क्रमांक टीपीबी. ४३१ ९/४७४/प्र.क्र. १४७/२०२० /नवि- ११.- ज्याअर्थी , महाराष्ट्र प्रादेशिक व नगर रचना अधिनियम, १ ९ ६६ ( यापुढे याचा उल्लेख "उक्त अधिनियम " असा करणेत आलेला आहे) चे कलम ३१ , पोट- कलम ( १ ) अन्वये प्राप्त अधिकारांचा वापर करून राज्य शासनाने अधिसूचना क्र. टीपीबी. ४३१७ /६२ ९/प्र.क्र.११८ / २०१७ /वि.यो. /नवि -११ , दि . ८ मे २०१८ ( यापुढे याचा उल्लेख "उक्त अधिसूचना " असा करणेत आलेला आहे) द्वारे बृहन्मुंबई प्रारुप विकास योजना-२०३४ ( यापुढे याचा उल्लेख "उक्त विकास योजना " असा करणेत आलेला आहे) सह विकास नियंत्रण व प्रोत्साहन नियमावली-२०३४ ला उक्त अधिसूचनेसोबतचे परिशिष्ट- ब मध्ये दर्शविलेले सारभूत स्वरुपाचे फेरबदल (ई.पी. ) वगळून उक्त अधिसूचनेसोबतचे परिशिष्ट- अ मध्ये दर्शविलेल्या सुधारणेसह मंजुरी दिली आहे. आणि ज्याअर्थी शासनाने उक्त अधिसूचनेस समक्रमांकाचे शुद्धीपत्रक दिनांक २२ जून , २०१८ रोजी निर्गमित केले असून त्यानुसार उक्त विकास योजना दिनांक १ सप्टेंबर २०१८ पासून अंमलात आली आहे. आणि ज्याअर्थी, त्यानंतर शासनाने उक्त अधिसूचनेस समक्रमांकाचे शुद्धीपत्रक व पूरकपत्र दिनांक २ ९ जून , २०१८ रोजी पारित केले असून सदर शुद्धीपत्रक व पूरकपत्र महाराष्ट्र शासनाच्या राजपत्रात दिनांक ३० जून , २०१८ रोजी प्रसिद्ध करण्यात आले आहे ;
आणि ज्याअर्थी , महाराष्ट्र शासनाने अधिसूचना क्र. टीपीबी. ४३१७/६२ ९/प्र.क्र.११८ (V )/२०१ ९/नवि-११ , दिनांक २३ नोव्हेंबर २०२० अन्वये उक्त अधिनियमाचे कलम ३१ ( १ ) अन्वये विकास योजनेतील ठराविक ई. पी . मंजूर केले आहेत ; आणि ज्याअर्थी, मंजूर ई. पी. च्या परिशिष्टामध्ये ई. पी. एमई ५८ चा समावेश आहे, ज्यामध्ये मुंबई रिफायनरी म्हणून ओळखल्या जाणाऱ्या हिंदुस्तान पेट्रोलियम कॉर्पोरेशन लिमिटेड (यापुढे याचा उल्लेख "एचपीसीएल" असा करणेत आलेला आहे) च्या न.भू.क्र. ३८२ (मेन ) , ३८२/१ ते ६६, मौजे आणिक, चेंबूर, मुंबई या मिळकतीवरील उर्वरित आरक्षण कायम ठेऊन, सर्व गार्डन/ पार्क आरक्षण ऐवजी ROS २.७ (ग्रीन बेल्ट ) दर्शविला आणि सदर मिळकत औद्योगिक विभागात (I ) दर्शविण्यात आली आहे ;

भाग एक (को.वि.पु. ) - ६५-१ २ महाराष्ट्र शासन राजपत्र असाधारण भाग एक-कोकण विभागीय पुरवणी, नोव्हेंबर १०, २०२१/ कार्तिक १ ९ , शके १ ९ ४३ आणि ज्याअर्थी , उक्त विकास योजनेनुसार, न.भू.क्र. ३८२ (मेन) , ३८२/१ ते ६६ , मौजे आणिक, चेंबूर, मुंबई या जमिनीच्या काही भागावर " फायर स्टेशन " ( RPU१.१ ) व १८.३० मी . रुंद विकास योजना रस्ता तर काही भागावर ग्रीन बेल्ट ( ROS२.७ ) दर्शविलेला आहे (यापुढे याचा उल्लेख "उक्त जमीन " असा करणेत आलेला आहे) ; आणि ज्याअर्थी , एचपीसीएल ने त्यांचे पत्र दिनांक १ ९ सप्टेंबर २०१ ९ आणि दिनांक १६ डिसेंबर २०१ ९ द्वारे उक्त जमिनीवरील " फायर स्टेशन " ( RPU१.१ ) व " विकास योजना रस्ता (१८.३० मी . रुंद) " ही आरक्षणे वगळणेबाबत शासनास विनंती केली आहे ;
