महाराष्ट्र नगरपरिषदा, नगरपंचायती व औद्योगिक नगरी अधिनियम, १९६५.
क्रमांक एमयुएम-२०१६/प्र.क्र.७७३/नवि-१७.---- महाराष्ट्र नगरपरिषदा, नगरपंचायती व औद्योगिक नगरी अधिनियम, १९६५ (१९६५ चा महा. ४०) (यात यापुढे ज्याचा उल्लेख " उक्त अधिनियम " असा करण्यात आला आहे.) याच्या कलम ३४१ ड, कलम ३ च्या पोट-कलम (२),(२अ) आणि (३) मधील तरतुदीनुसार, महाराष्ट्र शासन याद्वारे, अहमदनगर जिल्ह्यतील शिर्डी या नगरपंचायतीच्या संक्रमणात्मक क्षेत्राचे ज्यात सोबतच्या अनुसूची " अ " मधील क्षेत्राचा समावेश आहे, अधिक लहान नागरी क्षेत्र म्हणून रचना करण्यासाठी आणि उक्त लहान नागरी क्षेत्रासाठी " शिर्डी नगरपरिषद " या नावाने नगरपरिषद घटीत करण्याच्या दृष्टीने, उक्त अधिनियमाचे कलम ३४१ड, कलम ३ च्या पोट-कलम (२), (२अ) आणि (३) याद्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून अधिसूचना काढण्याचा आपला हेतू घोषित करीत असून, तिचा मसुदा यासोबत जोडलेला आहे.
२. सदर अधिसूचनेला आक्षेप घेणाया कोणत्याही व्यक्तीने, ही उद्घोषणा महाराष्ट्र शासनाच्या राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून तीस दिवसांच्या कालावधीत जिल्हाधिकारी, अहमदनगर, हातमपूरा, जी.पी.ओ.जवळ, अहमदनगर ४१४ ००१ यांच्याकडे त्यांचे लेखी आक्षेप कारणांसह सादर करणे आवश्यक असेल.
३. उक्त कालावधीत मिळालेल्या अशा कोणत्याही आक्षेपावर शासनाकडून विचार करण्यात येईल.

क्रमांक एमयुएम-२०१६/प्र.क्र.७७३/नवि-१७.---- ज्याअर्थी महाराष्ट्र नगरपरिषदा, नगरपंचायती व औद्योगिक नगरी अधिनियम, १९६५ (१९६५ चा महा. ४०) (यात यापुढे ज्याचा उल्लेख " उक्त अधिनियम " असा करण्यात आला आहे.) याच्या कलम ३४१ ड, कलम ३ च्या पोट- कलम (२),(२अ) आणि (३) मधील तरतुदीनुसार, शासन उद्घोषणा, नगर विकास विभाग, क्रमांक एमयुएम-२०१६/प्र.क्र.७७३/नवि-१७, दिनांक २ डिसेंबर २०२१ याद्वारे महाराष्ट्र शासन राजपत्र, असाधारण भाग एक-अ-मध्य उप विभाग, दिनांक २ डिसेंबर २०२१ यामध्ये प्रसिद्ध केली असून, महाराष्ट्र शासनाने अहमदनगर जिल्ह्यतील शिर्डी नगरपंचायतीच्या संक्रमणात्मक क्षेत्राचे (यात यापुढे ज्याचा उल्लेख " उक्त संक्रमणात्मक क्षेत्र " असा करण्यात आला आहे) ज्यात सोबतच्या अनुसूची " अ " मधील क्षेत्राचा समावेश आहे, लहान नागरी क्षेत्र म्हणून रचना करण्यासाठी व उक्त लहान नागरी क्षेत्रासाठी " शिर्डी नगरपरिषद " या नावाने नगरपरिषद घटीत करण्याचा आपला हेतू घोषित केला आहे ;
ज्याअर्थी, उक्त उद्घोषणेमध्ये नमूद कालावधीत प्राप्त झालेल्या आक्षेप आणि सूचनांचा शासनाने विचार केला आहे ;
ज्याअर्थी, भारताचे संविधानाच्या अनुच्छेद २४३ थ च्या खंड (२) मध्ये नमूद केलेल्या बाबी विचारात घेऊन महाराष्ट्र शासनाला, यासोबत जोडलेल्या अनुसूची " अ " मध्ये अधिक तपशीलवारपणे वर्णन केलेले अहमदनगर जिल्ह्यतील शिर्डी नगरपंचायतीचे संक्रमणात्मक क्षेत्र लहान नागरी क्षेत्र म्हणून विर्िनदिष्ट करणे इष्ट वाटते ;
त्याअर्थी आता, उक्त अधिनियमाच्या कलम ३४१ ड, कलम ३ च्या पोट-कलम (२), (२अ) आणि (३) अन्वये प्रदान केलेल्या अधिकारांचा वापर करून उक्त संक्रमणात्मक क्षेत्र हे, लहान नागरी क्षेत्र म्हणून विर्िनदिष्ट करीत असून, " शिर्डी नगरपरिषद " या नावाने नगरपरिषद घटीत करीत आहे.
उक्त लहान नागरी क्षेत्राच्या हद्दी या सोबत जोडलेल्या अनुसूची " ब " मध्ये विर्िनदिष्ट केल्याप्रमाणे असतील.

