No. SPP . 2021 / U.O.R.74/ D - XIV .-In exercise of the powers conferred by sub - section ( 8) of the section 24 of the Code of Criminal Procedure , 1973 ( Act No. II of 1974) and under section 8 ( 1) of the Maharashtra Control of Organized Crime Act, 1999 ( 30 of 1999) , the Government of Maharashtra hereby appoints Adv . Shekhar Jagtap as " Special Public Prosecutor " for conducting the case/ s in Hon'ble Additional Session Court ( Special MCOCA Court ) , Thane , which are arising out of C.R.No.93/2018 registered at Thane Nagar Police Station , Thane .

2. The fees of Adv . Shekhar Jagtap , as " Special Public Prosecutor " shall be paid by Home Department as per the fee proposal agreed by Home Department and approved by this department .

3. His appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment, Conditions of Service and Remuneration ) Rules , 1984 .

4. The Government reserves the right to revoke/ modify/ annul the order without assigning any reasons .

अटी:-

( १ ) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १ ९ ६० चे कलम १५६ व नियम, १ ९ ६१ चे नियम १०७ मधील तरतुदींनुसार कर्ज वसुलीची कार्यवाही करावी . कर्ज वसुली करताना सहकार कायदा , नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास आवश्यक ती चौकशी करून आवश्यकता भासल्यास सदरचे प्रदान केलेले अधिकार तात्काळ काढून घेण्यात येतील .

( २ ) सदरचे अधिकार सहकार कायदा कलम १०१ व ९ १ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील .

(३ ) वसुली अधिकारी यांनी दरमाह सोबत जोडलेल्या विहित नमुन्यात "अ -३ ", " अ-४ " व "ब" कर्ज वसुलीची माहिती या कार्यालयास सादर करावी. पुणे ग्रामीण जिल्ह्यामध्ये मुख्य कार्यालय असलेल्या ज्या सहकारी संस्थेचे कार्यक्षेत्र विभाग , दोन विभाग अथवा राज्य कार्यक्षेत्र आहे त्या संस्थांनी देखील त्यांची माहिती या कार्यालयास सादर करावी.

(४) अधिकार प्रदान केलेल्या वसुली अधिकारी असलेल्या व्यक्तीची बदली झाल्यास त्यानं राजीनामा दिल्यास किंवा सेवानिवृत्ती झाल्यास किंवा सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास , अशा अधिकाऱ्यास प्रदान केलेले अधिकार आपोआप रद्द होतील .

(५ ) वसुली अधिकारी यांनी वसूल केलेल्या संपूर्ण सरचार्ज रकमेचा भरणा वसूल केलेल्या महिन्यातच चलनाने शासकीय कोषागारात करावा. वसुली अधिकारी यांनी वसूल केलेला सरचार्ज , त्याचा शासकीय कोषागारात केलेला भरणा याबाबत संस्था स्तरावर स्वतंत्र नोंदवही ठेवावी . त्याबाबतचा नमुना "अ-१ ", " अ-२ " , " अ-३" , " अ-४ " सोबत जोडलेला आहे.

(६ ) मा. उच्च न्यायालय , मुंबई यांनी रिट याचिका क्रमांक १ ९ ४२ / २०१३ , दि बेसिन कॅथेलिक को- ऑप. बँक विरुद्ध महाराष्ट्र राज्य व इतर या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५ रोजी दिलेला आदेश विचारात घेऊन वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १ ९ ६० व नियम , १ ९ ६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी .

(७ ) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास , प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(८ ) शासन निर्णय क्रमांक संकीर्ण-१५०४ /प्र.क्र.२३१ / १५ - स, दिनांक २३ नोव्हेंबर २०१६ अन्वये वसुली अधिकाऱ्यांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

३ महाराष्ट्र शासन राजपत्र, भाग एक - मध्य उप- विभाग, गुरुवार ते बुधवार, नोव्हेंबर ११-१७ , २०२१ / कार्तिक २०-२६ , शके १ ९ ४३ (९ ) वसुली अधिकाऱ्यास त्यांच्या नावापुढे कोठेही " महाराष्ट्र शासन नियुक्त " आणि किंवा " सिव्हील कोर्ट ", " एक्झीक्युटीव्ह कोर्ट " या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही . त्याऐवजी वसुली अधिकाऱ्यांनी त्यांच्या नावापुढे " वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम , १ ९ ६० चे कलम १५६ व नियम , १ ९ ६१ चे नियम १०७ अन्वये ) " असे लिहावे .

(१० ) वसुली अधिकाऱ्यास वसुलीसाठी वापर करण्यात येणाऱ्या वाहनावर " वसुली अधिकारी पतसंस्था " असा फलक लावता येऊ शकेल . सहकारी बँक/ ( ११ ) वसुली अधिकाऱ्याने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या / जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांच्याकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही . संबंधित कर्जदार / जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी / पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्जवसूल करण्याची कार्यवाही करावी.

( १२ ) वसुली अधिकाऱ्यास , थकबाकीदाराकडून वसुली दाखल्यानुसार वसुलपात्र रक्कम व सरचार्ज रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

विभाग प्रमुख आणि इतर सर्व संबंधित अधिकारी यांना कळविण्यात येते की, राजपत्रित अधिकाऱ्यांच्या रजा, बदल्या, नेमणुका, शक्ती आणि त्यांच्या इतर वैयक्तिक बाबी यासंबंधीचे आदेश शासनाकडून राजपत्राच्या या भागात अधिसूचनांच्या स्वरूपात प्रकाशित केले जातात ; त्यामुळे वरील बाबीसंबंधी सर्व संदर्भ निकालात निघाले आहेत असे समजण्यात यावे. अशा अधिसूचनांमुळे त्यांच्या दुय्यम अधिकाऱ्यांची कार्यमुक्ती व तत्सम बाबी यासंबंधी आनुषंगिक आदेश काढणे आवश्यक असल्यास राजपत्र मिळाल्यानंतर त्यांनीच ते काढले पाहिजेत. कारण शासनाकडून इतर कोणतेही आदेश काढले जाणार नाहीत.
