क्रमांक खाक्षेस-२०१६/प्र.क्र.२५१ (एल.बी.४६)-डब्ल्यू/रस्ते-८.––ज्याअर्थी, महाराष्ट्र शासनाने, हिंदुदयसम्राट बाळासाहेब ठाकरे महाराष्ट्र समृद्धी महामार्ग [राज्य महामार्ग (विशेष) क्र.२] (यात यापुढे ज्याचा निर्देश " उक्त महामार्ग " असा करण्यात आला आहे.) शिवमडका, तालुका हिंगणा (जिल्हा नागपूर) या गावापासून सुरू होणाया व राष्ट्रीय महामार्ग क्र.३ (राम-३) वरील भिवंडी उपमार्ग, मौजे वडपे (तालुका भिवंडी, जिल्हा ठाणे) येथे संपणाया उक्त महाराष्ट्र समृद्धी महामार्गाच्या भागाकरिता महाराष्ट्र महामार्ग अधिनियमान्वये (१९५५ चा ५५) (यात यापुढील ज्याचा निर्देश " उक्त अधिनियम " असा करण्यात आला आहे.) शासकीय अधिसूचना, सार्वजनिक बांधकाम विभाग क्रमांक खाक्षेस-२०१६/ प्र.क्र.२४७/रस्ते-८, दिनांक ७ सप्टेंबर, २०१६ द्वारे महामार्ग प्राधिकारी म्हणून मुख्य अभियंता, महाराष्ट्र राज्य रस्ते विकास महामंडळ मर्यादित, मुंबई यांची नेमणूक केली आहे ;
आणि ज्याअर्थी, महाराष्ट्र राज्य रस्ते विकास महामंडळ मर्यादित हे उक्त अधिनियमाच्या कलम ४ च्या परंतुकामध्ये तरतूद केल्याप्रमाणे उक्त महामार्गाकरिता महामार्ग प्राधिकरण आहे ;
आणि ज्याअर्थी, यासोबत जोडलेल्या अनुसूचीमध्ये नमूद केलेली जमीन (यात यापुढे जिचा निर्देश " उक्त जमीन " असा करण्यात आला आहे.) सार्वजनिक प्रयोजनासाठी असलेल्या उक्त महामार्गाचे बांधकाम, देखभाल, व्यवस्थापन किंवा कार्यान्वयन करण्यासाठी आवश्यक असल्याने महाराष्ट्र शासनामार्फत उक्त अधिनियमाच्या तरतुदीखालील उक्त महामार्ग प्राधिकरणासाठी संपादन करण्यात यावी अशी महामार्ग प्राधिकरण असलेल्या महाराष्ट्र राज्य रस्ते विकास महामंडळ मर्यादित यांनी महाराष्ट्र शासनाला विनंती केली आहे ;
आणि ज्याअर्थी, उक्त जमीन, उक्त महामार्ग प्राधिकरणाला, उक्त महामार्गाकरिता सार्वजनिक प्रयोजनाकरिता संपादित करणे आवश्यक आहे, अशी महाराष्ट्र शासनाची खात्री पटली आहे ;
ज्याअर्थी, आता महाराष्ट्र महामार्ग अधिनियमाच्या कलम १५ च्या पोट-कलम (२) व पोट-कलम (३) आणि कलम १७ द्वारे प्रदान करण्यात आलेल्या अधिकारांचा, आणि याबाबतीत त्यास समर्थ करणाया इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र शासन, याद्वारे,----

भाग चार--ब--३४३--१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, नोव्हेंबर २३, २०२१/अग्रहायण २, शके १९४३ (एक) उक्त जमीन हिंदुदयसम्राट बाळासाहेब ठाकरे महाराष्ट्र समृद्धी महामार्ग [राज्य महामार्ग (विशेष) क्र.२] चे बांधकाम, देखभाल, व्यवस्थापन किंवा कार्यान्वयन करणे यांसाठी संपादित करण्याचा उद्देश घोषित करीत आहे ;
(दोन) अनुसूचीमध्ये संपादनाकरिता समाविष्ट असलेल्या उक्त जमिनीच्या जमीन मालकांकडून किंवा हितसंबंधित व्यक्तीकडून ही अधिसूचना राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून एकवीस दिवसांच्या आत हरकती व सूचना उपविभागीय अधिकारी किंवा प्राधिकृत अधिकारी, उपविभाग इगतपुरी- यंबकेश्वर, जिल्हा नाशिक यांचेकडे मागवित आहे.
उपरोक्त कालावधीत उक्त जमिनीच्या मालकांकडून किंवा हितसबंधित व्यक्तीकडून प्राप्त झालेल्या हरकती व सूचना उपविभागीय अधिकायांमार्फत विचारात घेण्यात येतील ;
अनुसूची संपादित करावयासाठी उद्देशित असलेल्या जमिनीचे वर्णन तालुका इगतपुरी, जिल्हा नाशिक

NOTIFICATION
MAHARASHTRA HIGHWAYS ACT.
No. PPP-2016/CR-251(L.B.46)-W/Road-8.––Whereas, the Government of Maharashtra has appointed the Chief Engineer, Maharashtra State Road Development Corporation Limited as the Highway Authority vide Government Notification, Public Works Department, No.PSP-2016/ CR-247/Road-8, dated the 7th September 2016, for the portion of the Hindu Hriday Samrat Balasaheb Thackery Maharashtra Samruddhi Mahamarg [State Highway (Special) No.2] (hereinafter referred to as "the said Highway"), starting from Shivmadka village in Hingana, Taluka (District Nagpur) and ending at Bhiwandi Bypass of National Highway Number 3 (NH-3) at Vadape (Taluka Bhiwandi of District Thane) of the said Maharashtra Prosperity Corridor, under the Maharashtra Highways Act (LV of 1955) (hereinafter referred to as " the said Act ") ;
And whereas, the Maharashtra State Road Development Corporation Limited is the Highway Authority for the said Highway as provided in the proviso to section 4 of the said Act ;
And whereas, the Maharashtra State Road Development Corporation Limited being the Highway Authority has requested the Government of Maharashtra that, the land mentioned in the Schedule appended hereto (hereinafter referred to as " the said land "), is needed for the building, maintenance, management or operation of the said Highway, being for the public purpose, be acquired by the Government of Maharashtra for the said Highway Authority under the provisions of the said Act ;
And whereas, the Government of Maharashtra is satisfied that, the said land is required, for the public purpose to the said Highway Authority, for the said Highway, shall be acquired ;
Now, therefore, in exercise of the powers conferred by sub-section (2) of section 15 read with sub-section (3) of said section 15 and section 17 of the Maharashtra Highways Act, and all other powers enabling in that behalf, the Government of Maharashtra hereby,––
(i) declares its intention to acquire the said land for the building, maintenance, management or operation of the Hindu Hriday Samrat Balasaheb Thackery Maharashtra Samruddhi Mahamarg [State Highway (Special) No.2] ;
(ii) invites objections and suggestions from the land owners or persons interested in the said land, whose lands are included in Schedule for acquisition, to the Sub-Divisional Officer or Authorized Officer, Sub- Division, Igatpuri - Trimbakeshwar District Nashik within twenty- one days from the date of publication of this notification in the Official Gazette.
The objections and suggestions received from the land owners and persons interested in the said land within the aforesaid period will be considered by the Sub-Divisional Officer ;
