क्रमांक एमआयएस -२०२१/प्र.क्र.९ ६/तांशि ४. महाराष्ट्र विना अनुदानित खाजगी व्यावसायिक शैक्षणिक संस्था ( प्रवेश व शुल्क यांचे विनियमन) अधिनियम , २०१५ ( सन २०१५ चा महाराष्ट्र अधिनियम २८ ) च्या कलम २३ द्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून, महाराष्ट्र शासन , याद्वारे महाराष्ट्र विनाअनुदानित खाजगी व्यावसायिक शैक्षणिक संस्था (पूर्णवेळ व्यावसायिक पदव्युत्तर तांत्रिक पाठ्यक्रमांच्या प्रवेशाचे विनियमन ) , नियम २०१७ यामध्ये आणखी सुधारणा करण्यासाठी पुढील नियम करीत आहे.
१. या नियमांस , महाराष्ट्र विनाअनुदानित खाजगी व्यावसायिक शैक्षणिक संस्था ( पूर्णवेळ व्यावसायिक पदव्युत्तर पदवी तांत्रिक पाठ्यक्रमांच्या प्रवेशाचे विनियमन) ( सुधारणा) नियम , २०२१ असे म्हणावे.
२. महाराष्ट्र विनाअनुदानित खाजगी व्यावसायिक शैक्षणिक संस्था (पूर्णवेळ व्यावसायिक पदव्युत्तर पदवी तांत्रिक पाठ्यक्रमांच्या प्रवेशाचे विनियमन ) नियम , २०१७ (यात यापुढे ज्याचा निर्देश " मुख्य नियम " असा केला आहे ) याच्या नियम २ मध्ये पोट - नियम ( १ ) मधील खंड (छ ) मधील " आणि प्लॅनिंग " या मजकुराऐवजी " आणि नियोजन, समुचित प्राधिकरणाने मान्यता दिलेले " हा मजकूर दाखल करण्यात येईल .
३. मुख्य नियमाच्या नियम ५ मध्ये,
(क) तक्त्यामधील , पोट-नियम ( १ ) मध्ये,-
(एक) नोंद ए समोरील " पात्रतेचे निकष " या स्तंभातील खंड ( एक) मधील " किंवा औषधनिर्माणशास्त्र " मजकुरानंतर " किंवा व्यवसाय पदविका " हा मजकूर समाविष्ट करण्यात येईल ; या भाग चार- ब- ३१३-१

(दोन) नोंद ई समोरील " पात्रतेचे निकष " या स्तंभातील " जे उमेदवार एचएससी किंवा " या मजकुराने सुरू होणाऱ्या आणि " व ज्यांची मातृभाषा मराठी आहे , असा उमेदवार " या मजकुराने संपणाऱ्या मजकुराऐवजी पुढील मजकूर दाखल करण्यात येईल :-
" जे उमेदवार महाराष्ट्र- कर्नाटक सीमाक्षेत्रातील किंवा महाराष्ट्र राज्यातील मान्यता प्राप्त संस्थेची एचएससी किंवा अभियांत्रिकी व तंत्रज्ञान किंवा औषधनिर्माणशास्त्र पदविका अथवा व्यवसाय पदविका उत्तीर्ण आहेत तसेच अर्हता परीक्षादेखील उत्तीर्ण असतील आणि जे महाराष्ट्र- कर्नाटक सीमाक्षेत्रातील रहिवासी आहेत आणि ज्यांची मातृभाषा मराठी आहे , असे उमेदवार स्पष्टीकरण.- महाराष्ट्र- कर्नाटक सीमाक्षेत्रामध्ये राज्य शासनाने त्या प्रयोजनासाठी घोषित केलेल्या गावांचा समावेश आहे. " ;
(ख ) पोट - नियम ( ६ ) ऐवजी पुढील पोट - नियम दाखल करण्यात येईल : -
" ( ६ ) जम्मू व काश्मीर स्थलांतरासाठी उमेदवारी,-
(क) आतंकवादी कारवायांमुळे १९९ ० पासून जम्मू व काश्मीरमधून भारताच्या कोणत्याही भागात किंवा जम्मू व काश्मीरच्या असुरक्षित सीमाक्षेत्रातून, जम्मू व काश्मीरमधील त्यामानाने सुरक्षित ठिकाणी विस्थापित झालेले आहेत अशा नागरिकांची मुले ; किंवा
