(cid:249)याअथ(cid:559), ठाणे शहराची सुधारीत िवकास योजना शासनाने महारा(cid:273)(cid:322) (cid:332)ादेिशक व नगररचना अिधिनयम, १९६६ चे कलम ३१ (१) नुसार (यापुढ(cid:578) याचा उ(cid:269)लेख "उ(cid:242)त अिधिनयम" असा क(cid:577)ला आहे.) शासन िनण(cid:593)य (cid:312)मांक िटपीएस-१२९७/१३१९/सीआर-१४८/९७/ निव-१२, िदनांक ४ ऑ(cid:242)टोबर, १९९९ अ(cid:261)वये मंजूर क(cid:577)ली असून, ती िदनांक २२ नो(cid:271)ह(cid:606)बर १९९९ पासून अंमलात आहे. तसेच सुधारीत िवकास योजनेतील वगळले(cid:269)या (cid:550)े(cid:327)ाची िवकास योजना शासन िनण(cid:593)य (cid:312)मांक िटपीएस-१२०१/२७४/सीआर-२८/२००९/निव-१२, िदनांक ३ एि(cid:332)ल, २००३ अ(cid:261)वये शासनाने उ(cid:242)त अिधिनयमानुसार मंजूर क(cid:577)ली असून ती िदनांक १४ मे, २००३ पासून अंमलात आली आहे. (यापुढ(cid:578) "उ(cid:242)त मंजूर िवकास योजना" असा क(cid:577)ला आहे.)

आिण (cid:249)याअथ(cid:559), ठाणे शहराची िवकास िनयं(cid:327)ण िनयमावली शासनाने उ(cid:242)त अिधिनयमाचे कलम ३१(१) अ(cid:261)वये अिधसूचना (cid:312)मांक िटपीएस/१२९५/सीआर-२२२/९४/निव-१२, िदनांक २८ एि(cid:332)ल १९९५ अ(cid:261)वये ठाणे शहरा(cid:247)या (cid:332)ा(cid:543)प िवकास िनयं(cid:327)ण िनयमावलीत काही फ(cid:577)रबदल क(cid:543)न उ(cid:242)त अिधिनयमा(cid:261)वये मंजूरी िदली आहे व सदर िनयमावली िदनांक १ जून, १९९५ पासून अंमलात आहे. (यापुढ(cid:578) "उ(cid:242)त िनयमावली" असा क(cid:577)ला आहे.)

आिण (cid:249)याअथ(cid:559), ठाणे शहरातील मो(cid:450)ा (cid:332)माणावर असले(cid:269)या जु(cid:261)या, मोडकळीस आले(cid:269)या आिण अनिधक(cid:565)त इमारत(cid:558)चे िनयोजनब(cid:460) आिण सुिनयंि(cid:327)त प(cid:460)तीने पुनिव(cid:593)कास हो(cid:256)याक(cid:555)रता, उ(cid:242)त िनयमावलीतील िविनयम (cid:312) १६५ म(cid:260)ये "नागरी पुन(cid:543)(cid:257)थान योजना" क(cid:555)रता िवशेष िनयमाची तरतुद महारा(cid:273)(cid:322) (cid:332)ादेिशक व नगररचना अिधिनयम, १९६६ चे कलम ३७(१) (क) (क) (ग) चे तरतुदीनुसार वैधािनक काय(cid:593)वाही पूण(cid:593) क(cid:543)न शासन अिधसूचना (cid:312). िटपीएस/१२१३/२७२६/सी.आर.-२४/१४, निव-१२, िदनांक ५ जुलै २०१७ अ(cid:261)वये मंजूर कर(cid:256)यात आली आहे. (यापुढ(cid:578) याचा उ(cid:269)लेख "उ(cid:242)त िवशेष िनयमावली" असा क(cid:577)ला आहे.)

आिण (cid:249)याअथ(cid:559), उ(cid:242)त िवशेष िनयमावलीतील तरतुदीनुसार नागरी पुन(cid:543)(cid:257)थान योजना व (cid:257)याअंतग(cid:593)त िवकिसत / पुनिव(cid:593)किसत हो(cid:256)याचे दृ(cid:273)टीने आव(cid:272)यक असले(cid:269)या इमारत(cid:558)चे आिण / िक(cid:573)वा बांधकामांचे नागरी पुन(cid:543)(cid:257)थान योजनेचा अंतभा(cid:593)व असलेले आराखड(cid:578) तयार करणेचे अिधकार आयु(cid:242)त यांना आहेत व (cid:257)याअनुषंगाने आयु(cid:242)त, ठाणे महानगरपािलका यांनी ठाणे महानगरपािलका ह(cid:459)ीत उ(cid:242)त िवशेष िनयमावलीतील तरतुदीनुसार एक(cid:563)ण ४४ (च(cid:271)वेचाळीस) नागरी पुन(cid:543)(cid:257)थान आराखड(cid:578) तयार क(cid:577)ले असून (यापुढ(cid:578) उ(cid:242)त "आराखड(cid:578)" असा

