क्रमांक िीएमएफ. ०६२१/प्र.क्र. ५७/उद्योग-९.—खाण व खदनजे (दवकसन व दवदनयमन) अदिदनयम,१९५७ (१९५७ चा ६७) मिील कलम ९ ब चे उप-कलम (३) आदण कलम १५ चे उप-कलम (४) आदण कलम १५ ए आदण उकत अदिदनयमातील कलम २० ए अंतग्गत प्रापत अदिकारानवये केंद्र शासनाने पाररत केलेलया आदेशास अनुसरुन महाराष्ट्र शासन खालीलप्रमाणे दजलहा खदनज प्रदतष्ान (प्रनयास) दनयम,२०१६ मधये सुिारणा करीत आहे :—
१. सदर दनयमास महाराष्ट्र दजलहा खदनज प्रदतष्ान (प्रनयास) दनयम, (प्रथम सुिारणा ) २०२१ असे महणावे.
२. महाराष्ट्र दजलहा खदनज प्रदतष्ान (प्रनयास) दनयम, २०१६ (यापुढे सदर दनयमास "मुखय दनयम" संबयोिले जाईल) मिील दनयम ५ चया उपदनयम (१) ते (३) ऐवजी खालीलप्रमाणे उपदनयम राहतील :—
(१) प्रदतष्ान प्रनयासाचे वयवसथापन दनयामक पररषदेकिे दवदहत करणयात येईल, जी राजय शासनाकिून दनयुकत केलेलया सव्ग दवशवसथांची बनलेली असेल. सदर दनयामक पररषदेमधये अधयक्ष, सदसय आदण सदसय सदचव यांचा अंतभा्गव खालील उपदनयमानवये दवदहत केलयानुसार असेल.
(२) संबंदित दजलह्ाचे दजलहादिकारी हे दनयामक पररषदेचे अधयक्ष असतील.
(१) २ महाराष्ट्र शासन राजपत्र असाधारण भाग एक-ल, डिसेंबर ६, २०२१/अग्रहायण १५, शके १९४३ (३) संबंदित दजलहयाचे लयोकसभा सदसय हे दनयामक पररषदेचे सदसय असतील, जर संबंदित दजलह्ात एकापेक्षा अदिक लयोकसभा सदसय असतील तर असे सव्ग लयोकसभा सदसय दनयामक पररषदेचे सदसय असतील. तथादप, सदरचा लयोकसभा मतदारसंघ ्गत सव्ग दजलह्ांचया जर एकापेक्षा अदिक दजलह्ांमधये येत असलयास संबंदित लयोकसभा सदसय हे सदर लयोकसभा मतदारसंघात अंतभ् दजलहा खदनज प्रदतष्ांनचया दनयामक पररषदेवर सदसय असतील.
(३अ) महाराष्ट्र राजयातील राजयसभा सदसय हे ते दनवितील तया कयोणतयाही एका दजलह्ाचया दजलहा खदनज प्रदतष्ानचया दनयामक पररषदेवर सदसय असतील. तयासा्ी संबंदित राजयसभा सदसय जया दजलह्ाचया दजलहा खदनज प्रदतष्ानचया दनयामक पररषदेवर सदसय महण्न दनयुकती हयोणयास इच्ूक असेल, तया दजलह्ाचे नाव शासनाचया खदनकम्ग दवभागाचया सदचव/ प्रिान सदचव/ अपर मुखय सदचव यांना कळवतील व संबंदित खदनकम्ग दवभागाचे सदचव/ प्रिान सदचव/ अपर मुखय सदचव हे राजयसभा सदसयांनी दनविलेलया दजलह्ाचया संबंदित दजलहादिकारी यांना राजयसभा सदसयांचे नाव कळवतील.
(३ब) संबंदित दजलह्ातील दविानसभा सदसय हे दजलहा खदनज प्रदतष्ानचया दनयामक पररषदेचे सदसय असतील. (३क) दविानपररषदेचे सदसय हे तयांनी दनविलेलया दजलह्ाचया दजलहा खदनज प्रदतष्ानचया दनयामक पररषदेचे सदसय असतील. संबंदित दविानपररषद सदसय हे जया दजलह्ाचया खदनज प्रदतष्ानचया दनयामक पररषदेवर सदसय महण्न दनयुकत हयोणयास इच्छुक असतील, तया दजलह्ाचे नाव शासनाचया खदनकम्ग दवभागाचया सदचव/प्रिान सदचव/अपर मुखय सदचव यांना कळवतील व संबंदित खदनकम्ग दवभागाचे सदचव/प्रिान सदचव/अपर मुखय सदचव हे संबंदित दविानपररषद सदसयांनी दनविलेलया दजलह्ाचया दजलहादिकारी यांना संबदित दविानपररषद सदसयांचे नाव कळवतील.