(ख) आतंकवादी कारवायांचा बिमोड करण्यासाठी जम्मू व काश्मीरमध्ये भारतीय प्रशासकीय सेवा ( भाप्रसे ) किंवा भारतीय पोलीस सेवा ( भापोसे) किंवा भारतीय विदेश सेवा ( भाविसे) यामधील बदली झालेल्या आणि केंद्रीभूत प्रवेश प्रक्रियेसाठी आवेदनपत्र सादर करण्याच्या अंतिम दिनांकास किंवा त्यापूर्वी कामावर रुजू झालेल्या अधिकाऱ्यांची मुले ; किंवा (ग ) आतंकवादी कारवायांचा बिमोड करण्यासाठी जम्मू व काश्मीरमध्ये पूर्वी किंवा सद्या पदस्थापित असलेल्या आणि प्रवेशासाठी आवेदनपत्र सादर करण्याच्या अंतिम दिनांकास किंवा त्यापूर्वी पदावर रुजू झालेल्या लष्करी व निमलष्करी दलातील कर्मचाऱ्यांची मुले; किंवा
( घ) काश्मीर खोऱ्यात राहत असणारे आणि जम्मू व काश्मीरचे अधिवास प्रमाणपत्र असणारे ( अस्थलांतरित ) काश्मीरी पंडित किंवा काश्मीरी हिंदू ; किंवा
(ङ) आतंकवादींचा सामना करण्यासाठी कार्यरत असलेल्या जम्मू व काश्मीर पोलीस दलातील कर्मचाऱ्यांची व अधिकाऱ्यांची मुले; या प्रवर्गाखाली पात्र असतील . "
४. मुख्य नियमाच्या नियम ७ मध्ये, पोट नियम ( ५ ) मधील खंड ( क) उपखंड ( दोन ) मधील दुसऱ्या परंतुकाऐवजी पुढील परंतुक दाखल करण्यात येईल :-
परंतु आणखी असे की, वरील दोन्ही कोट्यातील कोणतीही रिक्त जागा अनिवासी भारतीय जागांसाठी समुचित प्राधिकरणाची पूर्वमान्यता घेतली असेल अशा संस्थेला , अनिवासी भारतीय उमेदवारी असलेल्या उमेदवारांमधून भरता येईल . "
५. मुख्य नियमाच्या नियम ९ मधील , पोट- नियम ( ४ ) खंड (घ ) ऐवजी पुढील खंड दाखल करण्यात येईल :-
८८ (घ) सक्षम प्राधिकरणाने विहित केलेल्या पद्धतीनुसार प्रवेश उपस्थिती केंद्रावर प्रवेशासाठी उपस्थित राहण्याच्या वेळी , उमेदवार , त्याने आवेदनपत्रात केलेल्या दाव्याच्या पृष्ट्यर्थ सर्व मूळ कागदपत्रे सादर करील :
परंतु जर आवेदन पत्रात केलेल्या दाव्याच्या आधारावर उमेदवारास जागेचे वाटप केले असेल आणि अर्जात केलेल्या अशा दाव्याच्या पृष्ट्यर्थ उमेदवार कागदपत्रे सादर करू शकला नाही तर , वाटप केलेली जागा आपोआप रद्द होईल आणि ती जागा, पुढील फेऱ्यांमधील वाटपासाठी उपलब्ध होईल :
परंतु आणखी असे की, जर उमेदवारास झालेले जागा वाटप हे प्रवेश अर्जात केलेल्या दाव्याचा लाभ प्राप्त केल्याखेरीज झाले असेल तर असे जागा वाटप अबाधित ठेवण्यात येईल व उमेदवारास या नियमाच्या उप नियम ( ४ ) खंड (ङ) मधील तरतुदीनुसार अर्जामध्ये संबंधित बदल करता येतील . "
६. मुख्य नियमाच्या नियम १३ मधील खंड (त्र ) मधील ," मान्यता असण्याच्या अधीन राहून " या मजकुराऐवजी " संस्थेने पूर्व मान्यता घेतली असेल तर , " हा मजकूर दाखल करण्यात येईल .

