NOTIFICATION
No. SPP.2021 / U.O.R.70/ D - XIV . In exercise of the powers conferred by sub- section ( 8) of the section 24 of the Code of Criminal Procedure , 1973 (Act No.II of 1974) the Government of Maharashtra hereby appoints , Adv . Smt . Komal Kandharkar as " Special Public Prosecutor " for conducting the case/s in Hon'ble Special ( MPID ) Session Court , Mumbai and conducting the Criminal Writ Petition No. 2876/2020 and Criminal Writ Pettition No. 2878/2020 in Hon'ble High Court , Mumbai , which are arising out of C.R.No.25/ 2020 registered at E.O.W. , Mumbai ( C.R.No.284/2020 , Juhu Police Station , Mumbai ) .
2. The fees of Adv . Smt . Komal Kandharkar , as " Special Public Prosecutor" shall be paid by Home Department as per the fee proposal agreed by Home Department and approved by this department. 3. Her appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment , Conditions of Service and Remuneration ) Rules , 1984 .
4. The Government reserves the right to revoke / modify/ annul the order without assigning any reasons .

No. SPP - 2020/C.R . 37/ D - XIV.-In Continuation of Notification No. SPP - 2020/ C.R . 37/ D - XIV , dated 4thMarch 2020 , in exercise of the powers conferred under 32( 1 ) of the Protection of Children from Sexual Offences Act ( POCSO ) , 2012 ( No. 32 of 2012) , the Government of Maharashtra hereby designate the following Additional Public Prosecutors at Sessions Court in the following Districts in Maharashtra , as Exclusive Special Public Prosecutors to conduct the cases before the Special POCSO Courts ( Fast Track Special Courts ) constituted under Government Resolutions No. FTC1419/5/C.R.No.04/ Desk 09 , dated 4th March 2020 , 13th May 2020 , 13th August 2020 , 5th April 2021 and 6th October 2021 of Law and Judi- ciary Department and orders dated 25th July 2019 and 8th January 2020 passed by the Hon'ble Supreme Courtof India in Suo - Moto Write Petition ( Criminal ) No. 01/2019.

3. Above deignation as Exclusive Special Public Prosecutor shall be until further orders and also co-terminus with their appointment as Additional Public Prosecutor .
4. Above Additional Public Prosecutors are designated as above strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment , Conditions of Service and Remunera- tion) Rules , 1984 .

आणि ज्याअर्थी, उक्त नियमावलीतील काही तरतूदी जशा, झोपडपट्टी पुनर्वसन प्राधिकरणाच्या प्रकल्पांकरिता अॅन्सीलरी एफएसआय, प्रादेशिक योजना क्षेत्रात अपिलाची तरतूद इ. तरतूर्दीचे, तसेच या नियमावलीची काही क्षेत्रासाठी अंमलबजावणी करण्यासंदर्भात व्यवहार्यतः इत्यादींचे पुनरावलोकन करण्याबाबत शासनाच्याअन्य विभागांकडून आणि इतर संस्थांकडून निवेदने प्राप्त झाली आहेत;

०२. या पूरकपत्रातील तरतूदी सदर पूरकपत्र महाराष्ट्र शासन राजपत्रात प्रसिध्द झाल्याचा दिनांकापासून अंमलातयेतील.
०३. सदर पुरकपत्र, कामकाजाचे दिवशी एक महिन्याच्या कालावधीकरीता जनतेच्या अवलोकनार्थ सर्व संबंधित नियोजन प्राधिकरणे आणि नगर रचना आणि मूल्यनिर्धारण विभागाची जिल्हा कार्यालये या कार्यालयांमध्ये उपलब्ध राहील.

5.11 Board of Appeals Any person aggrieved by an order / communication made by an authority/Collector under these Regulations may prefer an appeal before the Board of Appeals . The board shall be constituted at division level consisting of the Divisional Head of Town Planning Department of the concerned division as President and concerned ADTP/TP of the district as a member.

ब) सदर मंजूर फेरबदल, पुणे महानगर प्रदेश विकास प्राधिकरणाचे क्षेत्र व रत्नागिरी जिल्हा प्रादेशिक योजना क्षेत्र वगळता, सदर अधिसूचना शासन राजपत्रात प्रसिध्द झाल्याच्या दिनांकापासून अंमलात येईल , असे निश्चित करीत आहे. पुणे महानगर प्रदेश विकास प्राधिकरणाचे क्षेत्राकरीता सदर एकत्रिकृत विकास नियंत्रण व प्रोत्साहन नियमावली, प्राधिकरणाची विकास योजना उक्त अधिनियमाच्या कलम ३१ अन्वये मंजूर होऊन अंमलात आल्याच्या दिनांकापासून अंमलात येईल. तसेच रत्नागिरी जिल्ह्याच्या प्रादेशिक योजना क्षेत्राकरिता सदर एकत्रिकृत विकास नियंत्रण व प्रोत्साहन नियमावली, या जिल्ह्याची प्रादेशिक योजना उक्त अधिनियमाच्या कलम १५ अन्वये मंजूर होऊन अंमलात आल्याचे दिनांकापासून अंमलात येईल.

