ज्याअर्थी, ठाणे शहराची सुधारीत विकास योजना शासनाने महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम , १ ९ ६६ चे कलम ३१ ( १ ) नुसार (यापुढे याचा उल्लेख " उक्त अधिनियम " असा केला आहे. ) शासन निर्णय क्र. टिपीएस. १२ ९ ७ / १३१ ९/ सीआर -१४८ / ९ ७ / नवि-१२ , दिनांक ४ ऑक्टोबर १ ९९९ अन्वये मंजूर केली असून , ती दिनांक २२ नोव्हेंबर १ ९९९ पासून अंमलात आहे. तसेच सुधारीत विकास योजनेतील वगळलेल्या क्षेत्राची ( Excluded portion ) विकास योजना शासन निर्णय क्रमांक टिपीएस . १२०१ / २७४ / सीआर-२८ / २००१ /नवि-१२ , दिनांक ३ एप्रिल २००३ अन्वये शासनाने उक्त अधिनियमानूसार मंजूर केली असून ती दिनांक १४ मे २००३ पासून अंमलात आहे . (यापुढे " उक्त मंजूर विकास योजना " असा उल्लेख केला आहे) ;
आणि ज्याअर्थी , ठाणे महानगरपालिका प्रारूप विकास नियंत्रण नियमावलीत काही बदल करून शासनाने निर्णय क्रमांक टिपीएस . १२ ९ ४/ १२५९ /सीआर -२२२ / ९ ४/ नवि-१२ , दिनांक २८ एप्रिल १ ९९ ५ अन्वये उक्त अधिनियमाचे कलम ३१ ( १ ) अन्वये विकास नियंत्रण नियमावली मंजूर केली होती व सदर नियमावली दिनांक १ जून १ ९९ ५ पासून अंमलात आली होती ;
आणि ज्याअर्थी , तत्कालीन मंजूर विकास नियंत्रण नियमावलीतील तरतुदीनुसार ठाणे महानगरपालिका हद्दीमध्ये ४४ नागरी पुनरुत्थान आराखडे (यु.आर.पी. ) दिनांक ५ मे २०१८ रोजीच्या शासन राजपत्रामध्ये अधिसूचित करण्यात आले आहेत ;
आणि ज्याअर्थी, शासन निर्णय क्रमांक टिपीएस . १८१८ / प्र.क्र . २३६/ १८ / कलम ३७ ( १ कक) ( ग) व कलम २० (४ ) /नवि-१३ , दिनांक २ डिसेंबर २०२० अन्वये शासनाने एकत्रिकृत विकास नियंत्रण व प्रोत्साहनपर नियमावली , मंजूर केली आहे आणि उक्त विकास नियंत्रण नियमावली दिनांक ३ डिसेंबर २०२० पासून अंमलात आली असून सदर नियमावली ठाणे महानगरपालिकेस लागू आहे. (यापुढे " उक्त नियमावली" असा उल्लेख केला आहे ) ;
आणि ज्याअर्थी , मा . सर्वसाधारण सभेने ठराव क्र. ३४५ , दिनांक १८ फेब्रुवारी २०२१ अन्वये जीवन नगर , भानुशाली वाडी व रघुनाथ नगर इ. मधील क्षेत्र समूह विकास आराखड्यात समाविष्ट करण्यास सूचीत केले आहे ;
आणि ज्याअर्थी, उक्त क्षेत्र हे पूर्वी अधिसूचित केलेल्या यु.आर.पी. क्र . ११ हाजुरी च्या हद्दीलगत असल्याने सदरचे क्षेत्र यु.आर.पी. क्र. ११ - हाजुरी मध्ये समाविष्ट करण्याचे प्रस्तावित आहे ( यापुढे प्रस्तावाधीन क्षेत्र असा उल्लेख केला आहे) ;

आणि ज्याअर्थी , उक्त नियमावलीतील विनियम क्र . १४.८.१ ( ii) ( b) च्या तरतुदीनुसार नागरी पुनरुत्थान आराखडा तयार करणेचे , अधिसूचित करण्याचे आणि जेव्हा आवश्यक असेल तेव्हा सुधारीत करण्याचे अधिकार आयुक्त यांना असल्याचे नमूद आहे. तथापि , उक्त विकास नियंत्रण नियमावलीतील विनियम क्र. १४.८.१ ( i ) च्या परिच्छेद २ नुसार नागरी पुनरुत्थान योजनेच्या हद्दी रस्ता, नाला किंवा रेल्वे लाईन अशा भौतिक हद्दींनी वेढलेल्या नसल्यास , उच्चाधिकार समितीशी सल्लामसलत करून , समुहाच्या हद्दी मा . महापालिका आयुक्त निश्चित करू शकतात ;
आणि ज्याअर्थी , वर नमूद केल्याप्रमाणे अधिसूचित करावयाचे प्रस्तावाधीन क्षेत्र भौतिक हद्दींनी वेढलेले नसल्याने सल्लामसलतीकरिता उच्चाधिकार समितीच्या बैठकीत दिनांक २२ ऑक्टोबर २०२१ रोजी ठेवण्यात आले व उक्त बैठकीमध्ये सदरहू क्षेत्र यापूर्वीच्या अधिसूचित आराखड्यामध्ये समाविष्ट करण्यास उच्चाधिकार समितीने शिफारस केली आहे ;
आणि त्याअर्थी, उक्त नियमावलीमधील विनियम क्र. १४.८.१ (ii ) (बी) अन्वये मला प्रदान अधिकारान्वये, ठाणे शहराच्या हद्दीतील यु.आर.पी. क्र . ११ - हाजुरीच्या यापूर्वीच्या अधिसूचित हद्दीमध्ये बदल करून सुधारीत हद्दीचा आराखडा यु.आर.पी. क्र . ११ -हाजुरी (सुधारीत क्षेत्र अंदाज १०.६४ हेक्टर ) म्हणून अधिसूचित करीत आहे .