आणि ज्याअर्थी , एचपीसीएल यांची विनंती विचारात घेऊन तसेच उक्त जमीन मुंबई रिफायनरी विस्तार योजनेत समाविष्ट असल्याने उक्त जमिनीवरील विकास योजना रस्त्याचे आरक्षण वगळणे तसेच एचपीसीएल चे मालकीच्या जमिनीमध्ये ग्रीन बेल्ट (ROS२.७ ) च्या हद्दीत बदल करणे , तर फायर स्टेशनच्या आरक्षणाची आवश्यकता असल्यामुळे त्यामध्ये बदल न करण्याबाबतची मुंबई महानगरपालिकेची विनंती विचारात घेता त्यामध्ये बदल न करणे सार्वजनिक हिताचे दृष्टीने आवश्यक आहे, अशी शासनाची खात्री झाली आहे; आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम ३७ च्या पोट- कलम ( १कक) अन्वये प्राप्त अधिकाराचा वापर करून शासनाने दिनांक ७ डिसेंबर , २०२० रोजीची सूचना त्यासोबतचे परिशिष्टामध्ये नमूद प्रस्तावित फेरबदलावर (यापुढे ज्याचा उल्लेख "प्रस्तावित फेरबदल " असा करण्यात आलेला आहे ) जनतेकडून हरकती / सूचना मागविण्यासाठी प्रसिद्ध करण्यात आली होती आणि ज्याद्वारे प्रस्तावित फेरबदलाबाबत प्राप्त होणाऱ्या हरकती / सूचनांवर संबंधितांना सुनावणी देण्याकरीता तसेच उक्त अधिनियमाच्या कलम ३७ ( १ कक) अन्वये विहित केलेली कार्यवाही पूर्ण करून प्रस्ताव शासनास सादर करणेसाठी उप संचालक, नगर रचना, बृहन्मुंबई यांची अधिकारी (यापुढे ज्यांचा उल्लेख "उक्त अधिकारी " असा करण्यात आला आहे . ) म्हणून नियुक्ती करण्यात आली आहे ;
आणि ज्याअर्थी , प्रस्तावित फेरबदलाची सदर शासन सूचना दिनांक ७ डिसेंबर , २०२० ही महाराष्ट्र शासनाचे असाधारण राजपत्रात १० डिसेंबर , २०२० रोजी प्रसिद्ध करण्यात आली होती आणि उक्त अधिकारी यांनी अधिनियमाचे कलम ३७ ( १कक) अन्वये वैधानिक कार्यवाही पूर्ण करून दिनांक २४ फेब्रुवारी २०२१ रोजीच्या पत्रान्वये त्यांचा अहवाल नगर रचना संचालनालयामार्फत शासनाचे अंतिम मंजुरीसाठी सादर केला आहे ;
आणि ज्याअर्थी , उक्त अधिकारी यांनी सादर केलेला अहवाल विचारात घेता व संचालक, नगर रचना , महाराष्ट्र राज्य, पुणे यांचेशी सल्ला- मसलत केल्यानंतर उक्त प्रस्तावित फेरबदल सुधारणेसह मंजूर करणे जनहिताच्या दृष्टीने आवश्यक आहे , असे शासनाचे मत झाले आहे ;
आता त्याअर्थी, उक्त अधिनियमाच्या कलम ३७ ( १ कक) (ग ) अन्वये प्राप्त अधिकारात आणि त्या संदर्भातील सर्व शक्तींचा वापर करून शासन याद्वारे :-
( अ) उक्त प्रस्तावित फेरबदलाचे प्रस्तावास खालील परिशिष्टामध्ये नमूद केलेप्रमाणे मंजूरी देत आहे.
(ब) सदरची अधिसूचना शासकीय राजपत्रामध्ये प्रसिद्ध झालेचा दिनांक हा उक्त फेरबदल अंमलात आलेचा दिनांक असेल.
(क) बृहन्मुंबई महानगरपालिकेच्या उक्त विकास योजनेच्या मंजुरी सोबतच्या फेरबदलाचे परिशिष्टामध्ये शेवटच्या नोंदीनंतर खालील परिशिष्ट समाविष्ट करणेचे निर्देश देत आहे.