(३ि) दजलहा खदनज प्रदतष्ानचया दनयामक पररषदेवर खालील अदिकारी हे पददसधद सदसय असतील :—
(ऐ) मुखय काय्गकारी अदिकारी दजलहा पररषद - पददसधद सदसय (बी) नगरपादलका/नगरपररषद/महानगरपादलका यांचया हद्ीत खाण बादित - पददसधद सदसय क्षेत् असलयास सदर सथादनक सवराजय संसथेचे प्रशासकीय प्रमुख
(सी) दजलहा वयवसाय व प्रदशक्षण अदिकारी - पददसधद सदसय (िी) दजलहा आददवासी दवकास अदिकारी
- पददसधद सदसय (ई) दजलहा आरयोगय अदिकारी
- पददसधद सदसय (एफ) काय्गकारी अदभयंता, दजलहा पररषद
- पददसधद सदसय (जी) दजलहा मदहला व बालदवकास अदिकारी - पददसधद सदसय (एच) महावयवसथापक, दजलहा उद्योग केंद्र
- पददसधद सदसय (३ई) दजलहा खदनकम्ग अदिकारी हे दनयामक पररषदेचे पददसधद सदसय सदचव असतील.
३. मुखय दनयमांचया दनयम ८ चया उप-दनयम (३) ऐवजी खालील उपदनयमाचा समावेश करणयात येत आहे :—
(३अ) वयवसथापकीय सदमतीमधये खालील सदसयांचा समावेश असेल,
(ऐ) संबंदित दजलह्ाचे दजलहादिकारी

NOTIFICATION
Mines and Minerals (developMent and regulation) act, 1957.
No. DMF-0621/C.R. No. 57/Ind-9.—In exercise of the powers conferred by sub-section (3) of section 9B and sub-section (4) of section 15 of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957), in it's application to the State of Maharashtra and in pursuance to the directions issued by the Government of India under section 20A of the said Act, the Government of Maharashtra hereby makes the following rules to amend the Maharashtra District Mineral Foundation (Trust) Rules, 2016, namely :—
1. These rules may be called the Maharashtra District Mineral Foundation (Trust) (First Amendment) Rules, 2021.
2. In rule 5 of the Maharashtra District Mineral Foundation (Trust) Rules, 2016 (hereinafter referred to as "the principal Rules"), for sub-rules (1) to (3) the following sub-rules shall be substituted, namely :—
"(1) The management of the District Mineral Foundation Trust shall vest in the Governing Council, which shall consist of all the Trustees of the Trust appointed by the State Government. The Governing Council shall consist of the Chairman, members and Member-Secretary as specified in the following sub-rules.
(2) The District Collector of the District shall be the Chairman of the Governing Council.
(3) The Member of the House of the People (Lok Sabha) in a district shall be the member of the Governing Council.
In case, there are more than one Member of the House of the People (Lok Sabha) in a district, then all such Members of the House of the People (Lok Sabha) in a district shall be the members of the Governing Council. In case, the constituency of one Member of the House of the People (Lok Sabha) falls in more than one district, then the Member of the House of the People (Lok Sabha) shall be a member of the Governing Council of District Mineral Foundation of all such districts.
(3A) The Member of Council of States (Rajya Sabha) from a State shall be the member of the Governing Council of District Mineral Foundation of one district selected by them. The Member of Council of States (Rajya Sabha) shall intimate the name of the district selected by them to the Secretary/ Principal Secretary/ Additional Chief Secretary (Mining), Industries, Energy and Labour Department, who in turn shall inform the concerned District Collector.
(3B) The Members of Legislative Assembly in the district shall be the members of the Governing Council.
(3C) The Members of Legislative Council shall be the members of the Governing Council of the District Mineral Foundation Trust of one district selected by them. The Members of Legislative Council shall intimate name of the district selected by them to the Secretary/ Principal Secretary/ Additional Chief Secretary (Mining), Industries, Energy and Labour Department,, who in turn shall inform the concerned District Collector. (3D) The following officers shall be the Ex-Officio Members of the Governing Council:-
(a) Chief Executive Officer, Zilla Parishad. Ex-Officio Member.
(b) Administration Officer of the Municipal Corporation or Ex-Officio Member.
Municipal Council, if the mine affected areas are within the limits of Municipal Corporation or Municipal Council.

(d) District Tribal Welfare Officer Ex-Officio Member.
(e) District Health Officer Ex-Officio Member.
(f) Executive Engineer, Zilla Parishad Ex-Officio Member.
(g) District Women and Child Development Officer Ex-Officio Member.
(h) General Manager, District Industries Center (DIC) Ex-Officio Member.
(3E) The District Mining Officer shall be the Ex-Officio Member-Secretary of the Governing Council.".
3. In rule 8 of the principal Rules, after sub-rule (3), the following sub-rule shall be added, namely :—
"(3A) The Managing Committee shall consist of the following Members :—
(a) The District Collector of the District Chairman.
(b) Chief Executive Officer, Zilla Parishad. Ex-Officio Member.
(c) District Vocation Training Officer Ex-Officio Member.
(d) District Tribal Welfare Officer Ex-Officio Member.
(e) District Health Officer Ex-Officio Member.
(f) Executive Engineer, Zilla Parishad Ex-Officio Member.
(g) District Women and Child Development Officer Ex-Officio Member.
(h) General Manager, District Industries Center (DIC) Ex-Officio Member.
(i) One representative of Pollution Control Board Ex-Officio Member.
(j) One representative of Mine Operating Agency or Member.
Mine Lessee in the District
(k) One representative of Non-Government
Member.
Organization's (NGO's) in the District
(l) District Mining Officer Member-Secretary.".