NOTIFICATION
MAHARASHTRA UNAIDED PRIVATE PROFESSIONAL EDUCATIONAL INSTITUTIONS ( REGULATION OF ADMISSIONS AND FEES ) ACT , 2015 .
No. MIS - 2021/C.R.96/TE - 4.-In exercise of the powers conferred by section 23 of the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admissions and Fees ) Act , 2015 ( Mah . XXVIII of 2015 ) , the Government of Maharashtra hereby makes the following rules further to amend the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admission to the Full Time Professional Post Graduate Technical Courses) Rules , 2017 , namely:-
1. These rules may be called the Maharashtra Unaided Private Professional Educational Institutions ( Regulation of Admission to the Full Time Professional Post Graduate Technical Courses) (Amendment ) Rules , 2021 .
2. In rule 2 of the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admission to the Full Time Professional Post Graduate Technical Courses ) Rules , 2017 (hereinafter referred to as " the principal Rules " ) , in sub - rule (1) in clause (g) , for the words " and Planning" the words " and planning , approved by the appropriate authority" shall be substituted .
3. In rule 5 of the principal Rules ,
(a) in the table , in sub - rule (1) ,-
(i) in the column " Eligibility Criteria " against entry A, in clause (i) , after the words " or Pharmacy" the words " or Diploma of Vocation " shall be inserted ;
(ii) in the column " Eligibility Criteria " against entry E , for the words beginning with the words " Candidates passing HSC or passing diploma " and the words ending with the words " and whose mother tongue is Marathi . " , the following shall be substituted , namely : -
" Candidates , passing HSC or passing diploma in Engineering or Technology or Pharmacy or Diploma in Vocation and also qualifying Examination from a recognized institutions located in the Maharashtra Karnataka Border Area or from Maharashtra , residing in the Maharashtra Karnataka Border Area and whose mother tongue is Marathi .
Explanation . - the Maharashtra Karnataka Border Area includes the villages declared by the State Government for that purpose ." ;
(b) for sub - rule ( 6) , following sub - rule shall be substituted , namely : -
"(6) Jammu and Kashmir Migrant Candidature.-
(a) The children of citizens , who are displaced from Jammu and Kashmir to any part of India from unsafe border area of Jammu and Kashmir to a relatively safer place in Jammu and Kashmir from 1990 onwards due to terrorist activities ; or ४

(b) The children of officers belonging to Indian Administrative Services ( IAS ) , Indian Police Services ( IPS) or Indian Foreign Services ( IFS ) posted to Jammu and Kashmir to combat terrorist activities and joined the post on or before the last date for submission of application for admission ; or
(d) Kashmiri Pandits or Kashmiri Hindu families ( Non - migrants ) living in the Kashmir valley and having domicile certificate of Jammu and Kashmir ; or
(e) The children of staff and officers of Jammu and Kashmir police engaged in combating terrorism , are eligible under this category . " .
(c) The children of staff belonging to military and paramilitary forces posted in the past or currently in the Jammu and Kashmir to combat terrorist activities and joined the post on or before the last date for submission of application for admission ; or 4. In rule 7 of the principal rules , in sub - rule (5), clause (a) , in sub - clause (ii) , for the second proviso , the following proviso shall be substituted , namely : - "Provided further that , any vacant seat in both the above quota may be filled in from NRI Candidature Candidates by the institutes which has secured prior approval of the appropriate authority for the NRI seats . " . 5. In rule 9 of the principal rules , sub - rule (4), for the clause (d), following shall be substituted , namely :- "(d) At the time of reporting for admission to ARC as per the method prescribed by the Competent Authority , the candidate shall produce all the original documents in support of the claims made in the application : Provided that , if the Candidate has allotted seat on the basis of claim made in the application and fails to produce the documents in support of the claim so made in the application , the allotment shall stand cancelled automatically and the seat shall become available for allotment in further rounds : Provided further that , if the Candidate is allotted a seat without availing any benefit claimed in the application , in such case , the allotment of the candidate shall be retained and he shall be allowed to modify his application , accordingly , as per the provisions of clause (e) of sub - rule (4) of this rule ." .
6. In rule 13 of the principal Rules , in clause (j) , for the words " subject to the approval " the words " if, the Institutes has secured prior approval " shall be substituted .