सदर अधिसूचित आराखड्याची हद्द दर्शविणारा नकाशा जनतेच्या अवलोकनार्थ खालील ठिकाणी , पुढील तीस दिवसांकरीता ठेवण्यात येत आहे:-
(१ ) उप संचालक, नगररचना , क्लस्टर सेल , यांचे कार्यालय , माजीवाडा, ठाणे,
(२ ) शहर विकास विभाग , चौथा मजला, ठाणे महानगरपालिका, ठाणे ,
(३ ) संबंधित प्रभाग समिती कार्यालय .
ही अधिसूचना व अधिसूचित नकाशा www.tmctp.thanecity.gov.in या संकेत स्थळावर सुद्धा उपलब्ध आहे.

THANE MUNICIPAL CORPORATION TOWN DEVELOPMENT DEPARTMENT
NOTIFICATION
No. TMC/ TDO /Cluster Cell/Notification/211 .
MAHARASHTRA REGIONAL AND TOWN PLANNING ACT , 1966 .
Whereas , the Revised Development Plan of the Thane City has been sanctioned by the Maharashtra Regional and Town Planning Act , 1966 , ( hereinafter referred to as " the said Act " ) vide Notification No. TPS - 1297 / 1319 / CR- 148 / 97 / UD -12 , dated 4th October 1999 , which has come into force with effect from 22nd November 1999 , and the Excluded Part ( EP) of the said Development Plan has been sanctioned under the said Act vide Government Notification No. TPS . 1201/274 / CR- 28/2001/UD - 12 , dated 3rd April 2003 which has come into force with effect from the 14th May 2003 ; ( hereinafter referred to as " the said sanctioned Development Plan " ) ; And whereas , the Development Control Regulations of Thane Municipal Corporation has been sanctioned by the Government after making some modifications in draft Development Control Regulations of Thane City vide Urban Development Department , vide Notification No. TPS . 1294/ 1259/ C.R. - 222/94/UD - 12 , dated 28th April 1995 under section 31 ( 1 ) of the said act which had came into force with effect from the 1st June 1995 ;
And whereas , according to provisions of erstwhile sanctioned Development Control Regulations . 44 Urban Renewal Plans are notified in Government Gazette dated 5th May 2018 within the limits of Thane Municipal Corporation ;
And whereas , State Government has sanctioned Unified Development Control and Promotion regulations vide resolution No.TPS . 1818/C.R . 236/ 18/DP & RP/ sec . 37 ( 1AA) ( C ) and sec . 20 ( 4 )/UD -13 , dated 2nd December 2020 ( hereinafter referred to as " the said Regulations " ) and Regulation No. 14.8 of the said Regulations specifies regulation for Urban Renewal Scheme and the said Regulation are in force for Thane Municipal Corporation from dated 3rd December 2020 ;
And Whereas , General body has passed a resolution No. 345, dated 18th February 2019 to include area of Jeevan Nagar , Bhanushali Wadi and Raghunath Nagar etc. in URP ;
And whereas , since the said area is adjacent to boundaries of earlier notified URP No. 11 Hajuri , this area is proposed to be included in URP No. 11- Hajuri . ( hereinafter referred as " the area under proposal " ) ;
And whereas , as mentioned in the Regulation No. 14.8.1 ( ii ) ( b ) of the said Regulations , that commissioner can prepare and notify Urban Renewal Plan and revise the same , as and when required . But , as mentioned in the para - 2 of Regulation No. 14.8.1 ( i ) of the said Regulations , if URS is not bounded by physical boundaries such as roads , nallahs and railway lines , then the boundary of the cluster can be decided / finalized by Municipal Commissioner, in consultation with High Power Committee ( HPC ) ;
And whereas , Since the said area under proposal to be notified is not bounded by physical boundaries , it is kept before High Power Committee meeting on 22nd October 2021 and High Power Committee has recommended to include the said area in earlier notified plan ;
Now therefore , as per powers conferred to me vide Regulation No. 14.8.1 ( ii) ( b) of the said Regulations , the notified boundaries of URP No. 11 - Hajuri are changed and revised boundary of URP No. 11 - Hajuri ( Revised area approx . 10.64 hect . ) is hereby notified .
The plans showing boundaries of new Urban Renewal Plan area is kept for inspection by general public at following places for next thirty days :-
1. Office of the Deputy Director of Town Planning , Cluster Cell , Majiwada , Thane , 2. Town Development Department , 4th Floor , Thane Municipal Corporation , Thane , 3. Concern ward office .