भाग दोन-१०३–१ २ महारा(cid:273)(cid:322) शासन राजप(cid:327) असाधारण भाग दोन, िडस(cid:606)बर ११, २०२१/अ(cid:314)हायण २०, शक(cid:577) १९४३ क(cid:577)ला आहे.) व जाहीर सूचने(cid:465)ारे िदनांक ५ मे २०१८ रोजी महारा(cid:273)(cid:322) शासन राजप(cid:327)ात (cid:332)िस(cid:460) क(cid:544)न (cid:257)यावर जनतेकड(cid:564)न सूचना/हरकती मागिव(cid:256)यात आले(cid:269)या हो(cid:257)या.

आिण (cid:249)याअथ(cid:559), (cid:332)ा(cid:262)त हरकती/सूचनां(cid:247)या अनुषंगाने वैधािनक काय(cid:593)वाही क(cid:543)न ठाणे महानगरपािलक(cid:577)ने िदनांक २ माच(cid:593) २०१९ रोजीचे प(cid:327)ा(cid:261)वये उ(cid:242)त ४४ आराख(cid:454)ांपैकी कोपरी (यु.आर.पी.१), राबोडी (यु.आर.पी.३), ट(cid:578)कडी बंगला (यु.आर.पी.६), हाजुरी (यु.आर.पी.११), िकसननगर (यु.आर.पी.१२) व लोकमा(cid:261)य नगर (यु.आर.पी.१३), या सहा नागरी पुन(cid:543)(cid:257)थान आराख(cid:454)ांना शासनाची अंितम मा(cid:261)यता िमळणेचा (cid:332)(cid:274)ताव सादर क(cid:577)ला होता. (यापुढ(cid:578) (cid:257)याचा उ(cid:269)लेख "उ(cid:242)त सहा आराखड(cid:578)" असा क(cid:577)ला आहे.) आिण (cid:249)याअथ(cid:559), ठाणे महानगरपािलक(cid:577)त शासनास सादर क(cid:577)ले(cid:269)या उ(cid:242)त ०६ नागरी पुन(cid:543)(cid:257)थान आराखडयां(cid:247)या (cid:550)े(cid:327)ापैकी कोपरी येथील नागरी पुन(cid:593)(cid:543)(cid:257)थान आराख(cid:454)ामधील अिधसूचीत िवशेष आिथ(cid:593)क (cid:550)े(cid:327)ाचा भाग वगळ(cid:564)न उ(cid:242)त आराखडयां(cid:247)या सुधारीत ह(cid:459)(cid:558)ना अिधसूचीत कर(cid:256)यास शासनाने (cid:257)यांचेकडील प(cid:327) (cid:312)मांक टीपीएस १२१९/८९३/(cid:332).(cid:312).१५/२०/निव-१२ िदनांक ४ फ(cid:577)(cid:334)ुवारी २०२० अ(cid:261)वये सहमती दश(cid:593)िवली आहे.

आिण (cid:249)याअथ(cid:559), उ(cid:242)त िवशेष िनयं(cid:327)ण िनयमावलीतील िविनयम (cid:312). १(ब) (ब) म(cid:260)ये, नागरी पुन(cid:543)(cid:257)थान योजना तयार कर(cid:256)याचे व अिधसुिचत कर(cid:256)याचे व (cid:257)यात आव(cid:272)यकतेनुसार वेळोवेळी सुधारणा कर(cid:256)याचे अिधकार आयु(cid:242)त यांना अस(cid:269)याचे उ(cid:269)लेिखत आहे.

आिण (cid:257)याअथ(cid:559), ठाणे शहरा(cid:247)या उ(cid:242)त कोपरी (यु.आर.पी.१), राबोडी (यु.आर.पी.३), ट(cid:578)कडी बंगला (यु.आर.पी.६), हाजुरी (यु.आर.पी.११), िकसननगर (यु.आर.पी.१२) व लोकमा(cid:261)य नगर (यु.आर.पी.१३) या नागरी पुन(cid:543)(cid:257)थान आराख(cid:454)ां(cid:247)या सुधारीत ह(cid:459)ी या अिधसूचने(cid:465)ारे खालील त(cid:242)(cid:257)याम(cid:260)ये नमूद क(cid:577)(cid:269)या(cid:332)माणे अिधसूचीत कर(cid:256)यात येत आहेत.

