Notice of Publication of Electoral Roll
No. P - 10/83742/ 2021 . Attention of all concerned is invited to the fact that pursuant to the provisions of Rule 4 ( 1 ) of Maharashtra State Pharmacy Council Rules , 1969 ( MSPC Rules , 1969 ) , the Council had decided 8th February 2019 as cut - off date for the purpose of preparation of Electoral Roll. Consequently , based on 8th February 2019 as cut - off date , the Electoral Roll was prepared and accordingly notice was published in the Maharashtra Government Gazette dated 18th June 2019 and in various newspapers on 18th June 2019 .
As required under Rule 4( 2 ) of the MSPC Rules , 1969 , the Electoral Roll was kept open for inspection in the office of Council situated at above office address upto 6th July 2019. The Registrar did not receive any claim for inclusion of name in the roll or also did not receive any objection as to inclusion of any other person's name in the roll or to any particulars in any entry in the roll . Therefore , the Electoral Roll prepared and kept open for inspection was deemed to be final on 13th Day of July 2019. Accordingly , same was handed - over to the Returning Officer appointed by Government of Maharashtra . As required under Rule 7 of MSPC Rules , the Returning Officer then prepared and published election program in the Maharashtra Government Gazette dated 2nd March 2020 and in various newspapers on 5th March 2020 .
Considering outbreak of COVID - 19 Pandemic and lockdown declared by Government of India , Returning Officer issued a Notice dated 4th April 2020 about postponement of Election Program which was published on MSPC official website and in Newspapers on 4th April 2020 .

Considering various revised orders issued by Government of India and Maharashtra Government under Disaster Management Act , 2005 regarding imposition and relaxation of norms regarding lockdown for breaking the chain of COVID - 19 , President , Maharashtra State Pharmacy Council , directed Registrar , MSPC to call for extra ordinary council meeting to discuss on the MSPC Election process in the current situation . The Council , in the meeting conducted via online mode on 22nd December 2020 , examined the issue and noted that there is a considerable time elapsed from the cut- off date fixed earlier . To avoid probable consequences which may arise due to the time elapsed and in view to that the Pharmacists those are newly registered or those who have renewed or re - entered their registration during the period of about twentymonths after 8th February 2019 , the cut- off date fixed earlier are not deprived off their right to cast vote or contest the election , the Council took a decision to revise the cut- off date . Therefore , the Council resolved to revise the cut- off date as 31st December 2020. Consequently , as required under Rule 4 (2 ) of the MSPC Rules , 1969 , the Electoral Roll was kept open for inspection in the office of Council situated at above office address from 8th March 2021 to 9th April 2021. The Registrar did not receive any claim for inclusion of name in the roll or also did not receive any objection as to inclusion of any other person's name in the roll or to any particulars in any entry in the roll . Therefore , the Electoral Roll prepared and kept open for inspection was deemed to be final on 22nd April 2021. Accordingly same was informed to the Returning Officer appointed by Government of Maharashtra However , considering the threat of spread of second wave of Covid - 19 in the State Government ofMaharashtra vide order No. DMU/2020/CR . 92/Dis M -1 , Dated: 4th April 2021 and subsequent orders imposed certain emergency measures to prevent and contain the spread of Covid 19 virus , including imposition of section 144 and Night Curfew , restrictions on Outdoor Activity , Public , Private Transport , working of offices , etc. throughout the State . In view of gradual change in the situation , Government of Maharashtra has revised the orders issued under the Disaster Management Act , 2005. Government of Maharashtra also issued the transfer orders of the officers which included Returning Officer . Various deliberations , discussions and communications were held with the President , MSPC , Returning Officer and the officials of Medical Education and Drugs Department of Government of Maharashtra about the varying situation , which was beyond control of the Council or the Returning Officer .
Consequent to above , considering the realistic time elapsed of about 10 months after the last cut -off date fixed by council that is 31st December 2020 , President , MSPC directed Registrar to call for an extra - ordinary meeting of the council to discuss the current scenario on the Election of the Council . The Council , in the meeting held via online mode on 18th November 2021 , examined the issue and noted that there is a considerable time elapsed after the cut- off date fixed earlier that is 31st December 2020. To avoid probable consequences which may arise due to the time elapsed and in view to that the Pharmacists those are newly registered or those who have renewed or re - entered their registration during the period of about ten months after 31st December 2020 , the cut - off date fixed earlier are not deprived off their right to cast vote or contest the election , the Council took a decision to revise the cut - off date . Therefore , the Council resolved to revise the cut - off date as 18th November 2021 .
In view of the aforesaid resolution of revision in cut - off date by the Maharashtra State Pharmacy Council and in supersession of the notice issued and published in the Gazette of the Government of Maharashtra dated 8th March 2021 , a fresh notice of publication of Electoral Roll is hereby issued. All concerned are requested to take a note of the following notice published as required under Rule 4( 2 ) of the MSPC Rules , 1969 .

Notice is hereby given that the electoral roll for election of members of the Maharashtra State Pharmacy Council under clause ( a ) of section 19 of the Pharmacy Act , 1948 , has been prepared in accordance with Rule 4 of the MSPC Rules , 1969 and copies of the roll will be available for inspection at the Office of the Council situated at 404 , R Square , Opposite E.S.I.S. Hospital , Lal Bahadur Shastri Marg , Mulund (West) , Mumbai 400 080 .

Every claim for inclusion of name in the roll, or every objection to the inclusion of any other person's name in the roll , or to any particulars in any entry in the roll , shall be addressed to the Registrar and shall be presented or sent by post to her at the address referred above , so as to reach her on or before the 29th December 2021 .
