise of the powers conferred by sub - section ( 8) of section 24 of the Code of Criminal Procedure , 1973 ( Act No.ll of 1974 ) the Government of Maharashtra hereby appoints , Adv . Shekhar Jagtap , as " Special Public Prosecutor " for conducting the case/s in Hon'ble Magistrate Court , Thane and Sessions Court , Thane , which are arising out of C.R.No.176/ 2021 registered atKopri Police Station , District Thane .
2. The fees of Adv . Shekhar Jagtap , Special Public Prosecutor shall be paid by Home Department as per the fee Proposal agreed by the Home Department and approved by this department .
3. His appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers(Appointment , Conditions of Service and Remuneration ) Rules , 1984 .

आणि ज्याअर्थी , शासनाने नियोजन प्राधिकरण म्हणून सिडकोचे क्षेत्र, पिंपरी - चिंचवड नवनगर विकास प्राधिकरण क्षेत्र , मल्टीमोडल इंटरनॅशल हब एअरपोर्ट ( मिहान ) अधिसूचित क्षेत्र , विशेष नियोजन प्राधिकरण म्हणून महाराष्ट्र विमानतळ विकास कंपनी लि. चे ( एमएडीसी) शिर्डी विमानतळ अधिसूचित क्षेत्र आणि विशेष नियोजन प्राधिकरण म्हणून महाराष्ट्र राज्य रस्ते विकास महामंडळाचे अधिसूचित क्षेत्र , या क्षेत्रांना उक्त मंजूर एकत्रिकृत विकास नियंत्रण व प्रोत्साहन नियमावली लागु करण्यासाठी उक्त अधिनियमाच्या कलम ३७ ( १ कक) व कलम २० (३ ) अन्वये अनुक्रमे सूचना क्रमांक टिपीएस -१८१८ / प्र.क्र.२३६ / १८ / कलम ३७ ( १ कक) व कलम २० (३ ) / नवि -१३, दि.०२ / १२ / २०२० आणि सूचना क्रमांक टिपीएस-१८१८ /प्र.क्र.२३६ / १८ / कलम २० ( ३ ) / नवि -१३ , दि.०२ / १२ / २०२० प्रसिध्द केल्या असून कलम १५४ नुसार अनुक्रमे निर्णय क्रमांक टिपीएस -१८१८/प्र.क्र .२३६ /१८ /कलम ३७ ( १ कक) व कलम २० ( ३ ) / नवि-१३ , दि.०२ / १२ / २०२० आणि निर्णय क्रमांक टिपीएस -१८१८ / प्र.क्र.२३६ / १८ / कलम २० (३ ) नवि -१३ , दि.०२ / १२ / २०२० अन्वये निदेश दिलेले आहेत;
आणि ज्याअर्थी , उक्त नियमावलीतील विनियम ६.३ तक्ता क्र . ६ - G, टीप ( iv ) नुसार टी.डी.आर व प्रिमियम एफ.एस.आय. वापराच्या अनुषंगाने प्राधान्यक्रम निश्चित करण्यात आलेला नसल्याने प्रिमीयम एफ.एस.आय.चा प्राधान्याने वापर करुन त्यानंतर टी.डी. आर . वापरला जाईल . त्यामुळे टी.डी. आर . चा वापर करण्याची क्षमता शिल्लक राहणार नाही . टी.डी.आर.चा वापर कमी होऊन त्याचा विपरीत परिणाम विकास योजना अंमलबजावणीवर होईल . तसेच अप्रत्यक्षपणे स्लम टी.डी.आर. ची मागणी देखील कमी होईल . त्यामुळे प्रिमियम एफ.एस.आय. व टी.डी.आर. वापराचा प्राधान्यक्रम निश्चित करण्याचे अनुषंगाने विनियम ६.३ तक्ता क्र . ६- G , टीप ( iv) मधील तरतुदीचे पुनरावलोकन करण्याबाबत पुणे महानगरपालिका , पिंपरी - चिंचवड महानगरपालिका, झोपडपट्टी पुनर्वसन प्राधिकरण , पुणे व पिंपरी - चिंचवड क्षेत्र तसेच अन्य काही संस्थांकडून शासनास निवेदने प्राप्त झाली आहेत;
आणि ज्याअर्थी , विविध निवेदने विचारात घेता आणि जनहिताच्या दृष्टीने, उक्त नियमावलीची प्रभावी अंमलबजावणी होण्यासाठी उक्त नियमावलीतील विनियम ६.३ तक्ता, क्र . ६ - G, टीप ( iv) मधील तरतुदीमध्ये सुधारणा करणे आवश्यक असल्याचे आणि या अनुषंगाने उक्त नियमावलीतील विनियम १.१० नुसार उक्त नियमावलीस पूरकपत्र निर्गमित करणे आवश्यक आहे, असे शासनाचे मत झाले आहे;
आणि त्याअर्थी, उक्त नियमावलीतील विनियम १.१० नुसार प्राप्त अधिकारात शासन याद्वारे उक्त नियमावलीस पूरकपत्र निर्गमित करून विनियम ६.३ , तक्ता क्र . ६- G, टीप ( iv) मधील तरतुदीमध्ये खाली नमूद केल्यानुसार सुधारणा करीत आहे.
