MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
ORDER
No. D.T.P.-D.P.Warud [O (R)+A]-Sec-127(2)-Order-TPV-VI-4561-2021.----
Whereas, the Development Plan of Warud Municipal Council [Original (Revised) + Additional] has been partly sanctioned under the provisions of Section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government in Urban Development Department vide its Notification No. TPS-2803-1896-CR-8(A)-2004-UD-30, dated 15th July 2005 (hereinafter referred to as "the said Notifica- tion") & came into force with effect from 1st September 2005, while Republished Development Plan of Excluded Part of Warud has been sanctioned vide Notification No.TPS-2806-379-CR-243-2006-UD-30, Dated the 6th June 2007 and came into force with effect from 16th July 2007 (hereinafter referred to as "the said Sanctioned Development Plan");
And whereas, in the said Sanctioned Development Plan,the land bearing S. No. 500 (Part) of Mouza Warud is reserved for (i) Site No. 24 "Shopping Centre" approximate area 0.2288 Ha., (ii) Site No. 25 "Vegetable Market " approximate area 0.6032 Ha. and (iii) Site No. 26 "Parking" approximate area 0.2432 Ha. (hereinafter referred to as "the said Reservations") for which Appropriate Authority is Municipal Council, Warud (hereinafter referred to as "the said Appropriate Authority");
And whereas, the land under said reservations has not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan came into force ;
And whereas, on behalf of the concerned land owners (hereinafter referred to as "the said Land Owners") of the land under the said Reservations in respect of areas (i) 0.2288 Ha. (ii) 0.6032 Ha. and (iii) 0.2432 Ha. respectively of S. No. 500/3A of Mouza Warud (hereinafter referred to as " the said Land") Adv. Pradeep Mahalle had served a notice under Section 127(1) of the said Act (hereinafter referred to as "the said Notice") on the said Appropriate Authority on 25th September 2017 ;
And whereas, the said land under the said Reservations is not acquired or no steps as required under Section 127(1) of the said Act have been taken by the said Appropriate Authority within a stipulated period from the date of service of the said notice ;
And whereas, the Chief Officer, Municipal Council, Warud vide letter No. 1716-2020, dated 11th August 2020 has requested to issue order under Section 127(2) of the said Act as no action has been taken in the stipulated time regarding land acquisition ;
And whereas, the Joint Director of Town Planning, Amravati Division, Amravati vide letter No. 1141, dt. 22nd Septem- ber 2021 has submitted report that the said Appropriate Authority has not taken any action within the stipulated period under the provisions of Section 127(1) of the said Act to acquire the said land and therefore, the said Reservations on the said land have been lapsed ;
And whereas, after considering the above facts in respect of the said Reservations on the said land in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order under Section 127(2) of the said Act, regarding the lapsing of the said Reservations on the said land ;
And whereas, the Government in Urban Development Department under Section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 1st December 2016, has delegated the powers exercisable by it under Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayats and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune.
Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservations in respect of the said land under Section 127(2) of the said Act and for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows-४ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, +]क्ष्दन् २१-२७, २०२१/+ह्य २९-ॅॅ ५, ॅ १९४३ After the last entry in the Schedule of Modifications accompanying the said Notification of the said sanctioned Development Plan, the following new entry shall be added:—

Note: (1) The said land so released from the said Reservations shall become available to the said land owners for the purpose of development as otherwise permissible in the case of adjacent land under the said Sanctioned Development Plan.
(2) A copy of the part plan of the said Sanctioned Development Plan showing the areas of the said land which is lapsed from the said Reservations is available in the office of the Chief Officer, Municipal Council, Warud, District Amravati during office hours on all working days for inspection to public upto one month.