The Maharashtra Regional & Town Planning Act, 1966
No.TPS- 1818/CR.236/ 18/Sec.37 ( 1AA) & Sec.20(3) (Part- 1 )/Addendum/UD - 13-
Whereas, the Government of Maharashtra has sanctioned the Unified Development Control and Promotion Regulations (' UDCPR ' ) (hereinafter referred to as "the said Regulations ") for the state except Municipal Corporation of Greater Mumbai, other Planning Authorities / Special Planning Authorities / Development Authorities within the limits of Municipal Corporation of Greater Mumbai , MIDC, NAINA, Jawaharlal Nehru Port Trust, Hill Station Municipal Councils , Eco -Sensitive/ Eco -Fragile region notified by MoEF & CC and Lonavala Municipal Council and Area under CIDCO's jurisdiction as Planning Authority , PCNTDA, MIHAN, MADC, MSRDC, in Maharashtra under the provisions of the Maharashtra Regional & Town Planning Act, 1966 (hereinafter referred to as " the said Act ") vide Notification No.TPS- 1818 /CR.238/ 18/DP . & RP./Sec.37 (1AA) (c) & sec.20( 4)/UD-13 , dated 02/12/2020 (hereinafter referred to as "the said Notification ") ;
And whereas , to make applicable the said sanctioned Unified Development Control and Promotion Regulations for the area of CIDCO as Planning Authority, for the area of Pimpri-Chinchwad New Town Development Authority, for the area of Multi -Model International Hub Airport Notified area (MIHAN) , for Shirdi Airport Notified area of Maharashtra Airport Development Company Ltd. (MADC) as Special Planning Authority and for notified area of Maharashtra State Road Development Corporation as Special Planning Authority, the Government has published Notices under section 37(1AA) & section 20(3) of the said Act, bearing No.TPS - 1818 /CR-236/ 18 /Sec.37 (1AA) & Sec.20(3 )/UD- 13, dated 02/12/2020 and No.TPS- 1818/CR-236/ 18 /Sec.20 (3)/UD - 13 , dated 02/12/2020 respectively alongwith directives under section 154 of the said Act, 1966 vide resolutions No.TPS -1818/ CR-236/18/Sec.37 ( 1AA) & Sec.20(3 )/UD- 13 , dated 02/12/2020 and No.TPS - 1818/CR- 236/ 18/Sec.20 (3)/UD - 13 , dated 02/12/2020 respectively;
And whereas, various representations from other Governments Departments, other Organizations are received on the said Regulations requesting to review some of the provisions like ancillary FSI for SRA Projects , Appeal provision for Regional Plan Area etc. , and applicability of the said Regulations for some area etc.;
And whereas after considering the various representations and in larger public interest, the Government of Maharashtra is of the opinion that, some of the provisions of the said Regulations shall be clarified or amended for smooth implementation of the said Regulations and addendum in this regard to the said Regulations shall be issued taking recourse ofthe regulation no.1.10 of the said Regulation, and addendum shall be issued to the said Notification;
१५ महाराष्ट्रशासन राजपत्र, भाग एक - मध्य उप- विभाग , गुरुवार ते बुधवार , नोव्हेंबर १८-२४ , २०२१ / कार्तिक २७ - अग्रहायण ३ , शके १ ९४३ Now therefore , in exercise of the powers conferred by regulation no.1.10 of the said Regulation, the Government hereby amends the said Regulations by issuing addendum to the said Regulations as mentioned in Annexure- A attached herewith, and in exercise of the powers conferred to the Government, amends the said Notification by issuing addendum to the saidNotification Dt.02/ 12/2020 as mentioned in Annexure -B attached herewith;
02. The provisions of this Addendum shall come into force from the date of publication of this addendum in the Maharashtra Government Gazette .
03. This addendum shall be kept open for inspection to the general public in the offices of all concerned Planning Authorities and District Offices of Town Planning and Valuation Department for the period of one month, on all working days .
This addendum is also available on the Government website www.maharashtra.gov.in (Acts/Rules)

New Regulation No.5.11
Any person aggrieved by an order / communication made by an authority/Collector under these Regulations may prefer an appeal before the Board ofAppeals . The board shall be constituted at division level consisting of the Divisional Head of Town Planning Department of the concerned division as President and concerned ADTP/ TP of the district as a member .
Annexure- B
sanctioning notification of the said Regulations dt.02/12/2020 clause (B) of B) Fixes the date of publication of this Notification in the Official Gazette as the date of coming into force of this sanctioned modification except Pune Metropolitan Region Development Authority and Ratnagiri District Regional Plan Area . For Pune Metropolitan Region Development Authority Area these Unified Development Control and Promotion Regulations shall come into force on the date of coming into force of the Development Plan of PMRDA after its sanction and u/ s 31 of the said Act and for area of Ratnagiri district Regional Plan, these Unified Development Control and Promotion Regulations shall come into force on the date of coming into force of the Regional Plan for Ratnagiri district after its sanction u/s 15 of the said Act .