भाग एक (म.उ.वि. ) - २ १०
महाराष्ट्र शासन राजपत्र, भाग एक - मध्य उप - विभाग , गुरुवार ते बुधवार , ऑक्टोबर १४-२० , २०२१ / आश्विन २२-२८ , शके १ ९४३ Regulation No.6.3 , Table 6 - G , Note ( iv) - Maximum permissible building potential on plot mentioned under column No.6 or 9 shall be exclusive of FSI allowed for Inclusive Housing as per Regulation No.3.8 . There is no priority fixed to utilise premium FSI or TDR as mentioned in column No.4 , 5 and 7 , 8. However the Authority , considering the local situation , may allow utilisation of premium FSI and TDR, in equal proportion of permissible premium FSI and TDR mentioned in column No.4, 5 and 7 , 8. ( e.g. if out of premium FSI mentioned in column No.4 & 7, 40 % is proposed to be utilised then out of TDR mentioned in column No.5 & 8 , 40 % TDR shall also be utilised . ) In such cases the Authority shall issue written , well - reasoned speaking orders to that effect . Other conditions of TDR utilisation shall be applicable as per the TDR Regulation No. 11.2 . In respect of service road , shown on development plan or in approved layout , or plots facing on major road , however deriving access from other roads , the width of highway or major road shall be considered for entitlement of building potential as per column 6 to 9 of above table , as the case maybe.

(ADDENDUM )
THE MAHARASHTRA REGIONAL & TOWN PLANNING ACT , 1966 .
No.TPS - 1818/CR.236 / 18 ( Part - 1 ) /Addendum/UD-13.-Whereas , the Government of Maharashtra has sanctioned the Unified Development Control and Promotion Regulations (' UDCPR' ) (hereinafter referred to as " the said Regulations " ) for the state except Municipal Corporation of Greater Mumbai , other Planning Authorities / Special Planning Authorities /Development Authorities within the limits of Municipal Corporation of Greater Mumbai , MIDC , NAINA , Jawaharlal Nehru Port Trust , Hill Station Municipal Councils , Eco- Sensitive/ Eco-Fragile region notified by MoEF & CC and Lonavala Municipal Council and Area under CIDCO's jurisdiction as Planning Authority , PCNTDA, MIHAN , MADC , MSRDC , in Maharashtra under the provisions of the Maharashtra Regional & Town Planning Act , 1966 (hereinafter referred to as " the said Act " ) vide Notification No.TPS - 1818 /CR.238/ 18 /DP . & RP./Sec.37 ( IAA ) ( c ) & sec.20 ( 4 ) /UD -13 , dated 02/ 12/2020 (hereinafter referred to as " the said Notification " ) ;
And whereas , to make applicable the said sanctioned Unified Development Control and Promotion Regulations for the area of CIDCO as Planning Authority , for the area of Pimpri - Chinchwad New Town Development Authority , for the area of Multi - Model International Hub Airport Notified area ( MIHAN ) , for Shirdi Airport Notified area of Maharashtra Airport Development Company Ltd. ( MADC) as Special Planning Authority and for notified area of Maharashtra State Road Development Corporation as Special Planning Authority , the Government has published Notices under section 37 ( 1AA ) & section 20 ( 3 ) of the said Act , bearing No.TPS -1818/CR- 236/18 /Sec.37 ( 1AA ) & sec.20 ( 3 )/UD -13 , dated 02/12/2020 and No.TPS -1818/CR- 236/18 / Sec.20 ( 3 ) /UD - 13 , dated 02/12/2020 respectively alongwith directives under section 154 of the said Act , 1966 vide Resolutions No.TPS -1818 / CR - 236/ 18/ Sec.37 ( 1AA ) & sec.20( 3 )/UD - 13 , dated 02/12/2020 and No.TPS - 1818/ CR - 236/ 18/sec.20( 3 )/UD - 13 , dated 02/12/2020 respectively ;