सदर आराखडयां(cid:247)या सुधारीत ह(cid:459)ी दश(cid:593)िवणारे नकाशे जनते(cid:247)या अवलोकनाथ(cid:593) खालील िठकाणी, सदरची अिधसूचना राजप(cid:327)ात (cid:332)िस(cid:460)ी झालेपासून ३० िदवसांकरीता ठ(cid:578)व(cid:256)यात आली आहे.

NOTIFICATION

Whereas, the Revised Development Plan of the Thane City has been sanctioned by the Government of the Urban Development Department, under section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966, (hereinafter referred to as "the said Act") vide Notification No. TPS- 1297/1319/CR-148/97/UD-12, dated 4th October 1999, which has come into force with effect from 22nd November 1999, and the Excluded Part (EP) of the said Development Plan has been sanctioned under the said Act vide Government Notification No. TPS/1201/1274/CR-28/2001/UD-12, dated 3rd April 2003 which has come into force with effect from the 14th May 2003; (hereinafter referred to as "the said sanctioned development plan");

And whereas, the Development Control Regulations of Thane Municipal Corporation has been sanctioned by the Government after making some modifications in draft Development Control Regulations of Thane city vide Urban Development Department, vide Notification No. TPS/1294/1259/ CR-222/94/UD-12, dated 28th April 1995 under section 31(1) of the said act which has come into force with effect from the 1st June 1995 ; (hereinafter referred to as "the said regulations");

And whereas, for the purpose of redevelopment in a planned and controlled manner of large numbers of old, dilapidated and unauthorized buildings of Thane city, provision of special regulation is made in regulation No. 165 of the said regulations for "urban renewal scheme" by following legal and due procedure under section 37(1)(AA)(c) of Maharashtra Regional and Town Planning Act, 1966 and accordingly notified vide the Government Notification No. TPS/1213/2726/CR-24/12 UD-12, dated 5th July 2017. (hereinafter referred to as "the said special regulations");

And whereas, the commissioner is empowered to prepare urban renewal plan which includes necessary development/redevelopment of buildings and/or constructions under urban renewal plan vide provisions of the said special regulations and accordingly the Commissioner, Thane Municipal Corporation has prepared 44 (forty four) Urban Renewal Plans in Thane Municipal Corporation limit. (hereinafter referred to as "the said plans"), and published in Maharashtra Government Gazette, dated 5th May 2018 and invited suggestions/objections from public on it;

And whereas, after following due procedure on received suggestions/objections, Thane Municipal Corporation has submitted Six Urban Renewal Plans out of 44 Urban Renewal Plans namely Kopri (URP-1), Rabodi (URP-3), Tekadi Bungalow (URP-6), Hajuri (URP-11), Kisan Nagar (URP-12) and Lokmanya Nagar (URP-13) to Government for final approval vide letter date 2nd March 2019 (hereinafter referred to as "the said six URPs") ;

And whereas, Government has given his consent to notify revised boundaries of the said six URPs, excluding notified special economic zone area from Kopri URP, vide letter No.TPS1219/893/ CR 15/20/UD12, dated 4th February 2020 ;

And whereas, as mentioned in the regulation No. 1(b)(b) of the said Special Regulations, the Commissioner can prepare and notify the Urban Renewal Plans, and revise the same, as and when required.

And therefore, the revised boundaries of the said Six Urban Renewal Plans namely Kopri (URP-1 ), Rabodi (URP-3), Tekadi Bungalow (URP-6), Hajuri (URP-11), Kisan Nagar (URP-12) and Lokmanya Nagar (URP-13) of Thane City are hereby notified as mentioned in table below :–

The plans showing revised boundaries of said plans are kept for inspection by General public for next 30 days from publication of this notification in Maharashtra Government Gazette at following places.

1. Office of the Joint director of Town Planning, Cluster cell, Special project office, 3rd floor, near oswal park, Pokharn road No.2, Majiwada, Thane (W.) 400 601.

2. Town development department, 4th floor, Thane Municipal Corporation, Thane.

3. Naupada-Kopri Ward office/Uthalsar Ward office/Wagale Ward office/Lokmanya Savarkar Nagar Ward office.
