(cid:312)मांक. मु(cid:329)ांक-२०२०/३१०/(cid:332).(cid:312).१२७/एम-१(धोरण). – (cid:249)याअथ(cid:559), क(cid:607)(cid:329) सरकारची आरो(cid:244)य योजना (सीजीएचएस) व रा(cid:249)य शासनाची आरो(cid:244)य योजना (एसजीएचएस) यांनुसार सवलती(cid:247)या दराम(cid:260)ये वै(cid:464)कीय उपचार कर(cid:256)यासाठी व आरो(cid:244)य देखभाल (सु(cid:342)ृषा) सुिवधा पुरिव(cid:256)यासाठी आिण एक(cid:563)ण खाटां(cid:247)या सं(cid:243)येपैकी िकमान १२.५ ट(cid:242)क(cid:577) खाटा आिथ(cid:593)कदृ(cid:273)(cid:448)ा दुब(cid:593)ल घटकांमधील (इ.ड(cid:264)(cid:269)यू.एस.) (cid:257)याअथ(cid:559) आता, महारा(cid:273)(cid:322) मु(cid:329)ांक अिधिनयम, १९५८ (१९५८ चा ६०) (यात यापुढ(cid:578) (cid:249)याचा िनद(cid:616)श, "उ(cid:242)त अिधिनयम" असा क(cid:577)ला आहे) या(cid:247)या कलम ९ (cid:247)या खंड (अ) (cid:271)दारे (cid:332)दान क(cid:577)ले(cid:269)या अिधकारांचा वापर क(cid:544)न, महारा(cid:273)(cid:322) शासन, जनिहताथ(cid:593) तसे करणे आव(cid:272)यक ंबई येथे (cid:556)(cid:274)थत असले(cid:269)या अस(cid:269)याची खा(cid:327)ी पट(cid:269)याने, या(cid:271)दारे, एल.एम.नाडकण(cid:559) माग(cid:593), नाडकण(cid:559) पाक(cid:594), बीपीटी वसाहत, वडाळा(पूव(cid:593)), मु दहा एकर (cid:550)े(cid:327)फळाचा भूखंड (मु ंबई पोट(cid:595) (cid:322)(cid:274)ट व मेसस(cid:593) झोिडयाक ंबई पोट(cid:595) (cid:322)(cid:274)ट (cid:247)या मालकीचा), तीस वषा(cid:597)(cid:247)या भाड(cid:578)प(cid:694)ावर दे(cid:256)यासाठी मु िहलो(cid:322)ॉिन(cid:242)स (cid:332)ाय(cid:271)हेट िलिमट(cid:578)ड यां(cid:247)याम(cid:260)ये कर(cid:256)यात आले(cid:269)या भाड(cid:578)प(cid:446)ा करारना(cid:266)या(cid:247)या संलेखावर, उ(cid:242)त अिधिनयमास जोडले(cid:269)या अनुसूची-एक(cid:247)या अनु(cid:247)छ(cid:578)द ३६ अ(cid:261)वये आकारणीयो(cid:244)य असलेले (cid:543)पये ८,८४,३१,१५० इतक(cid:577) मु(cid:329)ांक शु(cid:269)क आिण उ(cid:242)त अिधिनयमाअ(cid:261)वये आकारणीयो(cid:244)य असलेली (cid:257)याची (cid:543)पये ४,४२,१५,५७५ इतकी शा(cid:274)ती, पुढील शत(cid:559)(cid:247)या अधीन राहून, माफ करीत आहे :—

भाग चार-ब-३३३–१२ महारा(cid:273)(cid:322) शासन राजप(cid:327) असाधारण भाग चार-ब, नो(cid:271)ह(cid:606)बर १२, २०२१/काित(cid:593)क २१, शक(cid:577) १९४३ शत(cid:559) :— (१) (cid:543)(cid:244)णालय, या आदेशा(cid:247)या अटी व शत(cid:559)चे पालन करीत आहे िक(cid:573)वा कसे यासंबंधी संिनयं(cid:327)ण कर(cid:256)यासाठी संचालक, आरो(cid:244)य सेवा संचालनालय वा आरो(cid:244)य सेवा संचालक यांनी (cid:332)ािधक(cid:565)त क(cid:577)लेला अ(cid:261)य कोणताही अिधकारी हे स(cid:550)म (cid:332)ािधकारी असतील.
(२) (cid:543)(cid:244)णालय, वरील बाब(cid:558)संबंधात आव(cid:272)यक असलेली तपशीलवार िनयतकािलक िववरणप(cid:327)े, आरो(cid:244)य सेवा संचालक यांना सादर करील.
(३) (cid:543)(cid:244)णालय, गरजू (cid:271)य(cid:242)त(cid:558)वर क(cid:577)ले(cid:269)या मोफत सवलतीतील उपचाराशी संबंिधत असणारा अिभलेख ठ(cid:578)वील, मागणी क(cid:577)(cid:269)यावर, तो आरो(cid:244)य सेवा संचालकास उपल(cid:264)ध क(cid:544)न दे(cid:256)यात येईल.