And whereas , representations from Pune Municipal Corporation , Pimpri - Chinchwad Municipal Corporation , Slum Rehabilitation Authority , Pune , Pimpri- Chinchwad Area and some other organizations are received by the Government requesting to review the provision to fix priority to utilise Premium F.S.I. and T.D.R. in regulation No.6.3 , Table 6 -G , Note ( iv ) . As no priority is fixed to utilise T.D.R. and Premium F.S.I. as per regulation No.6.3 , Table 6 - G , Note ( iv ) of the said Regulations , Premium F.S.I. will be utilised on priority and then T.D.R. will be utilised . So no potential will be balance to utilise T.D.R. Utilisation of T.D.R. will be less and it will affect implementation of the Development Plan and also less demand for slum T.D.R. indirectly ;
And whereas , after considering the various representations and in larger public interest , the Government is of the opinion that , the provision in regulation No.6.3 , Table 6 -G , Note ( iv ) of the said Regulations needs to be amended for smooth implementation of the said Regulations and addendum in this regard to the said Regulations shall be issued taking recourse of the regulation No.1.10 of the said Regulations ;
Now therefore , in exercise of the powers conferred by regulation No.1.10 of the said Regulations , the Government hereby amends the provisionin regulation No.6.3 , Table 6- G , Note (iv ) as mentioned below , by issuing addendum to the said Regulations .
Regulation No.6.3 , Table 6- G , Note ( iv ) - Maximum permissible building potential on plot mentioned under column No.6 or 9 shall be exclusive of FSI allowed for Inclusive Housing as per Regulation No.3.8 . There is no priority fixed to utilise premium FSI or TDR as mentioned in column No.4 , 5 and 7 , 8. वरील अधिकाऱ्यांचे अंतिम वेतन प्रमाणपत्र व महाराष्ट्र कोषागार नियम २३६ चा दाखला ( ना मागणी प्रमाणपत्र ) महालेखापाल, महाराष्ट्र-१ , मुंबई , नागपूर -२ यांच्या कार्यालयास परस्पर पाठवावा, तसेच जे अधिकारी शासकीय निवासस्थानात राहत असतील, त्यांच्या निवृत्तीबाबत संबंधित कार्यकारी अभियंता यांच्या कार्यालयात कळवावे व आवश्यक दाखला मागवावा . ज्या अधिकाऱ्यांबाबत महसूलहानी / विभागीय चौकशी कार्यवाही सुरू आहे किंवा प्रस्तावित आहे , अशा अधिकाऱ्यांच्या प्रकरणी होणाऱ्या निर्णयाच्या अधिन राहून निवृत्तीवेतन लाभाची कार्यवाही करावी.
संबंधित अधिकाऱ्यांस नियमित सेवानिवृत्तीवेतन व सेवालाभ देण्यास काही कारणास्तव विलंब होणार असल्यास तात्पुरते निवृत्तीवेतन व सेवालाभ देण्यासाठी महाराष्ट्र नागरी सेवा ( निवृत्तीवेतन ) नियम , १ ९ ८२ मधील नियम १२६/१३० नुसार आवश्यक कार्यवाही तात्काळ करावी .

महाराष्ट्र विधानमंडळ सचिवालयातील " कक्ष अधिकारी तथा मालमत्ता व्यवस्थापक " ( गट-ब) (राजपत्रित) ( सेवा प्रवेश ) नियम , २०१४ या नियमातील नियम ४ नुसार श्री . वि. वि. काळे , सहायक मालमत्ता व्यवस्थापक यांना किमान तीन वर्ष कक्ष अधिकारी तथा मालमत्ता व्यवस्थापक या पदावर कार्यरत रहावे लागेल व तसा अंगिकारनामा तात्काळ कार्यालयाकडे द्यावा लागेल. परंतु, " कक्ष अधिकारी तथा मालमत्ता व्यवस्थापक " या पदावर कार्यरत असताना श्री . वि. वि. काळे हे या सचिवालयातील अन्य संवर्गात पदोन्नती करीता पात्र होत असल्यास त्यांना त्या पदावर पदोन्नती स्वीकारता येईल .