परिशिष्ट
" The reservation of " D.P. road of 18.3m . wide " on land bearing CTS No. 382Main , 382/1 to 66 of Village Anik , Chembur , Mumbai is deleted and boundary of Green Belt (ROS2.7) within the land owned by HPCL is changed and the land so deleted from reservations and Green Belt is included in Industrial Zone ( I - Zone ) and the consequential change in alignment of 13.40 m wide D.P. road on North - East of HPCL land holding boundary. However, there is no change in reservation of " Fire Station ( RPU1.1 ) " which is kept as it is , as shown on plan. "

NOTIFICATION
No. TPB - 4319/ 474 / CR - 147/ 2020/ UD - 11. - Whereas , in exercise of the powers conferred by sub- section ( 1) of Section 31 of the Maharashtra Regional and Town Planning Act , 1966 (hereinafter referred to as " the Said Act " ) , the State Government vide Notification No. TPB - 4317 / 629/CR- 118 / 2017 /DP /UD - 11 , Dt . 8th May 2018 ( hereinafter referred to as " the said Notification " ) has accorded sanction to the Draft Development Plan- 2034 of Greater Mumbai ( hereinafter referred to as " the said Development Plan " ) along with the Development Control and Promotion Regulations - 2034 for Greater Mumbai with modifications shown in SCHEDULE - A appended to the said Notification excluding the substantial modifications as shown in SCHEDULE - B appended to the said Notification . And whereas , Government has issued a corrigendum of even number dt . 22nd June , 2018 to the said Notification , as per which the said Development Plan has came into force from 1st September 2018. And whereas , thereafter Government has issued a Corrigendum and Addendum of even number dt . 29th June , 2018 to the said Notification, which is published in the Government Gazettedt . 30th June , 2018 ;
And whereas , Government of Maharashtra vide Notification dated TPB - 4317 /629/CR- 118 (V) / 2019 /UD - 11 , dated 23rd November 2020 has accorded sanction under section 31 ( 1 ) of the said Act to certain Excluded Part (E.P. ) of the said Development Plan; And whereas , E.P. ME58 is included in Schedule of sanctioned E.P , wherein , keeping all other reservations unchanged, all Garden/ Park reservations on land bearing CTS No. 382 Main, 382/1 to 66 of Village Anik, Chembur , Mumbai known as Mumbai Refinery of Hindustan Petroleum Corporation Limited ( hereinafter referred to as " HPCL " ) are shown as ROS 2.7 ( Green belt) and plot is shown in industrial ( I) zone ;
And whereas , as per the said Development Plan, there are reservations of Fire Station ( RPU1.1 ), D.P. road of 18.3m . wide and certain portion is shown as Green Belt ( ROS2.7) on land bearing CTS No. 382 Main, 382/1 to 66 of Village Anik , Chembur , Mumbai ( hereinafter referred to as " the said land " ) And whereas , HPCL vide their letter dated 19th September 2019 and dated 16th December 2019 has requested the Government to delete reservation of Fire Station (RPU1.1 ) , D.P. road ( 18.3m. wide) on the said land ;
And whereas , considering the request of HPCL and considering that the said land is included in Mumbai Refinery Expansion Project , the Govt . is satisfied that in the public interest it is expedient to delete the reservations of DP road on the said land and to change the boundary of Green Belt (ROS2.7 ) within the land owned by HPCL , however considering the need of Fire Station and request of MCGM it is necessary to not to make any change in the reservation of " Fire Station ( RPU1.1 ) " and keep it as it is ; And whereas , in exercise of the powers conferred under sub - section ( IAA) of section 37 of the said Act , Government had issued Notice of even No. dated 7th December , 2020 for inviting suggestions / objections from the general public with regard to " the proposed modification " ( hereinafter referred to as " the proposed modification " ) as mentioned in the Schedule appended to the said Notice and appointed the Deputy Director of Town Planning , Gr . Mumbai as the Officer ( hereinafter referred to as " the said Officer " ) to complete the procedure as stipulated under section 37 ( 1AA) of the said Act and to submit a Report on the objections / suggestions received in respect of the proposed modification to the Government after giving hearing to the concerned persons ;
And whereas , the said Notice dated 7th December , 2020 was published in the Maharashtra Government Gazette ( Extra- Ordinary Gazette) dated 10th December , 2020 and the said Officer has submitted his report vide letter dt . 24th February 2021 through the Director of Town Planning , Maharashtra State, after completing the legal procedure stipulated under section 37 ( 1AA) of the said Act ;
५ महाराष्ट्र शासन राजपत्र असाधारण भाग एककोकण विभागीय पुरवणी, नोव्हेंबर १० , २०२१ / कार्तिक १ ९ , शके १९ ४३ And whereas , after considering the Report of the said Officer and after consulting the Director of Town Planning , Maharashtra State , the Government is of the opinion that the proposed modification is required to be sanctioned with certain changes .
Now, therefore , in exercise of the powers conferred upon it under section 37 ( 1AA) ( c) of the said Act , the Government hereby :
(A) Sanctions the proposed modification as described more specifically in the Schedule hereunder.
(B) Fixes the date of publication of this Notification in the Official Gazette as the date of coming into force of this modification .
(C) Directs the Municipal Corporation of Greater Mumbai that in the Schedule of Modifications sanctioning the said Development Plan, after the last entry , the Schedule referred to at (A) above shall be added .
Schedule