(४) (cid:543)(cid:244)णालय, शासनाकड(cid:578) असे हमीप(cid:327) दाखल करील की, या आदेशा(cid:247)या नमूद क(cid:577)ले(cid:269)या अटी व शत(cid:559)चे ते पालन करील.
(५) (cid:249)याला या आदेशा(cid:261)वये मु(cid:329)ांक शु(cid:269)कात सवलत िदलेली आहे तो उ(cid:242)त करारना(cid:266)याचा प(cid:550)कार, अ(cid:261)य कोण(cid:257)याही आदेशानुसार िक(cid:573)वा धोरणानुसार (cid:257)याच (cid:271)यवहारासाठी मु(cid:329)ांक शु(cid:269)क माफ कर(cid:256)यासाठी िक(cid:573)वा कमी कर(cid:256)यासाठी ह(cid:242)कदार असणार नाही.
(६) जर (cid:543)(cid:244)णालयाने, उ(cid:242)त करारना(cid:266)याम(cid:260)ये िक(cid:573)वा आदेशाम(cid:260)ये िविनिद(cid:593)(cid:273)ट क(cid:577)लेले वै(cid:464)िकय उपचार कर(cid:256)यास व आरो(cid:244)य देखभाल (सु(cid:342)ृषा) सुिवधा पुरिव(cid:256)यास कसूर क(cid:577)ली तर, िक(cid:573)वा उ(cid:242)त करारना(cid:266)याम(cid:260)ये िक(cid:573)वा आदेशांम(cid:260)ये िविनिद(cid:593)(cid:273)ट क(cid:577)ले(cid:269)या अटी व शत(cid:559)पैकी कोण(cid:257)याही अटीचे िक(cid:573)वा शत(cid:559)चे उ(cid:269)लंघन क(cid:577)ले तर, जणू काही सु(cid:543)वातीपासूनच मु(cid:329)ांक शु(cid:269)काम(cid:260)ये सूट िदलेली न(cid:271)हती असे समजून, ते, संपूण(cid:593) मु(cid:329)ांक शु(cid:269)क व शा(cid:274)ती, कोण(cid:257)याही अस(cid:269)यास, (cid:332)दान कर(cid:256)यास पा(cid:327) असेल.

Order
No.Mudrank-2020/310/C.R.127/M-1(Policy).— Whereas, the Mumbai Port Trust and M/s. Zodiac Healotronics Pvt. Ltd. have entered into concession agreement on public private partnership for setting up a Super Specialty Hospital with a total capacity of 600 beds i.e. Grand Port Hospital (hereinafter referred to as "the said Hospital") located at L.M. Nadkarni Marg, Nadkarni Park, BPT Colony, Wadala ( East), Mumbai to provide medical treatment and healthcare facilities at concessional rate as per the Central Government Health Scheme (CGHS) and the State Government Health Scheme (SGHS) and to reserve at least 12.5% beds out of total number of beds to the persons from Economically Weaker Sections (EWS) or to the persons below the poverty line and to the State Government employees and their families and people at large;
Now, therefore, in exercise of the powers conferred by clause (a) of section 9 of the Maharashtra Stamp Act (LX of 1958) (hereinafter referred to as "the said Act"), the Government of Maharashtra, being satisfied that it is necessary to do so in the public interest, hereby remits the stamp duty of Rupees 8,84,31,150 chargeable under Article 36 of the Schedule –I appended to the said Act and penalty of Rupees 4,42,15,575 chargeable under the said Act therefore, on the instrument of lease agreement of a land parcel admeasuring ten acres situated at L.M. Nadkarni Marg, Nadkarni Park, BPT Colony, Wadala ( East), Mumbai (belonging to the Mumbai Port Trust) on a lease of thirty years, between the Mumbai Port Trust and the M/s. Zodiac Healotronics Pvt. Ltd. subject to the following conditions, namely :—
Conditions—
(1) The Director, Directorate of Health Services, Government of Maharashtra or any other Competent Authority, authorized by the Director of Health Services shall be the competent authority to monitor as to whether the Hospital is observing the terms and conditions of this Order.
(2) The Hospital shall furnish the detailed requisite periodical statements to the Director of Health Services in regard to above.
(3) The Hospital shall maintain record regarding free concessional treatment rendered to the needy persons, which shall be made available to the Director of the Health Services on demand.
(4) The Hospital shall file an undertaking with the Government that it shall abide by the enumerated terms and conditions of this Order.
(5) The party to the said Agreement, which has availed concession in stamp duty under this Order, shall not be entitled for remission or reduction of the stamp duty for the same transaction as per any other order or policy.
(6) If the Hospital fails to provide medical treatment and healthcare facilities specified in the said agreement or this Order, or commits breach of the any of the terms and conditions specified in the said agreement or this Order, shall be liable to pay the whole stamp duty and penalty, if any, as if there was no remission in stamp duty from the beginning.