PROCLAMATION
MAHARASHTRA MUNICIPAL COUNCILS, NAGAR PANCHAYATS AND INDUSTRIAL TOWNSHIPS ACT, 1965.
No. MUM-2016/C.R.773/UD-17.— In pursuance of the provisions of section 341D read with sub-sections (2), (2A) and (3) of section 3 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 (Mah. XL of 1965) (hereinafter referred to as "the said Act"), the Government of Maharashtra hereby announces its intention to issue a notification in exercise of the powers conferred by clause (a) of section 341D read with sub-sections (2), (2A) and (3) of section 3 of the said Act, with a view to constitute the transitional area known by the name Shirdi Nagar Panchayat as the smaller urban area, consisting of the local areas specified in Schedule "A", the draft notification of which is appended herewith.
2. Any person who entertains any objection to the said notification, is hereby required to submit the same in writing with the reasons therefor, to the Collector, District Ahmednagar, Hatampura, Near G. P. O., Ahmednagar 414 001, within a period of thirty days, from the date of publication of this Proclamation in the Maharashtra Government Gazette.
3. Any such objection which may be received during the said period will be considered by the Government.
DRAFT NOTIFICATION
URBAN DEVELOPMENT DEPARTMENT

No. MUM-2016/C.R.773/UD-17.— Whereas, by the Government Proclamation, Urban Development Department, No. MUM-2016/C.R.773/UD-17, dated the 2nd December 2021, published in the Maharashtra Government Gazette, Part-I-A, Extraordinary, Central Division Supplement, dated the 2nd December 2021, the Government of Maharashtra had announced its intention to issue a notification, in exercise of the powers conferred by section 341D read with sub-sections (2), (2A) and (3) of section 3 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 (Mah.XL of 1965), with a view to constitute the transitional area known by the name Shirdi Nagar Panchayat (hereinafter referred to as "the said transitional area") in Ahmednagar District, as the smaller urban area, consisting of the local areas specified in Schedule "A" in the said Proclamation ;
And whereas, the objections and suggestions received pursuant to the said Proclamation have been considered by the Government ;
And whereas, having regard to the factors mentioned in clause (2) of article 243-Q of the Constitution of India, the Government of Maharashtra considers it expedient to specify the said transitional area, more particularly described in Schedule "A" appended hereto, to be a smaller urban area ;
४ महाराष्ट्र शासन राजपत्र असाधारण भाग एक-अ---मध्य उप-विभाग, डिसेंबर २, २०२१/अग्रहायण ११, शके १९४३Now, therefore, in exercise of the powers conferred by section 341D read with sub-sections (2), (2A) and (3) of section 3 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra hereby specifies the said transitional area to be a smaller urban area for which there shall be constituted a Municipal Council by the name of the Shirdi Municipal Council.
The boundaries of the said smaller urban area shall be such as are specified in Schedule "B" appended hereto.
